AGREEMENT TO DEAL ELECTRONICALLY By choosing to electronically sign the VUU Housing Contract below, you agree to the following Terms and Conditions: Your access to the VUU Housing Contract is conducted electronically and you agree that the Office of Residence Life & Housing may communicate with you electronically for all aspects of the terms of the VUU Housing Contract, including sending you electronic notes. All electronic communications will be sent to your official VUU e-mail account. At the end of this document, you will be asked to provide an electronic signature. By doing so, you will be agreeing to the Terms and Conditions of the 2013-2014 VUU Housing Contract. Your electronic signature is legally binding. You agree to contact the Office of Residence Life & Housing if you need information about your VUU Housing Contract, and you recognize that electronic communication with that office may be interrupted by circumstances beyond that offices control. ELIGIBILITY Any person who has been admitted as a full-time student at Virginia Union University may enter into this agreement with the University. In order to be considered for housing, new students must be confirmed by the Office of Enrollment Management, submit a housing contractual agreement to the Office of Residence Life & Housing and be cleared financially with the university. To register for a room each year after the initial contractual agreement, a student must submit a housing contractual agreement and be cleared financially with the university. Students living in campus residency must enroll in a minimum of twelve (12) credit hours each semester. Special permission must be secured from the Director of Residence Life & Housing to continue on campus residency for students enrolled in fewer than 12 credit hours. A resident may not sublease or rent a room assignment or permit unauthorized persons to share the room except in accordance with the overnight visitation policy established by the Office of Residence Life & Housing. DURATION AND MODIFICATION OF AGREEMENT This contract is for the full academic year consisting of the fall and spring semesters of the same academic year. If student defers admission from the fall semester, contract applies for spring semester only. Thus, the student agrees that he/she will live in the university residence halls for the entire period of the contract. This contractual agreement becomes effective after signing by the student and written acceptance of the student into University housing by VUU, and expires on the date and time designated by the Office of Residence Life & Housing for residence halls to close in the spring semester.

This contractual agreement may not be modified except in writing, and if signed by the Director of Residence Life & Housing and/or the Vice President for Enrollment Management and Student Affairs. The student is responsible for adhering to the policies and procedures outlined in the Virginia Union University Student Handbook and theResidence Life & Housing Handbook. At the termination of the contract period, when moving off campus, or when moving to a new room assignment, a student must relinquish the keys to their present assignment and have the condition of his/her present room assignment assessed by residence hall staff as part of the residence hall checkout procedure. The student(s) who vacates his/her room without properly checking out will receive the appropriate fine assessment. Belongings remaining in the room become the property of the Office of Residence Life & Housing. Students who withdraw from the University during the academic year must vacate the residence hall on the same day as the withdrawal date. PERIOD OF OCCUPANCY The student may occupy an assigned room at the time specified by the university each semester. Students with housing assignments who do not officially register with the university on their designated registration date will forfeit their assignment. Exceptions will only be made for those students who provide notice in writing to the Office of Residence Life & Housing prior to their registration date. Please note that failure to occupy an assigned space does not automatically release the student from contractual obligation. Occupancy of the room must be relinquished at the completion of the contract. All residence halls are closed during the periods between semesters, and spring break. Residents who are not graduating are required to check out of their residence halls by the date and time designated by the Office of Residence Life & Housing. Graduating students are required to check out of their residence halls by 5pm on Commencement Day. The Universitys agreement is to provide a housing space, but not a particular room, and the University reserves the exclusive right to determine the particular space with the student is assigned. CANCELLATION OF THE HOUSING CONTRACT DURING THE ACADEMIC YEAR A resident student who fails to occupy