Deemed open means that enquiry was sent to minimum 6 parties for which prior approval of competent authority was obtained and minimum techno-commercially acceptable response is 3 or more. This will be treated at par with open. In case inquiry is sent to 6 parties other than approved list, the clause for deemed open shall not be applicable. In case of open tender where the techno-commercially acceptable response is less than 3, it shall be treated as Deemed limited at par with limited. Single Technically acceptable offer received against limited tenders shall be treated as single tender. Reasons for accepting "other than lowest" offer shall be recorded in writing. The terms 'Lowest' means lowest techno-commercially acceptable. In respect of sales contract, wherever the word 'Lowest' appears in (8) & (C) above, the same shall be read as 'highest'. Landed Cost for purchase and the proposed award cost for works contracts shall be.the value for determining the competent authority. The authority for termination of contracts shall rest with the same authority who had originally approved the contract. For the purpose of evaluation of tenders, the element of Purchase Preference, if any, given to the public sector undertaking as per Govt. instructions from time to time shall be considered. In case of single offer against an open enquiry, approval of next higher authority shall be taken but not beyond the level of ED/GM(IC). However, if value is within the delegated powers for single tender (non-proprietary items) the same authority shall be empowered to approve the case. (This note is to be read alongwith note no 2) In case of items covered under rate/running contracts entered into with DGS&D and in case of item under distribution / price control against allocation, it will not be necessary to invite tenders and powers as for open tender for lowest will apply.

11. The long term contracts (rate contracts and term contracts) for a period of above 3 years (except for contracts "for road transportation of petroleum products, Contracts for charter/hire of vessels, contracts for maintenance of buildings, office furniture, servicing of Air Conditioners, running and maintenance of vehicles and contracts for supplies and works of minor nature) AND having a value of more than Rs. 8 crores (cumulative) shall require approval of Director / Chairman. 12.
