Anniversary March on Washington embraces LGBT community as out and equal partner
By LOU CHIBBARO JR. lchibbaro@washblade.com Union leaders Randi Weingarten, president of the American Federation of Teachers, and Mary Kay Henry, president of the Service Employees International Union, both out lesbians, will be among at least four LGBT rights advocates to speak on Saturday at the 50th anniversary commemoration of the 1963 Civil Rights March on Washington. Also conrmed as out gay speakers are Rev. MacArthur Flournoy, director of faith partnership and mobilization for the Human Rights Campaign, and Adrian Shanker, president of the statewide LGBT rights organization Equality Pennsylvania. Other LGBT advocates were expected to speak at the Lincoln Memorial rally, but organizers of the event said they could not conrm additional speakers until an ofcial list was released later this week. Anti-gay Md. lawmaker charged with DUI


Anne Arundel County police early on Tuesday arrested a Maryland lawmaker who vehemently opposes same-sex marriage for allegedly driving under the inuence of alcohol. A police report that WBAL in Baltimore obtained said ofcers stopped state Del. Don Dwyer (R-Anne Arundel County) on Route 100 near Edwin Raynor Boulevard in Pasadena at 12:42 a.m. It said Dwyer told ofcers he had had two beers earlier in the night at a tavern in Baltimore. The police report said the ofcer who arrested Dwyer immediately noticed a strong odor of an alcoholic beverage coming from his breath and person. It also noted Dwyers speech was very slow and slurred. Dwyer also failed three eld sobriety tests. Dwyer faces a charge of driving while impaired and other trafc offenses that include driving with an expired registration. Dwyer, 55, in 2006 tried to remove Baltimore Circuit Court Judge M. Brooke Murdoch after she found Marylands same-sex marriage ban unconstitutional. Dwyer also sought to impeach Attorney General Doug Gansler, after he announced in 2010 the state would recognize same-sex marriages legally performed in other jurisdictions. Dwyers arrest comes nearly a year to the day after a boat he was operating crashed into another vessel on the Magothy River in Anne Arundel County. The incident left him, two other adults and four children injured. Dwyer in May pleaded guilty to operating a boat while under the inuence of alcohol. He was to have served probation under a plea bargain he reached with prosecutors, but an Anne Arundel County judge sentenced him to 30 days in jail and ordered him to pay a $1,000 ne. Dwyer appealed the sentence, but entered a second guilty plea in Anne Arundel County Circuit Court early this month. A retired judge from Harford County who was brought in is scheduled to sentence Dwyer in October. The Anne Arundel Republican told the Maryland Gazette in January that thenDel. Tiffany Alston of Prince Georges County and two Republican delegates who voted for the same-sex marriage bill contributed to his alcohol abuse. White House to hold LGBT brieng on Obamacare


Sebelius to keynote Sept. 12 event to build support for law
By CHRIS JOHNSON cjohnson@washblade.com As the administration works to implement health care reform, the White House has scheduled a brieng for LGBT advocates on Sept. 12 to discuss ways Obamacare will impact LGBT people, according to an invitation to the event. The email invitation, which is dated Aug. 20 and signed by LGBT liaison Gautam Raghavan, was apparently delivered to leaders within the LGBT community that support President Obama. It says Secretary of Health & Human Services Kathleen Sebelius will deliver a keynote address at the brieng. The administration is also set to provide an overview of the Affordable Care Act in addition to talking about key provisions related to the LGBT community and the enrollment effort for health insurance exchanges. As you know, many members of the LGBT community face limited access to health care and insurance, and are less likely to get the preventive care they need to stay healthy, the invite states. The Affordable Care Act directly addresses some of these needs, and the upcoming open enrollment period provides an important opportunity to get folks enrolled and transform the health and well-being of the LGBT community for generations to come. Neither the White House nor the Department of Health & Human Services would immediately respond to the Washington Blades request for conrm on the brieng or answer questions about it. Its unclear exactly who was invited to the brieng or how many people would attend. It doesnt appear to be open to the public or the press. According to the invitation, the administration will also provide a presentation of important new research on how LGBT communities perceive and access health care and suggest messaging strategies for reaching key sub-communities. The brieng is also set to include a panel discussion of best practices by community organizations engaged in LGBT health advocacy as well as breakout sessions to connect local leaders and plan regional enrollment events. The invitation emphasizes the need of LGBT supporters to educate others on the importance of implementing Obamacare. At the beginning of next year, the health care exchanges and the individual mandate under the law are scheduled to begin. Thats also the time when insurers will be prohibited from discriminating against or charging higher rates for individuals based on pre-existing medical conditions or gender, which has been interpreted to include protections for LGBT people. YOU are critically important to the education and enrollment effort, and this brieng is designed to equip community leaders like you with the tools, information, and resources you need to get involved and help your local communities get access to quality, affordable health care, the invitation states. The White House is holding this brieng amid a larger public relations push to build support for Obamacare, which is still viewed unfavorably by 54 percent of the American public, according to a poll this month from Rasmussen.

New D.C. anti-violence group debuts


A coalition of local LGBT organizations this week announced the formation of a new group called the D.C. Anti-Violence Collaborative. In a statement released on Tuesday, organizers said the new organization is dedicated to ending cycles of violence and oppression impacting the LGBT community in the District of Columbia. Gays and Lesbians Opposing Violence (GLOV), Casa Ruby, and D.C. Trans Coalition are among the organizations joining forces to operate the new group, the statement says. The D.C. Anti-Violence Collaborative will allow us to start coordinating vital services for survivors of violence in our communities, said Ruby Corado, founder and executive director of Casa Ruby, an LGBT community center with an outreach to the Latino and transgender communities. There is a tremendous need, and by working together across organizations, we will be better able to address that need, Corado said. Jason Terry, the anti-violence coordinator for the D.C. Trans Coalition, said the new group would enable its member organizations to better address issues of police violence, hate violence sexual violence, and partner violence through advocacy, education, grassroots organizing, and providing services. GLOV co-chair Hassan Naveed said the Collaborative would help create an inclusive advocacy agenda in a safe space for all intersections of the community. Its time for us to tighten coordination in our advocacy efforts and make sure we are providing representation for everyone, he said. The Aug. 20 statement says the new group will meet monthly and plans to organize two town hall meetings in the fall. Additional charges in Florida sex case


VERO BEACH, Fla. An Indian River County judge on Aug. 20 revoked bond for a woman who faces charges for having consensual sex with her teenaged girlfriend. WPTV reported Circuit Court Judge Robert Pegg charged Kaitlyn Hunt, 19, with transmitting material harmful to a minor by electronic equipment after she allegedly sent nude photos and videos of herself and more than 20,000 text messages to her then-14-year-old girlfriend in violation of a court order. The television station reported Det. Jeremy Sheppard of the Indian River County Sheriffs Department testied Hunt and her girlfriend had sexual contact on July 29. Equality Florida and other LGBT advocacy groups in February criticized prosecutors who charged Hunt, who was then 18, with lewd and lascivious battery on a child. Hunt in May rejected a deal with prosecutors under which she would have pleaded guilty to third-degree felony child abuse. She would not have had to register as a sex offender under Florida law under the terms of the plea.

Hawaii lawmakers urged to support marriage


HONOLULU Members of Hawaiis congressional delegation on Aug. 16 urged state lawmakers to support a bill that would extend marriage rights to same-sex couples. Congresswomen Colleen Hanabusa and Tulsi Gabbard and U.S. Sens. Mazie Hirono and Brian Schatz each spoke in support of the issue in a press release the group Hawaii United for Marriage released. Government ofcials, judges and bureaucrats should not have the power to declare one relationship morally superior to another, Gabbard said. Lawmakers did not vote on same-sex marriage bills before they adjourned in June. They could potentially debate the issue during a special legislative session later this year if Gov. Neil Abercrombie, who backs nuptials for gays and lesbians, calls for one.

Social conservatives slam 2016 hopeful for move

Chris Christie signed a bill into law on Monday banning ex-gay conversion for minors in New Jersey, which makes the state in the second in the country to enact such legislation. Christie signed the bill on the last possible day after the legislature passed it before it would have become law anyway with or without his signature. The bill passed in the Senate with a bipartisan supermajority of 28-9; and in the Assembly with a bipartisan supermajority of 56-14. The lead sponsors were Assembly member Tim Eustace, whos gay, and State Sen. Raymond Lesniak. In a signing statement made public on Monday, Christie said he was conicted about signing the bill because of possible infringement upon parental choice, but added he believed it was the right course of action. At the outset of this debate, I expressed my concerns about government limiting parental choice on the care and treatment of their own children, Christie said. I still have those concerns. Government should tread carefully into this area and I do so here reluctantly. I have scrutinized this piece of legislation with that concern in mind. The Republican governor added the mental health risks of attempting to change a childs sexual orientation outweigh concerns over the government encroaching on parental choice. I also believe that on issues of medical treatment for children we must look to experts in the eld to determine the relative risks and rewards, Christie said. The American Psychological Association has found that efforts to change sexual orientation can pose critical health risks including, but not limited to, depression, substance abuse, social withdrawal, decreased selfesteem and suicidal thoughts. I believe that exposing children to these health risks without clear evidence of benets that outweigh these serious risks is not appropriate. Based upon this analysis, I sign this bill into law. The statement accompanying the signing statement also says Christie believes people are born gay and that homosexuality isnt a sin a statement that is contrary to his Catholic faith. Christies signature will make New Jersey to second state to ban exgay conversation therapy for minors. California became the rst state after Gov. Jerry Brown (D) signed similar legislation into law in October. That law is being challenged by social conservatives in federal court in a lawsuit known as Pickup v. Brown. In January, the U.S. Ninth Circuit Court of Appeals issued an emergency injunction barring the California law from going into effect. In a statement immediately after the news on Monday, the social conservative group Liberty Counsel announced that it intends to challenge the New Jersey ban on conversation therapy in court as well. Mat Staver, founder and president of the Liberty Counsel, said the law provides a slippery slope of government infringing upon the First Amendment rights of counselors and therapists who want to provide counseling consistent with their religious beliefs. This bill is so broad that parents would be prohibited from seeking help for their son who developed unwanted same-sex attractions after being molested by the likes of Jerry Sandusky, Staver added. Counselors would only be allowed to afrm these unwanted feelings as good and normal. This is absurd and dangerous. This law would inict serious damage to children, parents, and counselors.

