A New Thread in “Unspoken India's” Tolerance Level

“Kantaben” a phobic character in “Kal Ho na Ho” movie ,a Gujarati tuned chorus behind her
every expression and appearance perhaps would have added nuts in mass comedy of movie
through suspicious immoral relationship of SRK and saif ali khan. She even prayed for
engagement of normalcy and decency in relationship.

But this time her phobia is actualized into reality when Delhi HC more jubilant decision for
legalized gay sex among consenting adults, with the idea of unnecessary enactment of law
which offers criminal offense against fundamental rights. However, Section 377 of the Indian
Penal Code, which criminalities homosexuality, will continue for non-consensual and non-
vaginal sex.

Before and after the decision, 24X7 news channels and English dailies regular scene- mass
campaign of news after every hour ( with note as “details awaited”), highly decorated sets with
colorful lights, in the shed of well knitted and dressed reporters, who wanks new secrets of
distorted history and details at the rush prime time, some channels business in reporting
(historical decision that something great happened) is also exuded as some movement of
busy peoples behind the reporters and babblers , dark red coloured headline of “breaking
news” (some one can really judge font as “time of roman” , italic 20 font), someone holding
mike in inset , flashing BSE sensex (running from right to left and left to right) under the strip
and and blinking strip of “new programme” in same channel as a national service to update
viewers , is a regular “ Tamasha” of Indian channels.

With the Delhi courts decision, flashing news , jubilant faces, screaming hoarders, dancing
Delhi bellies particularly pleasant sight to watch men locking lips or sticking their tongues into
each other’s mouth. They all were relived in really monsoon for them with the commentary of
“carnal intercourse against the order of nature” is no longer a punishable offence” The
statements — “We are free at last! For years we have been waiting for this day!” — made by
weeping activists of what is known as the ‘lesbian, gay, bisexual and transgender community .

In all while waching this great Indian Tamasha , most absurd feeling with the these peoples
and reporters who specially feels pride in denouncing berth of India as a 127th nation who
accepts Gay Sex. The mumming sound from Pakistani you tube sneakers engages Internet
traffic to attract new definition for Indians as “Gay Ho” was really boiling up.

The exercise to link social framework, acceptance and enactment of law by law enforcement
agencies unable to percept the strata of social values. “Kantabens” phobia , was real example
of India's social , moral, ethical values which derived from guidelines of humanity, religion,
culture and outlined with constitutional ridges of framwork.

Kantaben was following that the same unspoken social decency in society with the moral act.
Let me clarify her ethics which were fundamentally inculcated on every person in Indian
society since the nourishment of our civilized Sindhu-Ganges culture under the aegis of holy
guidelines and framework of Vedas, Manusmuti and Holy Indian sculptures like Mahabharata.

Please keep in mind treatises like Kamasutra and temples like Khujrao were never part of
mainstream Hindu society. They were developed by the fringe elements of social outcastes and
esoteric left-handed tantrics. Hinduism did not kill deviants like others . It just ostracised them
and let them do their own thing. This does not mean rest of the society regarded the deviant
behavior as normal. Look at the verse from, explictly condemning homosexuality,
Mahabharata, which is a scripture that mainstream Hindus follow:

In Manusmuti , the social guideline of Hindu cultural ,which arguably categories ladder system
in Hindu sociality explains unequivocal approach towards obnoxious cult in society by saying :
Homosexuality led to loss of caste status. So it was condemned in Hinduism. There is no
interpretation of Hindu scriptures that accepts homosexuality as normal or not antithetical to
Vedic dharma. Read the following verses from Manu Smriti:
11.174. A twice-born man who commits an unnatural offense with a male, or has intercourse
with a female in a cart drawn by oxen, in water, or in the day-time, shall bathe, dressed in his
clothes

11.67. Giving pain to a Brahmana (by a blow), smelling at things which ought not to be smelt
at, or at spirituous liquor, cheating, and an unnatural offense with a man, are declared to
cause the loss of caste (Gatibhramsa)

Verses from Srimad Bhagavatam 3.20.23

य त मढ दर च र व य न मथन रत
परषष स दष ज क बत ! उपय व#त त
पश!श य ब#& यव#त य च गर तलपग
क*र, मथन य च क ब ज यव#त त नर

