The respondent, a native and citizen of Mexico appeals fom the decision of the Immigration
Judge, dated December 21, 2011, denying his request fr a continuance while he pursues
nonimmigant status under the provisions of section 10l(a)(l5)(U) of the Immigration and
Nationality Act, 8 U.S.C. l 10l(a)(l5)(U), befre United States Citizenship and Immigration
Services (USCIS) and ordering his removal fom this count. Te record will be remanded to
the Immigration Judge.
We review Immigration Judges' fndings of fct fr clear eror, but questions of law,
discretion, and judgment, and all other issues in appeas, de novo. 8 C.F.R. 1003.l(d)(3).
Under the circumstances presented in this case, we conclude that it is appropriate to remand
the record to the Immigration Judge fr frther proceedings in order to provide the respondent
with a renewed opportunity to request that these remova proceedings be continued while USCIS
considers his request fr U nonimmigant status. SeeMat|eo/SachetSosa,25 I&N Dec. 807
(BIA 2012). Specifcally, on appeal, the respondent ha presented evidence that, aer the
respondent's last heaing befre the Immigration Judge, a law enforcement agency executed a U
Nonimmigrat Stats Certifcation (For 1-918, Supplement B) on behalf of te respondent's
sister, indicating that both the respondent's sister and mother provided statements to the police.
The respondent has also presented a receipt notice fom USCIS fr te application, fled by his
mother, and te respondent asserts that he may claim eligibility as a derivative of this application.
We express no opinion regarding the ultimate outcome of these removal proceedings at the
present time and we note that the respondent bears the burden of demonstating "good cause" fr
a continuance of these removal proceeding. 8 C.F.R. 1003.29, 1240.6. We fer note that
while, in cerain circumstaces, a continuance of removal proceedings may be waranted where
an alien is seeking a U visa fom USCIS, a continuance should not be grated where it is being
sought "as a dilatory tactic to frestall the conclusion of removal proceedings."
