PREFACE
In 2005 my mother was diagnosed with Alzheimer. A few years earlier, she was
already showing signs of dementia, although there was no definitive diagnosis, as is
often the case with Alzheimer. During these years my father and my brother Dror
continued to conduct business on her behalf, without taking the necessary legal steps.
That included a legal paper, jointly generated by my father and Dror, which my
mother purportedly signed in 2008, and and should be considered a forgery.
In the meanwhile in the US - I was subjected to death threats by banks and others,
until in April 2010 I had to escape, when armed federal agents tried to apprehend me,
and my neighbors told me that it looked like they were eager to shoot.
ACT I
In early June, 2010, a few weeks after I arrived in Israel, my father initiated court
procedures for consevatorship for my mother. The process started by filing a false and
deliberately misleading affidavit, which should be considered fraud. [1] My brothers,
Dror and Uri (the latter also showed up in Israel for the occasion) contributed their
signed consent letters as well. [1] However, none of the three said a word to me on
the subject, although I met all three of them a number of times during the same few
weeks, and shared a room with Uri for a couple of days in a Jerusalem guest house.

ACT II
By late 2010, early 2011, it was clear to me that dishonest conduct is going on, and
that my father and my brother Dror were the main perps. I tried to ask them directly
about it, and their conduct in response only strengthened my perception. At the same
time, my father and my brother Dror initiated various real estate transactions on
behalf of my mother, including an attempt to induce me to enter a fictitious real estate
contract.
By December 2012, I went to the Haifa court and asked to look at the court file. What
I found there was a set of false and deliberately misleading papers and affidavits that
were filed by my father, and records that were systematically biased to defame me, or
worse. At the same time, my father became disgruntled that I looked at the court
papers, instead of asking him for the information.
ACT III
Once I asked to see the papers, my father switched attorneys, and took a new attorney,
that according to my father, is one of the more expensive in the field in Haifa. In
parallel, the court file was moved to a new judge with no clear reason. The new judge
is likely to be unique in her reputation in Israel - googling her name revealed that
demonstrations were staged in front of her residence...
At the same time, Dror started spreading false stories that I "sued" them in court.
Once I discovered the multiple false affidavits filed by my father, I asked him to
correct the fraudulent papers, which he had filed in court, but he refused to do so.
Eventually filed the corrections myself. [2]
With an overpriced attorney come the privileges - now the case is in a state where
someone, between the judge, clerk, and my father's attorney (or more likely - all three
in collusion), engaged in falsification of court records, in an attempt to mislead me. In
short: the case evolved into a true demonstration of banana republic legal system. [3]
EPILOGUE
All of the above is conducted by my father and my brothers as purported fulfillment
of my mother's will under the conservatorship...
Watching my father at close to 90 years attempt to develop a career as a fraudster
is worthy of a Moliere play.
Regarding my brothers Uri and Dror were they motivated by greed alone, or
was there additional expectation of benefits through connections with corrupt law
enforcement agencies?
At this stage, the case provides a unique example of how fraudulent computer
systems, which have been implemented in the Israeli courts over the past decade, and
enable routine fraud in the courts. As such, and given the meticulous documentation, I
hope that the case would eventually become a textbook case in this regard.

and deliberately misleading facts in the Robert Raffael Zernik Affidavit,

I, the Undersigned, Joseph Zernik, ID # 0536... , after being warned that I must
say the truth, and that I may be subject to penalties prescribed by law if I do not
do so, declare as follows:
1. My name is Joseph Zernik and the Convervatee Rivka Shami Zernik is my
mother.
2.
of Robert Raffael Zernik, which was filed as part of the June 1, 2010
Request to Appoint a Conservator.
Appendix A is a copy of the June 1, 2010 Affidavit of Robert Raffael
Zernik, as obtained from the Office of the Clerk on January 13, 2013.
3. At the head of the Affidavit, my father, who was then candidate for
appointment as a Conservator declares as follows: after being warned that I
must say the truth, and that I may be subject to penalties prescribed by law
if I do not do so, declare as follows:
4. Later, under Paragraph 6, my father, Robert Zernik, declares, to the best of
my knowledge family members who agree to the appointment are: Brother,

