PICROMA SOFTWARE END USER LICENSE AGREEMENT (EULA) The software is licensed, not sold.

The terms and conditions for use of Picroma e.K. software by the end user are available below. By copying, installing or usi ng all or any portion the software on your computer you agree to these terms and conditions. Please read the following text carefully in its entirety. If you do not approve these terms and conditions, you must not install this software. Picroma e.K. holds all intellectual property rights in the software and allows y ou only to copy, download, install and use the software in accordance with the t erms and conditions of this agreement. You are only eligible to support, updates and upgrades if you obtained a valid l icense from Picroma e.K. Internet access is required for downloading the software as well as for the inst allation process and updates. 1 DEFINITIONS 1.1 "Picroma" means Picroma e.K. (Registergericht: Amtsgericht Saarbrcken, Registernu mmer: HRA 10951, USt-IdNr: DE262633465). 1.2 "Software" means (i) software files and other computer information of Picroma an d third parties, (ii) all copies and modified versions which are provided by Pic roma by updates or upgrades provided that these are not regulated by another agr eement. The Software and all authorized copies of this Software which you make a re the intellectual property of Picroma. The Software is legally protected in pa rticular by the copyright law of the Federal Republic of Germany as well as by i nternational treaties. 2 GRANT OF LICENSE 2.1 Picroma grants you a non-exclusive, non-transferable, non-sublicensable license for the use of the Software according to the terms and conditions of this agreem ent. You may not sell, lease, lend, rent or license the Software, and you may no t use it commercially by other means, unless described in Section 3.1. 2.2 You are allowed to make a backup copy of the Software which will not be used for purposes other than storage purposes. 2.3 You shall have no further right or interest to use the Software other than the l imited rights as specified in this agreement. Picroma reserves all rights not ex pressly granted. 3 USER GENERATED CONTENT 3.1 Picroma explictly grants you the permission to record and publish videos with ga meplay footage and to monetize these videos. Picroma is not responsible for any user-generated content, such as videos.

3.2 Picroma is not responsible for user-generated content within the Software, such as user names, chat messages, and user-designed in-game items. 4 SUPPORT, UPDATES AND UPGRADES AFTER LICENSE ACQUISITION 4.1 You can only receive support, updates and upgrades following the acquisition of a valid license with a registered Picroma user account. Support is provided only for the current version and for the previous version during one year after publ ication of the new version. Picroma can modify and partly or completely adjust t he extent of the support, upgrades and updates at any time. If you are using a D emo Version you are not eligible to support, updates or upgrades. 4.2 The Picroma user account registration is possible at no charge on the Picroma we bsite (http://picroma.com). A Picroma user account is necessary to purchase a fu ll software license or to obtain a free demo license. In such a process you are asked to agree to the storage and use of your personal data (name, address, cont act, email-address) for the purposes specified above. Picroma will not forward a ny personal data to third parties. 4.3 For the installation, updates or upgrades of the Software the computer on which the Software is installed must be connected to the Picroma server through the In ternet. 5 INTERNET CONNECTIVITY 5.1 The Software may cause your computer automatically to connect to the Interne t without notice, to communicate with the Picroma server in order to check for u pdates. No personal information is sent except your IP Address which is logged a s during any other website access. 5.2 Whenever the Software connects to the Internet and communicates with the Pic roma server, the Picroma Privacy Policy (http://picroma.com/privacy) shall apply .

6 ADDITIONAL LICENSE LIMITATIONS 6.1 A modification of the Software is permitted only in accordance with its intended function. You may not decompile, disassemble, carry out reverse engineering or try in any other way to determine the source code of the Software, unless this i s permitted by law. Furthermore, you must not modify the binary code of the Soft ware or create derivative works based on the Software. You may not modify any fi les that are part of the Software, unless expressly authorized by Picroma. 6.2 You may not use cheats, hacks, bots, or any other unauthorized software to modif y the funcionality of the Software. 6.3 You may not reproduce or copy the Software (except as permitted in Section 2.2).

7 NO UNBUNDLING 7.1 The Software contains multiple files which in its configuration ensure the compl ete functionality of the Software. The Software may be used as one product only. You must not arrange components of the Software in a new way and develop a modi fied version of the Software or a new product as a result. The configuration of the Software may not be modified for the purpose of distribution, assignment or resale.

8 LIMITATION OF LIABILITY 8.1 Picroma shall not be liable in any way for any damage or any loss resulting from using the Software, including, but not limited to, loss of data, computer failu re or malfunction, or any other damages or losses. Picroma shall not be liable for interruptions of service, including, but not lim ited to, service disruptions, software or harware failures. Picroma will interru pt the service on a regular basis for purposes of mainenance or updates and may do so without prior notice. 8.2 The total liability of Picroma in the context of this Agreement shall be limited to the amount which was paid for the Software, if any.
