General Information & Instructions to the Applicant

1. Brief about the project:1.1 Jaipur Development Authority, Jaipur intends to construct sewerage and Industrial effluent treatment plant (2 MLD STP, 1MLD ETP) & O&M for 5 years at one location at Kartarpura Nallah on Sahkar marg to treat water for reuse.

1.2 It is proposed to treat the open drain water of Kartarpura Nallah near Sahkar Marg by constructing STP of capacity 2 MLD and by constructing CETP of capacity 1 MLD to treat mixture of sewage and Industrial Effluent of Sudarshanpura Industrial Area including O&M for 5 years.   


The treatment plant can be a combined unit or 2 separate parallel units. Some of such components can be kept common. The plant site is located along the road between Sahkar Marg and Railway line (to Delhi) in JDA land near Imli Phatak Railway Crossing. The purpose of the treatment plant is to reuse waste water after treatment for horticulture works, washing railway wagons/bogies etc.
The operation and maintenance period after construction of the plant is 5 years.

 

The technology for treatment should be flexible to accommodate change in input quality of Effluent especially in case of ETP. The technology should be latest, proven and cost effective.

2. BID PROCEDURE
2.1 Bid document can be purchased from the office of Executive Engineer PHE-I, JDA, Jaipur Room No. 135, Main Building, Indira Circle, JLN Marg, Jaipur by depositing the Demand Draft in favor of Secretary, JDA amount to Rs. 1000/- or can be downloaded from JDA website www.jaipurida.org. The applicant will have to deposit the DD of Rs. 1000/- at the time of submission of bid. Two envelope system would be adopted, Envelope-I being technical bid and Envelope-II being financial bid. Each envelope should be sealed separately and subscribed as Envelope-I "Technical Bid" and Envelope-II "Financial Bid". Both envelopes would be placed in third envelope duly sealed bearing the name of applicant. In this third envelope, envelope of earnest money (DD of Rs.25000/-) and bid cost (DD of Rs. 1000/-) in favor of Secretary, JDA, Jaipur if document is downloaded from internet should be kept.

2.2 The bid shall be submitted to the office of Executive Engineer PHE-I on or

before the time specified i.e 3.00 pm on 15.3.13. 2.3 The Technical Bid would be opened on 15.03.2013 at 3:30 pm of bidders whose earnest money and bid cost (if downloaded) are found to be in order. 2.4 The Technical Bid would be opened in the Chamber of Superintending Engineer-5, JDA, Jaipur. 2.5 The Financial Bid would be opened only of those bidders who fulfill all the post qualification criteria. The date and time of opening of financial bid shall be intimated. 3. CRITERIA 3.1 The applicant should have successfully done the consultancy work of similar nature of work like consultancy of Sewage Treatment Plant/ Effluent Treatment Plant/ combination of both Treatment Plant for any Govt./Semi Govt. Department. 3.2 Completion of at least one project of value not less than Rs.5.0 crore in which the consultancy work was done by the bidders. 3.3 Annual Turnover not less than 25 lacs. 3.4 The above information must be supported with documents/ Certificate issued by competent authority not below rank of Executive engineer. The documents shall be duly attested by notary public. 3.5 Affidavit in the form of Annexure -I (To be given on Non-Judicial stamp Paper of Rs. 10/- only, duly attested by Oath-Commissioner/Notary Public) 4. Scope of Work
4.1 Collecting sample of sewage & industrial Effluent and get it tested from any recognized laboratory/ any Govt. Department. 4.2 Preliminary design giving technical parameters.

4.3 Preparation of General arrangement drawing as per site conditions/ measurements with tentative dimensions/ parameters
4.4 Preparation of DPR giving the technology to be adopted and cost estimates based on current rates.

4.5 Preparation of tender documents. 4.6 Preparation of O&M manuals 4.7 Modification in design/tender documents etc if required by the department shall have to be done without any additional cost. 4.8 Assisting in evaluation of tenders and selection of executing agency. 5. REPORTS TO BE SUBMITTED BY THE CONSULTANT The consultant shall furnish to the Client reports and documents strictly in given time. The draft reports can be submitted in single copy but the final report shall be submitted in 3 copies with soft copy of all the documents, report and drawings etc.