Florida county adopts trans ordinance


CLEARWATER, Fla. The Pinellas County Board of County Commissioners on Tuesday voted 6-1 to add gender identity to the countys human rights ordinance. The Tampa Tribune reported the proposal would prohibit most organizations in the county from discriminating against trans people in employment, housing and public accommodations. These include access to public restrooms that are consistent with their gender identity and expression. We cannot legislate against what is peoples hearts and minds, but we can set policy to protect every member of our community, Commissioner Charlie Justice said as the Tampa Tribune reported. The vote took place a week after Alachua County, in which the city of Gainesville and the University of Florida are located, approved a similar ordinance. Palm Beach, Broward, Monroe and Leon Counties and the cities of St. Augustine and Venice are among the other Florida municipalities that have enacted trans-inclusive human rights ordinances.

Amusement park cancels wedding contest


SANDUSKY, Ohio The Cedar Point amusement park has cancelled a wedding contest after a gay couple protested their exclusion from it. WKYC in Cleveland reported on Aug. 20 that Eric Morrison and Scott Kenimond wanted to be among the 13 couples to tie the knot during the opening of Cedar Points Halloween celebration next month. The television station said only heterosexual couples could enter the contest because Ohio law does not allow same-sex marriage. In todays world, its just not a fair thing to do to leave people out, Kenimond told WKYC. The amusement park told the television station in a statement it does not take any ofcial stance on political issues. It added it provides opportunities for all couples to have weddings, commitment ceremonies and other events at Cedar Point.

Journalist Greenwalds partner detained in London


White House says U.S. not involved in incident
By LOU CHIBBARO JR. lchibbaro@washblade.com The partner of journalist Glenn Greenwald, who wrote about classied U.S. surveillance information leaked by intelligence contractor Edward Snowden, was detained in London on Sunday by British authorities under a controversial anti-terrorism law. The Guardian newspaper, for which Greenwald is a reporter and columnist, disclosed that British law enforcement ofcials invoked the British Terrorism Act of 2000 to detain David Miranda, 28, at Londons Heathrow Airport for nine hours. Miranda and Greenwald live together in Rio de Janeiro, Brazil. Greenwald, an American citizen, has said he and Miranda, a Brazilian national, set up a household in Rio prior to the U.S. Supreme Court ruling overturning a provision of the Defense of Marriage Act, which prevented Miranda from obtaining U.S. residency as Greenwalds spouse. The British-based Guardian reported that airport authorities refused to disclose why they detained Miranda when he arrived on a ight from Berlin, where he was helping an American lmmaker who has been collaborating with Greenwald on a project related to the documents leaked by Snowden. The Guardian reported that the authorities released Miranda after the Guardians publication of the information he leaked. He surfaced rst in Hong Kong, where he agreed to news media interviews, before eeing to Russia, where he has been given temporary political asylum. U.S. prosecutors working on the Snowden case couldnt immediately be reached to determine whether British authorities consulted them about their detaining and questioning of Miranda. White House Principal Deputy Press Secretary Josh Earnest asserted on Monday that the United States was not involved in the detention of Greenwalds partner although he wouldnt rule out the possibility that U.S. authorities obtained information as a result of the detention. During a news conference on Monday, Earnest elded questions from several reporters about the detention of Miranda. Earnest asserted the U.S. government had no involvement in the British governments decision to detain Miranda and directed additional questions to British law enforcement. The United States was not involved in that decision or in that action, Earnest said. So if you have questions about it, then I would refer you to the British government. Earnest added that the British government did give the United States a heads-up the detention would take place. He also wouldnt rule out the possibility that the U.S. government obtained information from the material that was conscated as a result of this detention.

A spokesperson for Scotland Yard, the London police agency, told the Guardian that a 28-year-old man was detained at Heathrow Airport under Schedule 7 of the Terrorism Act of 2000 and was later released but provided no further details. According to the Guardian, the authorities conscated Mirandas laptop computer, cell phone, camera, memory sticks, DVDs, and games consoles. This is a profound attack on press freedoms and the news gathering process, Greenwald said in a posting Sunday on the Guardian website. seize large amounts of his possessions, is clearly intended to send a message of intimidation to those of us who have been reporting on the NSA and GCHQ, he said. But the last thing it will do is intimidate or deter us in any way from doing our job as journalists, Greenwald said in is posting. Quite the contrary: it will only embolden us to continue to report aggressively. The GCHQ is a British intelligence agency. In June, U.S. federal prosecutors charged Snowden with violating the U.S. Espionage Act and theft of government property for the leaking of classied information in his role as an NSA contractor while employed by the contracting company Booz Allen Hamilton. Wife says mayoral candidate targeted for being gay
By MICHAEL K. LAVERS mlavers@washblade.com The wife of New York City Council Speaker Christine Quinn said her spouse has received anti-gay death threats. Chris has gotten threats about being gay, Kim Catullo told the New York Daily News in an interview published on Monday during which she discussed Quinns mayoral campaign. Its hard to accept and we live in a place that is the most tolerant. Quinns campaign spokesperson Mike Morey declined to provide additional comments to the Washington Blade on Catullos claims. We dont have any more to add on that, he said. The Daily News published its interview with Catullo less than a week after a group of men attacked Michael Felenchak and Peter Nortman as they held hands while walking home from a movie theater in Manhattans Chelsea neighborhood. The New York Police Department has not made any arrests in the alleged anti-gay attack but ofcials on Aug. 16 released sketches of the suspects. This kind of anti-gay attack is unacceptable anywhere, but for it to happen in Chelsea which has such a large LGBT population is particularly shocking, Quinn said in a statement. Whats worse is that this is happening after a summer of repeated attacks on members of the LGBT community attacked just because of who they are. Quinn, a former executive director of the New York City Anti-Violence Project who married Catullo in a highprole wedding in May 2012, told the Blade during an interview earlier this month she would set a goal of the ve boroughs becoming a hate crime-free city if voters elect her mayor. She said she would accomplish this objective through working with the NYPDs Hate Crime Task Force, expanding the citys anti-bullying curriculum and partnering with faith-based organizations. Quinns comments to the Blade came less than three months after Elliott Morales allegedly shot Mark Carson, a gay man from Brooklyn, to death on a Greenwich Village street during what the NYPD said was a hate crime. Thats the work we have to keep doing until we get to the place where we get to zero as the statistics of hate crimes against any community, Quinn said. Catullo discussed recent anti-gay attacks in the city with the Daily News. When you have strides like marriage equality, you tend to think prejudice has panned, then things like that happen, she told the newspaper. It wakes you up again. A Quinnipiac University poll released on Aug. 13 shows Quinn, who would become the citys rst female and rst openly LGBT mayor if elected, has lost ground against New York City Public Advocate Bill de Blasio. Will Manning case harm effort to lift trans military ban?


