Demanding Justice
Continuation of the story of factual documentation facts not hear say nor word of mouth nor he said she said nor gossip. KUWAIT: William Bowers, a former US military officer GS-14 has been caught in a litigation case in Kuwait for years and hasn't been able to pay his bills which resulted in a travel ban that has left him stranded in Kuwait because of fault of a Kuwaiti law firm Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) P.O. Box 5750 Safat 13058 Kuwait. I William Bowers will state factual evidence not hear say nor word of mouth it all can be proven by documents I hold in my possession signed by legal government officials, head medical board, high court judgments. Along with that proof that his consultant that Mr. Ahmad GH. Al Otaibi sponsored Mr. Earnest W. Alexander has been found guilty of fraud and scam I also have a Criminal court judgment on his consultant which I push the Kuwait Prosecutor in investigating and prosecuted. Let me explain the situation so people can get a very clear picture of the whole issue. Back in Oct. 2006 I suffered injury to both knees in a military M88 recover tank doing maneuvers. I had trouble seeking proper medical attention from the company. So I seek a private hospital the Hadi Clinic started to attend my treatments from 2006-2007 So I looked up on the United States Embassy website in seeking lawyers which at the time they had Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) P.O. Box 5750 Safat 13058 Kuwait on their website under list of legal representative. So I went to Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) for a consultation which he stated if I did all the running around that it would only cost me 750 KD. So he told me I need to go to the Ministry of Social Affairs. So I had a translator who I hired to assist me which I filed my complaint with the Ministry of Social affairs which they had scheduled hearings for ITT and KRH (sponsor) to attend. At that time the Ministry of Social Affairs has instructed me to take all my medical reports to the Raza Government hospital to get an evaluation by the Head Kuwait Medical Board. At this time the company started to pay for my medical treatment and they had been advised I had to undergo my 1st knee surgery which was my left knee. I was instructed by specialist that if the 1st knee surgery may not correct the problem so the company paid for my 1st knee surgery. At that time I had undergo therapy after the knee surgery at that time while on crutches I started going to the Raza Government hospital to get an evaluation by the Head Kuwait Medical Board which 2 weeks later I got a final report

from the Head Kuwait Medical Board which they have stated I have 10% permanent disability to my knees for life and attend the schedule hearing with the Ministry of Social Affairs which at my first hearing ITT and KRH (sponsor) did not show. So the Ministry of Social Affairs scheduled for a 2nd hearing. This all as going on from January 2007 to June 2007 which when it came down to it ITT and KRH (sponsor) never tried to find a resolution to the injury did not show at the 1st, 2nd hearing which I personally went to the KRH (sponsor) building to speak with their head director there and allowed them take copies of the injury reports and the medical reports. They finally came to the 3rd hearing trying to play ignorant when in fact after the 2nd hearing I personally I personally went to the KRH (sponsor) building to speak with their head director there and allowed them take copies of the injury reports, explain the situation and the medical reports. KRH (sponsor) and ITT representative ask the Ministry of Social Affairs legal advisor they need time to review everything. So the Ministry of Social Affairs legal advisor set a 4th hearing which I attended but KRH (sponsor) and ITT never attend. So the Ministry of Social Affairs legal advisor wrote a report and instructed me to have my attorney which at the time I had signed a legal binding contract and paid 750 KD to Consultant Mr. Earnest W. Alexander in July 2007 who is under the sponsorship of Mr. Ahmad GH. Al Otaibi & Partners law firm to pick up a yellow slip of paper at the courts. After I got the legal contract with Mr. Ahmad GH. Al Otaibi & Partners law firm I had to go to the Justice to get a Power of Attorney for Mr. Ahmad GH. Al Otaibi to represent me in the Kuwait Courts. So during the period of July 2007 to 2009 I William Bowers accompanied with my spouse twice a week every month. Every time we visit with Consultant Mr. Earnest W. Alexander he kept giving us excuse after excuses saying the courts are too busy, too many holidays, and he had too many business trips that is why it had taken my case so long. During this period Mr. Ahmad GH. Al Otaibi never spoke nor met. So all this was going on in his law firm which he had give his consultant Mr. Earnest W. Alexander authority to sign and act on his behalf.

So when I fired Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) in 2009. I had taken my case to another law firm which is AL- KHASAB CONSULTATIONS GROUP LAWYER / MUBARAK AL-KHASHAB & PARTNERSCOUNSELLORS ATTORNEYS AT LAW & ARBITRATION (Mr. Bashar Al- Nasser) who I had signed the contract for them and paid them 1000 KD and made power of attorney to represent me in my labor case which they had started preparations to file the paperwork with the courts. Which when they investigated the Labor case that was supposed to be filed in the courts by Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) which they found they did not file any labor case

