AGREEMENT

LEAVE AND LICENSE AGREEMENT THIS LEAVE AND LICENSE AGRREMNT IS MADE AND EXECUTED AT PUNE ON THIS ____ day of _______ 2012.

BETWEEN __________________________________ __________________________________ __________________________________ __________________________________ PAN Hereinafter called the Licensor (Which Expression shall unless repugnant to the context or meaning thereof is deemed to includes its heirs, executers, successors, administrators and assigns) Party on the ONE PART M/s. Indian Institute of Tropical Meteorology, Under the Ministry of Earth Sciences, Govt. of India, New Delhi Conducting Research in the field of Atmospheric Sciences Having registered office at Dr. Homi Bhabha Road, Pashan, Pune 411008 Represented by its Director, Prof. Bhupendra Nath Goswami, Age 61 Years, Occupation Service, Address Dr. Homi Bhabha Road, Pashan, Pune 411008 PAN AANPG1461A Shri Sharad J. Khade, Age - 37, Occupation Service Address - As above Hereafter called the LICENSEE Party of OTHER PART WHEREAS 1. The Licensor is absolutely seized and possessed of or otherwise well and sufficiently entitled to the Residential Apartment No __________ on the ______________________ Pune admeasuring approximately ______ Sq. Ft., consisting of hall, kitchen, two bedrooms, and toilets and _____. Hereinafter referred to as the said premises The Licensee has approached the Licensor with a request to grant a license to use and occupy the said apartment on Leave and License basis for the purpose of residence of the Licensee and his family members for the period of 11 months, as stop gap arrangement. AND WHEREAS the Licensor having agreed to the request of Licensee, the parties are hereto desirous of reducing to writing the terms and conditions of the said Licensee as hereinafter contained.

NOW THEREFORE THIS LEAVE & LICENSE AGREEMENT WITHNESSETH AS UNDER 1. That upon the express declaration that only the permission to use is given and no other rights whatsoever have been given conferred and or intended to be given or conferred, the Licensor has agreed to allow the Licensee, to use the same for himself and his family members and no one else for a period of one term of eleven months from ___________ to ___________ and if agreed by the both the parties, renewable for the next term of eleven months on mutually agreed terms and conditions, to which fresh leave and license agreement shall be executed at the option of Licensor. The said premise is furnished with fittings and other paraphernalia and described in the list at the end of this Agreement, the same has been inspected by the Licensee and

admitted to be in good order and condition. The permission is given to the Licensee to use the said premises along with the said fittings and other paraphernalia and articles of the Licensors. The Licensee shall make reasonable use of the fittings and paraphernalia. 3. The permission given to the Licensee is absolutely personal for the use of himself and his family members and the Licensee shall not even part with the possession of the said premises or pay of its portion to anyone else or any other reason whatsoever. The monthly license fee for the use and occupation of the said premises is Rs. _______/(Rs. ___________________________________Only) including the use of fittings and paraphernalia has been fixed exclusive of Electricity/Telephone/Cooking Gas and Cable charges. The said license fee, of Rs. ___________/- [Rs. __ ________ _______ ____ ________ Only] for the entire period of 11 months has been paid by the Licensee vide RTGS __________ dated __________ after deducting tax at source of 10% . a) All the present and future cuss rates and taxes in respect of the premises including those on account of the use thereof under this agreement are to be borne by the Licensor alone. b) The society maintenance charges are to be borne by the Licensor. That the Licensor has installed separate meter for electricity purpose and the Charges for the electric consumption including meter tire shall be borne by the Licensee according to the bills issued by the Maharashtra State Electricity Distribution Board in respect of the said premises during the period of License Agreement. Also, Licensee has to bear piped gas charges as per the use/billing in totality. The Telephone and Cable charges are also to be borne by the Licensee. No right is given to the Licensee to make additions and alterations to the said premises of a permanent nature without prior consent in writing from the Licensor. That the Licensee shall be deemed to be only given to the Licensee for a period of 11 months, and shall not make or have any claims to tenancy, sub tenancy, or any other rights, title or interest or whatsoever nature in the said premises or portion thereof. It is agreed between the parties hereto that the Licensee shall not grant a sub license to any other person and shall not keep any other person in place or instead of the Licensee. The Licensee shall permit the Licensor or his duly authorized agent, surveyors, engineers, workmen to enter upon the said premises at all reasonable times, for the purpose of viewing the conditions of premises or for repairs after taking prior appointment with the Licensee. The Licensor hereby covenants with the Licensee that he has obtained all necessary permission lawfully needed for allowing the Licensee to use the said premises and that the Licensee shall peacefully and quietly enjoy the use thereof during the term hereby granted without any interruption whatsoever by the Licensor. The Licensee undertakes to abide by the rules, regulations and bye laws of the said society. In case of nuisance, the Licensor has right to terminate the agreement. That the Licensee shall not store any hazardous chemicals, material, inflammable articles etc. which will damage the property. On the expiry of this agreement the Licensee shall hand over actual vacant and peaceful possession to the Licensor without any objection whatsoever. The License stands terminated at the end of agreement period. The Licensee shall keep the said premises in good and tenable condition by effecting minor repairs, if any required, the Licensor being responsible for heavy and major repairs including the leakages or seepages. The Licensor shall not in any event be responsible or liable for any loss or damages to any goods or property of the Licensee whatsoever is the cause of such loss or damage. There is no intension between the parties to create the relationship of Landlord and Tenant by the execution of this Agreement of Leave and License. The License is given under the section 24 and 55 of the Maharashtra Rent Control Act 1999 (Maharashtra Act No. XVIII of 2000) with effect from 31.03.2000 and expenses for stamp duty & Registration & Advocate fees etc. shall be borne by the Licensor.

In the event of Licensee not vacating the premises as required under the terms of this Agreement, without prejudice to the right to recover from Licensee, double the License fee as provided under the Maharashtra Rent Control Act. The Licensor shall be entitled to recover and receive and Licensee shall be liable to pay in addition a sum of Rs. 500/(Rs. Five Hundred Only) per day by the way of damages. The Licensee is giving Undertaking and liable to get the certified copy of the nearest police station of the said premises within five days of taking possession or signing of the Agreement whichever is earlier.

IN WITHNESS WHEREOF THE PARTIES HERETO HAVE SET THEIR RESPECTIVE HANDS AND SEALS THE DAY AND YEAR FIRST HEREINABOVE MENTIONED. SIGNED SEALED AND DELIVERED.
