JOINT COUNTER-AFFIDAVIT
WE, MELODY BACARON y SINGSON of legal age, Filipino, and BARTELD SIMON EENKHOORN, also of legal age, citizen of Netherlands, all residents of Brgy. Cansilayan, Municipality of Murcia, Negros Occidental, Philippines, after having sworn to in accordance with law, hereby depose and say:
1. That we are the Respondents in Criminal Complaint, with NPS

DOCKET No. VI-14-INQ-13H-00153, pending for Preliminary Investigation, for the offense of ALLEGED violation of RA. 9208 as Amended by R.A. 10364 (Qualified Trafficking in Persons);
2. That the accusation against us will be the last thing that we will do in

our lifetime because we are both God-fearing and believes that the only way to prove of our love for God is to show love to our neighbour. We are not bad people as what we are indiscriminately projected of us by the local newspaper, TV and broadcast media. We did not, we do not and will never commit such unspeakable activity of human exploitation for whatever motivation because it runs counter to our religious belief in the first place;
3. WE VEHEMENTLY DENY THE ACCUSATION AGAINST US

BY THE COMPLAINANT IN THIS CASE, PSINP. NORBERTO BARNISA, CHIEF OF POLICE OF THE MUNICIPALITY OF MURCIA, NEGROS OCCIDENTAL. IT WAS A RESULT OF FABRICATED, TWISTED AND CORRUPTED INFORMATION COMING FROM THE WITNESSES WHO HARBORED RESENTMENT AND HATRED ON US. WE BELIEVE THAT THE COMPLAINANT, ENFORCEMENT AUTHORITIES AND EVEN LOCAL OFFICIALS OF THE MUNICIPALITY OF MURCIA WERE JUST MISLED AND MADE TO BELIEVE ALL THE LIES AGAINST US, the truth of the matter are the following:
a) We met each other through an online dating site sometime in

November 2009 known as asianbeauties.com. We became online friends for quite a while and the rest became history so that in 2010, Barteld decided to come to the Philippines to see me in person;
b) Since the first meeting we started to live together in a rented house

in Brgy. Villamonte, Bacolod City. In 2012, we moved to Brgy. Eroreco, Bacolod City;

c) In preparation to our married life we engaged in several business

ventures such as sugarcane and rice farming in leased farms and piggery, all located in Murcia, Negros Occidental;
d) Among the women named in this case, CORNELIA PATRIA was the

first to work for our household. She started in January 2013 while we were yet in Brgy. Eroreco, Bacolod City. She became our errand and assistant especially for Barteld who was having some medications due to old age and health complications;
e) In February 2013, the mother of Jonalu Gumban, (main witness) by

the name Ma. Luisa Gumban, went to our rented house in Brgy. Eroreco (we were just neighbors there) and pleaded if I could accommodate her daughter, Jonalu Gumban, a work in our house. Having grown up family that struggled in life, I have developed this compassion to people like Jonalu that I accepted her to my household. Her mother told me that she was having a hard time with Jonalu because she had failing grades, does not attend classes and refuses to be controlled and disciplined. In short, Jonalu had a very persistent wayward and rebellious character;
f)

In the same month (February 2013), it was Jonalus debut. Because her mother could not provide and feeling so sorry for her important day, we threw her a little debut party in the house. She cannot deny this; for Barteld, and one (1) another desktop computer which is placed in the living area for common use. We had also an unlimited internet connection in the house;

g) Back in Brgy. Eroreco, we had two (2) laptops, one for me and one

h) Cornelia Patria, having been separated from her husband for nine (9)

years asked me one day to teach her how to chat using the internet as she was also dreaming of having a foreigner boyfriend. So I taught her about the asian.beauties.com and some other dating sites and helped her go through with the registration because it was necessary for a member before one can connect with the male chatters. I allowed Cornelia to use the internet only after dinner because she was also taking care of other things during daytime. Gradually, Cornelia started to enjoy her new enchantment and got accustomed to the ins and outs of online dating;

When Jonalu Gumban joined our household in Eroreco, being an internet literate (which is very common to young nowadays), she did also join the online dating sites Cornelia was using. Of course she would use all the common websites such as Facebook, Yahoomail, Youtube and the likes. Not so long that Jonalu would spend more time in front of the computer than her work in the house. Several times I have reprimanded her about it; Knowing the importance of education, I urged Jonalu Gumban to continue her secondary education (Jonalu would never deny this).