Gay soldier sentenced to 35 years in prison
By LOU CHIBBARO JR. lchibbaro@washblade.com The decision by a military judge on Wednesday to sentence U.S. Army private Bradley Manning to 35 years in prison marks the conclusion of a protracted trial that transgender activists fear has set back their quest to persuade the military to lift its ban on transgender service members. The sentence came one week after Mannings attorneys argued that Mannings decision to leak more than 700,000 classied documents was due, in part, to the stress he was experiencing over his gender identity. Earlier in the trial, his attorneys disclosed that Manning who initially identied himself as a gay man had been quietly struggling over whether he was a transgender woman. Last week, the defense released a photo of Manning dressed as a woman with a blond wig. His attorneys presented as a witness a military therapist who testied that Manning emailed him the photo along with a letter describing his gender identity problem. You put him in that kind of hypermasculine environment, if you will, with little support and few coping skills, the pressure would have been difcult to say the least, the Associated Press quoted the therapist, Capt. Michael Worsley, as saying in his testimony last week in the Tannehill, a transgender woman and former Lt. Commander in the Navy. She currently serves as spokesperson for the Trans Chapter of SPARTA-A, a group representing mostly active duty LGBT service members. If Bradley Manning is transgender and if he struggles over this, we can empathize over that, Tannehill told the Blade in a telephone interview. But we do not believe it should excuse what he did. Tannehill added, We know many trans military people with highly distinguished careers. So the argument that being transgender made him do this is patently false. Tannehill and transgender advocate Autumn Sandeen, who transitioned from male to female after retiring from the Navy, said the negative publicity surrounding Mannings personal struggle with his gender identity is overshadowing the overwhelming majority of service members grappling with their gender identity who quietly do their jobs well. The two noted that as many as 120 closeted transgender service members afliated with the SPARTA-A group cant come out as positive role models because they would be subject to discharge under a military regulation that strictly prohibits transsexualism and gender transformation within the military. In my last four years in the Navy I was grappling with gender identity and yet I did my job, said Sandeen, who lives in San Diego. Among other things, Sandeen said she had access to classied information while serving on a ship. She and other transgender people she knows who had similar access to classied information have never mishandled or released such information. He will be used as the example of why transgender people shouldnt serve in the military, she said of Manning. Sandeen said the transgender people she knows, both civilians and military members, are divided over whether what Manning did was good or bad for the country, just as other Americans are divided over the issue. In July, Manning was found not guilty of aiding the enemy, the most serious charge lodged against him. But military judge Lind found him guilty of nearly all of the other charges led against him, including six counts of violating the U.S. Espionage Act. Mannings supporters say the information he leaked to the whistleblower group Wikileaks shined a spotlight on awed U.S. policies and military practices in the Iraq and Afghanistan wars that would not otherwise have been brought to the attention of the American public. Government prosecutors argued that his actions placed U.S. troops in jeopardy by revealing classied information that terrorists and other adversaries could use against U.S. military and civil personnel stationed overseas. Personally, if Manning comes out as transgender I will be someone who owns him, but owns him as a person who did wrong, Sandeen said. We have to take the good and the bad.

Crackdown threatens to overshadow Sochi games
By MICHAEL K. LAVERS mlavers@washblade.com Russian Sports Minister Vitaly Mutko on Aug. 18 once again defended his countrys law that bans gay propaganda to minors. We want to protect our children whose psyches have not formed from the propaganda of drug use, drunkenness and non-traditional sexual relations, he said during a press conference in Moscow as the Associated Press reported. Mutko also said the law that President Vladimir Putin signed in June will not affect athletes and others who attend the 2014 Winter Olympics that will take place in Sochi, Russia, in February. I can say once again that the freedoms of Russians and foreign athletes and guests who come to Sochi will be absolutely protected, Mutko said. Growing outrage over the gay propaganda law and Russias LGBT rights record continues to threaten to overshadow the Sochi games. Russian chess champion Gary Kasparov and playwright Harvey Fierstein are among those who have called for a boycott of the Olympics. Author Dan Savage, LGBT rights advocate Cleve Jones and others have called for a boycott of Russian vodka. Gay Olympic diver Greg Louganis, who was unable to compete in the 1980 Summer Olympics in Moscow because then-President Jimmy Carter boycotted them over the Soviet Unions invasion of Afghanistan the year before, is among those who feel the U.S. should compete in Sochi. President Obama, retired tennis champion Martina Navratilova and a number of LGBT advocacy groups that include Athlete Ally also oppose an Olympic boycott. American runner Nick Symmonds criticized Russias gay propaganda ban after he competed at the World Athletic Championships in Moscow last week. High jumper Emma Green Tregaro and sprinter Mao Hjelmer, who are from Sweden, painted their ngernails in rainbow colors as they competed in the same event. The AP reported Green Tregaro wore red ngernail polish as she competed in a high jump competition on Aug. 17 because Swedish athletic ofcials reportedly asked her to change their color. Yelena Isinbayeva, a Russian Olympic pole vault champion, criticized Green Tregaro and Hjelmer during an Aug. 15 press conference after she won her third world title at the World Athletic Championships. Isinbayeva also defended the gay propaganda law. We have our law that everyone has to respect, she said. Kseniya Ryzhova told Russian reporters during a Moscow press conference earlier this week that she felt insulted over reports that suggested she and Tatyana Firoya challenged the gay propaganda law when they kissed on the medal podium at the World Athletic Championships on Aug. 18 after they won the womens 4 x 400 meter rally. There was no hidden political motive, Ryzhova said, as Reuters reported. Meanwhile, the Miss Universe Organization on Aug. 20 expressed concern over the gay propaganda law and the ongoing anti-LGBT crackdown in Russia.

Gospel singer assailed for ex-gay advocacy

Commission on the Arts and Humanities paid anti-gay gospel singer Donnie McClurkin $5,000 for his cancelled appearance at a citysponsored concert held on Aug. 10 at the Martin Luther King Memorial, according to the commissions executive director Lionell Thomas. Thomas told the Blade this week that the Commission also had to pay for McClurkins airline ticket and for one of the two nights that he was booked to stay at a D.C. hotel due to the abrupt cancellation of McClurkins appearance. He said the city made these payments directly to an airline company and a hotel, not to McClurkin. Mayor Vincent Gray directed the Commission to ask McClurkin to withdraw from appearing at the concert, saying McClurkins past public statements condemning homosexuality and his role as an ex-gay leader would be inappropriate for an event commemorating Martin Luther Kings call for equality for all people. Thomas said the Commission was obligated to pay McClurkin his full $5,000 performance fee under a contract that a

producer retained by the Commission had entered into with McClurkin. Thomas said both the Commission staff and the 17-member commission appointed by the mayor and conrmed by the D.C. Council did not play a direct role in selecting McClurkin for the concert, which was entitled, Reections on Peace: From Gandhi to King. This was part of a much larger performance contract that we have with a producer to present approximately

seven shows over a period of time, and this is one of the shows that we were presenting, Thomas said. He was invited to be a part of the program by the producer, Thomas said of McClurkin. It typically doesnt go through the Commission for that level of detail. But Thomas acknowledged the Commission was ultimately responsible for the selection. He said the Commission staff was not aware of McClurkins controversial statements about gays and

homosexuality at the time the producer booked his appearance. The mayors ofce said Gray had not been informed in advance of McClurkins booking to appear at the concert. No disrespect to Mr. McClurkin, but Mayor Gray thought it best that he withdraw from the concert in the name of not having his appearance be a distraction at an event about peace, love and justice for all, mayoral spokesperson Doxie McCoy told the Blade.

N.J. judge urged to allow gay marriage


Christie: couples in civil unions should get full benets
By MICHAEL K. LAVERS mlavers@washblade.com A New Jersey judge last week heard arguments as to whether the state should extend marriage rights to samesex couples. The Associated Press reported Assistant New Jersey Attorney General Kevin Jesperson told Mercer County Superior Court Judge Mary Jacobson during a hearing in Trenton the federal government should recognize civil unions as marriages for Social Security and other federal benets. Jesperson said the six gay and lesbian couples that led a same-sex marriage lawsuit in 2011 should sue the federal agencies and not the state of New Jersey that dont recognize their relationships. Larry Lustberg, an attorney for Garden State Equality, an LGBT rights group, told Jacobson the state can resolve any potential inequalities same-sex couples face by allowing them to marry. It is the state, not the federal government that is the source of the problem here, Lustberg said as the AP reported. The hearing took place less than two months after the U.S. Supreme Court found a portion of the Defense of Marriage Act unconstitutional and struck down Californias Proposition 8. Neighboring New York and Delaware are among the 13 states and D.C. in which same-sex couples can marry. New Jersey and a handful of other states allow gays and lesbians to enter into civil unions. The American Civil Liberties Union in neighboring Pennsylvania last month led a lawsuit that challenges the states statutory ban on nuptials for gays and lesbians. The federal government recognizes the marriages of gays and lesbians who legally tied the knot as a result of the DOMA decision, although same-sex couples ability to receive Social Security and other federal benets depends upon whether the state in which they live will recognize their unions. Gov. Chris Christie in 2012 vetoed a bill that would have extended marriage rights to same-sex couples in the state. Acting New Jersey Attorney General John Hoffman earlier this month argued in a brief he led with the court that same-sex couples that have entered into civil unions in the state are eligible to receive federal benets under the U.S. Supreme Courts DOMA decision. The Christie administration criticized the White House for withholding federal marriage benets to gays and lesbians in civil unions. [Any] federal policy or directive or interpretation of Windsor that denies benets to civil union partners violates the due process and equal protection provisions of the United States Constitution as well as New Jerseys sovereignty rights, the brief states. LGBT rights advocates defended their lawsuit after the hearing. The states discrimination is all that bars same-sex couples from the full array of federal protections for their families, Lambda Legal Deputy Legal Director Hayley Gorenberg said. New Jersey can x this and it should. The buck stops right here. The U.S. Supreme Court decision striking down DOMA was historic for the nation, but out of reach for us here in New Jersey, Cindy Meneghin of Butler, N.J., who, along with her partner of Maureen Kilian and their two children, are among the plaintiffs in the same-sex marriage lawsuit. We wont give up until we have the freedom to marry and the opportunity to share that security and joy with our family. The AP reported Jacobson will not rule on the issue until at least next month.

