3. General Order 26.1.1 YY Ethics- Members of the Police Department shall not conspire or
knowingly engage in any activity which deprives any person of their civil rights, due process,
equal opportunity for employment, advancement, job opportunities, or any constitutionally or
statutory guaranteed right. No member of the Police Department shall disseminate
confidential, police-related information to any unauthorized person for any purpose. You are
alleged to have solicited information from an inmate to promote your advancement in the new
jail facility.
4. Auxiliary Services Standard Operating Procedure 038 Employee/Inmate Fraternization- Jailers
will not accept nor solicit any items, money, service, or consideration from any inmate, inmate's
family, friends of an inmate, or solicit a reward from any bondsman or agency. Additionally,
jailers will not recommend or direct an inmate toward any specific bondsman, attorney, or other
inmate agency. You are alleged to have solicited a letter from inmate regarding
Sgt supervisory performance on or about March 18, 2009.
5. General Order 1.3 Use of Force- Members shall use a reasonable amount of force necessary to
accomplish the arrest, overcome perceived resistance to arrest, defend themselves or others
from harm, or to control a situation. It is alleged that you have used force in the jail and did not
document it per policy, as well as to have used force when it was unwarranted.
Renton Municipal Policy 300-3 Harassment- It is the policy of the City of Renton to
maintain a work environment which is free of harassment based on race, color, age,
religion, sex, or national origin. This policy is not limited to in application to harassment
between supervisors and subordinates, but also includes harassment between co-workers.
4.0 POLICY:
4.1 It is the policy of the City of Renton to provide a work environment for its
employees, which is harmonious and free from intimidation. Toward this end, the City
will not tolerate any form or degree of harassment, including sexual harassment,
harassment because of race, ethnic background, religion, disability, or age. Prompt
investigation of all harassment complaints shall be undertaken, and appropriate
disciplinary action shall be taken against any employee who is found guilty of -any form
of harassment.
4.2. All employees have a direct responsibility for reporting any harassment they
experience. Other employees who are made aware that the actions are offensive or
unwelcome to the recipient also have responsibility for reporting harassment.
5.0 DEFINITIONS:
Specifically, The Equal Employment Opportunity Comniission's (EEOC) guidelines
define sexual harassment to include unwelcome sexual advance, requests for sexual
favors, and other offensive verbal or physical conduct of a sexual nature when:
5.1 Submission to such conduct is made a condition of employment; or
5.2 Submission to or rejection of such conduct is the basis of an employment decision
(tangible job benefits, promotion, retention, performance evaluation, etc.); or
5.3 When the conduct unreasonably interferes with the affected person's work
performance or creates an intimidating, hostile or offensive work environment.
5.4 Although this definition specifies sexual harassment, the third item identifying
hostile environment harassment- conduct that has the purpose or effect of unreasonably
interfering with an individual's work performance or creating an intimidating, hostile, or
offensive working environment - applies to all types ofharassment: sex, race, national
origin, religion, age and disability.
G.O. 26.1.1.B Unbecoming Conduct- Members of the police department shall conduct
themselves at all times, both on and off duty, in such a manner as to reflect most
favorably on the department. Unbecoming conduct shall include that which brings the
department into disrepute or reflects discredit upon the individual as a member of the
police department, or that which impairs the operation of efficiency of the department or
the individual.
G.0.26.1.1 UU. Treatment of persons in custody- Members of the police department
shall not mistreat persons, who are in their custody. Members shall handle such persons
in accordance with the law and departmental procedures.

EMPLOYEE I INMATE FRATERNIZING

I. Employee/Inmate Fraternizing
A. Professionalism- Employees ofthe Jail and other department members
temporarily assigned will act in a professional manner at all times when
interacting with inmates.
In the event friends or family of any employee of the Renton Police Department
are brought to the jail for booking, every precaution should be taken to maintain
professionalism.
B. Privileges- Granting of special privileges to inmates is prohibited by any member
of the Renton Jail.
C. Considerations - Jailers will not accept nor solicit any items, money, service or
consideration from any inmate, inmate's family, friends of an inmate, or solicit a
reward from any bondsman or agency. Additionally, jailers will not recommend
or direct an inmate toward any specific bondsman, attorney or other inmate
agency.
D. Fraternization- Members of the Renton Jail will not fraternize with any inmate
either on or off duty. If a Jailer finds that they cannot avoid fraternizing with
arrested individual (i.e. a family member) a memo outlining the unayoidable
nature of this fraternization will be forwarded to the Jail Manager.

n; Truthfulness- Upon the order of the Chief of Police, the Chief's designate, or a superior officer,
members of the Police Department shall fully and truthfully answer all questions specifically directed,
and narrowly relating to the performance of official duties, or fitness for office, which may be asked of
them.
YY. Ethics- Members of the Police Department shall not conspire or knowingly engage in any
activity which deprives any person of their civil rights, due process, equal opportunity for employment,
advancement, job opportunities, or any constitutionally or statutory guaranteed right. No member of
the Police Department shall disseminate confidential police-related information to any unauthorized
person for any purpose.
1.3.1 Use of Force -Authorization
I. The Revised Code of Washington, RCW 9A.16.020 (Use of force- When lawful) provides
statutory authorization for the use of force by a police officer. RCW 9A.16.040 (Justifiable Homicide or
use of deadly force by public officer, peace officer, or person aiding) describes the circumstances under
which deadly force may be used.
II. The protection of life is more important that either the apprehension of criminal offenders or
the protection of property. The member's responsibility to protect life must include his/her own life.
Ill. Members shall use a reasonable amount of force necessary to accomplish the arrest, overcome
perceived resistance to arrest, defend themselves or others from harm or to control a situation.
IV. The degree of force used should be in direct relationship to the amount of resistance perceived
by the member, or the imminent threat the person poses to the member or others.
v. Members will use only the force necessary to accomplish lawful objectives.

GOOD TIME, FINES AND PAYMENT OF BAIL

I. Good Time, Fines and Payment of Bail
A. Only prisoners serving time assigned by the Renton Municipal Court shall receive
credit for good time. Such reduction shall be approved by the Chief of Police or
his designee at the rate listed below.

granted to an inmate serving a commitment unless Renton Municipal
Court specifies no good time allowed.

FINDINGS OF FACT

1. Sgt told me that he was told by Sgt that he is a victim of
ongoing harassment in the jail by Sgt
2. Sgt said he is being harassed and attacked by Sgt squad as
documented in this report.
3. I met with Sgt in my office and he told me that he was a victim of work place
harassment in the jail by Sgt
4. Sgt wants the harassment to stop and to just be able to do his job without
worrying about his position.
5. Sgt told me he talked to inmate in the jail and inmate told
him things that caused him great concern for his job.
6. Sgt said the harassment has been ongoing for years, but he has not
addressed it as he did not want to cause problems. He was just going to deal with it and
do his job.
7. Sgt told me he noticed inmate appeared to be distressed with his
upcoming release date. Inmate had been in custody for approximately six
months and did not know where he was going to live when he got out of jail. He was
worried so he needed his release date to try and arrange a place to live.
8. Sgt had a conversation with inmate in the jail. Inmate told
Sgt during this conversation that he should be worried about his job as the
"A" side crew, supervised by Sgt appears to be conspiring to get him demoted,
fired, or to just quit his job.
9. Sgt. said he is the victim of harassment by Sgt Jailer and
Jailer who work for Sgt Sgt said the harassment
is a personal dislike.
10. Sgt does not believe Jailer is really part of the harassment; they have
a personal dislike but nothing more than that.
11. Jailer said he has a personal dislike for Sgt but does not talk bad
aqout him; he does his job and follows directions given by Sgt
12. Sgt said that inmate told him that he needed to watch his back, not
from other inmates but from jail staff members who worked for Sgt
13. Sgt became concerned for his position at the City of Renton when inmate
told him what Sgt said inmate was supposed to put in a letter
to the Jail Commander.
14. Sgt said this is a violation of Auxiliary Services SOP 038 Employee/Inmate
Fraternization. "Jailers will not accept nor solicit any items, money, service, or
consideration from any inmate, inmate's family, friends of an inmate, or solicit a reward
from any bondsman or agency."
15. Sgt does not believe his safety is at personal risk, only his supervisory position
and/or his job.
16. During the conversation with Sgt inmate stated two items that were
in Sgt recent evaluation: "No one wanted to work for him and he can't
make a decision. "
17. Sgt stated he did not discuss his evaluation with inmate and was
surprised that inmate' appeared to have knowledge of his evaluation contents.
18. Sgt said the only t'CVo people he shared some ofthe information in his
evaluation with were EHD Ofcrs and . He was looking for confirmation if he
really could not make a decision and if nobody wanted to work for him.
19. EHD Ofcrs and stated they never divulged the conversation they had with
Sgt regarding his evaluation with anyone.
20. Sgt was aware that Sgt received his evaluation and there were some
need improvement areas.
21. Sgt was told of Sgt evaluation while in the company of Manager
Bartley, who wrote the evaluation. He stated that he was only told it was not a
favorable evaluation
22. Sgt did have a conversation with Jailer and told him that Sgt
received a negative evaluation from Manager Bartley.
23. Jailer believes Sgt is an effective supervisor although his style is
different than Sgt
24. EHD Ofcr believes Sgt is an effective supervisor.
25. Jailer believes Sgt is an effective supervisor, he just has different ways
of doing things than what Sgt does.
26. Commander Wilcox met with inmate in the jail regarding his conversations with
Sgt and Sgt
27. Inmate told Commander Wilcox he contacted Sgt and asked for his
release date. Inmate said he told Sgt that he had asked Sgt
for his release date and had received several different ones.
28. Sgt said he had given inmate different release dates when he asked
for them. He gave him different dates as it was early in his sentence and he could not
give him a confirmed date at the time he was asked.
29. Sgt said he is aware that any inmate release date greater than seven days needs
commander approval. In the past he has always obtained approval.
30. Sgt gave inmate more than seven days of good time without approval.
He did not think to request approval as he thought 14 days was fair and adequate.
31. Sgt said inmate only complaint was his release date.
32. Sgt said when inmate asked for his release date, Sgt told him
he could a make decision and gave him a date of April1

34. Inmate stated he was worried about his safety if he did not write the letter as
requested by Sgt Inmate was concerned about his safety while in
custody and when he was released if he did not write the letter.