However, because of her deplorable school records, no secondary school nearby Eroreco would admit her. Cornelia Patria could attest to this fact because she was the one whom I requested to accompany Jonalu the whole time in facilitating her re-admission to school;
k) IT

WAS NOT TRUE THAT I EXPOSED HER TO EXPLOITATION USING THE INTERNET. I NEVER ORDERED NOR COERCED THEM TO GO ONLINE. IT WAS THEIR VOLUNTARY ACT TO ENJOY THE WORLD OF ONLINE DATING. I CAN ATTEST THOUGH IT WAS ADDICTING AND SOMETIMES, ONE MOVE CAN LEAD TO ANOTHER THAT BEFORE YOU KNEW IT, YOU STARTED TO EXCHANGE INTIMACIES WITH WHOEVER YOUR CONSTANT CHATMATE WOULD BE; WHEN THEY WOULD START TO CHAT DURING NIGHTIME BARTELD AND I WOULD ALREADY BE INSIDE OUR ROOM TO REST. WE HAVE NO IDEA WHATSOEVER OF THEIR DETAILED ACTIVITIES IN THE INTERNET; Cornelia Patria reported to me that one evening, while they were chatting, Jonalu Gumban suddenly stripped off her clothes in front of the computer camera and went on by showing her private parts to her chatmate. I got so angry when I learned about it the next day that I berated her almost the entire day for the said act. Naturally she got so offended and mad. Jonalu left the house but returned several days. She would always to this whenever she gets mad;

m) But one time, while we were yet in Brgy. Eroreco, Bacolod City,

n) Later, we got so busy attending our leased small farms in Brgy.

Cansilayan, Murcia, so that we started to look for another househelper because Barteld was an old man and could not physically assist me with the day to day work. I have a son in my first marriage by the name Harry who was also in his high school making it a little difficult for us;
o) Jonalu Gumban introduced to us her friend by the name REBECCA

NACION. We never knew she was a minor because she pretended she was of legal age and did not look like one. In May 2013, Rebecca started to work in our house in Eroreco. And just like the same, together with Cornelia and Jonalu, they started to share with each other their common interest online dating;
p) We must admit that we were knowledgeable about their online

dating activity. I (Melody) supported them with it because I was thinking they might also find the elusive opportunity in life through it, just like my experience. BUT CONTRARY TO THE FABRICATED STATEMENTS AGAINST US, I NOR BARTELD, OR BOTH OF US CONSPIRED TO HIRE, HARBORE, MAINTAIN OR IN WHATEVER MANNER RECEIVED THE MENTIONED WOMEN FOR THE END PURPOSE OF

PROSTITUTION, PORNOGRAPHY, SEXUAL EXPLOITATION, FORCED LABOR, SLAVERY, INVOLUNTARY SERVITUDE OR DEBT. WE DENY THAT WE TOOK ADVANTAGE AND EXPLOITED THEIR VULNERABILITY;
q) In June 2013, we moved to a newly rented house in Brgy.

Cansilayan, Murcia, Negros Occidental, not for any other purpose, but solely on account that Barteld liked the fresh air and farm atmosphere there, away from the busy life and roads of Bacolod City. Besides, the small farms we were leasing were situated near the said barangay making it convenient for me to attend to it. We brought along with us Cornelia Patria, Jonalu Gumban, Rebecca Nacion including my minor son Harry, and the 10-year old daughter of Cornelia, Diane;
r) Because the house was strategically located near the national road

and immediately fronting the Cansilayan Elem. School, we decided to put up an internet business and all other deskstop services such as, typing jobs, photocopy, research, and printing of documents. So we bought additional second hand deskstop computers, a printer-copier in one and subscribed to an internet provider. In fact we already started to process our application for business permit;
s) THE SAID INTERNET STATION WAS PLACED IN OUR