Union leaders among LGBT speakers at MLK rally

more diverse than ever, said Wade Henderson, president of the Leadership Conference on Civil and Human Rights, the nations largest civil rights organization, in discussing the 1963 march, in which famed civil rights leader Martin Luther King Jr. delivered his I Have a Dream speech. And Saturdays march will be a true reection of that diversity, said Henderson in a telephone news conference this week. Women, who held no speaking roles at the original march, will play leading roles in Saturdays event. Latinos, Asian Americans, Native Americans, and Arab Americans will all be represented as well, he said. And whereas Bayard Rustin, executive director of the 1963 march, was silenced because of his sexual orientation, the LGBT community has been embraced as an out and equal partner in Saturdays event, Henderson said. Joining Henderson in speaking at the news conference were Chad Grifn, president of HRC; Sharon Lettman-Hicks, executive director of the National Black Justice Coalition, an LGBT organization; and Rev. Darlene Nipper, deputy executive director of the National Gay and Lesbian Task Force. Shanker, a marketing director for a company near Bethlehem, Pa., said he was honored to have received a letter from Martin Luther King III and Rev. Al Sharpton inviting him to speak at the event. King III is the eldest son of Martin Luther King Jr. and one of the lead organizers of the 50th anniversary march. Sharpton, president of the New Yorkbased National Action Network (NAN), is another of the lead march organizers. Shanker has worked on LGBT rights initiatives in Pennsylvania for at least 10 years. This year he said he has followed in the footsteps of his grandfather, who, as a teachers union leader, helped arrange for thousands of teachers to travel to Washington for the 1963 march. He said that as part of his organizing for the 50th Anniversary March he recently spoke at an event in Philadelphia promoting the march at which King III also spoke. I guess some of the people who were there thought I was a good enough speaker that they wanted me to speak at the march, Shanker said. I do a lot of speaking and I do a lot of organizing in Pennsylvania But I certainly wasnt expecting an invitation to speak at the march. Its a major honor. He added, This is a time when we can really make it clear that the LGBT movement is focused on the broader civil rights agenda and is part of that broader

civil rights agenda. So Im very excited to be among many speakers at this event. Weingarten and Henry have been vocal supporters of LGBT equality as part of their work in the U.S. labor movement. The unions they head have endorsement LGBT rights, including marriage equality. Flournoy of HRC is a theologian, author, and preacher who has worked on civil rights issues for more than 30 years. He served as Faith Director for Marylanders for Marriage Equality, the group that led the successful ballot campaign last fall for Marylands samesex marriage law. In an open letter released on Monday, HRC, NBJC, the Task Force and Pride At Work, an LGBT arm of the AFL-CIO, along with 36 other LGBT advocacy organizations declared their strong support for the 50th anniversary commemoration March on Washington. History was made that day 50 years ago when thousands came to Washington, D.C. to lift up their voices in support of civil rights, employment protection, and an end to racial segregation in our nations schools, the open letter says. On Aug. 24, 2013, we will rededicate ourselves to that dream of equality and justice. The letter also notes that the LGBT rights movement celebrated historic victories in the past year, including voter approval of marriage equality in several states and the Supreme Courts rulings striking down a key provision of the anti-gay Defense of Marriage Act and Californias Proposition 8, which banned same-sex marriage in the nations largest state. But the open letter says that LGBT people like other minorities and immigrants continue to face discrimination in employment and other

areas, and that gays and transgender Americans continue to be victimized by violence based solely on their sexual orientation and gender identity. Working together, this rally and mobilization are an opportunity to lift up the voices of LGBT people as part of a broad progressive agenda for social and economic justice, the letter says. War Memorial, located across Independence Ave. from the Martin Luther King Memorial, is being used as the starting point for an LGBT contingent in one of many feeder marches that will culminate at the Lincoln Memorial, where the main rally was scheduled to be held. At least eight LGBT-related events, including forums and receptions, were scheduled to take place this week and next week in association with the 50th Anniversary March on Washington. Several of the events will honor Bayard Rustin, whom LGBT activists such as National Black Justice Coalition ofcial Mandy Carter of North Carolina have described as an unrecognized gay hero in the U.S. civil rights movement. At one of the events Tuesday night, D.C. gay activist Paul Kuntzler was one of four panelists to reect on their participation in the 1963 March on Washington. Kuntzler told a gathering at D.C.s Martin Luther King Library that he marched with a contingent of United Auto Workers Union members from Detroit, where he lived before moving to Washington. Post-DOMA govt decisions advancing marriage equality?

In the months after the ruling in June, the U.S. government has announced historic decisions in affording the federal benets of marriage to samesex couples that are legally wed. Shortly after the decision, the U.S. Ofce of Personnel Management granted spousal health and pension benets to gay federal employees, and just last week, the Pentagon announced it was implementing the benets along the same lines for gay U.S. service members. But to receive these benets, gay couples must be in legal marriages as opposed to any other form of legally recognized relationship, such as civil unions or domestic partnerships. OPM announced in a series of memos in July couples in these unions arent eligible for federal benets. And part of its rollout for same-sex spousal benets, the Pentagon granted up to 10 days leave to allow same-sex couples to travel to a marriage-equality state to wed as opposed to honoring domestic partnerships for the purposes of benets retracting a pledge earlier in the year to provide them. These changes mean gay couples living in the seven states that only offer civil unions or domestic partnerships Colorado, Illinois, New Jersey, Oregon, Nevada, Hawaii and Wisconsin will be left out in the cold in terms of federal benets unless they travel to a marriage-equality state to wed and return. That doesnt take into account rules for certain benets Social Security, taxes and family and medial leave that for the time being extend only to legally married gay couples only if they currently reside in a state that recognizes their union and not to those who apply for them in non-marriage equality states. The Obama administrations insistence that gay couples be married to receive federal benets is creating the policy that some observers say is leading the way toward national marriage equality by encouraging more states to adopt marriage rights for gay couples. Lanae Erickson Hatalsky, a lesbian and director of social policy and politics for the centrist group known as Third Way, said this approach is an organized way to implement he Supreme Courts decision against DOMA, but may also strategically advance marriage equality. In particular, itll demonstrate before the state courts hearing marriage equality litigation that civil unions arent marriage under the law. I think thats pretty smart for state litigation purposes and also for ease of administration, Erickson Hatalsky said.

The more we continue to make kind of a second-class status available at the federal level, the harder its going to be to take that step to what we all know is the goal. So, I think this is a pretty strategic way to kick things in that direction, whereas if you offer essentially a federal domestic partnership or civil unions, it undermines some of those arguments for why we do need marriage. In addition to battling for marriage equality in state courts in New Jersey, New Mexico and Illinois, LGBT advocates are pushing ahead with the legislative route for marriage equality in numerous states. In New Jersey, advocates are seeking to overturn Gov. Chris Christies veto, and in Illinois, theres a push underway to pass same-sex marriage legislation in the State House before the extended legislative session ends on Aug. 30. Lawmakers in Hawaii have also recently also met about passing marriage equality in the Aloha State. Each of these states already has civil unions. Dan Pinello, whos gay and a political scientist at the City University of New York, said the Obama administrations decision to grant benets only to legally married couples provides an incentive for lawmakers in these states to legalize same-sex marriage. The practical political effect of limiting federal benets to legally married same-sex couples will be substantially to increase the pressure on states like Illinois and New Jersey to embrace marriage equality fully, Pinello said. But the prevailing notion among observers is that the Obama administration is extending benets only to married gay couples because the Windsor decision allotted for that change and any push toward national marriage equality as a result of that implementation is incidental. Richard Socarides, a gay New York attorney who was an LGBT adviser for former President Clinton, said he thinks the Obama administration is not intending to advance same-sex marriage or to undermine civil unions through its implementation of the DOMA decision. Probably neither intentionally, Socarides said. Just doing what they think is legally appropriate. CUNYs Pinello similarly said the Obama administration had little room in the way its implementing the decision because the majority opinion made no mention of civil unions. I dont think that the Obama administration has much choice in the matter, because Justice Anthony Kennedys majority opinion in U.S. v.