an assigned room will remain obligated by the terms and conditions of the contract. A resident student may initiate cancellation of the contract because of withdrawal from the university. The contract will be terminated after the student has officially withdrawn from the university using the appropriate notification process. Residence hall fees and Board fees are not subject to cancellation during the semester because of the contractual nature involved. A resident student who withdraws from the university prior to the end of the fall semester will not be subject to spring room charges as long as by December 1, he or she officially notifies the Office of Residence Life & Housing via the Intent to Vacate form and subsequently completes the official residence hall check out process by the last day of the fall semester. A resident student who leaves the university at the end of the fall semester after having completed requirements for graduation will not be subject to spring room charges as their contract will be terminated. A resident student seeking to cancel a VUU Housing Contract during the academic year must provide appropriate written notification to the Office of Residence Life & Housing. Consideration for contract termination will only be given for cases that are deemed exceptional and extenuating, including but not limited to: graduation, medical

complications, active military duty, marriage, and incarceration. If a contract termination is approved by the Director of Residence Life & Housing, the residents room charges will be prorated at the discretion of the Office of Student Accounts. A resident student who is removed from the residence hall as a result of university disciplinary action or administrative withdrawal will not receive any refunds on his/her room charges. The University reserves the right to terminate the contract if the resident student fails to meet the universitys academic requirements. The University reserves the right to terminate the contract if the resident student fails to maintain full-time registration for the period of the contract. Termination of the contract is at the discretion of the Director of Residence Life & Housing. No adjustment in room charges will be made because of absence from the university for periods during the academic year. CONDITIONS OF OCCUPANCY The student agrees to reside in the room assigned and agrees to relinquish all keys when occupancy ends. The University does not provide services and/or room accommodations under this agreement during periods specified by the Office of Residence Life & Housing. The student, at his or her own risk, may leave personal property in the assigned room during recess periods and breaks (except for Summer Break.) However, the university strongly urges the student to take valuables home during these periods. The University is not responsible for loss or theft or damage to personal property in the residence halls and encourages that all residents obtain renters insurance. Personal property will be considered abandoned if left in or near the residence halls after a student vacates his/her room. The university will not take responsibility for such items and items will not be held by the University. Such items are subject to disposal. RESIDENCE LIFE INFORMATION The student agrees to provide the information and preferences requested on the housing contractual agreement for the purposes of hall, room, and roommate assignment. The University agrees to determine room assignments on the basis of the date that financial clearance was granted by the Office of Student Accounts and receipt of the housing contractual agreement. No student will be considered for housing until he or she satisfies all payments related to reserving a room and completing a housing contractual agreement. Designated assignments for students are made on a first come, first served basis. Specific room assignments (upon a students request) are not guaranteed. Special housing requests as a result of medical conditions/disabilities must be documented by a healthcare provider and provided to the Office of Residence Life & Housing when the housing contractual agreement is submitted. Housing accommodations are based on available space at the time a student clears to be housed. The student understands that the University makes all assignments without regard to race, color, religion, or national origin and rejects all requests for changes of assignments based upon such reasons. The University reserves the right to change room assignments at its discretion. These changes are typically done for the benefit of the individual student and/or the residence hall. The student agrees to observe the room change procedure established by the University and to have prior written approval before making a change of room assignment. Unauthorized room change will result in a fine assessment and the student moving back to his or her original room assignment.