35. Inmate said that he agreed to write the letter as he was scared of Sgt
Inmate has heard Sgt use force on other inmates and that Sgt
brags about his use of force. He was also told by Sgt that he could not go out in
the main jail area as he has too many uses of forces and if he has another one he will get
into trouble.
36. Sgt said that he has told other jail staff members that he cannot leave the
control room as he has had too many Use of Force reports and will get into trouble if he
leaves the control room. He cannot afford to have another use of force.
37. Sgt said to inmate that he needed to write in the letter to the Jail
Commander that Sgt was incompetent and could not make a decision.
38. Sgt said in his first interview that he did talk to inmate about Sgt
not giving him his release date and that was the only complaint inmate
voiced.
39. Sgt said in his first interview when he was asked if he has ever asked an inmate
to write a letter regarding an employee's performance he replied, "Affirmative."
40. Sgt said in his second interview that he had a conversation with inmate
regarding Sgt work performance but it was one-sided. Inmate said
Sgt was an idiot and incompetent.
41. Sgt said in his second interview that when inmate described Sgt
using the words incompetent, cannot make a decision, and is indecisive, he
{Sgt only repeated the words back to inmate
42. Sgt said that he may have used the words indecisive or can't make a decision
but he was only repeating words that inmate used.
43. Sgt said in his second interview that he has used the words incompetent,
cannot make a decision, or was indecisive with his jail staff referencing Sgt
abilities, but not to an inmate.
44. Sgt said in his first interview that he only told inmate how and to
whom he could file his complaint about Sgt
45. Sgt stated in his second interview that he and inmate did have a
conversation about the letter inmate needed to write to the Jail Commander
and to write what he was telling Sgt at the time.
46. In his first interview Sgt said he did not think inmate would write a
letter but he did tell him if he wants to file a complaint against Sgt he needs
to put it on paper.
47. In his second interview Sgt said he told inmate that if he had a
complaint to put it on paper; he also did not think inmate would write the
letter.
48. Inmate told Commander Wilcox that another jail staff member entered into the
kitchen area where he and Sgt were talking and Sgt told the other
officer what inmate was supposed to put in the letter and not to seal it so it
could be read first. He stated the jail staff member was
49. Jailer stated that Sgt told him to tell inmate if he wanted to
write a letter to go ahead and write his complaints in a letter and they will make sure it
gets up to Commander Wilcox.
50. Jailer stated he was aware that inmate was supposed to write a letter
but had no knowledge of what was supposed to be in it.
51. Sgt said in his first interview that no other jail staff was aware of the letter he
told inmate to write to the Jail Commander.
52. Sgt became aware of the requested letterby Sgt from inmate
while he was talking to inmate
53. Inmate said he has been in custody for six months and that jail staff talks freely
around him about any topic, including the daily operations of the Renton City Jail and
the proposed new jail.
54. Inmate said that it appears Sgt crew had no respect for Sgt
and was ganging up on him.
55. Inmate said his opinion is that it appears Sgt and his crew were out to
get Sgt demoted, fired, or to quit his job before the new jail opened up.
56. Inmate was advised by Commander Wilcox if he wished to write the letter he
may do so but it was not required and he should not feel obligated to write the letter. If
he did write the letter, he was to seal it and give it only to Commander Wilcox.
57. Commander Wilcox met with inmate the next morning and inmate
gave him a sealed envelope with a letter inside.
58. Commander Wilcox asked inmate for a contact phone number and/or address
as he was getting released. Inmate said that he would not give an address or
phone number as he was afraid for his safety since he wrote the letter. The only
telephone number he provided was his probation officers' telephone number.
59. In inmate letter, he wrote he had nothing to gain from writing the letter and
he was fearful for writing the letter, as things may get ugly, as the information he is
writing is sensitive (see attached letter from inmate
60. Inmate said that he agreed to write the letter as he was scared of Sgt
as he has heard Sgt use force on other inmates and he brags about it.
61. Inmate said his cell was adjoining the drunk tank where most of the force was
used.
62. Sgt said he believes Manager Bartley is receiving information about the daily
operations of the jail, especially any negative information, from Sgt
63. Sgt believes information is sent or relayed to Manager Bartley to make him
look bad.
64. Documented emails from Sgt to Manager Bartley confirm that Sgt does
have correspondence with Manager Bartley when any perceived negative issue comes
up that can be referenced to Sgt
65. Sgt said he has telephoned, emailed, and had face-to-face conversations with
Manager Bartley regarding Sgt job performance.

66. Sgt has written memo's regarding Sgt graveyard squad errors to
Manager Bartley. Sgt has the FTO side, who trained and signed off the jailers as
being trained. Sgt wrote a memo to Manager Bartley and she responded back
that Sgt will have the opportunity to address the issues and that Sgt
squad also has issues that need to be addressed.
67. Manager Bartley responded back to Sgt stating that his squad has issues too, he
cannot confirm his allegations, and he needs to take care of his squad (see attached
email).
68. Manager Bartley has addressed issues with Sgt and has criticized Sgt
about his squad, which has the same issues as Sgt squad.
69. Sgt has discussed his displeasure with Sgt or his perception of Sgt
work performance and abilities, with subordinate members of the jail staff.
70. Sgt said when he speaks poorly of Sgt he is only venting, and he vents
to anyone who is in the area at any time.
71. Sgt said he remains professional with inmates but not with jail staff.
72. Sgt said that he believes he has addressed Sgt job performance
enough so he did not think about bringing it up to the new Jail Commander.
73. Sgt believes that he did not have to bring everything up to the new Jail
Commander, as he has done previously with Manager Bartley, as he did not think it
mattered.
74. Sgt believes the harassment has been going on for the last two years but it
came to a head last November 2008 over a contraband issue he discovered in the jail.
75. Sgt believes the harassment got worse when he discovered an issue in the jail
over contraband drug baggies being held by another jailer who found them in an
inmate's property. The inmate was being transferred to another facility for booking. Sgt
called Manager Bartley and advised her of the incident. She was not
concerned about the issue and told Sgt she would look into when she came
back to work. Sgt said he documented the incident and placed the
contraband into an evidence locker. In Sgt interview, he said this was
"bullshit" and it was to make his squad look bad. Sgt was angry with Sgt
for this incident and vented to anyone and eve.ryone that he saw. This
incident occurred in November 2008.
76. Sgt said he believes that Sgt was resentful because of the contraband
incident and retaliated by talking to a trustee, asking him to write a letter to the Jail
Commander so the new Jail Commander will think he is incompetent as a supervisor.
76. Sgt said he knows the Use of Force Policy and the jail staff is trained in the Use
of Force Policy quarterly.
77. Sgt has been trained in verbal judo and he knows how to apply it in situations.
78. Patrol officers arrested a male subject and were transporting him to the jail for a BAC
test. Sgt and other members of the on duty jail staff heard on the radio that an
uncooperative DUI subject was being brought into the jail. When the officers arrived
with the subject, he was placed in the BAC room and handcuffed to the bench, being
observed by Officer Ashbaugh. The subject did not appear to be causing any problems;
he was just sitting on the bench as Officer Ashbaugh was preparing the BAC machine for
the test. Sgt entered walked through the BAC room towards the exit door.
When he returned he appears to begin a conversation with the subject. Sgt
then sits down next to the subject on the bench and continues talking with him. While
Sgt was talking with the subject, the subject put his finger in his mouth, pulled
his finger out, and attempted to touch Sgt face with his finger. Sgt
applied force to the subject by grabbing his hand and pulling it away from his face. Sgt

towards Sgt After Sgt left the BAC room, the subject was once again
calm.
79. A fight occurred between two inmates in a cell. Jailers responded to the cell and
extracted one of the inmates. The inmate was escorted to cell S-1 by Jailer Hoopii,
unrestrained. Sgt enters the cell and said he was explaining to the inmate how
the jail staff would investigate the assault incident. The video shows Sgt
entering cell S-1, putting on latex gloves, and aggressively approaching the inmate who
was handcuffed, seated on the floor, and compliant. Sgt placed himself within
inches of the inmate with his right hand extended towards the inmates face. The inmate
did not react at first but several seconds later he spat at Sgt Sgt then
used force and rolled the inmate to his left side then on to his chest. Jailer's Hoopii and
Dement assisted in placing the inmate into handcuffs. Sgt left the cell and
returned with the "WRAP." Sgt Jailer Hoopii and Jailer Dement placed the
inmate into the WRAP. There were no aggressive actions towards any member of the
jail staff, including Sgt recorded in the use of force video.
80. Sgt did use force against inmates. His written reports do not reflect what the jail
videos of the incidents reveal.
81. Sgt was advised by Commander Karlewicz during his first interview that he was
not to discuss this internal investigation with any department member, except his RPOG
representative.
82. Sgt violated the order by talking with Commander Manager Bartley,
Jailer , and Sgt
83. Sgt after his first interview, went to Commander office and had a
conversation with her about the internal investigation. He said she had asked him if
there was a gag order and he told her yes. He still talked about the investigation
knowing he was breaking the gag order.
84. Sgt stated he did not discuss any questions, he just discussed the nature of the
investigation and the charges against him.
85. Commander was interviewed by Deputy Chief Troxel regarding her and Sgt
conversation. Sgt told her that a trustee contacted him for his release
date. He gave the trustee a release date and the trustee was complaining about Sgt
. The trustee had written a letter of complaint and he (Sgt was being
accused of having helped the trustee craft the letter. There was also an allegation that
he (Sgt had used his taser and not reported it.
86. Commander said in her interview that they were both aware ofthe gag order
and after Sgt told her about the allegations, she just gave him some
professional advice. Then they just talked about Sgt children. At the end of
their conversation Sgt remarked, "Hey if anyone asks, we talked about
and " (Sgt children) and Commander replied "Okay".
87. Sgt was asked in his second interview if he indicated to Commander
that their conversation be kept between the two ofthem. He replied "No."
88. Manager Bartley was interviewed by Deputy Chief Troxel regarding this internal
investigation. Manager Bartley stated that Sgt had approached her several
times during this investigation. Each time she asked him if there was a gag order and he
replied yes. She told him then we are not talking about it.
89. Sgt said that he had a brief conversation with Sgt about the investigation
and the only item that Sgt brought up was the allegation of use afforce. The
conversation ended after that as Sgt was told by Sgt of the gag order.

