J.T Rule .Competence. P lawyer shall provide competent
representation to a client. Competent representation requires the legal
knowledge, skill, thoroughness and preparation reasonably necessary for
the representation.
J.Z Rule .Scope of Representation and Allocation of Authority
Between Client and lawyer.
Subject to paragraphs (c) <a) and (d), a lawyer shall abide by a client's
decision concerning the objectives of representation and, as required by
Rule 1.4, shall consult with the client as to the means by which they are to
be pursued. A lawyer may lake such aclion on behalf of the client as is
impliedly authorized to carry out the representation. A lawyer shall abide by
a client's decision whether to settle a matter. In a criminal case, the lawyer
shall abide by the client's decision, after consultation with the lawyer, as to
a plea to be entered, whether to waive jury trial and whether the client will
testify.
P lawyer's representation of a client, including (b) representation by
appointment, does not constitute an endorsement of the client's political,
economic, social or moral views or activities.
A lawyer may limit the scope of the representation (c) if the limitation is
reasonable under the circumstances and the client gives informed consent.
A lawyer shall not counsel a client to engage, or (d) assist a client, in
conduct that the lawyer knows is criminal or fraudulent, but a lawyer may
discuss the legal consequences of any proposed course of conduct with a
client and may counsel or assist a client to make a good faith effort to
determine the validity, scope, meaning or application of the law.
,3 Rule .Meritorious Claims and Contentions, P lawyer shall not
bring or defend a proceeding, or assert or controvert an issue therein,
unless there is a basis in law and fact for doing so thai is not frivolous,
which includes a good faith argument for an extension, modification or
reversal of existing law. A lawyer for the defendant in a criminal
proceeding, or the respondent in a proceeding that could result in
incarceration, may nevertheless so defend the proceeding as to require
that every element of the case be established.
I . Rule .Candor Toward the Tribunal.
A lawyer shall not knowingly: (a) Make a false statement of fact or law to a
(1) tribunal or fail to correct a false statement of material fact or law
previously made to the tribunal by the lawyer;
Fail to disclose to the tribunal legal (2) authority in the controlling
jurisdiction known to the lawyer to D directly adverse to the position of the
client and not disclosed by opposing counsel; or
Offer evidence that the lawyer knows to be (3) false. If a lawyer, the
lawyer's client, or a witness called by the lawyer, has ofered material
evidence and the lawyer comes to know of its falsity, the lawyer shall take
reasonable remedial measures, including, if necssary, disclosure to the
tribunal. A lawyer may refuse to ofer evidence, other than the testimony of
a defendant in a criminal matter, that the lawyer reasonably believes is
false.
A lawyer who represents a client in an adjudicative (b) proceeding and
who knows that a person intends to engage, is engaging or has engaged in
criminal or fraudulent conduc related to the proceeding shall take
reasonable remedial measures, including, F necessary, disclosure to the
tribunal.
The duties stated in paragraphs (a) and (b) continue (c) to the cnclusion
of the proceeding, and apply even if compliance requires disclosure of
information otherwise protected by Rule 1.6.
In an ex parte proceeding, a lawyer shall inform the (d) tribunal of all
material facts known to the lawyer that will enable the tribunal to make an
informed deCision, whether or not the facts are adverse.
.9 Rule .Fairness to Opposing Party and Counsel. A lawyer shall
not:
Unlawfully obstruct another party's access to (a) evidence or unlawfully
alter. destroy or conceal a document or other material having potential
evidentiary value. A lawyer shall not counsel or assist another person to do
any such act;
Falsify evidence, counsel or assist a witness to (b) testify falsely, or ofer
an inducement to a witness that is prohibited by law;
KnOwingly disobey an obligation under the rules of a (c) tribunal except for
an open refusal based on an assertion thai no valid obligation exists;
In pretrial procedure, make a frivolous discovery (d) request or fail to make
reasonably diligent effort to comply with a legally proper discovery request
by an opposing party;
(
In trial, allude to any matter that the lawyer does (e) not reasonably believe
is relevant or thai will not be supported by admissible evidence, assert
personal knowledge of facls in issue except when testifying as a witness, or
state a personal opinion as to the justness of a cause, the credibility of a
witness, the culpability of a civil litigant or the guilt or innocence of an
accused; or
Request a person other than a client to refrain from (f) voluntarily giving
relevant information to another party unless:
The person is a relative or an employee or (1)other agent of a client; and
The lawyer reasonably believes that the (2) person's interests will not be
adversely affecled by refraining from giving such information.
.0 Rule .Impariality and Decorum of the Tribunal and Relations
With 4UQ.
A lawyer shall not seek to influence a judge, juror, (a) prospective juror or
olher official by means prohibited by law.
A lawyer shall not communicate ex parte with a (b) judge. juror,
prospective juror or other official except as permitted by law.
Subject to the limitations imposed by this Rule or (c) by law, it is a lawyer's
right, afer the jury has been discharged, to interview the jurors to
determine whether their verdict is subject to any legal challenge. A lawyer
shall not communicate with a juror or prospective juror after discharge of
the jury if the juror has made known to the lawyer a desire not to
communicate, or the communication involves misrepresentation, coercion,
duress or harassment. The scope of the interview should be restricted and
caution should be used to avoid embarrassment to any juror or to influence
his or her action in any subsequent jury service.
A lawyer shall not engage in conduct intended to (d) disrupt a tribunal.
Before the jury is swor to tr the cause, a lawyer (e) may investigate the
prospective jurors to ascertain any basis for challenge, provided that a
lawyer or the lawyer's employees or independent contractors may not, at
any time before the commencement of the lrial, conduct or authori ze any
investigation of the prospective jurors, through any means which are
calculated or likely to lead to communication with prospective jurors of any
allegations or factual circumstances relating to the case at issue. Conduct
prohibited by this Rule includes, but is nol limited to, any direct or indirect
communication with a prospective juror, a member of the juror's family, an
employer, or any other person that may lead to direct or indirect
communication with a prospective juror.