Windsor explicitly limits the Courts decision to marriages, Pinello said. Civil unions and domestic partnerships arent within the holding of the ruling. Asked whether the administration had intended to advance marriage equality through its implementation of the DOMA ruling, a White House ofcial, speaking on condition on anonymity, said the administration is working to implement the Supreme Courts ruling in compliance with the law. The president has directed the attorney general to work with the Cabinet to review all relevant federal statutes to ensure this decision and its implications for federal benets and obligations are implemented swiftly and smoothly, the ofcial added. Still, the administrations method of enhancing marriage rights for gay couples is a drastic change from President Obamas declaration as a candidate in 2008 that civil unions represent the best way to secure that equal treatment, which he made before evolving in his position to embrace marriage equality last year. And implementing the DOMA decision only for married couples doesnt explain why the Pentagon withdrew domestic partners benets after pledging to implement them in February. Defense Secretary Chuck Hagel said in the memo last week announcing the implementation of the benets that domestic partnership benets are no longer necessary to remedy the inequity that was caused by Section 3 of the Defense of Marriage Act. Meanwhile, at the other end of the spectrum is Chris Christie, whose recent brief in the New Jersey lawsuit seeking marriage equality, known as Garden State Equality v. Dow, contends civil unions within New Jersey should be included among the unions to which the federal government awards benets. The argument is made in a brief arguing that the court shouldnt grant summary judgment in favor of marriage equality in New Jersey. The examples are endless, the brief states. Sufce it to say that a sizable, but indeterminate, number of the over 1,000 benets and responsibilities that were inapplicable to civil union couples because of DOMA are now available to them because they are spouses, husbands, wives, widows or widowers under New Jersey law. Arguably, his attorneys brief is shifting the debate another way by encouraging the expansion of civil unions in its argument that states with civil unions should be rewarded with the federal benets of marriage. Gregory Angelo, executive director

of Log Cabin Republicans, refuted the assertion of his organizations sometime ally Christie, saying says marriage equality is the way to go in New Jersey and would clear up any confusion about awarding federal benets of marriage in the state. Civil unions are not the same as civil marriage, Angelo said. In the wake of the DOMA decision we said that the focus was going to be on the states and thats where were focused. The Obama administrations decision to grant federal marriage benets to gay couples also shows that there are gray areas emerging since the Court overturned Section 3 of DOMA. The best, cleanest, strongest way to ensure benets is through legislative action. Plans are also set for a legislative x to ensure that couples in domestic partnerships and civil unions can receive certain federal benets. Rep. Linda Sanchez (D-Calif.) earlier this month introduced the Social Security Equality Act, which in addition to clarifying that married gay couples nationwide should receive Social Security benets would also ensure they ow to couples in civil unions. Additionally, Rep. Mark Pocan (D-Wis.) is expected to soon reintroduce the Domestic Partnership Benets & Obligations Act and the new version, according to a House aide in his ofce, is slated to provide gay federal employees in civil unions or domestic partnerships, like those in Wisconsin, with the federal benets of marriage. As this discussion is underway, the Human Rights Campaign is arguing that the federal benets of marriage in some circumstances notably Social Security benets should be available to gay couples in civil unions if theyre living in a state that recognizes them as spouses. Michael Cole-Schwartz, an HRC spokesperson, said his organization is pursuing a dual track advocating for marriage equality in all 50 states as it pushes for federal recognition of civil unions for certain benets. Under most federal laws, benets are designed to ow to married couples, which is why civil unions and domestic partnerships have always been insufcient, Cole-Schwartz said. The issue is that marriage needs to be available to couples in every state so that no couple is denied recognition from the federal government. However there are cases where if a state recognizes a member of a civil union as a spouse under state law, federal benets can ow to that person. We are advocating that those benets be available to couples in civil unions and we await further guidance from federal agencies as to their plans for those situations.

Gay attorney named to Md. bench

Mark Scurti, a well-known gay attorney in Baltimores LGBT community, was appointed by Gov. Martin OMalley on Aug. 13 to serve as an associate judge on the District Court for Baltimore City. Three other judges were named by the governor: Kevin M. Wilson, Martin D. Dorsey and Nicole P. Klein. I am pleased to appoint such an accomplished and diverse group of candidates to serve on the Baltimore City District Court, OMalley said in a statement. These appointees will bring to the bench a broad range of legal expertise and a true commitment to public service. Scurti, a partner at Towson law rm Pessin Katz Law P.A. (PK Law), has been appointed to a 10-year term and is expected to begin his new duties in early September. Becoming a judge has been a lifelong dream of mine to serve the citizens of Maryland, Scurti told the Blade. I see a judge as an instrument of justice, someone who is able to hear both sides of a dispute, weigh the facts and law and render an appropriate decision. Scurti has worked at PK Law since 2007, focusing his practice in all aspects of bankruptcy proceedings, debt restructuring and same-sex relationship law. He received his Juris Doctor from the University of Baltimore School of Law. In 2007, Scurti received a Distinguished Alumni Award for his work for OUTLaw, an LGBT advocacy organization at the University of Baltimore School of Law. The award has been renamed the Mark F. Scurti Award for Outstanding Contributions to the LGBT Community. Scurti was also instrumental in arranging the rst same-sex marriage ceremonies at Baltimore City Hall that took place right after midnight on Jan. 1. Va. university launches LGBT-specic clinic


RICHMOND, Va. Virginia Commonwealth University Medical Center this week was set to become the rst in the region to offer an LGBT-specic behavioral health medication management clinic, the school announced this week. Operated by the schools Department of Psychology, the clinic was scheduled to open Tuesday at the Universitys Nelson Clinic and plans to be available the rst and third Tuesday of every month. The idea of a culturally competent psychopharmacology clinic was created in response to the lack of psychiatric services and trained staff supporting the LGBT community in Central Virginia, Isaac Wood, senior associate dean for medical education and student affairs at the School of Medicine and attending physician of the clinic, said in a statement. The clinic seeks to raise awareness of the unique mental health needs of the community and provide culturally sensitive training opportunities for young health care professionals, the school said in its announcement. All new patients will need a referral by a licensed therapist or counselor, the university announced. For more information or a referral, the university says to contact the Department of Psychiatrys intake line at 804-828-2000.

NEW YORK A new study from the journal LGBT Health recommends that patients sexual orientation and gender identity be included in electronic health records so risk factors and prevention measures can be discussed. It pointed to a 2011 report from the Institute of Medicine that found limited health data available on LGBT patients, health disparities prevalent for such patients and decisions by major health care entities such as the Center for Medicare and Medicaid Services and others not to include sexual orientation or gender identity (SOGI) in health records. There is overwhelming community support for the routine collection of SOGI data in clinical settings, as evidenced by comments jointly submitted by 145 leading LGBT and HIV/AIDS organizations in January 2013, the abstract for the study reads. Gathering SOGI data in (electronic health records) is supported by the 2011 (Institute of Medicines) report on LGBT health, Healthy People 2020, the Affordable Care Act and the Joint Commission. Data collection has long been central to the quality assurance process. Preventive health care from providers knowledgeable of their patients SOGI can lead to improved access, quality of care and outcomes. Medical and nursing schools should expand their attention to LGBT health issues so that all clinicians can appropriately care for LGBT patients. Among the health issues that disproportionately affect LGBT patients are prevalence of sexually transmitted infections and HIV (with 66 percent of new cases of HIV in the United States occurring in gay or bisexual men in 2010), and the high rates of behavioral health issues, including suicidal ideation and attempts, often related to stigma, discrimination, bullying and hate crimes, the study said. Lesbians are more likely than straight and bi women to be overweight and obese, increasing their risk for cardiovascular disease, lipid abnormalities, glucose intolerance and morbidity related to inactivity, the study said. Lesbians and bisexual women experience cervical cancer at the same rate as heterosexual women but are much less likely to get routine Pap tests to screen for cervical cancer, the Institute of Medicine report found.

ACT UP says city negligent in PEP/PrEP awareness


NEW YORK ACT UP New York and its allies held a protest last week at the New York City Department of Health and Mental Hygiene sparked by recent funding cuts to the citys PEP program (post-exposure prophylaxis), what they say is a lack of awareness campaigns about the availability of HIV-prevention drugs (both pre- and post-exposure to HIV) and what they contend has been misleading data, the group said in a press release. The group is calling the current rates the second wave of HIV/AIDS or AIDS 2.0. PEP and PrEP are lifesaving drug regimens that can prevent HIV infection, yet few know about their availability, the press release said. The city has chosen not to alert citizens about either drug in hopes of stemming demand, even though knowledge of either drug can save lives. The good intentions of Mayor Bloomberg and his incompetent Health Department have given us a new HIV Emergency that relies on 30-year-old tactics and bad science to hide this disaster, said Jeton Ademaj of ACT UP. New York City spends little to none of its own money on HIV prevention. The (Department of Health) relies on federal funding and chooses to abandon HIV prevention when faced with funding cuts, rather than fund prevention itself. The lives of New Yorkers are worth (the Departments) money, he said in the press release. About 25 participated, according to Towleroad. In an e-mail response to Out, the department said, We stand by the favorable results we have achieved in reducing citywide morbidity and mortality associated with HIV and in the quality of our data. It cited $22.4 million set aside for HIV prevention in its current budget.

