American Justice

The legal profession in America is structured into two main key points, like the Judiciary and the lawyers. The judiciary stands for the judges , which are nominated by the President, confirmed by the Senate and appointed for life. A network of appointing them , then, exists and as expected there is also a network that is supposed to remove them , as plainly as they have been nominated. The judiciary enforces the legitimate laws of the legislative and executive branches of government and restricts citizens by law. The judges are somewhat independent of the law, but act according to
it when in session.

There persists a general distrust among the Americans , when it comes to lawyers. This
fact is given by their courtroom behavior or by simply their large numbers in the country. For a lawyers career, the most first important step is his University. There he studies academic lectures and also practical casework. Knowing the law of the state in which they will eventually practice is a must and of course , if they truly want to profess, they must pass the state bar examination. They work in various domains of the society like for the federal and state government or in industry and commerce, but most of them work in private practice and cater for individual and corporate clients. The lawyers are organized into the American Bar Association( ABA). Related to crime, America lives out a myth that they created themselves, in the sense that their country is seen as a highly criminal country, so with a high level of criminality. This country has a very high level of criminality among industrialized nations. Atlanta, Miami, Dallas, Fort Worth and St Louis remain the leading cities in which crime manifests itself the most. It is argued that 60% of all the crimes are committed by only 5% of the population and that the incidence group is teenage persons ageing 13 to 19. The most widespread criminal offence is murder. Reasons for crimes are various. There are police and detectives in the cities and marshals and deputies in rural areas that assure law enforcement in the state. The F.B.I. ( the Federal Bureau of Investigation) is responsible for federal crimes. The police cannot minutely search into an individuals house , papers, or even the persons in case without a warrant. The police must read suspects their legal rights before they are arrested or questioned. These rights include: the right to remain silent, to have an attorney present during questioning, and to consult a lawyer before making a statement.

The death penalty seems to be alright with the majority of the Americans and that as long as it is done in a fair and impartial manner , people accept it. The prisons problem is another critical issue in the American legal system and this they try to improve by various methods ,like the death penalty, because of the overcrowding of prisons and allowing some prisons to be run by private firms. Gun-owning and gun control is also a major issue in the American culture and although they support stricter than the present or the same gun-control laws to curb crime, they wouldnt give away their home gun.
As for my opinion , I believe that any system of law needs amendments, but the American system of law is a better one ,a better law system than most law systems. I do not think that lawyers should be despised in any manor ,just because they are many in the country.

Crime rates in our country are also high and probably this is given by the fact that the media influences the phenomenon. We do not the right to possess a gun for our own safety, stipulated in our constitution , but we have the Mafia , which in fringes many of the legal systems health. I consider the decision not to have any death penalty in this part of the world a more humane side of the system , probably the Americans should consider abolishing their death sentence or at least rethink it.
