    Following up on revelations that Environmental Protection Agency (EPA) Administrator Lisa Jackson used at least one “alias” email account not readily identifiable as that of the administrator, CREW sent Freedom of Information Act (FOIA) requests to nine agencies – including the Departments of Homeland Security, Education, Energy, Housing and Urban Development, Interior, Justice, State, Treasury, and Defense – asking for records that would show whether their agency heads also use alias email accounts. As CREW explained in its requests, the requested information will reveal how widespread this practice is in order to evaluate the extent to which it has led to under-inclusive responses to FOIA, congressional, and discovery requests, and a failure to preserve records in a way that complies with the Federal Records Act.

    This responds to your Freedom of Information Act (FOIA) request dated and received in this Office on November 30, 2012, in which you requested records sufficient to show the number of email accounts of or associated with the attorney general, the deputy attorney general, and the associate attorney general, and the extent to which those email accounts are identifiable as those of or associated with those individuals. This response is made on behalf of the Offices of the Attorney General, Deputy Attorney General, and Associate Attorney General. Please be advised that the Attorney General, Deputy Attorney General and Associate Attorney General each currently have one unclassified e-mail account. The Deputy Attorney General also has a classified e-mail account. The Deputy Attorney General and Associate Attorney Generals e-mail addresses utilize those officials names and thus are clearly identifiable as belonging to them. The Attorney Generals e-mail address does not use his name. This protects his privacy and security and allows him to conduct official business efficiently via e-mail. This e-mail account is searched along with other records of the Office of the Attorney General as appropriate. When releasing documents from this account in response to FOIA requests, the e-mail address associated with this account is redacted pursuant to FOIA Exemption 6, 5 U.S.C. 552(b)(6), but requesters are advised that the withheld information consists of the e-mail address of the Attorney General. This practice ensures that Attorney General e-mails released under the FOIA are identifiable as such. I trust that this response provides the information sought in your request. However, please feel free to contact me should you have any further questions. If you are not satisfied with my response to this request, you may administratively appeal by writing to the Director, Office of Information Policy, United States Department of Justice, Suite 11050, 1425 New York Avenue, NW, Washington, DC 20530-0001, or you may submit an appeal through this Office's eFOIA portal at http://www.justice.gov/oip/efoia-portal.html.
