AGREEMENT FOR CHILD CUSTODY

I, Eleanor Daoa Liwan-Valdez, 29 years old, born on May 16, 1981 and my husband, Roderick Frigiliana Valdez, 27 years old, born on June 25,1983 are in the state of unsteady marriage. In an attempt to provide for the best interest of our child, Erielle Deane Liwan Valdez, 4 years old, born on October 5, 2006, we, the parties voluntarily enter into the following agreement: 1. We believe that Eleanor is fitter and more proper parent to be awarded legal custody of our one and only minor child, Erielle. 2. We agree to advance the welfare and the best interests of our child. We realize that our separation may be a painful and traumatic event for her. We wish to try to reduce the trauma by demonstrating our continuing desire and ability to coparent. We agree not to undermine the respect and affection the child have for the other parent. 3. Considering the best interests of our child, we agree to rest the physical and residential care of Erielle with Eleanor with paternal access of two (2) consecutive days once a month at his most convenient days provided it falls on Saturday and Sunday. Provided further that if the two days are not availed during the month, they are not to be added to the two days allowed for the following month. In other words, if the two days are not utilized within the month, they are deemed forfeited. 4. To provide for continuity during the school year, since Eleanor intends to work outside the Philippines, the residence of the child shall be with Elma Daoa Liwan-Borja, sister of Eleanor. Elma Borja will have the primary day-to-day responsibility for the guidance and upbringing of the child during the school year. 5. The residence of the child shall be with Elma Daoa Liwan-Borja during the summer months. Elma Borja shall have the primary day-to-day responsibility for the guidance and upbringing of the child during that period. 6. During the time that the child is with Roderick, Eleanor or Elma shall have the right to call or text the child, Roderick or any relative of him to ensure the security of the child. 7. We have agreed that in case the child needs medical or dental attention and the child is with Roderick, Roderick should inform Eleanor or Elma immediately through telephone. 8. We both agree that Roderick should no longer reside in our house in Poblacion, San Gabriel, La Union unless given permission by Eleanor. 9. In case of special occasions like birthday of Erielle, we agree that it will be celebrated in Poblacion, San Gabriel, La Union. However, during Christmas Day or New Years Day

celebrations, Roderick may be allowed to take the child for three (3) days in addition to the allowed paternal access of two days for the month of December granted he chooses only one between the Christmas or New Years celebration. Therefore for the period of December, Roderick is entitled to five (5) days paternal access. 9. We both agree that when Roderick intends to remarry or cohabit, he waives his paternal access of two (2) days stated in agreement number 3 and the additional three (3) days stated in agreement number nine (9). However, if Erielle wants to see his father, Roderick can visit the child. During special occasions, Roderick may take the child out for lunch but not at the residence of the live-in partner. 10. We have agreed that financial support from Roderick is not obligatory since Eleanor earns more than Roderick. However, Roderick can still give financial support voluntarily. 12. This agreement reflects our current feelings with respect to the best interests of our child. 13. We sign this agreement this ____th day of April, 2011 and will take effect immediately. This agreement shall be valid and enforceable unless and until superseded by another agreement.