The sinful men who engage him/her self in immoral sensual offenses, hear terms ,”Viyono” ,
has indication of his/her quality depredation with animals and push that “nar” into impotent
“Purushtva”

Mahabharta (Chapter 13 : “Anusasana Parva” )

अय नन च व य नन च न गच1त व चकर ।
वपङग ! कव5न6 न र6 न त म ढमर,वस॥ १२५॥

"Those foolish men of evil conduct who engage in all forms of intercourse, taking advantage of
improper wombs (viyoni), and forcing themselves upon other men (pumsaka), are born again
without their organs as neuters." (Mahabharata 13.125)

Convincing on the facts of Kamasutra and Khajuraho's carvings

Sexual minority congress and their supporters reluctantly believe that unnatural and immoral
act is prohibited in Hindu culture and Indian society too. Some of new aggressive media
evangelist lead them to the rhetoric of Khajuraho temple sex carvings between holy Hindu
deities.
Facts About Khajuraho Temple

• It must be emphasized that Khajuraho Temples, do not contain sexual themes inside
the Temple premises or near the deity(The basic Universal Divine Energy
(Shakti) is a symbol of the union of man and woman) but only on external
carvings. They give the message that one should always have God as the central
point in one's life even though one is engaged in worldly activities.

• They also depict that the inner deity of the Temple is pure like the soul (atman)
which is unaffected by sexual desires and other gross tendencies, destiny etc,
whereas the external curvature and carvings of the Temples depict the bodily changes
that occur in us.

• The builders of that termple were followers of the Tantric cult (Ostacrised in Hindu
religion practices and agreesive way to attain God) which believes that
gratification of earthly desires is a step towards attaining the ultimate liberation. This
was one of the reasons why Tantrics perished.
• In Khajuraho Temples, the idols of Shiva, Nandi, Goddess Durga, Incarnations of Vishnu
etc are fully clothed.

• All over India, in no Temples have idols of Deities been shown nude and in sexual
positions .

Kamasutra and Homosexuality hyphenation with Ved

Some of more scholars from media chosen the platform of “Kamasutra” which is also same
connotation between sexual allowing which corroborate their deeds. That is absolutely
distortion of history . Those article about hyphenating “Kamasutra and Ved” by new born
newbies, wannabes. They have been written with a premeditated conclusion intended without
regard to the scriptures own self-evident meaning. Many scriptural statements have been
mercilessly twisted and distorted beyond recognition

A example of those freelance journalist taken referance from The Gay and Lesbian Vaishnava
Association /GALVA) article "Tritiya-prakriti and homosexuality in Vedic culture.

Quote from that article :

Quote 1: Homosexuality, on the other hand, occurs much more commonly,

which most estimates place at about 5% of the population, or one out of every
twenty people, and these people make up the majority of what is known in the
Vedas as "tritiya-prakriti: people of the third sex."

Quote 2: "[Quotes about homosexuals] ...can be found in the Caitanya-

caritamrita (1.13.106, verse and purport), and the "nartaka" transgender dancers
are also mentioned in the Srimad Bhagavatam (1.11.20-22) concerning Lord
Krishna's entrance into Dvaraka."

Quote 3: In Vedic literature,..... Transgender people were considered to be aloof

from this attachment, particularly gay males. They typically did not engage in
procreation or family life, and this was a special quality that made their status
unique within civilized Vedic culture."
In response to the GALVA article on homosexuality in Vedic culture , a participant Mr. Jahnava
Nitai Das has clearly reveled the misconception and distorion by prejudice minded peoples
who do not accepts Ved and twisted sacred texts to validate therir mis deeds.

For Quote 1:

„The article presented by some of media personeela and associaltion of GALVA accounts major
distortion of the vedic history. They stated that homosexuals make up the majority of
the "third sex" described in Vedic texts is pure speculation. The entire article is not one
of scholarship, but of distortion. Innocent people who are not familiar with the language of
such statements will be mislead“.
The fact is "the Vedas" do not speak of this. It is the Kama-sutra that describes the
"tritiya-prakriti", or third nature. To take a reference from the Kama-sutra and claim
it is found in "the Vedas" is in very poor taste.
„The real disease is not homosexuality nor prejudice, it is in not accepting the Vedic texts as
they are, and instead trying to interpolate our own thoughts into them. To take Kama-sutra
and keep it on the platform of a transcendental scripture is foolish“.