in the courts during the whole period between 2007-2009. So they filed documents to get it on record that Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander). So it was a uphill battle with KRH (Sponsor) and ITT because no case was filed according to the Kuwait Labor Law you must have your case filed and in the courts during the 1 year statute of Limitation. I have all the judgments back and forth between my 2nd attorney, KRH (Sponsor) and ITT, and Ministry of Social Affairs concerning the labor case. The Kuwait Courts kept kicking the case out of the courts stating that the 1st law firm Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) violated the Kuwait Labor law on the 1 year Statute of limitation. So every venue my 2nd lawyer was trying to take the courts refused to hear the case because it was past the 1 year statute of Limitation according to the Kuwait labor law. So my 2nd lawyer got the final judgment from the Kuwait high courts as to why the court refused to hear the Labor case which the courts have stated in the judgment that the 1st law firm Mr. Ahmad GH. Al Otaibi & Partners law firm (Consultant Mr. Earnest W. Alexander) is at fault. During this period while this was all going on I was using my reserve funds to support me and my spouse. We filed a complaint with the Kuwait Lawyers Association which at that time the going through an election period. When we filed the complaint I had my translator with me which we clearly left instruction when a hearing date was set for them to call me and my translator to attend. Which we did not receive no call from the Kuwait Lawyers Association. We had found out 2 months later they held the meeting and did nothing stating that Mr. Ahmad GH. Al Otaibi had done no wrong. But yet if they would have called me and my translator to attend the hearing I would have presented evidence to prove that he did violate the law, violated my rights, violated my labor law rights, and more. According to the Kuwait Sponsor Kafeel System it clearly states that sponsors are solely responsible for the people they sponsor under them. I tried to be a better person which I had set up a meeting with Mr. Ahmad GH. Al Otaibi with my translator as witness to find a resolution to this problem which in turn Mr. Ahmad GH. Al Otaibi clearly stated that the fault is on his consultant Mr. Earnest W. Alexander. That he did not take the responsibility as the owner of the law firm to resolve the problem. He clearly stated that he had stripped his consultant Mr. Earnest W. Alexander of signing any documents and act on his behalf because of this problem. The man was unwilling to resolve this problem and tried to settle for 6000 KD to resolve this problem which I did not accept. So I had no choice but to proceed to the next level which I had filed criminal charges with the prosecutor in the Justice palace which I

underwent interrogation and my spouse went under the same interrogation. Then the prosecutor called both Mr. Ahmad GH. Al Otaibi and Mr. Earnest W. Alexander in separately to interrogate them for them to answer to the high court judgment blaming the Mr. Ahmad GH. Al Otaibi & Partners at fault and negligence. Which we were informed after the interrogation of both Mr. Ahmad GH. Al Otaibi and Mr. Earnest W. Alexander. That Mr. Ahmad GH. Al Otaibi stated that he did not accept any responsibility of Mr. Earnest W. Alexander. The prosecutor found Mr. Earnest W. Alexander guilty of the fault, negligence and much more on other cases similar to my case which I had filed against him during the criminal court hearing which we found out that Mr. Ahmad GH. Al Otaibi represented Mr. Earnest W. Alexander during the criminal court hearing. Which in the appeal of the criminal court hearing Mr. Ahmad GH. Al Otaibi stated he was Mr. Earnest W. Alexander Sponsor. Which I have the criminal court judgment and appeal in hand. So I went to numerous lawyers in Kuwait to take a civil action against Mr. Ahmad GH. Al Otaibi many have told me they cannot take a case against another Kuwaiti Lawyer because they are colleagues which I was turned down by numerous lawyers. So I finally found a Lawyer who would represent me and has stated that all the evidence I have in my hands is very strong against Mr. Ahmad GH. Al Otaibi. Which my lawyers filed the brief in the courts 8/20/2013. The brief clearly states all the laws that have been violated according to the Kuwait Constitution, violating my rights, violating the law in the Kafeel sponsor system, denying my medical, pain, suffering, mental anguish and more. While this is still continuing me and my spouse have to struggle to survive in Kuwait because we know if we leave Kuwait is my case is lost. We struggle each day eating noodles, barely having any food, barely caring for our animals, barely taking care of our medical needs, growing in debt every day, having a landlord who threatens us every month because we barely have money to pay our rent and we are late with our rent. Because of this we cannot come and go as we please. Each day we barely sleep because in fear of being kicked out in the streets, and each day we figure out where we will be able to get our next meal. Our families in the states can send what they can afford. Which we thank God for that. 1.) I ask where is the Justice?

2.) I have served during the Iraq Invasion and help Kuwait is this how I get treated? I came back to Kuwait with the U.S. Military in 2006 again. 3.) I thought that if youre a lawyer you take oath to uphold the law, and assist those who need legal assistance?

4.) Why are the Kuwait Lawyers condoning lawyers who break the law and turn the other cheek? 5.) Why is the Kuwait Lawyers association not really looking into matters and not hearing nor giving the other persons a chance to prove their allegation??? 6.) Why are the Ministry of Social Affairs and the Kuwait lawyers association holding lawyers responsible under the law? 7.) Why doesnt Kuwait have stricter laws who hold laws and stop lawyers from breaking laws? 8.) Why do people have to suffer, struggle, try to survive to get Justice?

9.) Why do Government officials ignore lawyers who break laws, scam and commit fraud and more against the people they represent? 10.) Why when people who have solid evidence on paper when someone violates the law who are lawyers have to suffer mentally, and physically? 11.) Kuwait pointing fingers at expats but what about your own who also break the law and solid evidence to prove it???

Kuwait has stressed over and over to the people that they do not tolerate corruption, scams, frauds, people who break the law, do not tolerate civil rights violations, labor violations, human rights, and anything that violates a persons rights and the law. We pray every day for justice and what I truly deserve under the Kuwait law. We pray for help.
