APPLICATION: Voluntary deparure under section 240B of the Act; reconsideration
The Depament of Homeland Securty ("OHS") appeals te decision of the Immigration
Judge, dated April 25, 2013, grating the respondent te privilege of voluntarily departing this
country. The respondent, a native and citzen of El Salvador, has fled a motion to reconsider,
which we deem to be a motion to remad. See generaly 8 C.F.R. 1003.2(b). The respondent
does not dispute that he is subject to removal fom te United States because he is an alien who
is present in this country without being admitted or paroled or who arved at ay time or place
oter than as designated by the Attorey General (Tr. at 3-4; Exh. 1). See section 212(a)(6)(A)(i)
of the Immigation and Nationality Act, 8 U.S.C. l 182(a)(6)(A)(i).
Considering the totality of the circumstances presented in this case, we conclude tat it is
appropriate to remad the record to the Iigration Judge in order to provide the respondent
with an explicit opportunity to fle an Application fr Asylum and fr Withholding of Removal
(For I-589) and to take ay other action that he deems appropriate. When the respondent
indicated that he was ''a little bit aaid" of retng to El Salvador, the Immigation Judge
should have fer inquired into the respondent's claimed far befre addressing the issue of
voluntary departure (Tr. at 4; 6). Matter of C-B-, 25 l&N Dec. 888 (BIA 2012). Additionally,
given that the respondent is allegedly the subject of a active arrest warant in El Salvador fr a
double homicide and the DHS was expressly opposed to volunty departe, the Immigration
Judge should have issued a decision which contained specifc, clear, and complete fndings of
fct that were supported by the record and were in compliance with controlling law. See Matter
of S-H-, 23 I&N Dec. 462 (BIA 2002). At the present time, we express no opinion regading the
ultimate outcome of these proceedings. See Matter of L-0-G-, 21 I&N Dec. 413 (BIA 1996).

ORDER: The record is remanded to the Immigation Cou fr fer proceedings
consistent with the fregoing opinion and fr the entry of a new decision.
