of Haryana) are requested to please obey the Supreme Court of India order, which is reproduced as below, otherwise I will submit my report before the court about non functioning of these committees on October 1, 2013. Etc. etc. Respondents OFFICE REPORT The Writ Petitions along with Applications above mentioned were listed before the Hon'ble Court on 09.07.2013 with Office Report dated 06.07.2013, when the Court was pleased to pass the following Order :"We have heard learned counsel for the parties at length. On 23.08.2012, this Court passed a detailed order giving positive directions to all the State Governments and Union Territories to constitute their respective Committees in terms of the decision taken by Union of India on 26.04.2012. We are informed that all the State Governments and Union Territories have already constituted their respective Committees, as directed by this

Court on 23.08.2012. We are now concerned with the question as to whether these Committees are effectively and properly functioning and taking steps for proper implementation of the provisions of the various legislations, referred to in the previous order. It is pointed out that though the Committees have been constituted but they are not effectively and properly discharging their functions referred to in paragraph 4 of order dated 23.08.2012. We reproduce paragraph 4, for ready reference:"4. Functions of the State Committee for may be as following: Slaughter Houses so constituted

i) to identify and prepare a list of all the Slaughter Houses (S.H.s) located within the local self Govt. (Municipal Corporations, Panchayats etc.) ii) to call for reports from the District Magistrate or the Commissioner and District Food Safety Inspector as the case may be on condition/functioning of the S.H.s and also on the compliance of relevant applicable laws. Dy. the the

iii) to recommend modernization of old slaughter houses (S.H.s) and to relocate S.H.s which are located within or in close proximity of a residential area. iv) to recommend appropriate measures for dealing water/air pollution and for preventing cruelty to the slaughter. with solid waste, animals meant for

v) to carry out surprise & random inspections of S.H.s regularly and to issue directions for compliance of the recommendations that may be made by it. vi) to send bi-annual reports on the Committee and to refer issues that may recommendations or Central Govt. assistance. [Action: AWD)" We have to find out as to whether these Committees are properly functioning or not as per directions vide paragraph 4, referred to hereinabove. All the State Governments/Union Territories are directed to file their respective action taken reports within a period of one month. Mr. Raj Panjwani, learned senior counsel appearing for the petitioner, referred to order dated 10.10.2012 and submitted that on the state S.H.s to the Central require Central Committee S.H.S to Local Self

Pursuant to above Order, a letter dated 12.07.2013 alongwith certified copy of Order dated 09.07.2013 were sent to all the Chief Secretaries as well as to the Secretaries of the States and the Administrators of all the Union Territories and Central Pollution Control Board(CPCB) and Ministry of Environment & Forests(MoEF) directly and through their Standing Counsel for compliance, information and necessary action. WRIT PETITION (C) NO. 309/2003 It is submitted that Mr. V.G. Pragasam, Advocate has on 06.08.2013 filed an Affidavit on behalf of Government of Puducherry but the same is defective as copy of the affidavit has not been served upon Mr. Vijay Panjwani, Advocate and impression of Page No. 3 and 4 is dim and illegible. Defect was communicated to the Advocate vide this Registry's Letter dated 22.08.2013. It is further submitted that Mr. Yogesh Kanna, Advocate has on 17.08.2013 filed an Affidavit on behalf of State of Tamil Nadu and Mr. Irshad Ahmad, Advocate has on 21.08.2013 filed an Affidavit on behalf of State of Rajasthan but both the said affidavits are defective as copy of the affidavits have not been served upon Mr. Vijay Panjwani, Advocate. Defect was communicated vide this Registry's letter dated 22.08.2013 to the concerned Advocates. All the documents stands included in the Paper Books. It is again submitted that Mr. Shibashish Mishra, Advocate has on 26.08.2013 filed Additional Affidavit on behalf State of Odisha with the permission of the Hon'ble Court but copy of the same has not been served upon Central Agency Section. The aforesaid document is being circulated for the kind perusal of the Hon'ble Court. It is further submitted that Mr. Saurabh Mishra, Advocate has on 26.08.2013 filed Affidavit on behalf of State of Madhya Pradesh with the permission of the Hon'ble Court but the same is defective as the copy of the same has not been served upon Mr. Vijay Panjwani, Advocate. The aforesaid document has been placed in separate volume and is being circulated before the Hon'ble Court. It is further submitted that action Report is still awaited on behalf of remaining States and Union Territories. It is again submitted that no Status Report has been filed by Central Pollution Control Board (CPCB) and Ministry of Environment & Forests (MoEF) so far. It is lastly submitted that no document has been filed in Writ Petition(C) No. 330 of 2001, 44 of 2004 and Writ Petition(C) No. 688 of 2007 so far.