.0 Rule .Relatlons With Opposing Counsel. When a lawyer


knows or reasonably should know the identity of a lawyer representing an
opposing party. he or she should not take advantage of the lawyer by
causing any default or dismissal to be entered without first inquiring about
the opposing lawyer's intenlion to proceed.
4.J Rule .Truthfulness in Statements to Others. In the course of
representing a client a lawyer shan not knowingly:
Make a false statement of malerial fact or law to a (a) third person; or
Fait to disclose a malerial fact to a third person (b) when disclosure is
necessary to avoid assisting a criminal or fraudulent act Q a dient, unless
disclosure is prohibited by Rule 1.6.
4.4 Rule .Respect for Right of Third Persons.
In lep|sentig a client, a lawyer shaU not use (a) means that have no
substantial purpose other than to embarrass, delay, or burden a third
person, or use methods of obtaining evidence that violate the legal rights of
such a person.
A lawyer who recives a document relating to the (b) representation of the
lawyer's client and knows or reasonably should know that the document
was inadvertently sent shaU promptly notify the sender.
.J Rule .Bar Admission and Disciplinary Maters. An applicant for
admission lO the bar, or a lawyer in connection with a bar admission
application or in connection with a disciplinary matter, shall not:
Knowingly make a false statement of material fact; (a) or
Fail to disclose a fact necessar to correct a (b) misapprehension known
by the person to have arisen in the matter, or knowingly fail to respond to a
lawful demand for information from an admissions or disciplinary authority,
except that this Rule does not require disclosure of information othelWise
protected by Rule 1.6.
.Z Rule .Judicial and legal Officials.
A lawyer shalt not make a statement that the lawyer (a) knows to be false
or with reckless disregard as to its truth or falsity concering the
qualifications or integrity of a judge, adjudicatory officer or public legal
officer, or of a candidate for election or appointment to judicial or legal
office.
A lawyer who is a candidate for judicial office (b) shall comply with the
applicable provisions of the Code of Judicial Conduct.

.4 Rule .Misconduct. It is professional misconduct for a lawyer to:
Violate or attempt to violate the Rules of (a) Professional Conduct,
knowingly assist or induce another to do so, or do so through the acts of
another;
Commit a criminal act that reflects adversely L the (b) lawyer's honesty,
trustworthiness or fitness as a lawyer in other respects;
Engage in conduct involving dishonesty, fraud, (c) deceit or
misrepresentation;
Engage in conduct that is prejudicial to the (d) administration of justice;
Stale or imply an ability to infuence improperly a (e) government agency
or official or to achieve results by means that violate the Rules of
Professional Conduct or other law; or
Knowingly assist a judge or judicial offcer in ( conduct that is a violation
of applicable rules of judicial conduct or other law.

The Siale Bar alleges as follows:
1. Multiple grievances were received by lhe Office of Bar Counsel between the

period of Janua( 14 and Vah \5. 2012. conCtn|n ReSpondent Due to the serious

allegatins m misconduct, grievance files W opened and an investigaton was initialed by
Assistant Bar Counsel Patrick King.
2. Respondent was advised Othe grievancs via U.S. mail, e-mail and by a brief
m with Mr. King al the Stale Bar Ofce 0 Reno. Respondent did not coperate with
Ihe investigation and rather than respond 10 the grievances as requested, Respondent sent
non-lespOnSiv8 and disparaging e-mails.
3. Respondent OB8 not made a request lobe placed on disability status, nor has
no adtnged that he may have menial infrmity. illness. or addiction.
4. Tna investigation of Ihe grievances against Respondent shows a serious
pa"ern olmiuct.
5. On September 9, 2011, Respondent shoplifed a candy bar and cugh drops
from a WalMar stoe with an approximate value Ofourteen dollars ($14.00). On November
30, 2011, Municipal Court Judge Kenneth R. Howard found Respondent guilty of the offense
of Petit Larceny. a violation 0 RMC 8.10.040. Respondent appealed the judgment o
convi. The judgment of conviction was affired on appeal. See Exhibit 1.
During the Irial Respondenfs conduct was so disruptive that Judge Howard
found Respondent in direct contempt of Cour1 and sentencd him to sere three (3) days in
jail. See Exhibit 2.
7. On August 20. 201', Respondent was arrested on a second larceny charge for
allegedly stealing a cell phone. Those charges are CJrrenlly pending in Reno Justice Court.
8. Respondent was again arrested January 13, 2012. fOf allegedly abusing 911
emergency services, a gross m|8d8m8of.

