PROBATIONARY EMPLOYMENT CONTRACT (ADMINISTRATIVE)

KNOW ALL MEN BY THESE PRESENTS: This Probationary Employment Contract, made and entered into this ______ day of _________________ 2006 in ______________________________________, Philippines, by and between ___________________________________________________________, a corporation duly organized and existing under Philippines laws and with office address at the __________________________ __________________________________________________________, represented herein by its representative, ___________________________________, hereinafter referred to as the COMPANY; -AND___________________________________, a Filipino, of legal age, single/married, and a resident of ________ _______________________________________________________________________________, hereinafter referred to as the EMPLOYEE.

WITNESSETH THAT:
1. PROBATIONARY EMPLOYMENT. The COMPANY hereby appoints the EMPLOYEE for a probationary period of six (6) months starting on the date first above-written. During such period, the EMPLOYEE shall diligently and faithfully serve the COMPANY, devote all his time and energy exclusively to such service, and obey at all times all COMPANY policies, rules, and regulations. After the probationary period, and the EMPLOYEE meets the standards for regularization, he shall be regularized. 2. DAILY SALARY. The EMPLOYEE shall be entitled to a daily salary of ____________________________ ____________ (P________) and a transportation allowance of ______________________________________ (P________). The payment of daily salaries shall be made only for days when actual work was done. This no work, no pay rule shall also apply to Sundays and holidays. 3. GROUNDS FOR TERMINATION OF PROBATIONARY EMPLOYMENT. The COMPANY may terminate this Probationary Employment Contract if the EMPLOYEE: a. Fails to meet the production/performance standards that have already been agreed upon with the EMPLOYEE at the time of his employment; b. Performs work that is unsatisfactory, inefficient, slow, negligent, inaccurate, shoddy, haphazard, and/or fraught with errors and mistakes; c. Without any prior notice, fails to report to his assigned office for five (5) consecutive days; d. Engages in part-time work in any other undertaking or activity during working time and/or fails to devote full-time work to his employment with the COMPANY; and e. Fails to observe policies relating to punctuality, attendance and/or other terms and conditions of this Employment Contract, as well as rules and policies, that may be promulgated by the company. 4. STANDARDS FOR REGULARIZATION. The EMPLOYEE shall be regularized after the six-month probationary employment period if during the entire probationary employment period, the EMPLOYEE: (a) has consistently met the production/performance standards that have already been agreed upon at the time of his employment; (b) delivers work that is efficient, fast, well-prepared, thorough and correct; and (c) complies with all COMPANY rules, policies, and regulations, pertaining to, but not limited to, punctuality, time-in, reporting, and attendance. 5. MANAGEMENT RIGHTS. The COMPANY reserves its right to conduct a review of the performance of the EMPLOYEE at any time, whether on a daily, weekly or monthly basis. The COMPANY, during such probationary period, shall have the right to terminate the employment of the EMPLOYEE if he fails to meet the performance standards herein set out or meet company rules, policies, and regulations. In addition, the COMPANY retains its absolute and unqualified right to terminate the probationary employment of the EMPLOYEE at any time during the six-month probationary period, without any liability to pay any separation pay, should the COMPANY find the employment of the EMPLOYEE redundant, unneeded or unnecessary, and/or to transfer or reassign the EMPLOYEE to any of its offices at any time even without the consent of the EMPLOYEE.

6. PERIOD OF VALIDITY OF AGREEMENT. This agreement shall be valid and subsisting during the entire period of employment of the EMPLOYEE with the COMPANY and shall remain in full force and effect for a period of one year from the termination date of the EMPLOYEE employment, determined as of the time the EMPLOYEE submits an unconditional statement in writing, duly-received by the COMPANY, terminating his employment. 7. RIGHT TO INJUNCTION, DAMAGES, AND OTHER LEGAL REMEDIES. Any violation of any provision of this contract shall give the COMPANY the right to file for injunction and/or a temporary restraining order against the EMPLOYEE and/or his agent, partners, principals, associates or employers, plus a fifty percent (50%) share in all incomes, dividends, profits, and/or compensation arising from, in relation to, connected with, or as a consequence of the competing venture, plus damages of not less than P50,000.00, attorneys fees of not less than P50,000.00, and costs of suit. 8. OTHER CONDITIONS. The failure of the COMPANY for any reason whatsoever to require or insist upon strict compliance of any of the terms and conditions of this contract shall not be construed as a waiver of its right to enforce the same. The invalidity of any provision hereof shall not affect or impair other provisions which otherwise can be given full force and effect. IN WITNESS WHEREOF, the parties hereto have hereunto set their hands on this two-page Probationary Employment Contract in the place and on the date first above-written.