Health reform will help curb anti-LGBT bias

to issue regulations under the new law, is seeking information about the extent of discrimination in health care. If you have encountered health care or health insurance discrimination because of being LGBT or living with HIV, you can tell your story directly to OCR by submitting a formal comment online, through Sept. 30, at https://www.federalregister. gov/articles/2013/08/01/2013-18707/ request-for-information-regardingnondiscrimination-in-certain-healthprograms-or-activities. Starting Jan. 1, 2014, health insurers will be required to provide nondiscriminatory coverage, including a package of essential health benets, without regard to HIV status or other health conditions. This is great news for the LGBT community, which has lower levels of health insurance than the general population, and for people living with HIV/AIDS, who have been subjected to systematic discrimination by health insurance companies since the beginning of the epidemic. Starting Oct. 1 of this year, health insurance exchanges in D.C. and in Maryland, and a federally run exchange for Virginia residents, will begin operations. With some exceptions, starting Jan. 1, everyone will be required to carry health insurance. The Affordable Care Act is the most far-reaching reform of our nations health care system in decades. There are particularly exciting implications for the LGBT community and for persons living with HIV/AIDS. The ACAs sweeping prohibition of health care discrimination on the basis of sex promises to give advocates and the federal government a powerful new tool against LGBT discrimination by health insurers and health care providers. And, the new health insurance exchanges will give LGBT individuals and families, and persons living with HIV/AIDS, new access to nondiscriminatory and affordable health insurance that includes coverage of a broad range of essential health benets. A new tool to ght transgender and sexual orientation discrimination in health care, Section 1557 of the ACA prohibits discrimination on the basis of sex, disability, age, race, color or national origin, by a broad range of health insurers and health care providers. The actual scope of the new law will be eshed out in federal regulations and court decisions, but the law clearly covers any doctor, hospital or health clinic that accepts Medicare or Medicaid, and any health insurer operating under the new exchanges. There is a strong argument that the statutes prohibition of sex discrimination includes discrimination against transgender persons, and also discrimination based on sexual orientation. U.S. ambassador to Sweden welcomes LGBT advocates in new era of openness for Foreign Service
By BOB WITECK By good luck, I landed my very rst job after college at the U.S. Department of State nearly four decades ago. The State Department always has been a magnet for any young person excited about world affairs and surrounded by smart, dedicated professionals. While I could not then predict where my career might take me, I knew one thing for sure. The American Foreign Service, at the time, was likely to be a sensitive and risky environment for an openly gay man or woman. In 1974, we were conned by long ago norms and outdated security rules under thenSecretary of State Henry Kissinger that made it virtually impossible to successfully ascend the diplomatic ranks to live and work honestly and openly. Fast forward to the dramatic changes in Foggy Bottom in recent years, and Secretary Hillary Rodham Clintons declaration that gay rights are human rights. American diplomacy today not only reects this refreshing change, but also has improved the lives and the mission of our lesbian, gay, bisexual and transgender foreign service colleagues everywhere including the posting of LGBT senior diplomats and the appointment of outstanding Ambassadors like David Huebner who serves us in New Zealand, and last weeks swearing in of John Berry, now newly married and establishing his new home at our Embassy in Australia. All of these changes, of course, were made possible in part by the courageous work performed since 1992 by the leaders and members of GLIFAA (Gays & Lesbians in Foreign Affairs Agencies). Often with personal risk, GLIFAA gave birth to the Foreign Service trailblazers and allies essential to achieve the potential for LGBT people to serve openly and proudly in their ranks, and to welcome our spouses, partners and families. This month in Stockholm I witnessed these historic changes rst-hand when I was invited by the American Embassy staff to serve as a guest speaker during Swedens Pride season. While our U.S. Foreign Service professionals play many roles in world capitals, some like Embassy Counselor Jeff Anderson engage in public diplomacy that connects American visitors and thought leaders with our counterparts overseas. In the truest spirit of diplomacy, its about learning, listening and nding common values. In addition, it was encouraging to discover that one of GLIFFAs past presidents, Bob Gilchrist, today serves as Charge dAffaires at the Embassy in Stockholm. Jeff opened a new chapter this year for the Embassy by urging greater dialogue with LGBT business and civic leaders that gave me a unique chance to witness how Swedish society embraces openness, recognition and respect for LGBT people in all walks of life. We held a spirited Q&A session with the Embassys youth council, talked with business owners and entrepreneurs, and one morning, at the ambassadors residence, held a rst-ever breakfast conversation with a cross-section of 25 individuals representing LGBT and allied interests including business, government, media, faith, political party leaders and the military. Looking east toward the disturbing, darkening policies today of Russia, much of this conversation touched on several paths to combat Russian bigotry. While we spoke of boycotts, economic pressures and next years Olympics, it was encouraging to listen to Swedish perspectives on the global implications, Russia and beyond, and the long-term strategies it takes to achieve protections and lasting respect for LGBT lives, families and rights on all continents. Tobias Holdstock, deputy political adviser to Stockholms mayor, left us with a haunting observation. He questioned whether the tide of anti-gay bigotry in some parts of the world is a signal of worse things to come, or perhaps a closing chapter of shrill backlash to the advances made by nations like Sweden and the U.S. We also shared ideas about the dynamic intersection of American business with public policy, and how corporations are helping transform U.S. society to be more welcoming and inclusive. Over the past 20 years, I told rst-hand about the pioneering steps that global brands like American Airlines have taken to change policies for their employees as well as customers that inuenced many brands to follow. Outstanding civic leaders like Ulrika Westerlund and Helena Westin, representing RFSL advocates a Swedish group parallel to our Human Rights Campaign led a special panel to talk about LGBT business inclusion and progress globally. In turn, I described the unprecedented milestone this past spring when nearly 300 major U.S. corporations from Amazon, Google and Twitter to Marriott, Orbitz and Xerox told the U.S. Supreme Court that the unfair Defense of Marriage Act must be repealed because of its harm to their businesses and the American economy. What made these discussions especially meaningful and newsworthy for the Swedish was the personal engagement given by our Ambassador to Sweden Mark Brzezinski. Many will recognize his surname, since his father served as National Security Adviser in the Carter White House. We both have Virginia roots and degrees from the University of Virginia, and more important, a deeply shared desire to build bridges among LGBT and non-LGBT allies to advance human rights. At the start of Stockholms monumental Pride celebration in late July, Ambassador Brzezinski took a bold step. He mesmerized Swedish television and newspapers by hoisting the Rainbow ag along with our American ag at his residence. Americans and Swedes alike applauded the signal it sent to other Embassies including the Russians. With this warm gesture, the Stockholm Pride organizers in turn honored Ambassador Brzezinski by selecting him to offer welcoming remarks at this years opening celebration an historic and meaningful occasion for any American diplomat. Ambassador Brzezinski made the most of the moment. In a headline remark quoted by Swedens largest tabloid paper, he declared: Viar anti-antigay or put simply in English, We are anti anti-gay. Nor can we forget, throughout this remarkable experience, the ambassadors personal words of welcome to the Swedish LGBT leaders and activists who joined us as his guests at the residence. He chose three simple words to express what he and President Obama feel about the global movement for LGBT rights by honoring our courage, our dignity and our love.

Memories of marching with King 50 years ago


D.C. was a very different place in segregated 1960s
By PAUL KUNTZLER On Wednesday, Aug. 28, 1963, I participated in Dr. Martin Luther King Jr.s March on Washington for Jobs and Freedom. My partner, Stephen Brent Miller, and I were both 21 and living on Capitol Hill. Stephen had gone to work that morning in the Capitol Building where he was on the staff of House Appropriations Committee. Because of a fear that there might be riots, President John F. Kennedy declared a state of virtual martial law. My ofce near Dupont Circle was closed that day. Washington in 1963 was a different city from what it is today. Racism and segregation were a part of daily life. As difcult as it is now to believe, the staff of the House Appropriations Committee consisted of 22 white males. Further, Stephen was attending the Stenotype Institute of Washington to learn to become a stenotype court reporter. Only whites were permitted to attend the Institute, as was the case with all of Washingtons business schools. After moving to Washington from

Michigan in late December 1961, I landed my rst job in the proong department of Union Trust Company, a downtown bank. I got my job interview through an Arlington employment agency that had an agreement that they would send only white applicants. During my months at Union Trust, I befriended a young woman who had an African-American boyfriend. All of my colleagues expressed their disapproval that her boyfriend was black. In early January 1962, I began classes at the American Institute of Banking in the Dupont Circle neighborhood. My instructor for my rst class was a middleaged white male. After introducing himself, he said the Washington Post was a communist newspaper. He then went on to make a racial joke. In 1963, I was on the board of direc-

tors of the Mattachine Society of Washington, the Districts rst gay-rights group. Frank Kamany was its president. Frank went to the march that day with six others. Had I known, I would have gone with him. That Wednesday morning, I took a D.C. Transit bus to the Washington Monument grounds where civil-rights organizations, church groups and labor unions were gathering. The weather was sunny with the temperature in the 80s. I bought the march button: MARCH ON WASHINGTON FOR JOBS & FREEDOM, August 28, 1963. People came on 2,000 buses, 21 chartered trains and 10 chartered airplanes. I thought that about 25 percent of the marchers were white. Because my father worked for Chrysler Corporation in Detroit and had been

a member of the United Auto Workers, I marched with the UAW down Constitution Avenue to the Lincoln Memorial. That afternoon, I was halfway down on the left-hand side of the Reecting Pool underneath the trees near the World War II temporary buildings where there were soldiers. All three networks televised the program live from the steps of the Lincoln Memorial. Bayard Rustin, who was openly gay, was the march organizer. Among the actors present were Charlton Heston, Harry Belafonte, Marlon Brando, Diahann Carroll, Paul Newman and Sidney Poitier. Peter, Paul and Mary sang, If I had a Hammer and opera great Marian Anderson performed, Hes Got the Whole World in His Hands. Gospel legend Mahalia Jackson sang, Ive Been Buked and Ive Been Scorned. The most emotional moment for me was when people joined their hands together and swayed singing, We Shall Overcome. Then Rev. King delivered his great I Have a Dream speech. King linked his language to Lincolns language in the Gettysburg Address. King dreamed about his children being judged based on character, not on color. He dreamed of the day when the offspring of slaves and the offspring of their owners might enjoy each others company. The march was the largest gathering in Washington since General Ulysses S. Grant marched with his armies after the Civil War. The media consensus then was that 210,000 had participated. Many had come from communities around the country. They went back to those communities with an inspired message that helped to bring about change in their hometowns. President Kennedy welcomed the march leaders to the White House late that afternoon. JFK was relieved that the march was a success. When he greeted them, Kennedy said, I have a dream.