Chronological Summary of the Investigation
Sgt came into my office to advise me of a situation occurring in the jail that he
became aware of through a conversation with Sgt Sgt told me
that Sgt was being harassed in the jail by the other jail supervisor, Sgt
Sgt stated that he was told that Sgt went to a trustee inmate
named and asked the inmate to write a letter to the Jail Commander
stating that Sgt was a poor supervisor. Sgt related to Sgt that
inmate was acting peculiar and asked him if he was OK or was something
wrong. Sgt was aware that inmate release date was coming up.
Inmate told Sgt that he did not want to talk about it but did state to
Sgt that he needed to watch his back. Sgt asked why he needed to
watch his back. Inmate stated it was not from other inmates but from jail staff
members on the other side of his crew. Sgt related to Sgt that he was
told by inmate that Sgt and other jailers who work for Sgt were
out to get him. Sgt could not make any decisions, was an ineffective
supervisor and jail staff members on the "A" side (lead by Sgt were conspiring
to get Sgt demoted, fired or make him quit his job.
Sgt came into my office and requested to speak to me about a problem that
is happening in the jail that he is very concerned about it. Sgt stated that on
03-27-09 he noticed trustee inmate acting weird, not his usual self. Sgt
asked inmate if he was OK. Inmate stated that he was a
little stressed about getting out of jail. The conversation started out with them talking
about inmate father passing away while he was in jail and how he could not
travel to Moses Lake to see his mother due to probation restrictions. As the
conversation continued inmate asked Sgt if he (inmate had
done something wrong as Sgt was acting differently. Sgt stated he
was just focusing on work and other things. As the conversation continued, inmate
told Sgt that he needed to watch his back. Sgt asked
inmate what he meant by that. Inmate replied that it was not from
him or other inmates but from the people he works with at the jail. Sgt stated
he thought something was going on so he was guarded. Inmate stated that he
had asked Sgt for his release date a week ago but Sgt was going
home so he could not give it to him. The next day or about inmate asked Sgt
for his release date as he had to get a place to stay and get things in order
before hewas released. This conversation was taking place in the jail kitchen area he
believes. Sgt told inmate that he would give him a release date if he
(inmate would write a letter to the jail commander, Commander Wilcox,
stating how Sgt could not make a decision, was indecisive, nobody wanted to
work for him, and he was a bad sergeant. Inmate stated that Sgt left

the area, came back and wrote a release date of April 1st on the white board in the
kitchen, and then left. A few minutes later another jailer entered the kitchen area and
told inmate when he writes the letter to the commander not to seal it, give to

them so they could read it first.
I went to the jail to talk to inmate about his allegations and statements made to
Sgt Inmate requested that someone else be present when we
talked. EHD Ofcr was available and inmate stated he knew EHD Ofcr
and would feel comfortable with him in the room while we talked. I asked EHD Ofcr
to meet inmate and me in the jail courtroom. Inmate was very
apprehensive at the beginning of the conversation. When he realized who I was from
previous contacts on the street, he relaxed. He told me that he was very concerned
about talking to me, as he is worried about his future and safety. I assured him not be
concerned, that we could just talk. Inmate told me that he approached Sgt
a few weeks ago inquiring about his release date. Sgt told him that
he was getting off shift and going on his days off and he would talk to him when he
came back to work, or he could ask the oncoming crew to give him his release date.
Inmate said he asked Sgt the next day for his release date. Sgt
told him he would give him his release date if he wrote a letter to the Jail Commander
stating that Sgt could not make a decision, was indecisive, and a poor
sergeant. Inmate said he felt very uncomfortable with this request, as he did
not want to be involved and that it was not his place to be involved in the internal
workings of the jail. Inmate said he felt that if he did not agree to write the
letter he would not get his release date. He also felt his safety in the jail or out of jail
would be in jeopardy. Sgt walked away and a few minutes later came back into
the jail kitchen, wrote on the white board April1

walked out. A few minutes later Jailer entered the kitchen and told inmate
that he was not to seal the letter when he wrote it and he was to give it to him
or Sgt so they could read it first before it was given to the commander. Inmate
was told again that he needed to put in the letter that Sgt cannot
make a decision and is a bad supervisor and not to seal it. Inmate said that he is
aware of the operational procedures of the new SCORE facility as the jailers talk about it
in his presence. He is also aware that everyone is jockeying for a new position of
authority at the new jail and that jailers on Sgt crew are trying to make it so Sgt
gets demoted, fired, or quits before the new jail opens up. Inmate
said that he believes Sgt is the best qualified of the two jail sergeants to be a
sergeant. Sgt is not professional. Inmate said that Sgt told him
he (Sgt could not go into the jail area as he has used too much force this year
and he cannot afford to use any force, as he will get into trouble. Inmate stated
that he has seen and heard Sgt use force previously as his cell is next to rubber
room and drunk tank. Inmate believes that Sgt has used force on other
occasions and has not written them up as he knows Sgt has done more than

three uses of force. Sgt also brags about his use of force. Inmate said
because of his knowledge of Sgt behavior he was now in fear for his safety and
release date. Inmate said that he has been in custody for six months and is very
familiar with the daily operations of the jail. Jailers are so comfortable around him that
they have opened the key box with him standing there. Inmate said he knows
the combination to the key box and could escape if he wanted to. Inmate said
he could have just taken his release date and walked away and not said anything about
what had occurred between Sgt and him but he believes it was important to let
someone know what was going on in the jail, as it was not right. Inmate also
said he did not want the burden on his back if something happened. I told inmate
he had the option of writing the letter if he desired to or not writing the letter.
If he wrote the letter, he was to give it to me, sealed. I told him that I would check with
him in the morning and see if he had anything else for me.
I went to the jail and spoke with inmate in the jail kitchen. We spoke briefly and
he handed me a sealed envelope. He told me that he was not going to give me the
address of where he is going when he is released, as he is afraid for his safety. He did
not want the information to get out as he felt he might be targeted for retaliation by
members ofthe jail staff for writing the letter. He is also fearful of what is going happen
to him when he comes back to jail, as he has been in and out of jail his whole life,
whether he returned to the Renton Jail or the new jail as the same officers will be
working in both places.
I reviewed the letter had written. It contained most of the information we
discussed on 03-31-09. It also stated in part, "this is probably the hardest thing I've ever
done, because the information herein is sensitive and I'm feeling one-way a big weight
has been lifted from me, but in another I am now fearful, because this might get very
ugly".
I advised Chief Milosevich of the preliminary information that I have received up to this
date. I was instructed to contact the employees who were aware of the situation and
direct them not to discuss it with anyone. I contacted Sgt Sgt EHD Ofcr
and Evidence Technician and directed them not to discuss the situation with
any other member of the department. I also requested they write a memo to me with
any information they have at this time regarding the situation.
I was assigned Internal Investigation 03-09 from Chief Milosevich.
I researched City of Renton Policies and Renton Police Department General Orders for
violations of sections that may have occurred during this event.

I contacted Probation Officer JR Casimiro to obtain information of where I could contact
inmate Officer Casimiro said inmate has not checked in with him as of
this date and did not know his whereabouts. If he does make contact with inmate
he will advise me of inmate location so I may contact him or have
inmate contact me.
I conducted an interview with Sgt in my office, 2nd floor of the police
department.
Sgt told me for the last two years he has been the victim of work place
harassment by Sgt and members of his squad i.e. Jailer and now he
believes Jailer Sgt said he believes the harassment is personal dislike
by Sgt and Jailer He said he was just living with the harassment until he
spoke to an inmate. Inmate told Sgt during a conversation in the jail
that Sgt had requested that he (inmate write a letter to the Jail
Commander saying that he (Sgt could not make a decision and was
incompetent. He said this occurred when inmate asked Sgt for his
release date. Inmate had asked Sgt but he was getting off shift, did
not have time to calculate inmate release date, and told inmate to
ask Sgt the next day. Inmate told Sgt that Sgt told
him to ask for his release date. Inmate told Sgt that Sgt told
him that he needed to write a letter to the Jail Commander saying that Sgt
could not make a decision and he lacked abilities as a supervisor. Sgt gave
inmate a release date of April1

after inmate agreed to the write the
letter. Sgt said that inmate told him two things that were in his
evaluation he had just received a few days prior; he could not make a decision and
nobody wanted to work for him. This alarmed Sgt as he did not mention any
of the contents of his evaluation to any person except for EHD Ofcrs and He
only told them of his evaluation content to get validation that it was not a true and
accurate evaluation. Sgt said that inmate also told him he needed to
watch his back, not from inmates but from Sgt crew, as they were out to get
him demoted, fired, or to quit his job and not go to the new jail. Sgt said he
feels like no matter what he does it is turned around to make him look foolish or have a
lack of ability. He said that talking about him to his subordinates is one thing but going
to an inmate crossed the line of what he can take being uncomfortable in the work
place. Sgt also believes that Manager Bartley is being told negative
information about him by Sgt and that is why he had a less than favorable
evaluation. Sgt and his crew get what they want when he asks for it and Sgt