For Quote 2:

“The author makes another drastic distortion . Simply because a text is written in sanskrit
does not mean anything in regards to the authenticity and value of the text.“

„Both of the referred Caitanya-caritamrita (1.13.106, verse and purport) have absolutely
nothing to do with homosexuals at all. The particular word used in both verses is "nartaka".
Nartaka simply means "dancer". It is a very common word used throughout the Puranas and
Itihasas. It always refers to dancers, not to homosexuals.“

„In fact, Nartaka is a name of Lord Krishna, "nartaka-gopala"; and he is found in the holy
dhama of Udupi. It refers to Gopala the dancer, not to Gopala the homosexual. We have
two related words, one is "nartana" which means dancing, and the other is "nartaka",
which means "one who dances".

„The referred Srimad Bhagavatam (1.11.20-22) is as follows:

nt-ntRk-gNxvRhœ

sut-mgx-viNdnhœ

gyiNt caeÄmðaek-

cirtNy! Aтtin c

"Expert dramatists, artists, dancers, singers, historians, genealogists and learned speakers all
gave their respective contributions, being inspired by the superhuman pastimes of the Lord“.
thus they proceeded on and on.

The verse does not mean that the ntRk is a homosexual. The word „nartaka“ refers
specifically to a dancer, It is definitely not a sign of scholarship. „Nartana is the art of
dancing, and those that follow it are „nartakas“.
Conclusion :

“This shows that the article lacks any trace of scholarship. They just put forth what they want
people to believe without regard to language, context, or history, and expect everyone to
accept their distortions of precisely defined words”

“Anyone can only conclude that the distortion offered by the author of the article was
intentional, as there is nothing confusing about this word and its definition.”
What to speak of homosexuals, who are not even belonging to this third nature, but only
imagining themselves belonging to it.
„They want us to believe that homosexuals are "aloof from attachment". Is this sanity? Are we
to believe that homosexuals are somehow superior, free from attachments, and free from the
distractions to spiritual life?! „

Media shining and convenience for sexual preference

Frankly speaking the whole set of lobbed articles and their referances has sought to arise
anger and bitterness, not because sodomy has been legalized but the way media and so called
protesters who have poor taste of social value and hyped the affair up to in matchable
equivalence to man and woman relationship. In broader sense what consenting adults do
behind closed doors is entirely their business, so long as they don’t expect others to admiringly
emulate their dark deeds or endorse their queer behavior. Not only do they want homosexuality
to be accepted, but they want us to believe that homosexuals are superior to normal people”.
Tolerance also means to learn to live with criticism and non-acceptance; it is not a one-way
traffic. If you are different, so be it. But that does not mean everybody is going to hug and kiss
you, or treat you kindly. Nor does it necessarily mean everybody who is repulsed by the very
idea of men , after the enactment of law would jump into bed with men, or women making out
with women, or public display of coarse homosexual affection, is a homophobe.
In all media reporting and protagonists one common not necessary demand was that like all
minorities the ‘sexual minority’ too has special rights and these should be safeguarded, upheld
and enshrined in the Constitution. Most of bollywood celebrities and so called modern world
“commentariat” of 24X 7 channels have flooded their views on Section 377 of the Indian Penal
Code which was drafted 149 years ago in a certain social and political context, may not be
relevant today. Indeed, most if not all, sections of the IPC are outdated. But the existence of
Section 377 on the statute book has not really prevented deviation from ‘carnal intercourse in
accordance with the order of nature’. Removing it off or twisted as per “Non conseual penial
non vaginal sex” in the statute book, will not make much of a difference.
The media debates long why Section 377 was in statue book seems that our so called
Complementarits have poor taste and memory of of this culture. The reason why 377 persisted
for so long owed partly to the colonial inheritance. But far more important, it found a place in
the statutes because it corresponded to an unspoken social definition of Hindu ordinary
decencies.
Let me clear this point, as per section 377. which criminilise “Non conseual penial non vaginal
sex”, In last many decades after the enactment of this law no records of adult individuals being
prosecuted under Section 377 for consensual “carnal intercourse against the order of nature”
Kanchan Gupta , most renowned editor says,”If we have to accept that as ‘harassment’ of
gays, and paedophiles and rapists are to be allowed to walk free because we must be ‘tolerant’
of members of the ‘sexual minority’ community, then this wondrous land of ours is headed the
way of Sodom and Gomorrah.”
The hight court had undertaken surgery with general anaesthesia and announced decision on
the ground that consensual sex between two adults violates fundamental rights. It is a utterly
different matter to establish a moral equivalence between same-sex relationships and man-
woman relationships.
The Delhi High Court in its wisdom has decided that Section 377 violates liberty and equality
rights to its Indian citizens. So if Section 377 IPC, is a violation of fundamental rights by
criminalising consensual sexual acts of adults in private, then why it forgot to take into account
Articles 21, 14 and 15 of the Constitution.”
Article 21 guarantees protection of life and personal liberty.
Article 14 guarantees equality before law.
Article 15 prohibits discrimination on grounds of religion, race, caste, sex or place of birth.

