DONALD F. BENNETT, JR. RESIGNED HIS POSITION AS COUNCIL MEMBER EFFECTIVE SEPTEMBER 3, 2013. IN ACCORDANCE WITH CITY OF PEEKSKILL CHARTER 34 A MAJORITY OF THE COMMON COUNCIL MAY APPOINT A PERSON TO FILL SUCH VACANCY, THE TERM OF SUC H APPOINTMENT TO EXPIRE AT 12:00 MIDNIGHT ON THE DAY OF FIRST ANNUAL ELECTION AFTER THE HAPPENING OF THE VACANCY. THE COMMON COUNCIL DESIRES TO APPOINT VIVIAN MCKENZIE TO THE VACANT SEAT ON THE COMMON COUNCIL LEFT BY THE RESIGNATION OF MR. BENNETT.

RESOLUTION APPOINTING VIVIAN McKENZIE TO FILL THE VACANCY IN THE OFFICE OF COUNCIL MEMBER LEFT BY THE RESIGNATION OF DONALD F. BENNETT, JR.

WHEREAS, Donald F. Bennett, Jr., was elected to serve the office of Council Member for the City of Peekskill for the term of January 1, 2012 through December 31, 2015; and WHEREAS on September 3, 2013, the office held by Council Member Bennett became vacant upon his resignation, and; WHEREAS, Peekskill City Charter 34 provides that, if a vacancy shall occur in any elective office, a majority of the Common Council may appoint a person to fill such vacancy, the term of the office of the person so appointed to expire on 12:00 midnight of the day of the first annual election after the happening of the vacancy at which a successor can be elected, and a successor for the balance of the unexpired term to be chosen at such election, and the term of office of the person so elected to fill the unexpired term to commence on the day next succeeding the election; NOW, THEREFORE, BE IT RESOLVED, that, pursuant to C34 of the Charter of the City of Peekskill, the Common Council hereby appoints Vivian McKenzie to fill the vacancy in the office of Council Member left by Donald F. Bennett, Jr., upon his resignation as Council Member, the term of the office of such person to expire on 12:00 midnight of the day of the first annual election after the happening of the vacancy at which a successor can be elected, November 5, 2013.
