Te respondent, anative and citizen of Mexico, has appealed the August 9, 2012, decision
of an Imigation Judge denying his motion to continue proceedings. The Immigration Judge
ganted the aterative relief of volut depare. The appeal will be dismissed in pa, but the
record will be remanded on the issue of voluty depae. On appeal, the respondent seeks a
remad of the record so that he may proceed on his application fr a "U" non-immigrant visa
application pusut to section 10l(a)(l 5(U) of the Act. The appeal will be dismissed ad the
record will be remaded.
We review the fndings of fct, including the deterination of credibility, made by the
Immigration Judge under a "clealy eroneous" standad. 8 C.F.R. 1003. l(d)(3)(i). We review
all other issues, including whether te paies have met the relevant burden of proof, ad issues of
discretion, under a de novo stadad. 8 C.F.R. 1003.l(d)(3)(ii).
The respondent conceded that he is subject to removal as chaged pursuant to section
237(a)(l )(B) of the Immigration ad Nationaity Act, 8 U.S.C. 1227(a)(l)(B) (Exh. 6.). At his
removal heang, the respondent, through cousel, explained that he had requested evidence to
support his application fr a "U" visa, but had no new evidence to present since proceedings were
previously continued one year earlier. Cousel fr the respondent conceded that no application
was currenty pending wit the United States Citizenship ad Immigation Serices ("USCIS").
Tr. at 5-6. Wit that background, the Imgation Judge denied te respondent's request fr a
fer continuace (Tr. at 7).
Upon our de novo review, we do not fnd that te respondent demonstrated "good cause"
fr a continuace. 3cc Mohcr oJ3onchcz-3oxo, 25 I&N Dec. 807 (BIA 2012); 8 C.F.R.
1003.29, 1240.6. In determining wheter to gat or deny a continuance to await adjudication of a
visa petition, te inquiry is fcused on te likelihood of success of te application, which in this
case has even not been fled. MohcroJ Hovhmi,24 I&N Dec. 785, 791-92 (BIA 2009) (indicating
tat a motion fr a continuace should be supported by paiculazed facts ad evidence).
Therefre, we conclude that the Immigration Judge properly denied the respondent's request fr a
continuace.

Upon the basis of respondent's adissions, I have determined that the
Respondent is subject to removal on the charge(s) in the Notice to Appear. The
respondent has made application solely for voluntary departure in lieu of
removal.
It is HEREBY ORDERED that the respondent be GRATED voluntary departure in
oval, without expense to the Government on or before
any extensions as may be granted by the

conditions the District Director may direct.
It is FURTHER ORDERED:
