Dear Records Access Officer: Under the provisions of the New York Freedom of Information Law, Article 6 of the Public Officers Law, we hereby request a copy of records pertaining to the most recent audit of the building located at 165 West 9th Street in Brooklyn, including: DOBs Notice of Audit Objections The letter indicating DOBs Intent to Revoke Approval(s) and Permit(s) Any supporting documents generated by DOB or submitted by the applicant Any communications between DOB and the applicant, electronic or written Any documents or communications related to reasons for initiating and/or concluding the audit

As per our prior request, dated October 2, 2013, we are aware that an audit of this building was performed in the spring of this year and several objections were found, including those pertaining to the Zoning Resolution, Administrative Code, and Multiple Dwelling Law. It is our understanding that the audit was accepted on August 23, 2013. However, to date no detailed information has been made available related to the resolution of those objections or the penalties for any breaches of applicable legal requirements. On Friday October 18, 2013, it was brought to our attention that two notes were added to the Building Information Systems Applications Details webpage for Job No. 320581562 at 165 West 9th Street in Brooklyn: Job on Hold and Audit: Notice to Revoke 10/17/2013. When Council Member Brad Landers office requested more information about this most recent audit, the DOB representative did not make it available, citing ongoing litigation related to the building.

As you know, the Freedom of Information Law requires that an agency respond to a request within five business days of receipt of a request. If for any reason any portion of our request is denied, please inform us of the reasons for the denial in writing and provide the name and address of the person or body to whom an appeal should be directed. We understand that fees may be imposed to produce paper copies of these records. We would like to request any material in electronic form, as practical.