10. Respondent was arrested on November 13, 2011 by Reno Police Department
and charged with trespassing, a misdemeanor. tor which he was Jater convicted.
11. The circumstances leading to lhe abowntioned afest are as follows: at an
evicton hearing Justice of tile Peace FMf bMIf8 ordered that Respondent vacate the
home he was renting effective November 1. 2011. After the locks were changed and Ihe
eviction notia' was posted on the front door the owner, Or. MerlilS, discovered thai someone
had broken into m h an was barricaded in the basement The Reno Polic tried O
coax whmwas in tha basement V open tha door. Uf. Merliss was forced to kic open the
door where the RenO Police found Respondent. Respondent had broken into the home and
was living in the basement. Respondent was arrested for criminal trespass and was
subsequently convicted of that charge.
12. Respondent, represenling himself as cunset. fled a 36-page motion to
dismiss on March 5, 2012. The motion was denied by Judge Witliam Gardner and was
delermined Obe wilhout merit. The motion. on its face, demonslrates that Respondenllacks
competence to practice law.
13. Once Respondent was evicted. an order was obtained to remove his
belongings rrom the home. Respondent interlered with the contractor who was hired to
remove Respondenl's personal belongings. The polic wera called and aller lalling wilh
Respondent they recommended that he find something else O do. Respondent refused to
follow their advice and was subsequently arrested by the Reno police.

14. In the case of City OReno v8.ZQ8arer Coughlin. Case No. 11 TR
26800 21, a trial was held on a traffIC citation issued to Respondent. The matter was called
at approimately 3:00 p.m. and concluded without a verdict at about 4:30 p.m. after the court
held Respondent in criminal contempt Ocourt fOf his behavior and activities committed in the
direct presence of the court during lrial.
15. In a March 12, 2012 Order, Municipal Court Judge Dorothy Nash Homes found
by "clear and convincing evidence" thai Mr. Coughlin committed numerous acts of attorey
miscooduct. See Exhibit 3. Judge Holmes 8Jp!ained in her Order thai afer Respondent
sered his tiva-day contempt D court sanction imposed by the court on Februar 27, 2012,
Respondent 13K-file to the court a 224-page document. Judge Holmes found that the
document contained rambling references to his personal life and was incoherent.
16 . In her Order. Judge Homes found bV clear and convincing evidenc that
Respondent violated Rule of Professional Conduct rRPC") 1.1(Competence). RPC 1.3
(Diligence). RPC 3.1 (Meritorious Claims and Contenlions). RPC 3.2 (Expediting Litigation).
RPC 3.3(a) (Candor toward the Tribunal). RPC 3.4(e) (Fairness to Opposing Party and
Counsel). RPC 8.4 (c) (Engaging in Dishonesty. Fraud. Deceit or Misrepresentation) and
RPC 8.4(d) Engage in conduct that is Prejudicial to Administration of Justice) .
17. Respondent fled Affda . its of Poverty in Support of his Motion to Proced
Informa Pauperis. wherein he fails to disclose that he is a licensed attorney and instead
under Employment and Self-Employment he idenlifies himself as a "Jack of Alt Trades".
t8. Despite a claim of poverty in the above mentioned affla .. its. Respondent told
the Court that his incarceration for contempt would adversely afect his clients.
On March 22. 2012. Respondent appeared at the Reno Municipal Court
wearing (smitey lace) nan net pajamas. Respondent became argumentati .. e and Marshals

Respondent's inappropl"iale behavior in part as follows:
The most troubling aspect of this case was Mr. Coughlin's rude, sarcastic and
disrespectful presentation at lrial; Mr. Coughlin's inability to understand a balance
sheet: his failure to conduct discovery and his lack of knowledge with regard to
the rules ol evidenc and Ifial procedure. All of this was compounded with a
continuously antagonistc presentation of the ease Ihal resulted in a shift from a
fairly simple divoce case to a contentious divorce trial lasling an excessive
amount of time.
27. In light m0 forgoing Respondent violated RPt 1. 1 (Competenc); RPe 1.2
(Diligenc): RPC 3.1 (Meritorious Claims and Contentions); RPC 3.3 (Candor D the
Tribunal); RPC 3.4 (Fairness O Opposing Party and Counsel); RPC 3.5 (Impartiality and
Oecorum of the Tribunal): RPC 4.1 (Truthfulness in Statemenls O Others): RPC 9.9

8.1 (Disciplinary Matters); RPC 8.2 (Judicial and Legal Ofals); and RPC 8.4 (Misconduct).
