Lenovo Warranty Extension Agreement Consumer

Important notice: Please carefully read the following terms under which Lenovo, its authorized reseller or agent as the case may be (called Service Provider, We or Us) will provide warranty service to You. We will provide this service only in the United States and only if You first accept the terms of this Agreement or by Your initial use of this Service. If You do not accept the terms, are unable or unwilling to abide by the terms and conditions herein, do not use / complete the Service order. Instead, promptly notify the reseller you bought it from or Lenovo if you bought it directly from Lenovo for a complete refund within thirty (30) days of receiving this Agreement. THIS AGREEMENT You and Your shall refer to the purchaser. We, Us, and Our shall refer to Lenovo . WHAT THIS AGREEMENT COVERS This Lenovo Warranty Extension Agreement (called the Agreement) and its supported product list are the complete and exclusive agreement regarding Your acquisition of warranty extension and warranty service upgrade service (called Service) for Lenovo hardware products (called Product) and replace any prior oral or written communications between You or Lenovo regarding such acquisition. If You purchased a warranty extension, the duration of the Lenovo Limited Warranty for Your Product(s) will be extended for the term specified on Your Lenovo invoice. If You purchased a warranty service upgrade, Your coverage period begins on the warranty start date and will expire at the end of the term specified on Your Lenovo invoice. Your service will be upgraded to one of the service levels listed below. This Service must be purchased within your Products original warranty period. Post warranty service is not available for consumer purchase. On-site Service Your Service Provider (as defined below) will either repair or exchange the failing Product at your location and verify its operation. You must provide suitable working area to allow disassembly and reassembly of the Lenovo Product. The area must be clean, well lit and suitable for the purpose. For some Products, certain repairs may require sending the Product to a designated service center. Depot Service You will disconnect the failing Product for collection arranged by your Service Provider. A shipping container will be provided to You for You to return Your Product to a designated service center. A courier will pick up Your Product and deliver it to the designated service center. Following its repair or exchange, the service center will arrange the return delivery of the Product to Your location. You are responsible for its installation and verification. Lenovo warrants that each Product is free from defects in materials and workmanship under normal use during the warranty period. The warranty period for the Product starts on the original date of purchase specified on Your invoice or sales receipt unless Lenovo or Your reseller informs You otherwise in writing. Unless Lenovo specifies otherwise, these warranties apply only in the country or region in which You purchased the Product. WHAT THIS AGREEMENT DOES NOT COVER This warranty does not cover the following: y uninterrupted or error-free operation of a product; y loss of, or damage to, your data; y any software programs, whether provided with the Product, or installed subsequently; y failure or damage resulting from misuse, accident, modification, unsuitable physical or operating environment, natural disasters, power surges or improper maintenance by You;

any third party products, including those that Lenovo may procure and provide with or integrate into the Lenovo Product at Your request; and y any technical or other support, such as assistance with how-to questions and those regarding product set-up installation.. The warranty is voided by removal or alteration of identification labels on the Product or its parts.

HOW TO OBTAIN WARRANTY SERVICE Warranty service may be provided by Lenovo or Your reseller if authorized to perform warranty service, or an authorized warranty service provider. Each of them is referred to as a Service Provider. If the Product does not function as warranted during the warranty period, contact a Service Provider. In the United States, call 1-877-453-6686. If You do not register the Product with Lenovo, You may be required to present proof of purchase as evidence of Your entitlement to warranty service. What Lenovo Will Do to Correct Problems When You contact a Service Provider for service, You must follow the problem determination and resolution procedures that we specify. An initial diagnosis of Your problem can be made either by a technician over the telephone or electronically by access to a support website. Types of Service for Machines Repair Service will be provided either at your location, called On-site, or at a service center, called Depot. Under On-site Service, if Service is required as determined by your Service Provider, the servicer will use commercially reasonable efforts to respond as specified in the supported product list. Some parts are considered Customer Replaceable Units (CRUs). CRUs will be shipped to you for your replacement, or you may request that a Service Provider install some CRUs under one of the other types of warranty service designated for your Product. All defective CRUs must be returned to as the servicer specifies. Under Depot Service, if Service is required as determined by your Service Provider, you may deliver the failing Product or ship it suitably packaged (prepaid, unless the servicer specifies otherwise) to a designated location or we will use a courier to pick up and return the Product as specified in the supported product list. Exchange of a Product or Part When the warranty service involves the exchange of a Product or part, the item Your Service Provider replaces becomes Lenovos property and the replacement becomes Yours. You represent that all removed items are genuine and unaltered. The replacement may not be new, but will be in good working order and at least functionally equivalent to the item replaced. The replacement assumes the warranty service status of the replaced item. Your Additional Responsibilities Before Your Service Provider exchanges a Product or part, You agree to remove all features, parts, options, alterations, and attachments not under warranty service. You also agree to: 1. ensure that the Machine is free of any legal obligations or restrictions that prevent its exchange; 2. obtain authorization from the owner to have Your Service Provider service a Product that You do not own; and 3. where applicable, before service is provided: a. follow the service request procedures that Your Service Provider provides; b. backup or secure all programs, data, and funds contained in the Product; and c. provide Your Service Provider with sufficient, free, and safe access to Your facilities to permit Lenovo to fulfill its obligations. 4. (a) ensure all information about identified or identifiable individuals (Personal Data) is deleted from the Product or that, with respect to any remaining Personal Data you did not delete, you are in compliance with all applicable laws. CHARGES, PAYMENT, AND TAXES Except for credit card and debit card transactions, amounts are due upon receipt of Invoice. You agree to pay as specified by Us in the Invoice, including any late payment fee. You are responsible for any taxes related to this Service.

