To: The enterprises that are using machinery, equipment, hazardous chemicals required on Industrial Special Safety. Implement the assignment of Ministry of Industry according to Decision No.136/2004/QD-BCN dated Nov 19/2004 about issuing the management regulation upon the technical safety for the machinery, equipment, hazardous chemicals which are required Industrial Special Safety ( referred as objects); The Dong Nai Service of Industry branched by The Ministry of Industry will request the enterprises locating in Dong Nai are using machinery, equipment, hazardous chemicals required on Industrial Special Safety implementing the following scopes : 1/ Registration at The Dong Nai Service of Industry on the usages of the objects required Industrial special safety that the enterprises are using ( enclosed to the list ) 2/ The application for registration of using the objects includes : Declaration decoration ( complied with the Annex 1 issued on the Decision No. 136/2004/QD-BCN dated Nov. 19/2004 by the Ministry of Industry ) Nothorized copy of Certificate of the technical safety quarantine of the machine, equipment, required on Industrial Special Safety . The explanation of the origin of the hazardous chemicals, monthly chemical usage, maximum storage capacity of the tanks, warehouse and methods for storing them . 3/ Once dont use these objects, the enterprises have to report to the Service of Industry where they have registered in order to letting them know to erase the enterprise names on the records. 4/ The enterprises using the objects will be responsible for : + To implement the regulations as stipulated, criteria, regulations on technical safety and stipulation on objects belonging to management boundary . + To be allowed to put those into operation once having them checked safely and quarantined. + To observe, process, cope with the problem(s), incidence(s), involved with the technical safety within the enterprises limited legist ration duties. + To record and supply all the documents, records relevant to objects so the inspector(s), observer(s), quarantine service(s) may require. + To make sufficient preparation as stipulated by the laws to carry out the quarantine execution. + To organize the training on safety as regulated . + To unify the planning for quarantine with the quarantine service and inform the Industry Service before the day of quarantine . + Making a report on the year quarantine issue and a planning for the coming year to the Industry Service on Nov. 30 yearly.( as-built report form regulated in Annex 3 attached to Decision No. 136/2004/QD-BCN dated No. 19, 2004 by Ministry of Industry. Based on the said scopes, Service of Industry requires the enterprises seriously implementing those, if theres any breach theyll be fined as stipulated on current laws.

Implement the Decision No. 136/2004/QD-BCN dated Nov 19/2004 of the Minister of Industry upon Issuing the machinery, equipment, hazardous chemicals which are required on Industrial Special Safety . Sub-Department of Industrial safety instructs the execution the decision as follows : 1/ To the Service of Industry. aArranging the execution of the registration on machinery, equipment, hazardous chemicals required Industrial Special Safety. The subdepartment as stipulated on the Chapter 2. To the machinery, equipment, the application for registration includes the declaration decoration form as regulated on Annex 1, copy of the Certificate of technical safety quarantine organ, an explanation sheet on the origin of chemicals, the purpose of usages, and their noxiousness The registration of chemicals applied for manufacturers, chemical storage services with any quantity. After checking the application , if its legal , Service of Industry will records all the application documents . bDue May 30 and Nov 30 yearly, based on the execution situation of the service, the report of the enterprises, Service of Industry sets report on statistics, finalizes the registration and the quarantine to report the Ministry of Industry as stipulated on Annex 2. cOrganizing the instructions, checking, the enterprises located on Dong Nai Territory as stipulated in Artcle 2 on the registration, quarantine & execution the legal regulations, criteria, technical safety regulations on machinery, equipment, hazardous chemicals required Industrial Special Safety. Finding out and proposing to the relevant authorities punishing, fining due to the breaches as on the article 16. 2/ To the enterprises who manufacture, storage, use the machinery, equipment, hazardous chemicals required Industrial Special Safety. All the enterprises in the article 2 when manufacturing, using, storing the machinery, equipment, hazardous chemicals required Industrial Special Safety have to : - Be responsible for the organization of the implementation as stipulated at article 21 . - Record the machinery, equipment, hazardous chemicals required Industrial Special Safety. - On Nov. 30 annually , setting the report on statistics, generating the registration and quarantine as formed on Annex 3 to send to the service of Industry where the company is located . 3/ To the quarantine Service of Industrial Technical Safety : Te quarantine Service of Industrial Technical Organization ( referred as the Quarantine ) is the organ which authorized by the Ministry of Industry to quarantine the machinery, equipment required Industrial Special Safety . The Quarantine has responsibilities for following the regulations as said on the chapter 3, article 20.

Instructing the enterprises manufacturing, storing, using, set the report on statistics of quarantine of the enterprises . Due May 30 and Nov. 30 annually, setting report on statistics of quarantine issue of the enterprises as formed on Annex 5 sending to the Sub-Department of Industry. 4/ Fees and charges : - Fees and charges will be decided by the Ministry of Finance . - Sub-Department of Industry report to the Service of Industry, Finance to examine the issue . - Sub-Department of Industry proposes the Service of Industry the enterprises who manufacture, storage, and the quarantine will base on the regulations of the Decision No. 136/2004/QD-BCN instruct the details for implementation