crew does not receive the same equitable treatment from Manager Bartley.
Sgt said that he believes the real work place harassment began after a
contraband incident he became aware of and reported during the month of November
2008. Manager Bartley told him that she had talked to other jail staff members and
nobody wanted to work for him. Sgt said that everyone who is working for
him currently bid for his side during shift bids. Sgt said his concern is for his
position as a sergeant and as an employee. He would like the harassment stopped so he
can just do his job and not worry about his position.
I contacted the City of Renton IS department and received authorization to copy Sgt
"I" drive. I received a copy of Sgt "I" drive. I received authorization
to view/copy the email of Sgt and Jailer located on the City of Renton's
email domain.
I contacted Renton EHD and probation departments to ask if they had any information
of where inmate was living and if he was required to check in with Renton's
probation office. The answer to both questions was negative.
I contacted jail nurse Judy Wygle and requested she contact Sound Mental Health, who
was supposed to have picked up inmate from jail for outpatient treatment, to
see if they had any contact information for inmate Inmate never
made contact with Sound Mental Health upon his release from Renton City Jail.
Inmate whereabouts are unknown at this time.
I reviewed Sgt "I" drive and email of sent and deleted files.
I reviewed 288 sent files. Deleted files did not reveal any significance. Deleted files of
deleted files could not be recovered. The current email system cannot recover any
deleted file that has been deleted after 15 days of deletion. The period of emails I was
looking for, if deleted, are not recoverable.
Jailer email reflected the same issues I had with Sgt email.
I conducted an interview with EHD Ofcr in the interview room on the 2nd floor of
the police department.
EHD Ofcr was present with me when I spoke to inmate on 03-31-09 as
inmate felt comfortable having a person who he knew sit in on our interview.
EHD Ofcr said inmate appeared to be nervous about telling me what he
was told to do, i.e. write a letter about Sgt lack of supervisory abilities.
Inmate said he asked Sgt for his release date but Sgt was
getting off shift and did not have time to calculate it. Sgt told inmate
to contact Sgt the next day and he would be able to give him his release date.
Inmate said in his conversation with Sgt he told him that the other

sergeant and his crew were out to get Sgt demoted, fired, or to quit his job.
During his conversation with Sgt in the jail kitchen, inmate was told
that he needed to write a letter to the Jail Commander saying that Sgt was
incompetent and indecisive. Inmate said that he agreed to write the letter to
get his release date and he was fearful for his safety in the jail if he did not write it. After
Sgt told him what to put in the letter, he walked out of the jail kitchen. Inmate
said another jailer, who he identified as Jailer entered the jail kitchen.
Inmate said it appeared to him that Jailer was aware ofthe letter as he
told inmate not to seal the letter so they could read it before it was submitted.
EHD Ofcr said that he does believe that inmate was in fear for his safety,
as he has known inmate for many years and knows his characteristics.
EHD Ofcr said he does believe there is harassment and retaliation in the jail. He
said that he has felt harassed or received retaliation from Sgt and Jailer
who is a direct report to Sgt EHD Ofcr believes retaliation is just part of
Jailer nature, if something does not go his way he tends to retaliate. EHD Ofcr
said when the position of a Transport Officer was opened up it was never posted
for current jailers to test for. EHD Ofcr as a member of the RPOG Executive Board,
had RPOG require the position be posted and tested for. Jailer did not like that
idea and started a petition in the jail to get the EHD officers, who had been appointed to
the EHD position without testing, to be required to rotate to out back to a jailer
position. EHD Ofcr said he felt this was harassment or retaliation, as he had not
agreed with Jailer
Jailer was served with his 24-hour notice.
Sgt was served with his 24-hour notice
Commander Chad Karlewicz interviewed Sgt in room 519, with RPOG
representative Sgt Dave Skelton also present.
Sgt said it was one of his responsibilities to ensure there is a cohesive working
relationship in the work place and between both the "A" and "B" side squads. Sgt
said he is aware of the City of Renton's Harassment Policy, which he
characterized as, "Any uncomfortable workplace'co-ndition created by either unwanted
comments, touching, performance." When Sgt was asked if he had knowledge
of the Auxiliary Services SOP 038 Employee/Inmate Fraternization, he said, "Yes, I wrote
it." Sgt was asked if he had knowledge of any member of the jail staff having a
conversation with any inmate regarding other jail employees. Sgt said "Yes, I did
with a trustee named Sgt said inmate was complaining to
him about Sgt and he told inmate if he wanted to file a complaint he
needed to put it on paper. Sgt said this conversation took place in the jail
kitchen. Inmate only complaint he voiced at this time was not getting a solid
release datefrom Sgt when he asked for it. Sgt said he and inmate
were the only two people in the jail kitchen when the conversation took place.
Sgt said that he did not discuss inmate writing the letter to the Jail
Commander with any other jail staff member. Sgt said that he did not direct any
other member of the jail staff to make sure inmate wrote the letter and did not
think inmate would actually write a letter. Sgt said he did not tell
what to put in the letter, he just told him if he had a complaint he had to put it
on paper and send it to the Jail Commander. Sgt said that he only said that if Sgt
can not make a decision, he can and gave inmate a release date. Sgt
was asked what his intent was on asking inmate to create a letter and
he said, " was actually pissed at so if he wanted to file a beef he could
file a beef." Sgt said he did not tell any jail staff member that inmate
may write a letter and what to do with it. Sgt said he may have come back into
the control room and said "well pissed at Sgt about the release
date thing" but that was all.
Sgt said that when gifting good time to inmates in an amount over two weeks
he has always received approval from Manager Bartley, but thought it was not a
problem so he decided not to advise the new Jail Commander of his decision. Sgt
said he did give inmate a proper release date.
Sgt was asked if his words or actions ever worked in a manner to discredit Sgt
with any city employee and he replied, "Yes." Sgt stated he has
vented to Manager Bartley and other members ofthe jail staff about Sgt
supervisory abilities but he called it just venting. Sgt said he always remains
professional to inmates, but not to staff.
Sgt said one specific incident occurred which he thought was "bullshit" occurred
in November 2008. Jailer located contraband in an inmate's property when that
inmate was being transported to another facility. Jailer told Sgt of the
contraband and placed the contraband baggies in his personal jail storage cubicle. Sgt
learned of the incident and retrieved the contraband baggies from Jailer
storage cubicle. Sgt called Manager Bartley and told her of the
incident. She said not to worry about it and she would take care of it when she returned
to work. Sgt said he followed policy, generated a case report, and placed the
contraband baggies into evidence. The issue is that Sgt squad left the
contraband baggies in the inmate's property. Sgt squad found the baggies. Sgt
squad wanted to use the contraband baggies to train Sgt squad in
how to conduct a proper search. Sgt felt that Sgt only called Manager
Bartley and generated a case report to make Sgt squad look bad.
Sgt said he had a conversation with Manager Bartley referencing Sgt
last evaluation but it was only that Sgt was receiving a non-

favorable evaluation. Sgt did tell subordinate Jailer about the non-
favorable evaluation.
Sgt believes Sgt is an ineffective supervisor, as he (Sgt
won't make a decision. Sgt said he has shared his opinion with Manager Bartley
many times and her response is that she is working on it.
Sgt is trained in the Department's Use of Force Policy. Sgt stated he has
not used his taser in the jail in more than a year. He has had two Use of Force reports in
the recent months and they were soft, empty hand techniques. Sgt has made
statements that he could not leave the control room as he has had too many use of
forces.
I conducted an interview with Jailer in room 520.
Jailer and I were the only two present; he did not request RPOG representation.
Jailer said that he was aware of inmate being upset about his release
date as he had marked four dates on the white board in the jail kitchen which were
given to him by Sgt Jailer told inmate if he wanted his

and he gave him a date. Jailer told inmate if he had a grievance or
whatever, like Sgt said, write it down in a letter and it will get up to Commander
Wilcox. Jailer said that he never told inmate what to write in the letter
or what to do with it if he wrote one. He only knew was upset about his release
date. He never solicited a letter from inmate regarding Sgt Jailer
said he was not part of any conversation between Sgt and inmate

Jailer said he and Sgt have never gotten along very well together. He
does not go out of his way to talk about him. He does work overtime on Sgt
squad and he respects Sgt rank, but he will not go out of his way to have a
conversation with him. Jailer believes Sgt is effective in what he is
doing right now and he follows policy. Jailer said that Sgt follows all
policies to his knowledge. Jailer said that there is a difference between the two
jail sergeants; Sgt is more of a black and white decision maker and Sgt
is more in the gray area.
I conducted an interview with Jailer in my office, the 2nd floor of the police
department.
Jailer was approached by inmate who requested his release date. Jailer
told inmate that he had to ask either Sgt or Sgt as
they were the only two that could give him trustee gift time. Jailer said he was
not aware that Sgt talked to inmate about writing a letter to the Jail

Commander about his (inmate complaint about Sgt Jailer
said that the first he heard of a letter being written by inmate was when Sgt
mentioned it after his interview. Sgt talked about the letter and
something else he could not remember but he did not go into detail. The other thing Sgt
mentioned was that Jailer was also involved in the investigation. Jailer
did not speak to anyone about his involvement in this investigation, according
to Jailer
Jailer says he gets along with both sergeants and both squads as he works a
Monday through Friday schedule. He does not believe there is harassment in the jail
from anyone.

