Dear Mr Means

This is to provide Notice in accordance with Section 5 13 of the Mineral Rules And 1 Regulations Of The Colorado Mined Land Reclamation Board For Hard Rock Metal and Designated Mining Operations that the operations at above captioned mining operation are now in Temporary Cessation
In accordance with Rule 5 13 Notice by Operator the following information is provided 1
a The date of cessation

By correspondence dated January 4 2013 the operator notified the Division that reclamation will begin after the DOE s release of the ongoing Preliminary Environment Impact Assessment PEIS for DOE properies and a full understanding of DOE s finding this pending any subsequent litigation by intervening parties as a result of DOE s PEIS

b The reasons for non production or cessation of the mining operation


Because the property is not available for full access in order to conduct mining operations or to properly conduct the studies necessary to fully develop an Environmental Protection Plan EPP and for these reasons the mine is not currently an active operation it has been determined that Temporary Cessation is the appropriate designation for this mine

Temporary Cessation is more specifically indicated to be appropriate in accordance with the rules at Section 2 13 for the following reasons 1 There have been no personnel working at the site for one hundred eighty 180 consecutive days Only activities which can be described as maintenance or housekeeping or related activity have been ongoing Activities which are not significantly moving the site towards completion of the mining operation are not underway There is no sale or processing of material or movement of stockpiled material and Mine development has ceased and mining has not recommenced

c A plan for resumption of mining Resumption of mining is not anticipated at this time due to the DOE s ongoing Preliminary Environment Impact Assessment PEIS for DOE properies whereby the ability to mine remains in abayance and access to conduct mining activity is prohibited d The measures to be taken to comply with reclamation requirements and or other activities related to the performance standards of Section 3 1 while the mine is in Temporary Cessation
Gold Eagle Mining intends to initiate the reclamation process in accordance with the

origianl reclamation plans on file with DMRS Since the DOE prohibits activity on the sites until the issueance of its PEIS reclamation will begin after the DOE s release of the PEIS and a full understanding of DOE s finding this pending any subsequent litigation by intervening parties as a result of DOE s PEIS
e Demonstration that the existing Financial Warranty is adequate to cover the reclamation liability

Reclamation liability instruments are held by existing agreement with the Department of Energy and include DOE approved coverage for all reclamation described in the orignal reclamation plans on file with DMRS
