Award death sentence to all accused in Nirbhaya's murder says prosecution


NEW DELHI, NOV 01: The Delhi high court on Friday commenced hearing on the confirmation of the death penalty awarded to four convicts in the December 16, 2012, gangrape case here. The prosecution said it has all the evidence against the four convicts awarded the death penalty by the trial court. Special public prosecutor Dayan Krishnan, starting the arguments, briefed the court and said all the accused had conspired to rob and rape the victims. ROHIT SINGH RANA India may be one outside to a foreigner. It may be a big land mass with a huge population. To him, it also may appear a vibrant democracy with great politicians. It is only the insiders called Indians, who know how the country is made to run. There is a sizzling saying it is only the earthworm who knows the pecking of a bird or it is only the horse who feels the taste of iron band in his mouth. The same is being repeated by the politicians and leaders who are busy making their own Indias, suiting and tailor made to their electoral needs. Unfortunately, India and Bharat are made to fight with one another with almost all present day politicians drawing a blank on Bharat and ill informed about India. Whether the country is passing through one of its darkest periods or a churning of disparate and deranged ideas is taking place, only time will tell. That indeed is a great distance away, but immediately there is a laughter challenge going on between Modi and anti Modi camps. View the situation as dispassionately as possible, one is forced to take a 60-40 chances in favour of the Gujarat Chief Minister. Reasons are not far away; in fact they are literally under our very nose. We can smell them but not see and that makes some spicy addition to the plot. The recent addition to the Modi diatribe is Kapil Sibal. In all fairness to him, he is a good constitutional expert and a famous lawyer. But when it comes to playing the game of politics befitting his stature, he too like his overzealous 10 Janpath camp followers adopts the same dubious line. Wonder, why such things happen. Sibal has castigated Modi for his lack of knowledge of Indian history. Agreed, the Gujarat Chief Minister did misquote history, maybe he does not know about Alexander or Takshishila. He ought to improve on his history. On the other side if Sibal is asked about Indian history, many things of crucial importance too will not be known by him is any bodys guess. Congress has developed and crafted a Congress history of India where there is fewer places for Hindu culture and Sanskrit civilisation which form the bed rock of Indian conscience called Bharatityata- Indianness. Many in their camp are ill at ease why India existed prior to 1947 forgetting conveniently to the peril of the nation that Gandhi, Nehru Patel, Kriplani, Bhave, Sarojini Naidu, Rajendra Prasad and many other eminent men vouched for the basic and intrinsic spirit of Indianness. For the time being, let us assume dynasty democracy is good for the nation because it has produced great stalwarts like Nehru and Indira. Law of nature does not guarantee a string of political geniuses down the line in a dynasty. Once, Dr Sarvapalli Gopal, the historian son of great Dr Radhakrsihnan himself on radio talk said that it was impossible for him to emulate his father. Biologically genetic combinations define the inherent greatness of a man or potential to become great. But who will listen, Digvijay, Salman, Sibal, Tiwari, Ajay Maken and host of diehard Congressmen look the other way, when hard biological truths stare on their face. Rajiv Gandhi was a pilot. Records say not an outstanding one, born in the first political family of India; he was after the unfortunate assassination of his mother, hurled in the midst of political heat. Ask any dispassionate and impartial political commentator and he shall nurse no outstanding opinion about his rule. Now comes Rahul and we have seen the poor gentleman is not made for politics but who cares, his coterie will never countenance with that. For them he is the best choice India can have. Even the economist prime minister, who prefers to remain silent on crucial issues, thumped his chest to proclaim that he too was willing to work under Rahul. Sycophancy at its best or worst, but paranoia crossing limits. The nation with heavy heart, has suffered Sibals notional loss theory in 2-G Spectrum scam and unfortunately we are made to suffer his noxious and imprudent statements again. Saying Modis rallies are driven by black money, may be easy to say but hard to prove and if there is an investigation in this regard, why there was no such investigation when Indira addressed bigger rallies or when Rajiv spoke at large rallies. It is another specious argument which is being hurled because Congress is unable to gather people in bigger numbers compared to Modis rallies. Truth is hard to face, it is bitter to swallow, but if taken in right earnest can be of great help. Today Congress, Rahul and men like Sibal have to face the truth and understand its silent language.

Why Hurriyats is unhappy over HCs verdict?

First security forces were derided for resorting to firings but when they came up with effective non lethal means Hurriyat is peeved because when less blood is shed it loses its sinister political presence. court for confirmation of their sentence. Awarding death penalty to the four, the court said their "hair-raising beastly and unparalleled behaviour" definitely qualified as one of the "rarest of rare cases" that deserved the death sentence. A 23-year-old woman was brutally gang-raped in a moving bus by six people, including a juvenile. The accused then threw her and her male companion out of the vehicle, stripped of clothing, to die by the roadside on the cold December night. The woman died of grave intestinal injuries on December 29 at Singapore's Mount Elizabeth Hospital where she was airlifted for specialized treatment. One of the six accused was found dead in a cell in Delhi's Tihar Jail. A juvenile involved in the crime was, on August 31, sent by the Juvenile Justice Board to a reform home for three years, the maximum term under the juvenile law.

