Please excuse the poor and uneducated Bulgarian language text of my “Signal”. I have
therefore done my best to keep that letter short and am also providing English text below.
In the attached list the Minister will find the names, citizenships and amounts owed the
state budget by each of the foreign citizens deprived of their liberty and serving his
sentence at the Sofia Central Penitentiary 10th Prisoners Group. Each has as a part of his
criminal conviction a requirement that he pay a fine to the state budget or by some other
means that he satisfy or extinguish his fine on the grounds of Article 187§(1) abstract 4 of
the Tax Procedure Code of Bulgaria. Only when this is done will any of the individuals
identified in the provided list be allowed a transfer according to the Convention on the
Transfer of Sentenced Persons or parole (conditional early release) on the grounds of
Article 70 of the Criminal Code of Bulgaria.
The Minister will discover that in several instances of the list I have provided it is more
than one year since the Executor’s Order according to Article 170 of the Criminal Code
of Procedure Bulgaria was sent from the criminal court and received by the Ministry of
Finance Agency for State Takings – Sofia Division office of the “Public Executor”.
According to law, the Public Executor is obligated to immediately establish the property
of the debtor and thereby the possibilities and the necessary costs of the Agency
collecting this debt/fine. The Agency/Public Executor required to act in collecting the
sum or in the alternative required to declare the debt/fine as uncollectible on the grounds
of Article 187§(1) abstract 4 of the Tax Procedure Code Bulgaria, and thereby
extinguishing the debt and ending the collection proceedings against any foreign citizen
deprived of liberty. In which case the Agency and the Supreme Prosecutors Office must
allow the foreign citizen to leave the country on the grounds of the Convention on the
Transfer of Sentenced Persons or to be conditionally released (paroled) on the grounds of
Article 70 of the Criminal Code Bulgaria.
In each of the cases I have listed this cannot occur because and except when and only if
the Agency first fulfills its obligation to Article 152 if the Law on the Execution of
Punishments Bulgaria and then to Article 187§(1) abstract 4 of the Tax Procedure Code
Bulgaria.
Why is the Agency-Sofia not fulfilling this legal obligations and duty?
Official case files at the Sofia Central Penitentiary and the documents therein together
with other facts i.e. Agency bank records will lead the Minister to only to one objective
conclusion; that there is a criminal intent/purpose whenever officials of the Agency
decide to not meet, but instead to ignore their obligations to the law and that this crime
relies on fraudulent documents and when corruption/corrupted officials/representatives of
Sofia City Prosecutors Office and other Officials of the State accept these
falsified/fraudulent documents. Who together are accepting these obvious forgeries and
using their official status and position to accept bribes from foreign citizens deprived of
liberty whose lawful desire and is only to seek to realize their legal possibility of
conditional release on parole or their transfer to prisons in their own country.
If the Minister investigates the 3 instance/cases I have provided of those foreign citizens
deprived of liberty and all those who have been released during the last three (3) years, he
will himself uncover evidence/proof that there are crimes committed by officials who are
responsible to the Minister and officials who are responsible to the Supreme Prosecutors
Office of the Bulgaria.
In order to be sure that there is an investigation I have send copies of this letter and the
attached list to other ministries, the Government of Canada and the international media.
I wish the Minister successfully unmasks not only the crimes of corruption but also
success in uncovering incompetence and thereby to bring an end to at least one small part
of the dishonesty and ineffectiveness within the Ministry of Finance. Possibly then the
Minister of Justice will also clean his house.