GARAGE, IMMEDIATELY FRONTING THE ROAD. HAD WE INTENDED THE SAID INTERNET STATION FOR THE PURPOSE OF COMMITTING OR FACILITATING ACTS OF TRAFFICKING IN PERSONS OR OTHER ILLEGAL ACTIVITIES, WE COULD HAVE SAFELY PLACED IT INSIDE THE HOUSE OR IN ANY ROOM OF THE HOUSE WHERE WE CAN CONTAIN AND LIMIT THE PEOPLE ENTERING THERETO OR ISOLATE IT FROM THE PRYING PUBLIC AND AUTHORITIES EYES. Please the attached photos of the said garage, ANNEXES A, A-1 & A2;
t) At the opening of classes this June 2013, my (Melody Bacaron)

mind was still fixed on Jonalus education so I enrolled her at the Cansilayan National High School located in the same barangay which I was so happy because she was admitted enrolment thereon. I bought her personal needs, including her school uniform and supplies. I treated her with great concern hoping that with my humble efforts, I could be of help of transforming her;
u) Seizing also the opportunity, Cornelia asked me to allow her to run a

little carenderia in the same garage for her additional income which I sully supported. Later, she asked me to help her establish a bigger carenderia with videoke of her own because she told me that she was already feeling so shame of my unconditional help on her and her daughter. Because of this, we hired ARLENE

BILLONES, a resident of the said barangay to be our cook and helper in the house to fill in the work when Cornelia leaves;
v) Their usual activities after dinner, which was browsing, video

streaming, chatting and online dating, continued at the Brgy. Cansilayan, Murcia rented house. Barteld being of old age would normally go to bed at around 10:00 oclock in the evening. I would usually join him going to bed and would wake-up late the next day, between 9:00 to 10:00 oclock. PRACTICALLY, EXCEPT FOR THE ONLINE DATING, I AND BARTELD HAD NO KNOWLEDGE ABOUT THEIR OTHER ACTIVITIES ON THE INTERNET AT NIGHT UNTIL THE NEXT MORNING, BECAUSE WE DEEMED IT INAPPROPRIATE TO PRY ON THEIR PRIVATE MOMENT WITH THEIR CHATMATES. EXCEPT THAT I ADVISED THEM TO BEHAVE PROPERLY ONLINE SO THAT THEY COULD ATTRACT HONEST AND SINCERE CHATMATES;
w) The attitude of Jonalu Gumban had shifted from bad to worse in

Cansilayan, Murcia because she gained lots of friends there and who looked up on her because she was accustomed to city life. Many times I confronted her about her rebellious ways, ranging from poor performance in school, not attending classes (as reported to me by her classmates), to going out at nightime with her local friends without telling us where she was going. Most often than not, she would come home late or worse, early in the morning the next day. This is explains why she would always be sleepy, worn out and tired when she enters her classes as what her teachers commented;
x) In the middle of July 2013, I finally got fed up of her pernicious

ways and did not want to get all the blame from her mother should anything happen to her. So I decided to return her back personally to her mother in Bacolod City. I also did the same to Rebecca Nacion because she also started to follow the steps of Jonalu, besides, they were close buddies in the house that she was convinced by Jonalu to leave the house as well;
y) Several days after I returned the two to their parents, Arlene Billones

told me that Rebecca kept on texting and calling her and was pleading that she returns to the house because she had nothing to do in her parents house and they were starving. I got pity on Rebecca because I knew she was just influenced by Jonalu, so I decided to bring her back to our house;
z) Two (2) days after the return of Rebecca,

surprisingly Jonalu showed up, and this time, she was convincing Rebecca to leave us for good because somebody will help them in their studies and other needs. In short, Rebecca Nacion finally left the house for good. It was more or less a week before the raid of our house;

aa) Having few hands in the house, and with the coming opening of

Cornelias carenderia-videoke house nearby, I and Cornelia agreed to hire helpers to assist her run the carenderia-videoke house. In the previous past, back in Eroreco, a certain CHE-ANN, who was referred also by Jonalu worked for us and she referred us three (3) interested women to work as carenderia-videoke assistants. This purpose of their hiring was even affirmed by JEAN ANCERO y Dilag, JANET ATIENZA y Miranda and ANA ROSE PLANA y Basena, in their sworn statements, dated August 7, 2013, subscribed before Assist. Provincial Prosecutor Ma. Consolacion Bascug; Please see ANNEX B, which is the affidavit of Felicito Makila y Ciocon, the owner of the place to be rented by Cornelia Patria for her carenderia-videoke business;
ab) On the set date, August 5, 2013, it was true that Barteld and I fetched

JEAN ANCERO, JANET ATIENZA & ANA ROSE PLANA somewhere in the SM Hypermart in Cadiz City, Negros Occidental. Barteld loves so much the long drive that he did not hesitate to go for a long drive to Cadiz City;
ac) It was true that I told them that they are free to use the internet in my

house at nightime, NOT FOR THE PURPOSE OF EXPOSING OR EXPLOITING THEM AS WHAT THE COMPLAINANT WOULD LIKE IT TO APPEAR, BUT BASICALLY AS A KIND-HEARTED PERSON WHO WAS AWARE THAT THEIR WORK LATER IN THE CARENDERIA-VIDEOKE BUSINESS WILL BECOME ROUTINARY AND WOULD CAUSE THEM TO LEAVE THEIR WORK TO THE EFFECT THAT IT WOULD HAMPER THE OPERATION OF THE BUSINESS AFTERALL THE INTERNET CONNECTION AT HOME WAS UNLIMITED;
ad) IN THE MEANTIME THAT THE CARENDERIA HAS NOT

OPERATED YET, SO AS NOT TO MISS HOME, I TOLD THEM THAT THEY WOULD BE FREE TO USE THE INTERNET AS LONG AS THERE WILL BE NO MORE CUSTOMERS USING THE SAME;
ae) During the inquest proceedings in August 7, 2013 at the

Provincial Prosecutors Office, Bacolod City, IT WAS INSISTED IN NO UNCERTAIN TERMS BY THE THREE WOMEN, JEAN ANCERO, JANET ATIENZA & ANA ROSE PLANA THAT IT WAS THEIR VOLUNTARY ACT TO USE THE INTERNET IN MY HOUSE AND CHAT WITH FOREIGNERS BECAUSE IT WAS FREE; THAT NO ONE EVER FORCED OR COERCED THEM TO DO SO; THAT THE MAKE UP KITS WERE THEIRS AND I WAS NOT THE ONE WHO PROVIDED IT FOR THEM;

af) WE STRONGLY DENY THAT WE HIRED, RECRUITED,

TRANSPORTED, TRANSFERRED, HARBORED, PROVIDED, OR RECEIVED THEM FOR THE PURPOSE OF PROSTITUTION, PORNOGRAPHY, SEXUAL EXPLOITATION, FORCED LABOR, SLAVERY, INVOLUNTARY SERVITUDE OR DEBT;
ag) IT WAS NOT TRUE BASED IN THEIR ALLEGATION THAT

I AND BARTELD TOLD THEM TO DRESS SEXY AND ENTERTAIN FOREIGN CLIENTS OVER THE INTERNET. THE TRUTH IS SINCE WE WERE ALL HAVING FUN WITH ONLINE DATING IN THE HOUSE I ADVISED THESE LADIES THAT THEY SHOULD LOOK AND DRESS UP NICELY WHEN CHATTING AS THEY WERE OBVIOUSLY LOOKING SO UNTIDY- BUT DEFINITELY NOT TO DRESS SEXY;
ah) IT WAS ALSO A PURELY FABRICATED STORY

THAT I WAS THERE BESIDE THEM WHILE THEY WERE CHATTING AND WAS ORDERING THEM WHAT TO DO; TREATED THEM LIKE ANIMALS BECAUSE WE TREATED THEM LIKE A MEMBER OF THE FAMILY. THEY EAT WHAT WE ATE, AND WE WOULD NORMALLY EAT TOGETHER IN THE SAME TABLE. THE TRUTH IS, THERE WERE TIMES WHEN JONALU AND REBECCA WOULD EVEN CONSUME THE FOOD RESERVED FOR BARTELD BUT WE DID NOT MIND IT. ARLENE BILLONES COULD ATTEST TO THIS;

