STATION AT ABOUT 10:55 AM OF MAY 5, 2013. HER STATEMENT WAS TAKEN IN TAGALOG DIALECT AND WAS TRANSLATED AND RECORDED IN ITS ENGLISH EQUIVALENT BY THE SAME INVESTIGATOR WITH THE CONFORMITY OF THE DECLARANT IN THE PRESENCE OF PSI BYRON F ALATOG. A2: I am MAGIE T MAGASTINO, 28 years old, married, 3rd year high school by highest education, born on December 4, 1985, native of San Juan Tabuk, Kalinga, presently residing at km 6,La Trinidad,Benguet. Q3: What prompted your presence in this office? A3: To give my statement regarding a case of theft that transpired this morning in my stall. Q4: When and where was the incident committed? A4: At around 9:30 AM of May 6, 2013 inside my stall located at the dry goods section of La Trinidad Market, Km 5, La Trinidad, Benguet. Q5: Kindly narrate what happened? A5: I was inside my stall as usual waiting for customers to buy my imported clothing apparels from Malaysia when three (3) girls speaking in their own dialect which I cannot understand come looking at my display. Q6: How long did the girls stay inside your stall? A6: They stayed for almost 20 minutes sir. Q7: What else? A7: They left my stall without buying anything sir. Q8: Then what did you do afterwards? A8: I decided to fix the clothing that was disarranged and as I was fixing I noticed that the blouse which was hanging on display disappeared. Q9: Then what did you do next? A9: I shouted for help and it was then that the patrol officer policeman in that area came to respond to my call where I immediately pointed to him the direction where the three girls had taken. Q10: Was the patrolling officer able to apprehend the girls? A10: No sir, he came back to me after a few minutes and identified himself and told me that he was not able to see the girls. Q11: Can you tell me base on your observation and assessment the age bracket of the girls? A11: From 20 to 25 Sir. Q12: Can you recognize this girls if ever they will come to the market again? AFFIDAVIT OF COMPLAINT I, Magie T Magastino, of legal age, married, businesswoman ,and a resident of Km 3, Pico La Trinidad, Benguet after having duly sworn to in accordance with law hereby depose and state: 1. That I am one of the lessees in one of the stalls located at the Market Section of km 5, La Trinidad, Benguet; 2. That my stall number is 209; 3. That at about 9:00 AM of May 3, 2013, I noticed that the imported blouse with brand name Guess Marcial which was hanging on display disappeared after three (3) girls came to look at the goods on display but did not buy anything; 4. That upon discovery I shouted for help and it was then that the duty policeman on Patrol attended to my shout for help; 5. That I immediately pointed to him the direction where the three (3) girls had taken; 6. That the patrol officer immediately gave chase; 7. That a few minutes later the patrol officer came back to me and identified himself as PO2 Frenzyl G Mendosa and told me that he was not able to see the girls; 8. That he advised me to come to their office and file a complaint; 9. That I am executing this affidavit to support my complaint for theft against the unidentified girls; 10. That I am executing this affidavit to attest to the truthfulness of the foregoing facts.