Sgt was served with new allegations and was given his 24 hour notice for his
second interview on 05-05-09 at 1645 hours.
RPOG Guild Representative Sgt Skelton talked with Sgt and requested to move
the interview to 1500 hours 05-05-09.
I conducted a second interview Sgt at 1506 hours in the 2nd floor interview
room at the police department. Sgt was represented by RPOG Guild
Representative Sgt Skelton.
Sgt was asked if he knew the contents ofthe City's harassment policy. He
replied that harassment is defined in the workplace as creating an uncomfortable
environment, negative unwanted talking, touching, and creating a hostile work
environment.
He was asked if he believed his words actions or conduct could sway a subordinates
thoughts or conduct towards other members of the department. He replied

Sgt said he did have a conversation with inmate regarding Sgt
performance as a supervisor. He said it was a one sided conversation as
inmate was upset with Sgt over his release date. Sgt said
ihmate said he (Sgt was an idiot, he's incompetent, and somebody
should be told about him. Sgt told if he wanted, to say he (Sgt
is an idiot and he's incompetent and he doesn't know what he is doing, put it
in a letter. Sgt said he only repeated the words inmate used to tell him
how he felt. Sgt said he has used the words, incompetent, cannot make a
decision, or was indecisive to other members ofthe jail staff when he has referred to Sgt
abilities.
Sgt said that inmate had asked him for a release date a month prior
and he told inmate he had to wait until it got closer to his scheduled release
date before he could be given a firm date. When inmate asked Sgt
for a release date, he would give him one but he gave him four different dates. Sgt
said inmate complaint was his release date and he told him (inmate
if he wanted to file a complaint, he could do that. Sgt said that the
release dates Sgt had given inmate were different than the release
date Sgt gave, but the ones Sgt had given could have been correct
release dates.
Sgt said his only intent when he heard inmate was upset was to go to
talk to him and calm him down. While he was talking to inmate the words
"won't make a decision" and "indecisive" came up but they were inmate
words and he was only repeating them. Sgt told inmate he needed to
put his complaint on paper.
Sgt was asked if the words "cannot make a decision, indecisive, and
incompetent" are words that supervisors use to describe an employee's performance.
He said "Yes." He also said he has heard other subordinate staff members using the
same words when talking about Sgt
Sgt said when he came to work inmate asked about his release date
and he used the words indecisive and incompetent, Sgt repeated the words
back to inmate Sgt said that inmate had the four release
dates on the white board and a speech prepared for him. When Sgt was asked if
any of those dates could have been correct he said, "Yes".
Sgt said he typically lets the Jail Commander know for approval when an inmate
is gifted time. This time he chose not to advise/request approval with Jail Commander
Wilcox as he figured with the amount of time inmate had already been in jail,
fourteen days was fair and adequate. Sgt said he did not think Commander
Wilcox would have an issue with it.

Sgt said he was surprised inmate wrote a letter to the Jail Commander.
Sgt said he did not encourage inmate to write the letter, he just told
how to. Sgt told inmate if he wanted to file a complaint that he could
put his words on paper and send it to the Jail Commander.
Sgt has talked with Manger Bartley about complaints he has received from
members ofthe jail staff towards Sgt Sgt said Manager Bartley
replies she will address the complaints. Sgt said that he has never talked to Sgt
about his leadership issues that he believes Sgt has as he would
think it was a personal attack.
Sgt said the only conversation he had with Manager Bartley over Sgt
evaluation was that it was a negative evaluation or he needs improvement.
Sgt said that he has conversations with Manager Bartley in person, by
telephone, or through email regarding day-to-day jail business. She ran the a ~ f o r the
last ten years so if he did not know an answer he would talk to her about his question.
I asked him if he would be surprised that I talked to Jailer about this
investigation and he replied. "No." The only thing Sgt said about the
investigation was he thought the allegations were crap. Sgt said he did not have
any conversations with Jailer after the first interview.
Sgt said after his first interview he vented to anyone who was around him about
the investigation as he thought the charges he was accused of were crap.
Sgt said he did not talk to Jailer about the investigation. Jailer in
his interview said Sgt did talk to him about the allegations but was unclear if Sgt
really said what exactly his interview was about.
Sgt said he talked to Jailer about the allegations, the letter and the
harassment and said they were crap. Sgt said he did not go into the questions
with Jailer
Sgt said after his first interview he went to Commander office and
talked to her about the investigation. He said he was vague with her and she reminded
him of the gag order but he kept talking. He said he talked about the charges, the
allegations, and what he thought of them. Commander reminded him of the
gag order so they changed the subject to his children. Sgt said that Commander
just listened as he vented. Sgt stated he knew he had disobeyed the
gag order at the time he started talking to her. Sgt said he did not indicate to
Commander that the conversation they had be kept between the two of them.

Commander was interview by Deputy Chief Troxel. She was asked if Sgt
had asked her to keep the conversation between the two of them. Commander
said Sgt told her that their conversation was to be kept between the
two of them and if any one asked what they talked about suggested that their
conversation was <!bout his kids (see attached Statement of Commander
Manager Bartley was interviewed by Deputy Chief Troxel. She was asked if Sgt
talked with her about this investigation. Manager Bartley said Sgt started to talk
about the investigation and she asked him if he was told not to talk about it. Sgt
said yes and Manager Bartley said "Okay we're done we are not going to talk about it."
She did not have any further conversation with Sgt about the first interview.
Sgt contacted Manager Bartley again after he was served with the new charges,
one involving the possibility that he violated the gag order. During various conversations
she had with Sgt he would bring up the investigation and she would not talk
with him about the investigation and reminded him of the gag order (see attached
Statement of Manager Bartley).

Wilcox had been looking for Use of Force Reports regarding jail staff. The
Use of Force Reports are stored in office. Later she heard from
Manager Bartley that there was an internal involving jail staff. Bartley had
heard from Chief Milosevich on the day of the initial interviews of Sgt
and Jailer Milosevich had told Bartley that the complaint had
something to do with a letter of complaint written by a Trustee regarding Sgt
and some of the language in the letter resembled some language
in an evaluation that Bartley had completed on The letter may
have listed some allegation about Use of Force issues in the jail.

after his first interview. (with Commander Karlewicz). was aware of a
gag order, as was He was directed by Karlewicz to not talk about
the investigation with anyone except his guild representative, and/or one of
the investigators. told that their conversation was to be
kept between the two of them. If anyone were to ask what they talked about,
suggested that their conversation was about his kids.

she (Barley) "shut him down" ( before he could talk about it with her.

05/20/09 1245 Conducted interview with Bartley in my office. Bartley and I were the only
ones present. She became aware of the internal when she received an email
from Chief Milosevich advising that he wanted to talk with her briefly about a
complaint in the jail. On her way to work that day, when walking through the
parking garage, Bartley saw and asked him what was going on in
the jail. did not know, apparently because he had not been notified
yet for his interview.
Bartley and Milosevich spoke in person that morning shortly after her arrival
at work. Milosevich told Bartley that the complaint had something to do with a
letter of complaint written by a Trustee alleging that Sgt was a bad
supervisor. The letter was allegedly solicited by and Jailer
Later that same day, came by Bartley's office and let her know he
was notified of an interview the next day. He asked for guidance on if I who
he should have as a guild rep. Bartley approached and asked if
Sergeant Skelton would be available for to take to his interview.
After first interview, he stopped by to see Bartley. She was on the
phone and could not talk. Later she went down to the jail to talk with
about SCORE issues. started to hand her the sheet with the
allegations on it. She asked him if he had been told not to talk about it. When
told her that he had, she told him that they were done, that they
were not going to talk about it anymore, and she handed back the sheet.
Once was made aware of a second interview, he told Bartley that
there were some new charges, one involving the possibility that he violated
the gag order. Since then, they have had a few conversations about jail and
SCORE issues. Each time if would start to bring up the Internal,
Bartley would confirm that he had been told not to talk about it. When
confirmed that, they would not talk about the investigation.
Additionally, Bartley claimed that there were no other discussions, either by
email, text, cell phone or any other means.
Bartley spoke at various Urnes with Commanders and Wilcox about
the internal. With the conversation was brief, and after Bartley h.ad
returned from an out-of-town trip to Louisville. Bartley had asked, what was
new at work. responded that she did not want to talk about the
internal. Bartley felt that she said something she shouldn't have said.

5/20/09 1245 This was apparently after and had talked, in violation of
gag order. With Wilcox, it was a 30-second conversation. Bartley
cont. had asked if there were something where she could fill-in the details, or was it
something else. Wilcox told her that it was something that happened on his
watch, it had to do with accountability and it was his No one
else on jail staff spoke with Bartley about the Internal.
Bartley then shared some general information with me about how complaints
from inmates are handled. We discussed "kites" v. "grievances", how those
are tracked, who investigates and responds in how much time, etc. On
average Bartley believes that the jail receives 2 or 3 grievances a month.
Grievances must be responded to in writing within 72 hours.
I asked, based upon her limited knowledge of this complaint, would it have
normally come through as a kite or grievance? Bartley said they are handled
on a case-by-case basis. If the information comes through and is it clear that
it is a grievance, even if the word grievance is not on the written document, it
will be handled as a grievance.
I directed her to not discuss this investigation with anyone except Chief
Milosevich or one of the investigators. She said she understood.

It seems like uh Trustees have a little more riding on the line so they usually
ask the supervisor.
WILCOX: Have you heard any member of the Jail staff ask or solicit any person to write a
letter about the performance of any member of the Jail?
Yes.
WILCOX: Have you ever asked an inmate to write a letter about the performance of any
other Jail staff person?
No.
WILCOX: On March 27,2009, or about, did you have contact with any inmate inside the
Renton Jail that you were concerned about the change in their behavior?