ai) IT WAS ALSO A TOTAL LIE FOR THEM TO SAY THAT WE

aj) IT WAS ALSO NOT TRUE THAT WE PREVENTED JONALU

TO LEAVE THE HOUSE FOR PURPOSES OF DETAINING HER. THE TRUTH IS, WE DEEMED IT APPROPRIATE TO RESTRICT HER MOVEMENT DURING NIGHTIME, BECAUSE SHE WOULD FREQUENTLY GO AROUND THE VILLAGE AT NIGHTIME WITH HER FRIENDS. IT WAS ALL FOR HER SAFETY; IF I INDEED PREVENTED JONALU FROM GOING OUT OF THE HOUSE, HOW COULD SHE BE THEN CONTINUING TO ATTEND HER CLASSES DURING SCHOOL DAYS?
ak) THE ALLEGATION ALSO THAT WE REQUIRED THEM TO

GO ONLINE FROM 11:00 IN THE EVENING UNTIL 5:00 OCLOCK THE NEXT MORNING FROM MONDAY TO FRIDAY, AND ON WEEKENDS UNTIL 8:00 OCLOCK IN THE MORNING WAS EXTREMELY OUTRAGEOUS AND UNBELIEVABLE. WE ARE ALL AWARE THAT NO PERSON COULD LAST FOR A WEEK EXPOSING IN THE SAID PATTERN ESPECIALLY SO THAT JONALU HAD TO ATTEND CLASSES BETWEEN MONDAY TO FRIDAY;

al) AS TO BARTELD, HE WAS AS INNOCENT AS I AM OF THE

CHARGES FILED AGAINST US. HE EVEN SELDOM SPEAKS TO ANY OF THESE WOMEN, INCLUDING CORNELIA AND ARLENE DURING THEIR STAY IN THE HOUSE. MOST OF THE TIME, HE STAYS IN THE ROOM AND WOULD RELAX AT THE UPPER TERRACE;
am) JONALU

GUMBAN AND REBECCA NACION HAD A BITTERNESS, ANGER, HATRED AND RESENTMENT ON US FOR STOPPING THEIR EMPLOYMENT WITH US AND SUPPORTING JONALU IN HER SCHOOLING. THE GENERAL PUBLIC IN BRGY. CANSILAYAN, MURCIA ARE AWARE THEIR ACTIVITIES IN THE VILLAGE WHICH WE DEEM IMPROPER TO ELLABORATE HERE. PUNONG BARANGAY BALIGUAS OF THE BARANGAY WAS AWARE OF IT; THE INFORMATION OF THE HONORABLE INVESTIGATING PROSECUTOR, JONALU GUMBAN AND REBECCA NACION RE-ENTERED OUR HOUSE IN BRGY. CANSILAYAN, WHICH WAS SUBJECTED TO A RAID AT AROUND 11:00 OCLOCK IN THE MORNING OF AUGUST 7, 2013 AND TOOK OUR PERSONAL BELONGINGS INSIDE THE HOUSE WHICH ARE: 2 NOKIA CELLULAR CELLPHONES, IMPORTED CHOCOLATES AND AROUND P 800.00 CASH. THEY ALSO TOOK THE PERSONAL MONEY OF CORNELIA PATRIA AMOUNTING TO P 1,500.00. THEY MADE AN ALIBI TO THE POLICE OFFICERS WHO ACCOMPANIED THEM THAT THEY WILL GET THEIR PERSONAL BELONGINGS, BUT THE TRUTH IS, THEY BROUGHT EVERYTHING OF THEIR PERSONAL BELONGINGS WHEN THEY LEFT SEVERAL WEEKS AGO. THEY HAD NOTHING LEFT IN OUR HOUSE. JONALU GUMBAN WAS PERSONALLY RETURNED BY ME TO HER MOTHER IN MID JULY 2013 AND REBECCA NACION LEFT FOR GOOD A WEEK BEFORE THE RAID; CLEARLY, THESE TWO WOMEN TOOK ADVANTAGE OF THE ENTIRE SITUATION, ADDING INSULT TO OUR INJURY. Attached is the Excerpt of the Police Blotter Entry No. 13-2208, Dated August 16, 2013 attesting this fact, ANNEX C.

ao) The August 7, 2013 raid was a nightmare to both of us. We felt so

disappointed with the authorities for being misled by Jonalu and Rebecca to believe their version without ascertaining the veracity of the circumstances;

