(vi) For the purpose of classifying an account as
'inoperative' both the type of transactions i.e. debit
as well as credit transactions induced at the
instance of customers as well as third party
should be considered. However, the service
charges levied by the bank or interest credited by
the bank should not be considered.

Dear Sir,
Unclaimed Deposits I Inoperative Accounts in Banks
Please refer to our Circular DBOD.No.Com.BC.1 09/C.408/A-77 dated October 1, 1977
wherein banks were advised that deposit accounts which have not been operated upon over
a period, say two years should be segregated and maintained in separate ledger/s. Further,
banks were also advised vide our circular no. DBOD.No.Leg.BC.45/C.466(1V)/89 dated
November 15, 1989 that they should ensure that their branches follow-up accounts which
remained inoperative for a year or so by sending suitable advices to the customers and if the
said letters are returned undelivered, they may immediately be put on enquiry to find out the
whereabouts of customers or their legal heirs in case they are deceased.
2. In view of the increase in the amount of the unclaimed deposits with banks year after
year and the inherent risk associated with such deposits, it is felt that banks should play a
more pro-active role in finding the whereabouts of the account holders whose accounts have
remained inoperative. Further several complaints have been received in respect of
difficulties faced by the customers on account of their accounts having been classified as
inoperative. Moreover, there is a feeling that banks are undeservedly enjoying the unclaimed
deposits, while paying no interest on it. Keeping these factors in view, we have reviewed the
above instructions issued by us and advise banks to follow the instructions detailed below
while dealing with inoperative accounts:
(i) Banks should make an annual review of accounts in which there are no operations
(i.e. no credit or debit other than crediting of periodic interest or debiting of service
charges) for more than one year. The banks may approach the customers and inform
them in writing that there has been no operation in their accounts and ascertain the
reasons for the same. In case the non operation in the account is due to shifting of the
customers from the locality, they may be asked to provide the details of the new bank
accounts to which the balance in the existing account could be transferred.
(ii) If the letters are returned undelivered, they may immediately be put on enquiry to
find out the whereabouts of customers or their legal heirs in case they are deceased.
(iii) In case the whereabouts of the customers are not traceable, banks should
consider contacting the persons who had introduced the account holder. They could
also consider contacting the employer / or any other person whose details are available
with them. They could also consider contacting the account holder telephonically in
case his telephone number / Cell number has been furnished to the bank. In case of
Non Resident accounts, the bank may also contact the account holders through email
and obtain their confirmation of the details of the account.
(iv) A savings as well as current account should be treated as inoperative / dormant if
there are no transactions in the account for over a period of two years.
(v) In case any reply is given by the account holder giving the reasons for not
operating the account, banks should continue classifying the same as an operative
account for one more year within which period the account holder may be requested to
operate the account. However, in case the account holder still does not operate the
same during the extended period, banks should classify the same as inoperative
account after the expiry of the extended period.
(vi) For the purpose of classifying an account as 'inoperative' both the type of
transactions l.e, debit as well as credit transactions induced at the instance of
customers as well as third party should be considered. However, the service charges
levied by the bank or interest credited by the bank should not be considered.
(vii) Further, the segregation of the inoperative accounts is from the point of view of
reducing risk of frauds etc. However, the customer should not be inconvenienced in any
way, just because his account has been rendered inoperative. The classification is there
only to bring to the attention of dealing staff, the increased risk in the account. The
transaction may be monitored at a higher level both from the point of view of preventing
fraud and making a Suspicious Transactions Report. However, the entire process
should remain un-noticeable by the customer.
(viii) Operation in such accounts may be allowed after due diligence as per risk
category of the customer. Due diligence would mean ensuring genuineness of the
transaction, verification of the signature and identity etc. However, it has to be ensured
that the customer is not inconvenienced as a result of extra care taken by the bank.
(ix) There should not be any charge for activation of inoperative account.
(x) Banks are also advised to ensure that the amounts lying in inoperative accounts
ledger are properly audited by the internal auditors / statutory auditors of the bank.
(Xi) Interest on savings bank accounts should be credited on regular basis whether
the account is operative or not. If a Fixed Deposit Receipt matures and proceeds are
unpaid, the amount left unclaimed with the bank will attract savings bank rate of
interest.
3. Banks may also consider launching a special drive for finding the whereabouts of the
customers / legal heirs in respect of existing accounts which have already been transferred
to the separate ledger of 'inoperative accounts'.

Please refer to our Circular DBOD.No.Leq.BC.34/09.07.005/2008-09 dated August
22, 2008, wherein detailed instructions have been given to banks on dealing with
unclaimed deposits / inoperative accounts. They have been advised to find the
whereabouts of the customers and their legal heirs. These instructions, inter alia,
include i) annual review of accounts in which there are no operations, ii) operations in
such accounts to be allowed after due diligence and iii) no charge to be levied for
activation of inoperative account, etc.
2. Keeping in view public interest, it has been decided that banks should, in addition
to the instructions contained in the above mentioned circular, playa more pro-active
role in finding the whereabouts of the accountholders of unclaimed deposits/
inoperative accounts. Banks are, therefore, advised that they should display the list
of unclaimed deposits/inoperative accounts which are inactive / inoperative for ten
years or more on their respective websites. The list so displayed on the websites
must contain only the names of the account holder(s) and his/her address in respect
of unclaimed deposits/inoperative accounts. In case such accounts are not in the
name of individuals, the names of individuals authorized to operate the accounts
should also be indicated. However, the account number, its type and the name of the
branch shall not be disclosed on the bank's website. The list so published by the
banks should also provide a "Find" option to enable the public to search the list of
accounts by name of the account holder.

