IN RESPONSE TO DEFENDANTS RULE 60(b) MOTION

COMES NOW Defendants, FLORINDA CHAVEZ, Individually, BEATRICE
MARTINEZ, Individually and JOE CARDENAS, III, Individually, by and through their
undersigned attorneys of record, and, files this Reply to Plaintiffs Brief in Response to
Defendants Rule 60(b) Motion. For cause of action, Defendants would show unto the Court the
following:
1. The Plaintiff=s only claims within their Original Complaint were Federal Trademark
Infringement, False Designation of Origin and Unfair Competition, Common Law Trademark
Infringement, and Common Law Unfair Competition, because the Defendants created a Texas
non-profit corporation using the name and titles of Texas LULAC.

The basis of these claims by the Plaintiff
were the Defendants used the Marks of the League of United Latin American Citizens (hereinafter
ALULAC@) without LULAC=s approval. LULAC requested the Defendants be temporarily,

preliminarily and permanently enjoined from engaging in the acts of trademark infringement,
unfair competition, and trademark dilution. There are no claims contained in Plaintiff=s
Complaint to remove the Defendants as officers or not allow the Defendants to run for any elected
position in LULAC or its state organization Texas LULAC.
2. The Plaintiff is now attempting to use this Judgment that was entered in this cause against
the Defendants and the Complaint on which the Judgment is based did not seek or request that
Defendants not be allowed to run for an elected office within LULAC or the State Organization,
Texas LULAC. The Plaintiff is attempting to use the Judgment as both a sword and a shield. As
the Plaintiffs attempt to argue the Court may not interfere with the internal matters of a non-profit
volunteer organization and then claim the Judgment does not allow the Defendants to run for an
elected office. By the argument below, the Defendants is able to show the Court has the ability to
interpret its own Judgments and this does not interfere with internal matters of LULAC but the
court is exercising its jurisdiction to interpret its own Orders. The Defendants request the Court
Declare the Judgment does not prevent the Defendants from running for an elected office within
LULAC and Texas LULAC. Further and in the alternative, if the Court does find that the
Judgment prevents the Defendants from running for elected office within LULAC or Texas
LULAC it was due to fraud, misrepresentation or misconduct of LULAC.
DECLARATORY JUDGMENT
3. Under the Declaratory Judgment Act, a federal court may only declare the rights and other
legal relations of parties in a case of actual controversy. 28 U.S.C. 2201; Fed.R.Civ.P. 57.
That controversy must be of a justiciable nature, thus excluding an advisory decree upon a
hypothetical state of facts. Ashwander v. Tenn. Valley Auth., 297 U.S. 288, 325, 56 S.Ct. 466, 80

L.Ed. 688 (1936). This circuit interprets the 2201 case of actual controversy requirement to be
conterminous with Article III's case or controversy requirement. Hosein v. Gonzales, 452 F.3d
401, 403 (5th Cir.2006). An actual controversy is a dispute that is definite and concrete,
touching the legal relations of parties having adverse legal interests. MedImmune, Inc. v.
Genentech, Inc., 549 U.S. 118, 127, 127 S.Ct. 764, 166 L.Ed.2d 604 (2007).
4. A federal court has ancillary jurisdiction to interpret a prior federal court order where the
effect of such an interpretation would, inter alia, nullify or prevent future enforcement of the
original federal judgment. Peacock v. Thomas, 516 U.S. 349, 357, 116 S.Ct. 862, 133 L.Ed.2d
817 (1996) (holding the exercise of ancillary jurisdiction has been limited to attempts to execute,
or to guarantee eventual executability of, a federal judgment).
5. Both the Plaintiff and Defendants have differing opinions as to the language contained
within the Judgment entered by this Honorable Court. The Court pursuant to Rule 57 may issue a
declaratory judgment to establish the existing rights, status, or other legal relationships of the
parties and determine the rights of the parties pursuant to a prior Federal court order. See Royal
Ins. Co. of Am. at 960 F.2d at 1292. By its very nature, a declaratory judgment seeks to determine
the rights of the parties as they currently exist, it does not involve the modifications or correction
of a prior judgment. See 28 U.S.C Section 2201(a)(authorizing a federal court with proper
jurisdiction to declare the rights and other legal relations of any interested party seeking such
declaration, whether or not further relief is or could be sought). City of El Paso, Texas v. El Paso
Entertainment, Inc. 382 Fed.Appx361,2010 WL 2465227 (C.A.5 (Tex.)
6. As shown by the attached Exhibits Defendants were issued membership cards by LULAC
stating they were members in good standing and based upon the LULAC Constitution they are

entitled to vote and be candidates for an office in their Council, District, State or National
Conventions.