WILCOX: Why did you contact this inmate and have a conversation with him?
as he was leaving, mentioned that Mr. was acting kind
of odd. He and I have known each other for a few years. He's been coming
here for a few years so, I went to go talk to him about his behavior and find out
what was going on. He was getting close to release date and I was thinking he
was maybe getting stressed out.
WILCOX: Did the inmate tell you anything that alarmed you?
. Yeah, he told me to watch my back.
WILCOX: Why did he tell you to watch your back?
After our conversation went on for a little bit, he said, watch your back cause
he has, I believe because he has concern for me. Uh, he trusts me, I don't

believe he trusts everyone and uh he said basically, watch your back and I had
him define that as you know, is it inmates, and he said no, it's the staff.
WILCOX: Did you believe this inmate?
Yes.
WILCOX: Why do you believe this inmate?
He mentioned things that appeared on my evaluation which was given to me
the same week that he mentioned this. He, and just because of past suspicions
that I've had.
WILCOX: What specifically did he ask you about watching your back. You said it was
not to worry about other inmates attacking you, it's from Jail personnel, is that
correct?
Yes, he said, specifically, because I asked him, he said not from, not from
inmates or himself, he said from the staff members.
WILCOX: What did he say the staff members, why did he tell you to watch your back
with the staff members? Did he explain that?
Yeah, he said they don't wa,nt to work with me. They don't, they want my job.
WILCOX: Did he give you names of employees that do not want to work with you or who
want your job?
He didn't give names, but he described them. He, he and then when I gave a
name he would confirm it.
WILCOX: What names did you give him?
Uh, He described as the one who's not
working here, but working at the Training Facility. He described as
the one with the stripes similar to mine, and he described the tall bald guy from
dayshift.
WILCOX: Officer has he been gone from our facility at training for a few months?
Yes, I believe since January.
WILCOX: How long has been at our facility?

my inabilities or lack of abilities.
WILCOX: When did they approach to write the letter that you're aware of?
If if left in January, I'd imagine sometime between before January,
was at least the first approach.
WILCOX: Now, was this the first time that you heard from inmate or from any
person that a letter was asked to be written through your commander about
your inabilities, or lack of abilities, or any actions against you?
No, it was the first I've heard of that, yes.
WILCOX: Do you feel that when the inmate told you that he was told to write a letter to
the Jail Commander about your abilities, or lack of, how did you feel.
I was shocked. I was set back.
WILCOX: You mentioned a minute ago about the evaluation, what was that comment
about the evaluation?
He uh, he addressed two things that were on my evaluation that I received just
a few days prior to talking with and that was that no one wants to
work with me, which was a comment on my evaluation, and uh I can't made a
decision?
WILCOX: Did you share the contents of your evaluation with inmate prior?
No.

To get a feel for things. Sometimes you know, people, I, I like to, I trust
people's input, and, cause you know you can't always see everything about
yourself. So I trust them for validity type thing.

Probably because he was reading the harassment part of it. He was seeing the
harassment part of it.
WILCOX: Do you feel threatened right now? Inside the working, inside the Jail by other
members of the staff?
I feel that I have to dot my eyes and cross my tees very carefully.
WILCOX: Why is that?
Just because this is deeper than what I, what I thought. You know, this is, you
know I've always had my suspicions and now this is the kind of
confirmed my suspicions of, of people I guess not uh, not wanting me to be
around.
WILCOX: So do you feel that you're being harassed in the workplace?
Yeah.
WILCOX: Could you explain again, why you feel you're being harassed in the workplace?
I'm not quite sure. Just the, going to an inmate and talking to them about my
abilities, or inabilities, or lack of abilities, whatever they call it, is beyond me
to fathom that that would be something I would, that would ever happen and I,
I would never do it, I don't know why they, why anyone would want to do it. I,
I, urn, I just feel like they're, things are coming at me, people are like
sabotaging me.
WILCOX: Do you believe that you are an ineffective supervisor?
An ineffective supervisor?
WILCOX: Yes.
No, I don't think I'm ineffective.
WILCOX: Are you aware of any members ofthe Jail staffwho do not wantto work for
you as their supervisor.
Apparently, yeah, I am. Apparently the whole other side.

The A side.
WILCOX: Who's on the, who's in charge of the A side as a supervisor?

I believe so, yes.

WILCOX: Have you ever been placed on a formal written action plan to improve your
performance?
No.
WILCOX: Other than being told that you have done wrong in the past, what mentoring
has been provided to help you grow as a supervisor?
When I have a question, there has been a little guidance here and there.
WILCOX: Who have you received that guidance from?
Manager Bartley.
WILCOX: And what kind of guidance has she given you to improve your abilities?
I would say, specifically, I can't you know, nothing can come to my mind right
now specifically, but generally, it's, it's uh limited I'd say.
WILCOX: But is it information to help you grow to become a supervisor. Is it good
information that she gives you to help you out?
Yeah.
WILCOX: I stated earlier you did share information in your last evaluation with Officer
and Officer , is that correct?
Yes.

Pretty much the whole thing, you know. I had it in front of me, I was going
through it piece by piece.
WILCOX: And you shared that because you were looking for feedback, support, venting,
or what reason were you giving your evaluation out to subordinates?
Yes, feedback, support, urn I had a feeling that I was going to have to not
contest, but at least write some kind of response to the evaluation so I wanted
to make sure that I was on the right track.
WILCOX: Did you share any of the information on your last evaluation with any inmate
being held in the Jail.
No.
WILCOX: Do you believe that Officer , Officer would share the information
from your evaluation you told them what Sgt. Officer
Officer or any other member of the Jail staff?
No.
WILCOX: Why do you believe that?
When I talked to them about it, I talked to them up in their offices which is, A
- away from the Jail, and I trust in them not, they know it's you know a
personal thing.
WILCOX: Did you share any of the information of your evaluation with any inmate within
the Renton Jail?
No.
WILCOX: How do you believe that :related information off of your evaluation to
you?
I believe it could have been not maybe directly told to him, but diffused to him
from other staff members, like or or
WILCOX: Do you believe there has been input to your evaluation from members of the
Jail to Manager Bartley.

or a, your uh peer sergeant would give information to Manager Bartley to your

With the feedback that I got from coupled with the stuffthat's on my
evaluation, it appears that people that spoke to may have had input on
my evaluation.
WILCOX: Have you ever heard any member of the Jail staff having a conversation with
any inmate regarding Jail operations?
Not that I know of.
WILCOX: Were you aware that inmates watch the Jail staff open the key box and observe
what the key box combination is?
Not until March.
WILCOX: When you became aware of that information that inmates watch officers open
up the key box and knew what the combination was, what course of action did
you take?
Changed the combination that night.
WILCOX: Did inmate ever ask you for his release date?
A long time, you know, Trustees earn extra good time uh. I told him that the
schedule for good time is no longer applicable we'll see what we can do.
We're only allowed to gift so many days and I told him he's probably looking
at a release date around the first of April.
WILCOX: Did you give him his release date when he asked you that day?
I did not write it up on the board.
WILCOX: Why not?

I believe so. He was released on the first and the date was changed to the first.
WILCOX: Do you know which Jail officer gave him his release date?
Uh, from, from him, he told me that gave him the release date.
WILCOX: Do you know when Sgt. gave him his release date?
Sometime around the ~ n d of March.
WILCOX: Was it the correct release date?
It was the date that I've told him in the past that we were aiming for, yeah.
WILCOX: Did relate anything to you during your conversation with Sgt.
about his release date, how he's going to get it, or what he needed to do to get
it?
He said to me that basically said if you want to get your release you
gotta write your letter to get the release date. That's basically said.
WILCOX: What letter are we talking about for the release date, is that a kite?
The letter of my uh inability to make decisions and lack of ability.
WILCOX: So your stating that Sgt. told an inmate that he needed to write a letter
to somebody that you were, you had inabilities and if he wrote that letter he
would get his release date.
That's what relayed to me.
WILCOX: Do you know if wrote that letter?
I don't. I don't believe he did. Otherwise he wouldn't have disclosed to me,
so I, I don't believe he wrote it.
WILCOX: Do you know if anybody else had anything to do with that letter? Any Jail staff

went to CJTC. Was this more recent than that, or is it past?
Urn, he, well, he, he told me about this you lmow around march, gosh, the end
of March 20 something, uh so I don't, I don't really lmow exactly when he was
approached by people. He said, basically he said in short, anybody who
doesn't work with you, I should have concerns about, and various levels.
WILCOX: What were those concerns again.
Uh, to watch my back.
WILCOX: why.
Because he felt that my job was in jeopardy.
WILCOX: The inmate thought my job was in jeopardy.
Yeah.
WILCOX: How did he think that your job was in jeopardy?
With the request for him to write about my lack of ability and people not
wanting to work with me.
WILCOX: Did the inmate, was the inmate concerned by your lmowledge of him, that he
was scared if he did or did not write the letter?
I think he had some concerns about getting a release date about not writing, if
he didn't write the letter, he thought his release date would be pushed back.
WILCOX: Do you think he had fear for his safety? If he did not write the letter?
Yeah, I think he has some concerns about that. It was never a point of
discussion. But, I mean, as we were talking, I could, if, if, you ask me my gut
feeling, yes he had some concerns about his release date. He had some

concerns about his uh if he ever came back to jail I believe. Our jail,
repercussiOns.
WILCOX: Repercussions from Jail staff, inmates?
Yes, Jail staff.
WILCOX: What Jail staff do you think he'd get repercussions from, from not writing a
letter.
The people who asked him, The people he described
as asking him to write the letter.
WILCOX: Are you concerned about your position here at the Renton Police Department?
Yeah.
WILCOX: Why?
Because, I, maybe not so much here, but possibly in the future at the new
facility that's being built. I don't know, I'm going to have a hard time
describing it because I don't, not very good at putting it into words necessarily,
but I just feel that every time I do something, there's a counter to it to make me
look kind of foolish or have lack of ability. After talking to that
reinforced that. And apparently they're, these people, that I've mentioned are
willing to do things, like talk to inmates, why wovldn't I have a concern for my
job?
WILCOX: Is talking to an inmate to solicit a letter about your performance or any person's
performance, is that a violation of our SOPs at the Renton Police Department?
In my eyes, yes, it's part of the, the fraternization with inmates.
WILCOX: Do you believe that your being harassed by other employees in the department,
or supervison in the Police Department?
Yeah. I, I believe there's a group of people.
WILCOX: And why do you feel that this group of employees are harassing you. Why do
you feel uncomfortable in the workplace?
Uh, I try to do the right thing and sometimes my right thing might make me
appear to be a pot stirrer or a rat or whatever you want to call it, but I try to do

the right thing because that's why I was raised to be and that's why I have a job
in law enforcement is to do the right thing.
WILCOX: So do you feel that other members of the Jail staff are conspiring to either get
you demoted, fired, or make you quit with the Renton Police Department here
or before you get to the new SCORE facility?
Yes.
WILCOX: And why is that belief?
Why?
WILCOX: Yes.
Just going to the inmate uh, going to staff members, and you know, talking,
them talking to that, that's the big thing.
WILCOX: Are you aware of any other inmate that's been approached by Jail staffto
request a letter or information about any member of the Jail staff?
No.
WILCOX: Do you think it's your responsibility to ensure a cohesive working relationship
in the workplace?
I think everybody has a responsibility to have a cohesive work place.
WILCOX: Have you ever been asked by any member of the department for input into
another member ofthe Jail staffs evaluation other than the other Jail Sergeant?
No. Can you repeat, I don't-
WILCOX: Have you ever been asked by any member of the department for input on
another members of the Jail staffs evaluation other than from the other Jail
Sergeant to complete an evaluation on an employee?
Yeah, no, never.
WILCOX: Do you believe that the information or the behavior that, that you have
____ against you is inappropriate?
Yes.

