7/16 Meeting with BG, MH, MJ, PR and SA

Re: FBFDOJ Policy Making and Implementation

BG suggested that the FBI was not a policy maker. FBI's role was not policy driven, rather it
was driven by a case by case basis (which is restrictive by nature). Probably little overall pre 9-
11 counterterrorism guidance, and guidance may not have always been taken seriously. BG
noted that a Feb. 1999 "Electronic Communication" ("EC") was distributed regarding
counterterrorism, but again, it may not have been given priority in the field. Also suggested
reading DOJ's IG Review Audit Report (RDOJ 03002360—Sept. 2002).

Prior to 9-11, NY field office handled much of the counterterrorism and A/Q issues.

Suggested contacting Gorelick about DOJ's counterterrorism approach.

MJ is interested in: l)FBI's overseas operations (and how FBI staff operated with embassy staff),
2)where FBI should have been present but was not and 3)FBI presence at the NSC.