What has marriage equality wrought?


Finding humor in the unexpected consequences of gay nuptials
and quiet of your own home when you got tired of them. Im thinking the situations coming out of all this would make a great Broadway play. Something titled, Now Were Just Like You, Oyveh! it could be a musical. Gone are the days when being selsh about time and space were not something to feel bad about. The times you could kick that trick out anytime you liked. The days you told your trick you had a 6 a.m. ight, even though the airport didnt open till seven, so they werent upset when you asked them to leave early because you needed your beauty sleep. Remember when being gay meant we didnt have to deal with parents asking when we were nally going to get married and give them grandkids. Today with marriage equality victories, Jewish mothers have started calling their gay sons with the same questions they used to only ask their daughters. Recently a friend told me he was going to break up with his boyfriend unless the guy was willing to make a commitment. I asked what commitment? Do you want a promise of monogamy? He said no he wanted a ring on his nger and if the prick didnt offer marriage soon he would break up with him. I thought, Wow, the world is upside down. Straight couples are putting off marriage for years and the LGBT community is rushing into it with the young often not having any real idea of the possible consequences. With so many law school graduates out of work, marriage equality could offer a new and lucrative practice area a whole new set of couples looking to get pre- and postnups. Then will come the divorces, which could be really interesting with ghts not only over the kids but so much more. Just imagine the scene in the lawyers ofce. The couple is sitting on opposite sides of the table ghting over visitation rights and who will pay the debts incurred during the marriage. I am not paying for any of those Jimmy Choos you charged. The female legal assistant in the room says, I didnt think Jimmy Choo made shoes for men. To which the couple jointly responds, He doesnt. Some straight comics used to joke about marriage equality saying, We support marriage equality because you should all suffer just like we do and the LGBT community laughed. Today some are nding that a little less funny. We have situations where couples got married in states that legalized gay marriage but now live in a state in which their marriage isnt recognized. That makes divorce more difcult and some just give up and live their lives as single again. That can lead to its own strange situations. Mom calls and says, Honey is your husband coming to Thanksgiving dinner with you? No mom, we arent living together anymore but I am bringing Barry. Whos Barry? Oh hes the guy I am living with here in Virginia. My husband is living in Ohio with Brad and hes bringing him home to meet his mother. There are days when it seems half my gay friends are rushing to the altar judging by their announced relationship changes on Facebook. Pictures of their kids are now competing on Facebook with those of their animals and that sandwich they had for lunch while my straight friends are living as some mothers would say, in sin. Im still ghting for marriage equality as a universal right but we really need to keep our sense of humor over some of the consequences.

When you could be uncle or auntie to your siblings or friends kids, spoil them rotten, then return to the peace

Graham fails homeless with outdated approach


Mayors new strategies are producing results, beneting those in need
more than 70 percent of D.C. voters in 1984. Passage of the D.C. Right to Overnight Shelter Act was the rst time U.S. voters created a legal right to shelter. During my involvement I simultaneously managed two independently operated city-nanced shelters in abandoned school buildings an experience that taught me much about the limited capacities of government. Public monies and empty properties were the useful resources, with service delivery the embarrassing deciency. To this day, the countrys most successful programs are government partnerships with the private sector, volunteers and faith communities. Government inability to think and act as a business enterprise and measure performance and results rather than program size and dollars allocated is the greatest failure of bureaucrats. That is a lesson not yet learned by D.C. elected ofcials. Many local leaders are content to keep doing the same thing over and over, regardless of whether it works or merely illustrates a failure of approach. The politicians reex is to spend more money, without concern for common sense or critical evaluation. When it comes to the homeless, no one represents this shortsightedness more than D.C. Council member and Human Services Committee chair Jim Graham. As demonstrated by public hearings Graham held on the issue this year, he has proven less interested in xing whats wrong than simply wrenching more money for program budgets. Grahams approach is nothing more than old-fashioned posturing employing outdated politics of the past. Worse, he combines a lack of disciplined oversight with a disinterest in solutions from other jurisdictions, placing the District in bottom-of-the-barrel disrepute. The result? Serving fewer people at greater cost and over budget by millions. All while leaving recipients stuck in a cycle of perpetual reliance. Fortunately for the homeless and other taxpayers, an initiative by D.C. Mayor Vincent Gray is starting to show results. Patterned on the success of similar programs elsewhere, Rapid Re-Housing offers an immediate response for families entering shelters or on the brink of homelessness. Its an effort to break with current failures while curtailing a culture of dependency. Grays action-oriented get-tough strategy, coupled with nally beginning to comply with federal welfare reform measures instituted 20 years ago, have met opposition from Graham. These new policies, however, have proven successful in moving homeless families into private market apartments utilizing short-term subsidies and supportive case management. The result? Three-quarters of families succeed, not returning to shelters, at less than one-third the astounding shelter cost of $50,000 per family per year. Emergency housing becomes available to others when not occupied long-term and more are served with limited available funding, producing broader benets. Housing in D.C. has become extraordinarily expensive and low-income housing is increasingly scarce. The number of homeless families has more than doubled in the past ve years, affordable housing has decreased by half during a decade and there are no simple solutions. But a city cant wait to solve poverty to reduce homelessness. Mayor Gray is re-focusing transitional shelter and encouraging self-sufciency. Coupled with affordable housing investments over the next 10 years, Gray offers a more forward-moving approach than the status quo Graham seems to prefer. Posing as defender of the poor while becoming a barrier to better outcomes is no longer supported by a public interested more in progress than pathos.

When I headed to D.C. three decades ago, it was to join a small group of activists responding to the needs of what was an ignored and largely invisible group the homeless. We opened overnight shelters, feeding and housing nearly 1,000 people and reducing the number of dead bodies discovered on wintry city sidewalks. We addressed an unmet need and forced the issue onto both local and national agendas. At the time the District made little effort to shelter the more than 10,000 locals traversing life on the street. Later would come a ballot initiative approved by

Honoring the work of Bayard Rustin


King condante was key march organizer and openly gay
of the March on Washington for Jobs and Freedom this week, there should be a fulledged chapter on a certain trailblazer instead of the asterisk one usually sees, assuming there is even a mention of the man. Bayard Rustin is probably the most important civil rights leader youve never heard of. Rustin was one of the lead organizers of the March on Washington that is synonymous with Dr. Martin Luther Kings I Have a Dream speech. Rustin was a condante and adviser to King, and one of the chief organizers of the 1963 March on Washington. But you wouldnt know that by looking through the history books. Nor would you know that as Kings special assistant, Rustin would raise money for and organize many of the vital meetings that were had with King and other colleagues in the weeks and months leading up to the March. Even though Rustin would go on to be on the cover of Life magazine, he was only known to a tiny fringe of America. You see, Rustin was a gay black man. Ten years prior, in 1953, Rustin was arrested on a morals charge having sex in a parked car with two men. Many of the civil rights activists involved in the 1963 march objected to his participation. As a way to attempt to tarnish the March, South Carolina Sen. Strom Thurmond even sought to disgrace Rustin from the Senate oor. Thurmond derided Rustin for being a communist (true), a draft dodger (also true, though Rustin called himself a conscientious objector) and a homosexual. Although I vehemently disagree with most of Rustins political positions and philosophies, the ght for equality knows no ideology. This is why it is nice to see that Rustin will be posthumously awarded the Presidential Medal of Freedom, our nations highest civilian honor by President Obama. And it was especially pleasing to hear Congressman John Lewis, the last living speaker from the March on Washington, mention Rustin last month at the commemorative celebration in Statuary Hall at the Capitol. Ten years ago, a documentary of Rustin was made, titled, Brother Outsider: The Life of Bayard Rustin. This lm should be required viewing for everyone in the community, right along with Before Stonewall

Thousands expected for Gay Softball World Series


By WILL OWEN The annual Gay Softball World Series, organized by the North American Amateur Athletic Association, is returning to D.C. after 10 years and is expected to be the biggest tournament the organization has ever hosted. The opening ceremonies begin Monday with

the tournament to be held Tuesday through Saturday. We have over 156 teams conrmed and it will be the largest World Series ever, says Wayne Williams, co-director of this years tournament. Weve had tremendous support from the LGBT community and the city itself. The citys been our partner from the beginning. Gay softball teams from all over the U.S. and Canada participate in the Associations Gay Softball World Series each year. The games are free to attend and this years expected turnout is between 3,500-4,000 spectators

and participants. The Association is technically a co-ed organization, but the majority of its teams are all male. Teams compete in ve different divisions, including A, B, C, D and Masters, which is reserved for players 50 and older. Many local Association leagues have tournaments to decide which teams will go to the World Series and which division they will compete in. The age range varies. You have to be 18 and over to play, and there is no upper age limit, Williams