CONDITIONS OF CONTRACT

1. PROGRAMME OF THE WORK Time is the essence of the contract and it shall be clearly understood that the consultant is bound to complete the work in all respects within the time specified. The tender programme of work shall include a progress schedule of the jobs mentioned in the scope of work which shall be related to the total time prescribed for the completion. This progress schedule, after modification, if any, during the progress of seeking clarification while examining the tender, shall form a part of the contract. The present schedule may be amended as and when necessary by agreement between the Engineer-In-Charge and the consultant within the limitation of time imposed by the contract.
The acceptance of the above programme by the Engineer-In-Charge shall not relieve the consultant of any of his responsibility to complete the whole of the works by prescribed time or extended time, if any.

In order to monitor the progress of work, the Engineer-In-Charge shall be given by the consultant on every Monday. 2. EXTENSION OF TIME
If the consultant shall desire an extension of time for completion of the work on the grounds of his having been unavoidably hindered due to reasons begone his control, he shall apply in writing to the Executive Engineer (PHE-I), JDA, Jaipur within 5 days of the date of the hindrance on account of which he desires such extension as aforesaid or other duly authorized ground have been shown there for, authorized such extension of time, if any, as may, in his opinion be necessary or proper.

3. SUB LETTING
The contract shall not be assigned or sublet without the written approval of the Executive Engineer (PHE-I), JDA, Jaipur and if the consultant shall assign or sublet his contract or attempt to do so, or become insolvent or commence any insolvency proceeding or make any composition with his creditors, or attempt to do, or if any bribe, gratuity, gift, loan, requisite reward or advantage, pecuniary or otherwise, shall either directly or indirectly be given, promised or agents to any public officer or person in the employ of Government in any way relating to his office or employment, or if any such officer or person shall become in any way directly or indirectly interested in the contract, the Executive Engineer (PHE-I), JDA, Jaipur there-upon by notice in writing rescind the contract, and the security deposit of the consultant shall there-upon stand forfeited and be

absolutely at the disposal of Executive Engineer (PHE-I), JDA, Jaipur and in addition the consultant shall not be entitled to recover or be paid for any work therefore actually performed under the contract. 4. SUSPENSION OF WORK The consultant shall on the written order of the Engineer-In-Charge suspend the progress of the consultancy work or any part thereof for such time or times and in such manner as the Engineer-In-charge may consider necessary. If the suspension is ordered for no fault of the consultant, he shall be entitled to reasonable extension of time but no compensation of any kind whatsoever shall be claimed. 5. WORK TO BE EXECUTED UNDER DIRECTION OF EXECUTIVE ENGINEER (PHE-I ), JDA, JAIPUR All the works to be executed under the contract shall be executed under the direction and subject to be approval in all respects of the Executive Engineer (PHE-I), JDA, Jaipur for time being, who shall be entitled to direct at what points and in what manner they are to be commenced and from time to time carried on. 6. COMPENSATION FOR UNREASONABLE DELAY If the consultant fails to complete the various jobs assigned to him as per the scope of the work in the given time, he is liable for compensation (% 1% per week or such smaller amount as may be fixed, by the accepting authority on the contract value. When delay in completion of the work/part work amounts to less than a week the compensation payable shall be proportional to the number of days involved provided that the total amount of compensation for delay to be paid under this condition shall not exceed 10% of the contract value of the work.
The amount of compensation may be adjusted or set off against any sum payable to the consultant under this or any other contract with the JDA, Jaipur.