Prof Eliyahu Shamir.... However, in conversation with my uncle on March

24, 2013, my uncle informed me that he had no knowledge of the Request
to Appoint Conservator in 2010, that he had never been asked for his
opinion in this matter at that time, and surely never provided his consent in
this matter.
5. Further under Paragraph 6, my father, Robert Zernik, declares, Opinion of
Joseph Zernik is unknown, since he severed all contact with all family

6. Such factual statement is false and misleading for the following reasons.
7. On April 28, 2010, I arrived in Israel as a Returning Resident, and
established my residence in Jerusalem.
Appendix B is a copy of a page from my paasport, showing my
entry to Israel on April 28, 2010.
8. In the period between the date that I entered Israel (April 28, 2010) and the
date of signing of the above referenced Affidavit by the Conservator (June
1, 2010) I was in contact with many of my family members, and my father
was well aware of that.
9. Upon arrival in Israel, I traveled straight from the airport to the Jerusalem
home of my uncle, the Conservatee's brother, Prof Eliyahu Shamir. There I
stayed for a few days with my uncle, my aunt Gilah Manusevich, and their
children Ilan and Shirah Shamir.
10. On the morning following my arrival in Israel, on April 29, 2010, my uncle
Eliyahu Shamir approved my connection to the Hebrew University
computer network Computer Science Department as his guest.
In a visit to the Hebrew University on February 26, 2013, the
network administrator found the registration of my connection to the
computer network of the Computer Science Department on April 29,
2010, as my uncle's guest, and she emailed a copy of the registration
to Prof Eliyahu Shamir by email.
11. The morning after my arrival in Israel, on April 29, 2010, my uncle Eliyahu
Shamir and my aunt Gilah Manusevich helped me find a desk at the
Computer Science Library, and there I worked on a daily basis in the
following weeks. Therefore, I met my uncle and my aunt almost on a daily
basis during this period.
12. Within a week or two from my arrival in Israel I visited my parents, the
Conservator and the Conservatee in Haifa.
13. In Haifa I also met my brother Dror Zernik and his wife Hilah.
14. Within the same period, between my arrival in Israel and the filing of the
above referenced Affidavit, I also stayed a few days with my cousin Amit
Leshem-Sarni.
15. Within the same period, I also stayed for two night with my brother Uri
Zernik, son of the Conservator and the Conservatee, who arrived for a visit
from the United States, in the same room in the Hebrew University Guest
House Belgium House, as guests of our uncle, Prof Eliyahu Shamir.

 Appendix C is a copy of computerized records, which I received

from the Receptionist at the Belgium House on February 26, 2013,
and which document my stay in the same room with my brother in
the Belgium House and the corresponding payments.
16. In a meeting with my uncle, Prof Eliyahu Shamir, on February 26, 2013, he
told me that if summoned, he would appear and testify on these matters in
Court.
17. In May-June-July 2010, I was in contact with many of my family members,
including my father and my brothers Dror and Uri Zernik, but during these
months none of them said a word about the Request to Appoint a
Conservator, none of them asked for my opinion in this matter. Therefore,
like my uncle, Eliyahu Shamir, I had no knowledge of the Request to
Appoint a Conservator.
18. Once I discovered in January 2013 the above referenced Affidavit by my
father, I asked my father a number of times, both verbally and in writing to
correct the Affidavit, since it is false and harmful to me. The Conservator
refused and continue to refuse to correct the Affidavit.
19. I have no doubt that my mother, the Conservatee, Rivka Shami Zernik,
would never have filed a false and misleading to any court in any matter,
nevertheless a false affidavit that harms her son.
20. I have no doubt, that had my mother, the Conservatee, Rivka Shami
Zernik, filed a false and misleading affidavit with any court, she would
have corrected it immediately upon learning about it.
21. Based on instant Declaration and the concomitantly filed Declarations,
conduct of my father, the Conservator Robert Raffael Zernik, should be
deemed as the opposite of fulfilling the will of the Conservatee, which
started even before his appointment and continued during the period of the
Conservatorship, and included the generation of papers that are
systematically biased against me, in his name and/or in the name of the
Conservatee in this Court and possibly in other places as well.
22. Instant Declaration is filed as part of a series of Declarations, pertaining to
the conduct and competency of the Conservatorship in the above referenced
court file, as detailed in the Notice Regarding Declarations filed with
instant Declaration today.