Whos your LGBT hero? The Stonewall drag queens. Whats Washingtons best nightspot, past or present? This is very difcult for me to answer. From 1972 to 1985 and briey in the 90s, I worked for the company that owned and ran the Lost and Found and The Pier. They were both fabulous in their day and in their own way. Describe your dream wedding. Ive never thought that I would have one. Although now, it would be the beach in Ptown with Angel. What non-LGBT issue are you most passionate about? Immigration reform. Troubled ballet legend honored in biographical show


By PATRICK FOLLIARD Powerful, brilliant and gay, Russian impresario Sergei Diaghilev famously started the Ballets Russes in Paris in 1909, smartly bringing together the best artists, composers, choreographers, dancers and fashion designers to create the most revolutionary dance company of its era. The unstoppable Diaghilev is equally well known for fostering the career of his much younger lover, the legendary Nijinsky (1889-1950). Roundly considered the 20th centurys greatest male ballet dancer, Vaslav Nijinsky is remembered for dancing and choreographing daring new sexually charged works like Afternoon of a Faun, Jeux and Rite of Spring. Without Diaghilevs support, it wouldnt have happened. Diaghilev and the Ballets Russes, 19091929: When Art Danced with Music, an exhibition currently at the National Gallery of Art (through Oct. 6) explores the man and his achievement. CulturalDC is joining the fun in presenting the Slovenia-based Mladinsko Theatres production of local playwright Norman Allens oneman play Nijinskys Last Dance at Flashpoint, D.C.s downtown arts space. When I began to see pictures of Nijinsky (advertising the National Gallery show) on the sides of buses running up and down 16th Street, I knew that I wanted to be a part of this, says Allen, who is gay. So he approached both the National Gallery and CulturalDC (part of whose mission is to match spaces for performances) and told them about this Slovenian production of his play. Third time no charm at least so far for Top Chef visionary


By JONATHAN HOWARD When I interviewed Top Chef nalist Mike Isabella for the opening of Bandolero (3241 M Street) in Georgetown, he said there were three key components to a perfect night out a welcome feel, cocktail in hand and delicious food at the ready. So, when Isabella announced the opening of Kapnos and G (2201 14th Street N.W.), I was excited to see how these key components would come to life at this location when it opened on July 5. Isabella and co-owners George and Nick Pagonis drew inspiration from Northern Greece when they created the menu of small plates, spreads, breads and vegetables. There are two woodred grills with rotating spits as well as a large oven for stone-baked at breads. Guests are even able to enjoy carvings from entire animals that have been spit roasted all day. The main idea behind Kapnos (which means smoke in Greek) is to modernize an ancient cuisine and bring this new twist to the diners of Washington. With all the chatter and the big names involved in this project, as well as the fact that I didnt dine there until a few weeks after opening, I was expecting a very strong meal. When I strolled up to the hostess stand, I felt like I was disturbing the women who were standing there. They completely ignored me and then eventually, without even making eye contact, told me to hold on. So much for the welcome feel. We were seated, but our waiter treated us as if we were getting in the way of his evening, so we quickly ordered some wine and several dishes off the menu and watched him scurry away. Overall, the service was cold, disinterested and unwelcoming. The night was not off to a good start, but

I was still holding out hope for the food. There were numerous items on the menu that caught our eyes and we were excited for all of them. However, as tends to be the issue with small plates and the roving kitchen concepts in D.C., we received our salad at the end of the meal and our substantial proteins early on. The tzatziki and the whole bronzino with preserved lemon, tomato, kale and capers were our two favorite plates served, with several dishes being nothing more than mediocre. The spiced baby goat was one of the spit-roasted items I was most looking forward to, but when I took my rst bite, I thought I had put chewing gum that had spent the day next to the campre in my mouth. Thank goodness the Greek Skouras Agiorchitiko red wine we ordered was so delicious and full bodied or I may have spit out the goat entirely. Grafato and Bandolero are winners for Isabella but in my mind Kapnos falls short of the high standard he has set for himself. The service was poor and the food served that night was weak. Hopefully, these major kinks are worked out over the next few months. There is still another aspect to the space at 2201 14th Street, and that is G, a sandwich shop for lunch and an extension of Grafatto in the evenings. The tempting sandwiches include Italian classics like the chicken parm and the meatball sub, healthy options like the roasted cauliower sub, and pressed sandwiches like the Cubano panini. It was hard for me to decide between the parm and the cubano, but the chicken won out in the end. With Isabella having roots in New Jersey, I was hoping for the perfect chicken parm sub. While it wasnt quite what I remembered from my childhood, it was a tasty twist on the classic chicken parm with crisp, toasted bread, tender chicken smothered in red sauce and covered in melted cheese.

Gay gardeners celebrate lives spent growing their own food

Its 10 minutes to lunchtime and your stomach is smarter than you are. You want to nish the project in front of you, but your stomach has other ideas. It snarls and aches and reminds you that breakfast was hours ago. At that point, you know you might as well give in, no matter what kind of work is on your plate. You wont get anything done anyhow. But where will that next meal come from? In the new book To Eat by Joe Eck and Wayne Winterrowd, youll read a tribute to gardening and to knowing whats really on your plate. In early 1970, Eck and partner Winterrowd, moved from Boston to Pepperell, Mass., and into a 211-yearold farmhouse surrounded by wooded land and a vegetable garden. Theyd always wanted to be country gentlemen and they could not have been more lucky than to start in that house. There, they learned and they ate. They discovered gardening tricks, and they ate. They delighted in experimenting with crops, and they ate. Eating, they say, has always been central. After a glorious year in Copenhagen (where chickens happily scrabbled on parquet oors and gardening was sorely missed), the men moved on to Boston and a Victory Garden near the Fenway. In 1974, they moved onto 28 acres of weeds

and woods in South Vermont. They named their estate North Hill and set about making gardens, arbors and meals. They planted four different kinds of apple trees, each near sticks when put in the ground. Those trees yield snacks and eventually pies and sauce. Their spinach crop is good, but not as good as they had in Pepperell; then again, spinach is tricky. Beets were used for salads and sides; carrots were found wild and cultivated; roadside weeds became delicious meals; and while they once grew unusual kinds of potatoes, they gladly saw their favorites become national staples. They raised pigs (Showering with a pig is not a common experience), beef and chickens; and delighted in Brussels sprouts in winter, rhubarb in spring, lettuce all summer long and onions in the fall. No matter how excellent the produce of your best local supermarket may be, they say, there is something deeply rewarding to growing your own food. Partly a love letter to the earth and partly a paean to good eating, To Eat is one of those delicious little books that, like a great meal, youll want to savor. With the circumspection of veteran gardeners, New England authors Joe Eck and the late Wayne Winterrowd share their observations about growing plants, livestock and their relationship. I took great delight in their quietly humorous stories of being gentlemen farmers; if youre a gardener, youll nd solid tips in each quick-to-read chapter and if youre a gourmand, youll drool at the recipes here, too. Student-Athlete Scholarship Fund, the Ben Cohen StandUp Foundation (anti-bullying) and PETS-Washington, D.C. (provides care for pets owned by those living with HIV/ AIDS). The Association is a registered non-prot with a charitable mission. Softball is an opportunity for players to come together as a group and organize activities in that regard, to represent the best of gay softball, Williams says. I absolutely love the gay softball community, says Tony Mase, shortstop for Washington-based team Capital Punishment. Theres just something about the camaraderie among the teams that play in the league that you dont get playing in other leagues outside of that community. For instance, our teams play in a straight league on Friday nights, and its not that bad to play in it, but its just not as fun and outgoing as it is in the LGBT league. This years World Series will demonstrate the cohesion among D.C.s gay softball community. Six D.C. teams are competing, which is more than ever before. Ed Vincent, the coach of the Logan Tavern team and co-director for the tournament, describes the World Series as important. [The Association] provides this opportunity as kind of a safe haven for the LGBT community to play in an organized league setting, Vincent says. Its really important that the players feel comfortable and secure to play in a league where they can compete at all levels, whether its the A division thats the best or the B division thats more recreational. The tournament really allows the softball players to be role models for LGBT youth and other LGBT people out there. Theres a way to get involved and a way to form an association and a network of friends. Its almost like a family, Williams says. A lot of these people really know each other. This site, which also is available as a mobile app, allows you to collect, organize and share visual bookmarks of all the things that interest you. You can browse categories such as home decor, architecture and gardening, then pin the images you like to your very own pinboard. You can also browse and follow the boards of other pinners who have similar interests. Beyond Pretty Pictures. If you want more than just pretty pictures, look no further than Houzz, the leading online platform for home remodeling and design. Houzz was launched in 2009 by Adi Tatarko and Alon Cohen, a couple that purchased a 1950s home to renovate but found it difcult to communicate their vision and ideas to an architect. Embracing their tech-savvy, Silicon from design-build rms, to landscape architects, to lighting specialists. Another cool feature is the discussion section, which enables you to post any design dilemmas you may be encountering, and receive feedback and suggestions from other Houzz users. But dont worry, if youre feeling overwhelmed, you can lter by room, style and geographic location.
