APPENDIX C CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS: This CONTRACT OF LEASE executed and entered into in the City of Legazpi, by and between: NGATASYA GUTIERREZ, hereafter called the LESSOR-OWNER, and JEANE NAPULIS, also of legal age, Filipino, with residence and postal address at Pag-asa Homesite Subd. Rawis, Legazpi City 4500, hereinafter called the LESSEE. WITNESSETH: The LESSOR-OWNER hereby lets and lease and the latter hereby accepts in lease from the former a portion only of the residential property consisting of 25 sq. m., more or less, studio-type apartment, situated at Lot 13 Blk. 6 Pag-asa Homesite Subd. Rawis, Legazpi City, under the following terms and conditions, to wit: 1. The term of lease is for 6 months commencing from December 1, 2012 and expiring on June 1, 2013 during which a period, the LESSEE shall be bound to pay the LESSOROWNER a monthly rental of SEVEN THOUSAND PESOS (Php 7,000.00) only due and payable in advance within the first ten (10) days of each month; 2. The LESSEE hereby expressly agrees and warrants that the leased premises shall be used for residential purposes only by herself and said LESSEE is hereby prohibited or use said premises for any other purpose or purposes without the prior consent of the LESSOR; 3. The LESSEE shall not directly or indirectly sublease, assign, or transfer her right of lease over the leased premises or any portion thereof under any circumstance whatsoever, and any such contract made in violation of this clause shall be null and void; 4. The LESSEE hereby expressly acknowledges that the leased premises are in good tenantable condition and agrees to keep the same in such good and tenantable condition for which purpose she binds herself to undertake at her own expenses all ordinary repairs necessary to maintain the same in such condition. It is expressly understood and agreed, however, that the LESSEE shall not commence or proceed with any such repair work nor in any case introduce improvements or make any alteration in the leased premises without the prior written consent of the LESSOR. Provided, however that all improvements or alteration of whatever nature such as may be made therein shall not be removed therefrom but shall belong to and become the exclusive property of the LESSOR upon the termination of the lease, without need for reimbursement for the costs thereof; 5. Charges for water consumption, electricity, telephone and other utility services in the premises, as well as for the repairs of the utility system shall be for the exclusive account of the LESSEE; 6. The LESSEE shall not make alterations or changes in the electric or plumbing installations or in any other improvements installed within the leased premises, without the prior consent of the LESSOR;

7. The LESSEE shall not bring or store in the leased premises any inflammable or explosive goods or articles which may expose the leased premised to fir or increase the fire hazards; 8. The LESSOR or his duly authorized representatives shall have the right to inspect the leased premises at any reasonable hour of the day; and 9. Upon signing of this Contract, the LESSEE shall pay unto the LESSOR an amount equivalent to one (1) month deposit, the same to be applied in payment of back rents if any, upon the termination of this Contract and other expenses and charges billed on the LESSEE for water, electric, telephone and other utility services then remaining unpaid and that the LESSEE should at least stay in the leased premises for at least three (3) months otherwise said deposit will be forfeited in favor of the LESSOR. IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and signatures this 1st day of December, 2012 in Legazpi City.