LIMITATION OF LIABILITY Lenovo is responsible for loss of, or damage to, Your Product only while it is 1) in Your Service Provider's possession or 2) in transit in those cases where Lenovo is responsible for the transportation charges. Neither Lenovo nor Your Service Provider is responsible for any of Your date including confidential, proprietary or personal data contained in a Product. You should remove and/or backup all such information from the Product prior to its service or return. Circumstances may arise where, because of a default on Lenovo's part or other liability, You maybe be entitled to recover damages from Lenovo (including fundamental breach, negligence, misrepresentation, or other contract or tort claim), except and to the extent that liability cannot be waived or limited by applicable laws, Lenovo is liable for no more than the amount of actual direct damages suffered by you, up to the amount you paid for the Product. This limit does not apply to damages for bodily injury (including death) and damage to real property and tangible personal property for which Lenovo is required by law to be liable. This limit also applies to Lenovo's suppliers, resellers and Your Service Provider. It is the maximum for which Lenovo, its suppliers, resellers, and Your Service Provider are collectively responsible. UNDER NO CIRCUMSTANCES IS LENOVO, ITS SUPPLIERS, RESELLERS OR SERVICE PROVIDERS LIABLE FOR ANY OF THE FOLLOWING: 1) THIRD PARTY CLAIMS AGAINST YOU FOR DAMAGES (OTHER THAN THOSE UNDER THE FIRST ITEM ABOVE); 2) LOSS OF, OR DAMAGE TO, YOUR RECORDS OR DATA; OR 3) SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OR FOR ANY ECONOMIC CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR SAVINGS) EVEN IF WE ARE INFORMED OF THEIR POSSIBILITY. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. GENERAL Nothing in this Agreement affects any statutory rights of consumers that cannot be waived or limited by contract. A copy of Your invoice is Your proof of entitlement to Service and You may be asked to present Your Invoice to confirm Your entitlement to Service. Lenovo and our related companies may store, use and process contact information and other businessrelated information about You, including names, phone numbers, and e-mail addresses, in any country where We do business. Such information will be processed and used in connection with our business relationship and may be provided to entities acting on our behalf to accomplish these purposes, and to Lenovo resellers who promote, market and support certain Lenovo Products and Services. Lenovo may also disclose such information where required by law. You and We agree that, under this Agreement, all information exchanged is nonconfidential. If either You or We require the exchange of confidential information, it will be made under a signed confidentiality agreement. Neither You nor We will bring a legal action, under this Agreement, more than two years after the cause of action arose unless otherwise provided by local law without the possibility of contractual waiver or limitation. Neither You nor We are responsible for failure to fulfill any obligation due to causes beyond its control. In the event that any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of this Agreement remain in full force and effect. All Your rights and all Our obligations are valid only in the United States. Both You and Lenovo consent to the application of the laws of North Carolina to govern, interpret, and enforce all of Your and Lenovos rights, duties, and obligations arising from, or relating in any manner to, the subject matter of this Agreement, without regard to conflict of law principles.