FURTHERMORE, OUR CONSTITUTIONAL RIGHT AGAINST ARBITRARY ARREST AND ILLEGAL SEARCH AND SEIZURE WERE VIOLATED. THE IMPLEMENTING AUTHORITIES DID NOT OBSERVE THE RULES OF ENGAGEMENT WHEN THEY IMPLEMENTED THE SEARCH WARRANT. THEY DID NOT INTRODUCE THEMSELVES AND ANNOUNCED THEIR PURPOSE BEFORE ENTERING OUR PREMISES. THERE WAS NO DENIAL OF THEIR ENTRY BUT THEY SUREPTICIOUSLY ENTERED OUR DWELLING, REASON FOR ARLENE BILLONES, JEAN ANCERO, JANET ATIENZA & ANA ROSE PLANA TO BE SURPRISED OF THE PRESENCE OF THE RAIDING TEAM INSIDE OUR HOUSE ESPECIALLY SO THAT THEY WERE POKING THEIR GUNS TO EVERYONE, INCLUDING THE SAID WOMEN. CORNELIA PATRIA AND THE THRE WOMEN CAN ATTEST TO THIS FACT; AT THAT TIME, BARTELD WAS UP IN THE TERRACE FINISHING HIS LAST STICK OF CIGARETTE WHILE MELODY WAS IN THE SALA WATCHING A MOVIE; THE RAIDING TEAM STARTED THEIR SEARCH AND CONFISCATION OF OUR COMPUTERS AND ITS COMPONENTS IMMEDIATELY UPON ENTRY WITHOUT EXPLAINING THEIR PURPOSE. THE SEARCH AND SEIZURE WERE PRACTICALLY MADE NOT IN OUR PRESENCE AS LAWFUL OCCUPANTS OF THE HOUSE; BARTELD HAVE TO DEMAND SEVERAL TIMES BEFORE THEY IDENTIFIED THEMSELVES AND SHOW THEIR BADGES BECAUSE THEY WERE NOT EVEN DRESSED IN PROPER UNIFORM; ARLENE BILLONES, JEAN ANCERO, JANET ATIENZA & ANA ROSE PLANA WERE JUST USING THE INTERNET WHEN THEY RAIDED THE HOUSE AND NOTHING MORE. NO CRIME WAS BEING COMMITTED WHEN THE AUTHORITIES EFFECTED THE SEARCH HENCE, THEY HAD NO GROUNDS TO EFFECT WARRANTLESS ARREST ON OUR PERSONS; WE PROTEST THAT IT IS NOT A CRIME PER SE TO POSSESS COMPUTERS; IT IS NOT A CRIME PER SE TO USE THE INTERNET OR CHAT AT 1:00 OCLOCK IN THE MORNING; IT IS NOT A CRIME PER SE TO HAVE FOUR WOMEN CHATTING IN THE INTERNET AT THE SAME TIME; IT IS NOT A CRIME PER SE TO GO ONLINE DATING; IT IS NOT A CRIME PER SE TO HAVE MAKE UP KITS BESIDE THE COMPUTER WHILE CHATTING; AND IT IS NOT A CRIME PER SE TO WEAR MAKE UP WHILE CHATTING;

SINCE OUR ARREST AND DETENTION WAS ARBITRARY OUR DETENTION IN AN INHABITABLE PRISON CELL OF MURCIA, NEGROS OCCIDENTAL IS ALSO ARBITRARY;
aq) WE ARE ALSO DISHEARTENED WITH THE DESPERATE

AND UNNECESSARY EFFORTS OF THE POLICE AUTHORITIES IN INTIMIDATING, COERCING AND FORCING THE WITNESSES AGAINST THEIR WILL TO EXECUTE AN AFFIDAVIT AGAINST US, MORE PARTICULARLY ON CORNELIA PATRIA Y NARCA AND ARLENE BILLONES Y BATERBONIA. WE ARE THANKFUL HOWEVER THAT THE TWO BRAVELY RECANTED THEIR PRIOR AFFIDAVITS WHICH WERE ALL SECURED UNDER COMPULSION AND FEAR. Please see attached affidavits of Cornelia Patria and Arlene Billones, ANNEXES D and E;
ar) We believe that eventually, the innocent witnesses namely: JEAN