It is also clear from the declarations of the Defendants that they would not have
signed or agreed to a Judgment if it actually stated they were not allowed to run for an elected
office within LULAC or Texas LULAC.

The Judgment was entered to address the claims of the
Plaintiff and that was the intent of the Judgment that was entered. Further, by reviewing the
actual language contained in the Judgment, it is unambiguous due to the fact the language cited by
Plaintiff does not even exist within the Judgment.
7. The Court has the inherent authority to Declare the rights of the parties as it pertains to the
Judgment that was entered by this Court.

RULE 60(b)(3) MOTION
8. If the Court finds that the Judgment does include language that prevents the Defendants
from running for an elected office within LULAC and Texas LULAC the Defendants would argue
this is the result of the fraud perpetuated by the Plaintiff.
9. It was the original intent of the Plaintiff in the entry of the Judgment to not allow the
Defendants to run for an elected office within LULAC even though the Complaint the Plaintiff
relies on does not contain a reference or request to not allow the Defendants to run for an elected
office within LULAC or Texas LULAC.

regarding the use of Mark=s of LULAC and Defendants identifying themselves as officers of
LULAC or Texas LULAC. The Judgment entered in this cause disallowed the Defendants from
referring to themselves as officers of LULAC because that was the claims of Plaintiff that the
Defendants were claiming they were officers of LULAC or Texas LULAC. This was identified
within the Plaintiff=s Complaint.

10. Rule 60(b)(3) allows for relief from a Final Judgment based upon fraud, misrepresentation,
or misconduct by an opposing party. If the true intent of the Plaintiff was to not allow Defendants
to run for an elected office within LULAC or Texas LULAC that should have been clearly
identified within Plaintiff=s Original Complaint. There is not one statement or word by the Plaintiff
in their Original Complaint about the Defendants not being able to run for an elected office.
Further, this would have been a part of negotiation.
11. During negotiations for the entry of the Judgment it was never stated nor alleged that
Defendants would not be allowed to run for elected office within LULAC and Texas LULAC.

It
is clear from the response from Plaintiff that their true intention was to prevent the Defendants to
run for an elected office when they filed this litigation. LULAC is not only making
misrepresentations LULAC is attempting to circumvent their own constitution by not allowing the
Defendants to run for an elected office.
12. As stated within Roger Edwards, LLC v. Fiddes & Son Ltd. 427 F.3d 129, 134 (1
st

Cir.2005) Ain parsing Rule 60(b)(3), an initial, and important, distinction to grasp is between fraud

or misstatements that are committed during the course of a commercial transaction and fraud or
miss-statements perpetrated in the course of litigation the former is the subject-matter of litigation,
meant to be investigated through the discovery process and resolved by the evidence at trial. Id.
By contrast, fraud perpetrated in the course of litigation interferes with process of adjudication,
and it is the kind of litigation-related fraud that principally concerns Rule 60(b)(3) fraud provision.
Id. Once such fraud is proven, the Judgment may be set aside merely upon the movant=s showing
that the fraud substantially interfered with the movant=s ability to fully and fairly to prepare for and
proceed at, trial. Id. This is a far less demanding burden than showing that a different result
would probably have ensued. Id.
13. If this was the true intent of the Plaintiffs the Defendants should have been entitled to fully
and fairly prepare for these claims of the Plaintiff. But this was never an issue until after the
Judgment was entered and because this was the true intent of the Plaintiffs the Defendant should
be afforded the ability to contest this intent and fully and fairly prepare for trial. The Defendants
easily meet the burden of presenting clear and convincing evidence of the fraud perpetrated by the
Plaintiff and the Court should set aside the portion of the Judgment claiming the Defendants are
not able to run for an elected office with LULAC and Texas LULAC.
WHEREFORE, PREMISES CONSIDERED, Defendants FLORINDA CHAVEZ,
Individually, BEATRICE MARTINEZ, Individually and JOE CARDENAS, III, Individually,
respectfully pray that the court grant their requested relief, either at law or in equity, to which they
may show themselves to be justly entitled.

RELIEF FROM JUDGMENT, AND PRELIMINARY INJUNCTION

COMES NOW DEFENDANTS FLORINDA CHAVEZ, INDIVIDUALLY, BEATRICE
MARTINEZ, INDIVIDUALLY AND J OE CARDENAS, III INDIVIDUALLY, by and through
their undersigned attorneys of record, and, in accordance with Federal Rule of Civil Procedure
57, 60, and 65 file this, their Motion for Declaratory J udgment, Relief From J udgment and
Preliminary Injunction. For cause of action, Defendants would show unto the Court the
following:
I.
STATEMENT OF FACTS

1. The underlying dispute involved federal and state law trademark claims made by
the Plaintiff against Defendants. Plaintiffs basic claim was that Defendants had created a
separate entity (Texas League of United Latin American Citizens) that allegedly caused a
likelihood of confusion with Plaintiff.

