T rial by jury and represent at ive g overnment are usually seen as t w in


pillar s of demo cracy in t he Unit ed St at es. T he right of jury nullificat ion is the key t o ensuring t hat t he comm on people may play a role in
t he judicial process to prevent injust ice. In t he ear ly y ears of the Republic and t he Ant ebellum er a, jury nullificat ion w as accepted in most
cases even t ho ug h it beg an t o be chal lenged mor e and mor e by judges
as a r esul t of t he m odernizatio n of t he Am erican societ y. T he U. S.
Supreme Cour t f inally denied t his right in 1895. Jury nullif icat io n,
how ever, is still exercised de f act o by juries in bo th federal and stat e
cour ts. Apparent ly, t his tr aditio n has sur vived the challenges f rom
t he pr ocess o f modernizat ion and w ill co nt inue t o endur e. T hus w e
see in recent years t he repeat ed appeal f or reaff irming t he right of jury
nul lif icat ion in t he U nit ed Stat es. H ow t o keep t he judicial sy st em as
a democratic inst it ut ion is still an issue for Am ericans t o t hink
t hrough in t he 21st cent ury .