The University reserves the right to modify or terminate room assignments for disciplinary reasons, catastrophic conditions, facilities closures, or irresolvable incompatibility of roommates. The student, upon accepting a housing assignment, agrees that his/her housing privilege may be revoked if the student violates the housing agreement, the Residence Life & Housing Handbook or the Student Handbook. If one of the occupants of a room moves or a room is not fully occupied, the student who remains agrees to accept an assigned roommate or to move to another room upon request. To accommodate occupancy overflow, the Office of Residence Life & Housing reserves the right to utilize designated temporary room assignments, pending assignment or relocation to a permanent living space. These are for a limited time only and the student must vacate the space upon expiration of the temporary agreement. Students who withdraw from classes and/or quit attending all classes during the academic year must vacate university housing immediately after the last date of attendance. Students who do not comply with this requirement will be held liable for room and board charges beyond the last date of attendance and may be subject to university sanctions and/or legal proceedings. Assigned residence hall rooms are to be used strictly as the students residence and for no other purpose. Residents may not use the residence hall, the assigned room or any equipment or facilities found in the hall or the room for purposes of conducting a personal business or engaging in any illegal activity. Assigned students are required to attend mandatory hall and floor meetings in the residence halls. Failure to attend these meetings may result in the cancellation of the housing contract and/or ineligibility to participate in the housing process. In addition, appropriate fines will be assessed. Alterations to the residence hall room, (including but not limited to electrical wiring; attaching hardware to walls; or painting the room) are not permitted. The resident is responsible for the condition and proper care of the accommodations assigned to him or her and shall reimburse the university for all damages done within or to said accommodations during the term of the contract. The students responsibility for damage includes, but is not limited to, damage to room furnishings and damage caused from either inside the room or outside the room to doors, windows and screens. The student is subject to charges for damage to public areas in the assigned residence hall, regardless of the identity of the person or persons responsible. Residents overnight guests and visitation is limited as outlined in the Residence Life & Housing Handbook. LIABILITY The University does not assume any legal obligation to pay for the loss of or damage to items of personal property of the student which occurs in its halls or on its grounds, prior to, during or subsequent to the period of the contract. Each student is encouraged to carry appropriate insurance to cover any such losses. ROOM ENTRY BY UNIVERSITY OFFICIALS The University reserves the right to enter a students room/suite to perform routine or emergency repairs or maintenance. In such cases it is the students responsibility to ensure access to the areas needing repair and to protect personal property against damage. The University also reserves the right to enter a students room/suite as deemed appropriate for reasons including, but not limited to health concerns, safety concerns, and suspected violation of university or residence hall polices. ADDITIONAL TERMS AND CONDITIONS Each resident is required to abide by all university and residence hall regulations. Regulations are communicated

electronically through the VUU Housing Contract, the Student Handbook, the Residence Life & Housing Handbook and the residence hall staff. It is the residents responsibility to be familiar with this information. Breach of this contract or violation of any Virginia Union University regulation may result in removal of the resident from the residence hall with prior notice, except where the university determines that continued occupancy by the student may pose a danger to the life, safety or health of the resident or other residents, in which case the resident may be removed without prior notice. In the event that the room assigned to the resident is destroyed or made unavailable to the university and the university does not furnish other accommodations, the contract shall terminate. All rights and liabilities of the parties hereto shall cease and payments previously made by the student may be refunded on a prorated basis as determined by the Office of Student Accounts for the period for which the accommodations were made unavailable to the student. Execution of the VUU Housing Contract is not a commitment to admission to Virginia Union University. Only currently enrolled students are permitted to live in the residence halls. The Office of Residence Life & Housing will conduct information workshops to inform, educate and update students on rules/regulations, processes and revisions related to housing. HOUSEKEEPING & RESPONSIBILITY FOR DAMAGES The resident is responsible for the condition and proper care of the accommodations assigned to him or her. Defacing University property is not permitted. Residents will be assessed a fine by the University for the cost of the repair and replacement of personal and community damage as appropriate. Each resident is required to maintain his/her room in acceptably safe and sanitary condition. The residence hall staff will periodically inspect the rooms to ensure this condition of the contract is being met. Student agrees to remove all personal belongings from the room and leave the room in a clean and orderly condition when occupancy ends. Students who fail to clean and check out of their rooms properly will be assessed a fine for improper check out and may forfeit the privilege to reside on campus depending on the condition of the room. The resident agrees to adhere to the Group Billing Policy. Group billing is a policy that charges expenses incurred through, but not limited to the following acts: acts of vandalism, theft, destruction of property, improper trash removal, uncleanliness of public areas, and unauthorized use of the fire exit doors and equipment. The fine assessment will be applied to each residents account of the floor or hall where said acts occurred. The thrust of the policy is to involve the residents in the care and upkeep of their residence hall. It is important that all residents understand that a person, or persons, identified in an incident will be held solely responsible for all damages and responsibilities.