2. On or about December 19, 2012, the Parties entered into an Agreed J udgment in
which Defendants agreed to abandon the use of the defunct non-profit corporation, abandon any
fundraising efforts on behalf of the defunct non-profit corporation, and abandon identifying
themselves as officers of the defunct non-profit corporation. In all respects, Defendants
maintained the good-faith belief that their dispute with Plaintiff had been resolved without any
lingering disagreements or controversies.
3. On or about March 2, 2013 and after the underlying dispute was ostensibly
resolved, Florinda Chavez declared her candidacy for State Director of LULAC. For the next
three months, Florinda Chavez electioneered her candidacy through an extensive e-mail and
public relations campaign to other members of LULAC. At no point during her candidacy did
anyone advise or inform Florinda Chavez that she was, in any way, ineligible to serve as an
officer for LULAC.
4. On or about J une 2, 2013 at the Texas State LULAC Convention and at the very
moment that LULAC membership were set to vote for the State Director, Ms. Chavez was
declared to be ineligible for State Director by Mr. Roger Rocha, the National Treasurer of
LULAC. Before an auditorium full of LULAC convention delegates, Mr. Rocha stated that the
Honorable Frank Montalvo had rendered a Final J udgment declaring that Ms. Chavez was
disqualified from holding any elected office within the LULAC organization.

5. Upon information and belief, Luis Vera, Esq., General Counsel for LULAC and
Plaintiffs counsel, aided and abetted Mr. Rochas and Mr. Ortizs fraudulent misrepresentation
by urging and/or soliciting the wrongful disqualification of Ms. Chavezs candidacy.
6. Defendants Beatrice Martinez and J oe Cardenas have also been prejudiced in that,
through the fraudulent misrepresentations and improper use of the Final J udgment, they were
denied the opportunity to support and cast ballots in favor of Ms. Chavez, the candidate of their
choice. Mr. Cardenas and Ms. Martinez are also, according to the misuse of the Final J udgment,
barred from office.
II.
ARGUMENT & AUTHORITIES

A. Request for Declaratory J udgment
7. Pursuant to Rule 57 and the Declaratory J udgment Act, Defendants contend that a
substantial controversy exists between the Parties herein and that said Parties maintain adverse
legal interests of sufficient immediacy and reality to warrant the issuance of a declaratory
judgment.

The Fifth Circuit has held that a court may issue a declaratory judgment to establish
the existing rights, status, or other legal relationships of parties.

This Court has jurisdiction to
adjudicate the existing right of the Parties because it entered the Final J udgment that is currently
being misconstrued by Plaintiffs agents and representatives.
8. In the present dispute, Defendants aver that Plaintiff, through its agents and
representatives, are distorting the Final J udgment rendered by this Court for an improper
purpose. More specifically, Defendants contend that Plaintiff, through its agents and
representatives, has, in the past and in the present, wrongly claimed that this Court disqualified

Ms. Chavez from declaring her candidacy or holding elected office within the LULAC
organization.
9. Defendants seek a speedy hearing on their request for declaratory relief.
Defendants seek reasonable and necessary attorneys fees and taxable costs of court as provided
by Rule 57 and the Declaratory J udgment Act.
B. Request for Relief From J udgment
10. Pleading in the main and in the alternative, Defendants submit their Motion for
Relief From J udgment pursuant to Rule 60.

Rule 60 allows a party to seek relief from a
judgment or order based upon, inter alia, fraud, misrepresentation, and misconduct; or a
satisfied, released, or discharged judgment; because applying a judgment prospectively is no
longer equitable; or for any other reason that justifies relief. Defendants aver that Plaintiff has
engaged in fraud, misrepresentation and misconduct by misusing the Final J udgment for an
improper purpose for which Defendants never agreed. Defendants further aver that the they have
complied with all the terms and conditions of the Final J udgment and that it has been satisfied,
released and/or discharged such that it cannot be used for any further purpose including to
disqualify Defendants from actively participating in LULAC elections either as a candidate or a
voter. Defendants aver that application of the Final J udgment for any future purpose is no longer
equitable. Finally, as Defendants contend that their predicament justifies relief.
C. Request for Preliminary Injunction
11. Due to the actions of Plaintiff, Defendants request that the Court issue a
Preliminary Injunction pursuant to Rule 65 to prevent Plaintiff from disqualifying the Defendants
for an elected office or position within LULAC.