The Engineer-In-charge shall keep a watch as to whether the actual progress of work is as per the time schedule and in case the consultant defaults in achieving progress on works at intermediate stage as per this schedule and continue to do so even after one month after a notice in writing from the Engineer-In-charge, the consultant will render himself liable to action as provided above. 7. ARBITRATION
If any question, difference or objection what so ever shall arise in any way in connection with or arising out of this instrument or the meaning of operation of any part thereof or the rights, duties or liabilities of either party, then save in so far as the decision of any such matter as herein before provided for and has been so decided every such matter constituting a total claim of Rs. 5,000/- or above, whether its decision has been finally decided accordingly or whether the contract should be terminated. or has been rightly terminated as regards the rights or obligations of the parties as the result of such termination shall be referred for adjudication to a sole arbitrator to be appointed as hereinafter provided.

For the purpose of appointing the sole arbitrator referred to above, the Director Engineering-I, JDA will on receipt of notice from the consultant, send a panel of 2 names not below the rank of superintending Engineer and who shall all be presently unconnected with the contract. The consultant shall on receipt of the

names as aforesaid select any one of the persons named, to be appointed as a sole arbitrator and communicate his name to the Director Engineer-I, JDA, Jaipur. The Director Engineer-I, JDA shall thereupon appoint the said person as the sole arbitrator without delay. The arbitrator shall give reasons for award. Subject to the aforesaid, the provisions of the arbitration and conciliation Act,, 1996 or any statutory modification or re-enactment thereof and the rules made there under and for the time being on force shall apply to the arbitration proceedings under this clause. 8. FINAL CERTIFICATION FORM
Within 10 days after the full job is completed the consultant shall give notice of such completion to the Engineer-In-charge and within thirty days of receipt of such notice the Engineer-In-charge after verification shall furnish the consultant with a certificate indicating the date of completion. However, if in the opinion of the Engineer-In-charge there are any jobs incomplete he shall intimate the consultant at the earliest about the incomplete job. Neither certificate of completion shall be issued nor shall the jobs mentioned in the scope of works are fully completed.

9. TERMINATION OF THE CONTRACT

(For closure in full or in part due to amendment or reduction in scope of work.) If at any time after acceptance of the tender, the Deptt. Decides to abandon or reduce the scope of the works for any reasons what so ever, and hence not require the whole or any part of the works to be carried out, the consultant shall have no claim to any payment of compensation or other wish what so ever on account of any profit or advantage which he might have derived from the execution of the works in full but which he did not derive in consequence of the fore-closure of the whole or part of the works. The consultant shall be paid at contract rate due amounts for the jobs completed.

10. CHANGE OF CONSTITUTION OF THE CONSULTING FIRM

Where the consultant is a partnership firm, the prior line approval in writing of the accepting authority shall be obtained before any changes are made in constitution or the firm.

Where the consultant is an individual Hindu Undivided Family business concern such approval as aforesaid shall likewise be obtained before the consultant enters into any partnership agreement where under the partnership firm would have the right to carry out the works hereby undertaken by the consultant.
If prior approval as aforesaid is not obtained the contract shall be cancelled as provided above.

11. INSTRUCTIONS AND NOTICES Subject as otherwise provided in this contract, all notices to be given on behalf of JDA and all other actions to be given on behalf may be given or taken by the Engineer-In-charge or any officer for the time being entrusted with the functions, duties and powers of the Engineer-In-charge All instructions, notice and communications etc. under the contract shall be given in writing and if sent by registered post to the last known place of abode or business of the consultant shall be deemed to have been served on the date when in ordinary course of post these could have been delivered to him

12. RECOVERY FROM CONSULTANT Whenever any claim against the consultant for the payment of a sum of money arises out of or under the contract the JDA shall be entitled to recover such sums by appropriating, in part or whole of the Security deposit of the consultant. In the event of the security being insufficient or if no security has been taken then the balance of the total sum recoverable, as the case may be, shall be deducted from any sum then due or which at any time thereafter may become due to the consultant under this or any other contract with the JDA. Should his sum be not sufficient to cover the full amount recoverable, the consultant shall pay to the JDA on demand the balance remaining due. The JDA shall further have the right to effect such recoveries under P.D.R. Act. 13. JURISDICTION OF COURT In the event of any dispute arising between the parties here to in respect of any of the matters comprised in this agreement, the same shall be settled by a competent court having jurisdiction over the place where agreement is executed at Jaipur and by no other court.