3. Banks should also give on the same website, the information on the process of
claiming the unclaimed deposit/activating the inoperative account and the necessary
forms and documents for claiming the same. Banks are required to have adequate
operational safeguards to ensure that the claimants are genuine.
4. Banks should complete action as above by June 30, 2012 and keep their websites
updated at regular intervals.

Strengthening the Regulatory Framework for Unclaimed Deposits
Please refer to paragraphs 102 and 103 of the Monetary Policy Statement for the year
2012-13, announced on April 17, 2012 proposing certain measures for strengthening the
Regulatory Framework for Unclaimed Deposits.
2. In terms of our Circular DBOD.No.Leg.BC.34/09.07.005/2008-09 dated August 22,
2008 detailed instructions have been given to banks on dealing with unclaimed
deposits/inoperative accounts. They have been advised to find the whereabouts of the
customers and their legal heirs. These instructions, inter alia, include i) annual review of
accounts in which there are no operations, ii) operations in such accounts to be allowed
after due diligence, and iii) no charge to be levied for activation of inoperative accounts,
etc.
3. Despite the above instructions, banks have not been pro-active in tracing customers
linked with unclaimed deposits/inoperative accounts. Also, the need to identify the
owners of these unclaimed deposits/inoperative accounts is closely linked to KYC due
diligence. Therefore, in terms of our circular DBOD.No.Leg.BC.81 /09.07.005/2011-12
dated February 7, 2012 banks were advised that they should display the list of
unclaimed deposits/inoperative accounts which are inactive/ inoperative for ten years or
more on their respective websites by June 30, 2012. The list so displayed on the

websites must contain only the names of the account holder(s) and his/her address in
respect of unclaimed deposits/inoperative accounts, etc.
4. On a review, with a view to further strengthen the regulatory framework for inoperative
accounts and unclaimed deposits, banks are advised to put in place a Board approved
policy on classification of unclaimed deposits; grievance redressal mechanism for quick
resolution of complaints; record keeping; and periodic review of such accounts.

1. Period after which bank-accounts become inoperative for non-operation
2. Total number of such inoperative bank-accounts and total amount III such
inoperative accounts for each of the Bank as per data last available/compiled
3. Is there any system whereby money parked in such inoperative bank-accounts
transferred to some government-fund or to RBI after some specified period like a
system exists for compulsory transfer of unclaimed dividends of companies to a

have failed to provide IS-digit account numbers to each of their account-holder?

taken to inform account-holders of change of account-numbers and to issue new
cheque-books with 15-digit new account numbers printed on cheque books

24. Is it true that it has been decided that every family will compulsorily having at
least one bank-account?
25. If yes, please provide complete and detailed information together with related
correspondence/file-notings/documents -etc on reaching to the decision
mentioning also any probable date to achieve the desired goal mentioning also
how the purpose can be achieved when a family and not an individual may
required to be having at least one bank-account when normal banking-transactions
require fund-transfer by/to an individual and not to a family as a whole
26. Estimated number of individuals having at least one bank-account mentioning
also number of people entitled to have a bank-account revealing minimum age to
open a bank-account by self to be operated
27. Is there any move that every person entitled to operate bank-account may
compulsorily have a bank-account?

There is a system whereby companies have to compulsorily transfer unclaimed dividends I
to a special government-fund so that private bodies may not take advantage of public

Same system of compulsory transfer of money in, bank-accounts like 'inoperative',
'suspense' or in any other name or form should be there whereby such money may be

compulsorily transferred to specially maintained accounts for customers of different banks
at Reserve bank of India (RBI) after some specified period in a manner that claimantls may

not face difficulty in claiming such money later. Banks must compulsorily inform account
i
holders well in advance before transferring such money to RBI.

In present era of multinational banks dominating Indian banking, such a step is much
needed to avoid banks taking undue advantage of unclaimed deposits and money parked in

Make IS-digit account-numbers compulsory on cheque books

Reserve Bank of India (RBI) has made it mandatory for all banks to provide I5-digit

account-numbers to all account-holders of different types. System has become still more
t
important because fast switching over to electronic transfers through services like RTGS
and NEFT etc. But many banks have failed to provide new I5-digit account-numbers in
their system especially in respect of savings accounts, what to talk about for printing at
cheque-books resulting in wrong credit-debit and bouncing ofRTGS and NEFT.
Public-sector Corporation Bank is amongst such banks despite the system having been

introduced long back. RBI should direct all banks to compulsory switch on to I5-digit
, .
account-numbers immediately at the most in a month's time. Old cheque-books (including
for savings accounts) should be replaced free-of-cost with new cheque-books with printed
,
I5-digit code.

Banks usually in their system generate personal ID apart from account-number for each
, i
individual operating a single or joint account. This personal individual ID should also be
t
printed on pass-books to make operations simple for banks. Presently bank-staffers have to
i
unnecessarily spend extra time to first trace ID for aspects like issuing TDS
t
certificates.
Banks require separate forms for availing services like Net-banking or Mobile-Alert etc.

Option to avail such service should be available in account-opening form itself. FOTInS to
avail such services should be sent by Speed Post to all old account-holders also for their

knowledge about such services having been made available.
