Contract Agreement (Unit Price)

1. In compliance with your Invitation to Bid for the construction of the Officers Camp Building at Tando Alam Oil Complex, Distt. Hyderabad, Province Sindh and subject to all the conditions thereof, the undersigned (hereinafter called Bidder), a corporation organized and existing under the laws of the State of Pakistan having examined the Drawings and Specifications and related Bid Documents and the site of the proposed Work, and being familiar with all of the conditions surrounding the construction of the proposed Project including the availability of materials and labor, hereby proposes to furnish all supervision, labor, materials, tools, equipment, and incidentals, and to perform the Work in accordance with the Bid Documents within the time specified herein below and at the unit prices shown for each bid item on the Unit Price Schedule attached hereto. These prices are to cover all expenses incurred in performing the Work under the Bid Documents, of which this proposal is a part. The attached unit prices include all supervision, labor, materials, tools, equipment, overhead, profit, insurance, taxes and other direct and incidental costs. Bidder agrees to commence work on a date to be specified in the written Notice to Proceed to be issued by OGDCL and to be substantially complete within Four Hundred (450) days and to complete the Work within Three Hundred and Sixty Five (365) consecutive calendar days thereafter. Accompanying this proposal is a certified Bid Bond in an amount equal to five percent (5%) of the total bid in accordance with the Instructions to Bidders. Also attached is a designation of Subcontractors and suppliers required to be identified in this bid showing their company name, description of work and percentage of overall project bid total contract. The undersigned Bidder agrees to execute the Contract and to deliver the Performance Bond and the Labor and Materials Payment Bond as required by the Bid Documents within ten (10) calendar days from the date when the written Notice of Award of the Contract is delivered at the address given in this bid proposal. 2. The following documents after incorporating addenda, if any except those parts relating to instructions to bidders shall be deemed to form and be read and construed as part of this agreement, vis: a) The contract Agreement b) Letter of acceptance c) Addendum d) The bid; e) Conditions of contract, including general terms and conditions, additional terms and conditions, approved technical terms and conditions. f) All appendixes of bid

Scope of work Specifications, Contract Drawings and approved of work Performance security Bond BOQ Any other document forming part of contract.

3. Notwithstanding any other provision to the contract , in the event of any conflict between provisions Of the contract that cannot be removed Through harmonious interpretation the various documents comprise the contract will be given priority In accordance with the sequence period herein above.

4. Bidder understands that the OGDCL reserves the right to reject any and all bids and to waive any informalities or irregularities in any bid. It is further understood that award of the Contract, if it be awarded, will be made on the basis of the lowest responsive, responsible bid, that in the sole opinion of the OGDCL is in the best interest of the Tando Alam Oil Complex. The Bidder agrees that this bid shall remain open and may not be withdrawn for a period of Sixty (60) days after the bid date and time designated in the Invitation to Bidders. The undersigned hereto acknowledges and represents that he has sufficient authority, and has taken all steps necessary to obtain authority, to execute and submit this bid and to bind the bidder as contemplated herein.