Our Left-liberal, secular commentariat that dominates English language media and has gone
into a tizzy welcoming the Delhi High Court’s judgment that for equal rights for another
minority in India, forgot to mention Articles 21, 14 and 15 that even violates under the section
of article 377. What will they say on India’s Muslim women who are held in thraldom by the
All-India Muslim Personal Law Board and who are denied both rights and dignity in the name of
shari’ah.
If so then Muslim women shall have equal rights as Hindu (or Christian) women in matters of
divorce, maintenance, inheritance and adoption. How would the commentariat react? What
would the secularists offer, on French President Nicolas Sarkozy’s assertion that the burqa is a
symbol of subservience that suppresses women’s identities and turns them into “prisoners
behind a screen”, have then said?
The reactions that makes angry and bitter feeling for the protesters and media reporters ,
freelance journalists, LGBT community, NGO's and direful celebrities, who obsessed for
fundamental right and indiscrimination for sexual minority who actually hasn't faced either
discrimination and repression from Indian society but their attitude towards Indian society was
defamatory. Worser than bad was attempt to corroborate and hyphenate homosexuality on
ladder of Hindu scripts and national leader statements.
If someone was really obsessed fro fundamental rights, then why woudn't our media
commentariat denied in speaking about 1/20 th populations protection under the articles of
21,15 and 14. Those unspoken lives have been facing discrimination since their birth,
legitimized by Rajiv Gandhi’s stunning decision to undo the Supreme Court’s historic judgment
in the Shah Bano case through a shameful Act (Muslim Women's protection on Divorce) Act,
1986 of Parliament.
Agresssive militant gay campaigners have made life impossible for those who want to lead
private lives without ‘coming out’ and flaunting their sexuality. In Britain, for example, the age
of consent for voluntary homosexuality was 21 at the time of the Sexual Offences Act of 1967;
by 2000, this was lowered to 16 despite the fierce opposition of the House of Lords and the
Christian churches; now there are demands for legalising gay marriages and altering the
school curricula to show that man-woman relations are not the natural order of society.
Twisting Section 377 may strengthen India’s pretentious claims to being a ‘liberal democracy’,
but so long as the remains on the statute book, but the invocation of equality and the
principles of non-discrimination are a double edged sword. By highlighting those stigma on
Indian soeities unspoken decenscy to accommodate and tolerate, has now the potential to spin
out of control.
A nation where discrimination is sanctified by law and Articles 21, 14 and 15 of the
Constitution exist only on paper for millions of its citizens who suffer in silence as a jubilant
LGBT community screams, “Gay Ho!”
Constitutional law provides the steel framwork for civilian guidline. But in world , its
paradoxially diffrent to compare law enacted-the gesture of de-criminalising homosexuality
from endorsing it. The recognition of gay rights and its accompanied by a robust assertion of
the state and society’s commitment to family values is act as buffer zone . Perhaps this buffer
zone has prevented India to preserve its cultural heritage despite myriad invasions.

With kind regards,

Shital