WILCOX: Why do you feel it's inappropriate?
If you don't like somebody you work with, and there's no rule that says you
have to like everybody you work with I guess, but you- I feel like I'm under
attack by them if that makes sense. They, they're willing to go to inmates,
they're willing to possibly, talk within themselves to get me to be either
demoted, or fired, or just quit, flat out quit.
WILCOX: Have you ever heard of these words from anybody else besides me?
No.
WILCOX: So, what is going to be your position when you go to SCORE, is it, are you
tasked to go over as a supervisor as you are right now?
From what I've heard, everybody will go over in the same capacity that they
currently are. Promotions could be given, but there was a conversation with
Penny Bartley around the 25

of November that makes me lead to believe that
that my position as a supervisor could be in jeopardy. The conversation came
from an incident with me putting some stuff into evidence, some baggies into
evidence, and she said, she asked me where do I see myself at SCORE. And I
said, doing the same thing I'm doing now and she said, I don't lmow if that's a
good fit for you. You do better with, with being working with inmates and
stuff, which would imply to me that I'm going to go over there and possibly
lose my supervisory position as a sergeant.
WILCOX: But she did not say that verbatim that you're going to be demoted going over to
SCORE.
No, no.
WILCOX: But implication is that you believe is there that you will be demoted.
She implied that that could be a very real thing.
WILCOX: Do you think that she receives information from members of the Jail staff, or
she solicits information from the Jail staff to try to get you to make you look
bad and uh in light of your supervisory experience?
Yes.
WILCOX: Why do you believe that?

Like I said before, I believe she has input from from uh and those
people to, to influence her on her evaluation of me. -she told me that she talked
to, after the baggie incident, she told me she talked to staff members and said,
and she said staff members plural, and said that my my actions were
inappropriate and I don't make decisions and all this other stuff. That was in
that November discussion.
WILCOX: Were your actions inappropriate? Were they violations of policy?
No, I, went by the policy. To put these things away in a safe environment.
WILCOX: Are there any other, is there any other information that you have that would
state that you're being targeted for harassment, that there is no belief in you,
In that, in that conversation in November, Penny Bartley also said something
else that kind of set me back which was, she said that the Chief said, who are
you trying, Who's trying to fuck by doing this? And I can't believe the
Chief would say something like that first of all.
WILCOX: She or the Chief?
The words that she said, were, the Chief said, "Who's trying to fuck?"
Is it , or is it Penny and I wasn't trying to screw anybody over. I thought
those words were kind ofharsh for the Chief to say so I talked to him about it.
WILCOX: And that conversation was?
The conversation was, he, he, he got a funny look on his face as he was trying
to recall a conversation and he even said, I don't know, I'm trying to figure out
where she would get that from in his conversation with her.
WILCOX: Do you think there's personality clashes between you and Sgt.
Sure.
WILCOX: Why.
I'm a little bit more easy going. At the same time I want things to be done
correctly. I know it sounds kind of contradictory, but it's not. My approach is
more easy going, but I want things to be done in the correct manner to make
sure you know everything's dotted and crossed.
WILCOX: Do you hold your subordinates accountable.

Yeah, I work with people. If they need information I can give it to them.
WILCOX: Do you believe there's any other members of the department that would
believe, substantiate, or think that it's true that there's a possibility that you're
being harassed in the work place?
From the feedback that I got that when I shared that information about the
conversation, I, I believe would think that I'm being
harassed.
WILCOX: The main thing, is do you, believe you're being harassed in
the workplace?
Yes.
WILCOX: Who do you believe is harassing you in the workplace?
The people that I've mentioned, I believe those two, I was
surprised to hear that was involved in this. I also, I believe that
and work very closely with Bartley, Pe1my Bartley in this.

A- how long's it been going on, and when do you think it got to the point that

I think it all came to a head back in November with that, that evidence and
baggie incident. I believe that's when it all came to pretty much slap me in the
face and other things you know, looking, looking back and I can't really think
of an incident in particular but you know there's been like possible peaks and
and uh glances but the the big .one came in November when I, when I did what
I felt was the right thing to do.
WILCOX: So you believe that after the November incident that things were more
prominent it is with the other side and Sgt. uh area of
supervision on the A side?
Yes.
WILCOX: Do you believe this has been unbecoming conduct of a supervisor or other
officers?
I would think yes, I mean that's, that's, by the, by the general orders and stuff,
yes, I do.
WILCOX: Do you believe that it's right for a super, for a staff person to ask an inmate for,
solicit any type of information?
No.

I've never lmow for Trustees or inmates to to being asked something like that

we don't necessarily ask them to do, but that's usually all their self-motivated
stuff.

said something about tazing somebody one night. I
don't know if it was documented or not. I don't even lmow what night it was.
He just he said that he heard the tazer go off three or four times.

I don't know the extent of that if he actually saw it or heard it or what, but.
WILCOX: Did he lmow if somebody else was involved in it?
Uh, I imagine other people over there, as far as Jail staff. We usually, it's not
common practice that you on a one on one with an inmate.
WILCOX: Do you believe what told you about that, the watch your back and the
words that he used that were out of your evaluation and that uh people are
conspiring to in one way shape or form either to harm your urn employment
with the City of Renton, or to continue a psychological battle to harming you to
watch yourself, or second guess yourself?
Yeah, I believe I don't know why else, why he would say something
like that. I, I believe him.
WILCOX: Do you share information about officers that you write evaluations on with
other officers in the jail?
No. Well, information from their evaluations?
WILCOX: Yes.

that that is confidential information, do you in tum, take it upon yourself to
relay that infonnation to your co-workers?
No.
WILCOX: Do you have anything else to add to this?
I think everything's pretty well covered. This isn't comfortable to do.
WILCOX: Why do you think it's not comfortable?
I guess it's not comfortable because I, don't want to be a problem.
WILCOX: Do you believe you are a problem?
At this point in light of what was given, the information that was given to me
by an inmate. I don't think I'm the problem anymore.
WILCOX: Why did you think you were a problem prior?
Just feeling like everything I did in the Jail was was wrong.
WILCOX: So you have no confidence in your supervisory ability?
I have confidence in my supervisory ability, yeah, but it just seems like that
whenever I did something, it was always looked, it was always looked through
and through with a magnifying glass.
WILCOX: And who did you get that feeling from? Another supervisor, from your
manager, from other staff members?
Other staff members, and you know.
WILCOX: Did anybody ever bring it to your attention that you could have done this
better, you could have done that better, were you offensive, defensive with it or
was it welcome information.

I try and take it as welcome information you know, I, I run my ideas past
people, too. You know, when it comes to you lmow, let's move these inmates
around, or let's do something, what do you think if we move this guy over here
you know, does anybody see that coming, you lmow. What could come if we
did this? What could come if we did that? I, I opened it for discussion. Um,
there's nothing so pressing in the jail besides you lmow uh use of force or some
kind ofuh CPR first aid type situation that can't be talked about for a couple
seconds before we go and do it.
WILCOX: How do you feel, what do you feel would make your work environment better
at this time?
Staff getting along. It seems like we have A side and B side and we're always
going to have that as long as we maintain the schedule. But uh, just everybody
working towards the same goal and that you lmow booking people, instead of
finding reasons not to book people. If there's something blatant, you lmow, get
it, get it fixed. If the guy has a cut and looks like he's going to need stitches,
yeah, go get it fixed.
WILCOX: That's department procedures and that's what should be done.
( Yeah.
WILCOX: I'm talking about your working relations with other staff members in the jail.
Oh. I don't lmow, I've never really thought about it in particular I guess.
WILCOX: Are you concerned about being in the Jail with other staff members?
For my safety?
WILCOX: Yes.
Safety wise I don't believe I'll get harmed. I believe my career is at jeopardy
more than anything.
WILCOX: And that is because.
Because of this I guess conspiracy or whatever you want to call it to uh get me
out of here. Whether it's taking my stripes away, or make me quit, or get me
fired. I don't, I, a conspiracy I think.

Inmate said he wanted to discuss things that he felt were very wrong
in our Jail.
Okay. Did say that he was attempting any favoritism?
No, actually he said he had nothing to gain, he was being released the next day,
but because he felt very strongly about these issues that were, he felt were
wrong, he wanted to discuss them with Commander Wilcox.
Do you recall stating that he was in fear of losing his good time or to
be jeopardy if anyone found out he was talking to the Jail Commander?
Yes.
What did he state that he wanted to talk about?
Well, again, he just felt there were some things that were wrong going on in the
Jail. Specifically between his position as Trustee which he said he held for
about six months and the fact that the staff was getting way too comfortable
with him around as Trustee saying things that he didn't believe should be
shared with someone in his position. He said there's a hierarchy there that
needs to lmow certain things and that hierarchy needs to be careful that
someone in his position doesn't hear some things and that wasn't being done.
Okay, so he stated that Jail personnel were comfortable talking around him
about other Jail staff?

