My apologies for the Mass Mailing and for the Urgent Tag. However, I wanted to make sure that you were all aware of the recent letter from District Court Judge Ben Clyburn stating that the District Court would no longer enforce Late Fees and Tagging Fees for Speed Camera and Red Light Camera Programs. Since we have all implemented different fee structures for our programs it is Judge Clyburn's conclusion that we do not meet the Uniformity Clause in the state constitution and that mention of these fees needs to be removed from tickets immediately. I'm not sure how you feel but I feel strongly that not being able to collect late and tagging fees will be a significant detriment to enforcement.
To that end Senator Ramirez has introduced legislation (SB 1101) that will address this issue. Special Thanks to the Senator for trying to drive this issue. Given that session is almost over in Annapolis -- this bill would need to pass in less than a week. We need you to contact your delegations to indcate the importance of this bill.

Greetings Mayor Martin and Council, I want to the opportunty to update you on the progress of the Fairmount Heights speed monitoring program. I have attached 2 summaries which will illustrate where we are with regard to citatons issued, late fees accrued, and the expected revenue to be collected form violators. Please keep in mind that we share an agreed upon 60/40 revenue splt wth Brekbrd, with 607o of the total revenue collec{ed coming to the town of Fairmount Heights. Also please keep in mind that the numbers shown are only from August through today whch is just a little over 2 months. We still have a second camera that wll soon be installed tested and operating on Sherifi Rd. Though we now have some revenue generated fom actual fines collected; I can say with confidence that our progEm is working more effectively than projecied- As citations and late fees are paid, revenue deposits will be made on a one time monthly basis on or abod the 15th of each month. lt is very mportant to remember that the revenue generated ftom this program by "Law" most be used towards the public safety of the town. lf you have additional questions or mments about the speed monitoring program, please ftee to contact me.
Additionally, after many months of working to sve our Livescan Fnger Printing program, and more mportantly, gefting the program launched; I'm proud to say that we are only one step away. That step will be fulfilled on November 13th when technicians from the state of Maryland will come to the town to nspect and ensure all the proper secur protocols to protect information elecfonically are in place. We wll be gven final approval to launch by the State of Maryland upon satisfactory completon of that very important inspection. Lastly, our "Cops& Kids Readng" program wll officially launch on Wednesday, November 14th, when Sgt Monis, myself and any interested members of the Councl wll read to groups of Head Start thru Kndergarten studenb at Robert Gray Elementry Scool. Please review the schedule below and let me know no later than Friday, November gth f you would to participate in this activity and what time slot(s) you would like. Guidelines Regarding Acceptance or Rejection of Violations

The "report reference line" is used by the camera system as a point of reference showing an approximate area (on the 1" photograph only), where the target vehicle ends or has advanced beyond. As an added secondary form of reference for the evaluator of the photograph(s), he or she may refer to this line in determining if the target vehicle's rear tires have advanced. (or are directlv on), this line. The report reference line should primarily be used as the threshold whereby the target vehicle has passed or is bevond. Any target vehicle captured in a photograph with a report reference line will have: Entered the RADAR beam for detection and speed measurement; and Remained within the beam long enough for a speed measurement to be made and an image taken showing a target vehicle exceeding the set threshold (e.g. the radar communicates to the camera to capture the image when a violation is detected).

The key point to convey is that the criteria for confirming a violation is that the vehicle has moved bevond the "report reference line". Even in cases where there are multiple vehicles within the camera field of view, it is possible to accurately determine the violating vehicle (such as in the image attached). On occasions where more than one vehicle's position and proximity to the report reference line