I believe the Trustee's cell that's located next to the padded cell.

Yes. Well, they'd be two different cells, but they're on each side. It could be
either one.
Okay. Did state that he knew that Sgt. had three uses of force
incidents and could not go on the floor as he'd get into trouble ifhe used force
again?

Well, just overall performance in the Jail between the two sergeants. In his
opinion, he felt like Sgt. and the people that he supervised, the A
team, were all out to get Sgt. or to, they didn't like Sgt.
for some reason. From what he observed over the last six months. He beli.eves
Sgt. handled issues in the Jail better than Sgt. so he felt it
was unfair that all of these people, Sgt. and the people on his team
were like ganging up against Sgt.

crew, were trying to get Sgt. demoted, fired, or quit his job?
He believes so.
stated that he approached Jail staffto inquire what his release date
was. Do you remember who he approached first?
From what he said, he asked Sgt. first.
And did he get the release date from Sgt.
No, apparently Sgt. was going on his days off actually
established a date which was important to because he was hoping to
arrange housing upon his release. He was technically homeless and wanting to
arrange housing so the date was important to him.
Did say that he asked Sgt. for a release date?
Yes, when Sgt. came on duty, he asked him that question as well. If
he could establish a release date.
When Sgt. talked with about his release date, did
state that Sgt. solicited information from him about another Jail staff
member's performance?
Well, uh, uncertainty about his release date first of all was because
if your Trustee there's, instead of normal good time, you're gifted time and
supposedly it'.s up to the Jail Sergeant to determine how much good time, extra
good time you get. Sgt. apparently said to him that if he writes a letter
stating that Sgt. was incompetent and an indecisive Sergeant that he
would establish a release date for him.

So Sgt. requested the inmate to write a letter about another member of
the Jail staffs performance and that would have been Sgt.

So, in words do you believe that the target of the letter was

How was instructed to get the information to the Jail Commander?
He was to write the letter and uh submit it to Sgt.
Was to give the letter to a Jail staff member prior to sending to the
Jail Commander or to just Sgt.
He indicated after he was told to write the letter, another Jail staff member
came into the kitchen and told him not to seal the letter before he submitted it
as they would like to read it.
Did he state who that Jail staff member was who told him not to seal it so he
could read it prior?
He said it was Officer
And what was told to be put in that letter to the Jail Commander?
He said that he was told to write a letter saying that Sgt. was
incompetent and an indecisive sergeant.

The only location was just with Officer and Officer
approached in the kitchen area and told him not to seal the letter

Yes.

requested to write a letter by Sgt.
From what said, it sounded that the other staff member was aware that
the letter was requested. did not mention it to anyone.
WILCOX: Did appear to be credible to you in his conversations regarding what
he knew about the Jail operations?
I believe he was sincere. Again, he indicated he had nothing to lose. He was
going to be released the next day. He described his history in prison as well as
in our Jail. He's often used as Trustee. He's considered to do a good job and
to be honest his uh, uh, his coming forward the day before his being released is
typical of many inmates that are in our Jail. Working home detention, many
times when somebody' s being released, they wait until after they are released
to say something negative about somebody else in the Jail, for again, because
they are afraid of some sort of some retaliation if they speak up earlier.
WILCOX: When this happens is it usually against a Jail staff member or is it against an
inmate?
Generally, the report we get at home detention or, are maybe reports against
like a Trustee, inappropriate action by a Trustee by example.
WILCOX: When stated that he knew about daily operations of the Jail, were
there any other security issues that you heard besides he observed the
combination of the key box?
He just said that a lot of information is being shared with him around, standing
there listening to the conversation. He said he would never do it, but with his
experience in different jails and prison, had he wanted to escape, he very easily
could have done it just knowing the eve1yday operation and hearing what the
Jail staff is saying in his presence.

Not that I recall. He talked over all about things in there saying about his
performance as a sergeant, but nothing that I could tell you specifically.
Did you talk to anybody in the Jail staff or an inmate or any other person about
Sgt. evaluation?
No.
Do you believe that Sgt. is an ineffective supervisor?
I think there's room for improvement. I don't think anybody here- I have very
high standards and my idea of supervision is different than, than what I've seen
here because I come from a private sector and was taught how to be a
supervisor. I think Sgt. is very sincere. I think he works hard. I
think he needs some attention though to make sure that he meets deadlines and,
and he could be more effective.
Do you think Sgt. is being harassed in the work environment based
upon your personal observations?
I believe there is harassment and retaliation evident in our jail.

Well, in the past my personal experience, I've seen what I felt was harassment

I think that's pretty much Officer nature. And I think with them being
good friends, I think it's easy to work together and you lmow, kind of plot
against people, but I think Officer , that's kind of his nature. If something
doesn't go his way, that uh, he tends to retaliate.
And how would he basically retaliate in you mind.
Well in my personal experience, I felt as a member of the Executive Board,
when the Transport position became available in the jail, it was a new
opportunity for the Jail staff, yet the position was never posted for the Jail staff
to interview for and as a result of that I went through the Guild and uh, made
that opening available to everybody on the staff to compete for. This
apparently upset Officer and he started to retaliate uh and made an issue
where after working 14 years at Home Detention, he claimed that myself and
Officer never interviewed for the position, uh, started a petition in the
Jail that was not approved by the Police Officer's Guild trying to get us to
rotate out of that position and uh in fact got enough steam behind it to have it
go up to the Labor Management and have the Chief decide what action should
be taken and I felt that was either harassment or retaliation for me uh
disagreeing with them. Apparently somebody out there, Officer or
somebody decided who's going to be the Transport Officers and they didn't
intend to make it available to the whole staff. When that didn't go according to
their plan, I was the problem.

I think , was a large part of it.
And what portion do you think that Sgt. has on it since he is the

Well, I think it's his responsibility to make sure that these things don't happen.
Do you believe there's any harassment on the B side with Sgt.
No.
If Sgt. did his job as a supervisor, and he filed a policy, a harassment
policy within the department of 300-03 would this have been taken care of.
Would this issue, potential perceived harassment been addressed as it should
have been prior?
I don't know. I would hope so.

Well, doing security checks, they usually ask you questions.
Okay. Did Trustee ever ask you for his release date during
the month of March 2009.
He did if it was the month of March, yes, he did.
Where did that conversation take place?
I went to the kitchen to get something, cause I don't go in there for
conversations, I go in there to go get something eat, tea, or something to eat
and he has an attitude, he's ticked off. He's got one of those erase boards and
he's got everything explained out how when he asked Sgt. when
his release date was about the gifted time. And he had the dates marked
down there. There's like three or four dates and he said, that everytime he'd
ask Sgt. he gives him a different date. I said well I need to ask
Sgt. then. If you want an answer, ask Sgt. And then he
starts, and then he asks Sgt. I notified, well, I notified Sgt.
about it, I said well, when Sgt. comes, go ahead and ask him because
he, he never did get his gifted time. So he asks Sgt. Sgt.
gave him a date.
What do you mean by gifted time? Is that different from a good time
release ... (interrupted)
It's not Trustee time anymore. You can't give Trustee time. You can gift
time to like Trustees for the extra time for their work performance and stuff.
And that is in accordance with our current Jail policies, correct?
Yes. So, Sgt. gave him the time that he was going to be getting
released. And I uh, I said if you got a grievance or whatever with the other
sergeant, go ahead and write it and we'll go ahead and make sure Sgt said,
well Sgt. says write on a letter. And I told him, I said, go ahead and
write you a letter or whatever and we'll make sure it gets up to Commander
Wilcox. That uh, you asked him like three or four times and you were given
a different date, or if any date when you asked him, approached him and he
even said that Sgt. even quit going to the kitchen to confront him

totally different. I mean it's like was angry about

he couldn't get out, he couldn't get an answer. Just like uh when Sgt.
when he first got promoted, I was on his graveyard side. And I
was working that day and uh, so the guy comes in and they arrested him at the
drivethrough at McDonalds and that's where it started off at. And so the guy,
the officer that brought him in asked Sgt. can he go ahead and eat
his McDonalds cause he still had his McDonalds with him and he didn't get a
chance to eat it. Sgt. says uh huh, ask Jailer there. I said,
why ask me, you're the one in the stripes, I said just make a decision. He
says well I did make a decision, you decide what to do. I'm like, okay, I
threw his food away. Now that's where, that's where it kicked off where it
was in my evaluation also. And, I mean, we was only joking around now I
can even testify that I was joking around at that time and just took it
real personal. So- that's where it kicked off in my evaluation.
Has there been other issues and times throughout the years -
Not that I know of, not that I remember.
Because bringing food into the Jail. That's not allowed is it?
Disposable food that can go bad, we through it away, but uh, it's just making
a decision. Make the first decision make the first
decision. And from that day on he's from what I know, never did make a
decision. Meanwhile ever smce, so.

Sgt. can make a decision, and he will make one and uh, I mean it's
just the types ofleaderships I guess so. It's the way that people looks at- it's
just like a kid growing up, their parents are lazy most of the time the kids
going to be lazy. Uh some bout some people likes to work with
because not on their ass all the time, or doesn't make sure that
you're doing the right stuff, checks are being done and Sgt. is
straight forward and he'll make sure the stuff gets done so his ass don't get
chewed out and he'll make a decision. That's the difference between the
crews. So, differences because ofthe leadership on each
side. So they're used to on the other side and we used to it on this side.
So you think a lot of dissension is accountability maybe for a word is that Sgt.
is holds more accountable in a black and white aspect where Sgt.
holds accountable but not so much in the black, white, a lot of
gray area in it?
A lot of gray area.
But he is effective as a supervisor. He does get the job done as a supervisor-