SC commends Bhim Singh's fight for justice for Pak & Foreign Prisoners
NEW DELHI, NOV 01: Lauding the role of Senior Advocate Professor Bhim Singh's fight for justice for Pakistan and Foreign Prisoners , Apex Court on Friday said that it is because of the efforts of Singh that Pakistani and foreign prisoners lodged in different jails of India could have been repatriated. Justice R.M. Lodha observed that, "whatever relief the foreign prisoners have been able to secure, it is because of Prof. Bhim Singh's selfless and forceful commitment to the cause of civil rights and civil liberties. Prof. Bhim Singh has been taking up these cases before us with whole devotion. He has been spending money to pursue the matter for several years. We can say that Prof. Bhim Singh deserves commendation for his excellent work in this regard." While expressing his gratitude to the Supreme Court for lighting the lamp of

democracy through its historic judgments and orders particularly relating to the civil liberties of persons irrespective of their nationalities, Prof. Bhim Singh said that more than 300 foreign nationals from Pakistan, Pakistan administered Kashmir, Afghanistan, Iran and some other countries who were detained in different Indian jails since 1991 have been repatriated

to their respective countries. He said that there are nearly 300 Pakistani prisoners, who are still languishing in different jails in India. Prof Bhim Singh expressed deep shock on the failure of the Government of India to repatriate 21 mentally challenged Pakistani prisoners, who have been languishing in different jails namely Jaipur, Sriganga Nagar, Jaiselmer, Amritsar for

years in spite of the direction of the Supreme Court of India to lodge such prisoners in some safe houses. Prof Bhim Singh urged the Supreme Court to find a way out for their human-living and survival with dignity. The court directed the Additional Solicitor General P.P. Malhotra, Sr. Advocate to file a status report on these petitions. Prof Bhim Singh also raised

the issue of 15 Bangladeshi prisoners lodged in Okha Marine Police Station without any offence registered against them. He made a strong plea to the court for their strong message to the Union of India. Singh also appealed the Apex Court to release Abdul Sharif, son of Ghulam who has been detained in Central Jail, Amritsar from past 16 years.

Divisional Commissioner reviews arrangements for visit of Parliamentary Sub Committee


JAMMU, NOV 01Divisional Commissioner, Jammu, Shantmanu on Friday convened a meeting of senior officers to review the arrangements regarding visit of sub-committee on the action taken on 137th report of rehabilitation of J&K migrants of the department related parliamentary standing committee on Home Affairs to Jammu and Srinagar from November 5 to 7. Preparations regarding the visit of parliamentary subcommittee to Purkhoo and Muthi migrant camps on November 6 and interaction with migrants on November 7 were discussed in details. Divisional Commissioner deputed liaison officers with the sub-committee for the Later, a meeting of the parliamentary sub-committee with the Chief Secretary would also be convened. JAMMU, NOV 01: Stating that the right to organize peaceful protests is an inalienable right of the people in a democratic polity, State Secretary CPI (M) Mohammad Yousuf Tarigami on Friday appealed all the political parties and trade unions irrespective of their affiliations to rise to the occasion against denial of democratic rights in the state. Addressing a press conference at Jammu, Tarigami condemned the police crackdown against workers of Chenani-Nasari four-lane road & tunnel project in Jammu region. He said the way right to peaceful protests is being stifled; it will only encourage the emergence of autocratic and violent forces in the society. He demanded immediate release of workers who have been detained by police in false and frivolous cases. The CPI (M) leader observed that democratic process should not be misconstrued only with the electioneering process but the same means protection of constitutional guarantees of democratic rights which include civil liberties and right to protest as well. Tarigami said the management of the project should carry the workers along and not to take them at a ride. "The management should listen to them, talk to them; engage them allow them to protest and accommodate their long pending demands," he remarked. Tarigami said: "It is unfortunate that during the recently concluded autumn session of legislative assembly in Srinagar, the employees were protesting outside the assembly premises in favour of their long pending demands. SOPORE, NOV 01: People Friday alleged that soon after the departure of Syed Ali Geelani from Iqbal Market Sopore, CRPF and police personnel flexed their muscles on people who were raising anti-India slogans. However, terming the allegations baseless, a police official said that hundreds of youth participating in Geelani's rally pelted stones on police and CRPF personnel deployed in Sopore. According to reports, as thousands of people started marching from Sopore to Doabgah, scores of youth who were part of the rally resorted to stone pelting which created panic there. Those people who were not aware about this development ran for safety. Police and CRPF personnel responded with tear gas shelling and charged people with canes. In order to disperse agitated youth police resorted to aerial. An eyewitness said that peace disturbed in the town after Geelani left the venue. "Youth were seen collecting the stone as Geelani Sahab was read to leave the venue. Everything was peaceful till then, even Geelani Sahab appealed to youth to be peaceful and not to resort to violence," he said. Police official said that it was necessary for the police to respond as the procession was big and laxity could have proven fatal. "We brought situation under control and everything is normal there," he said. Reviewing arrangements for Muharram, Chief Secretary asked the concerned authorities to extend all possible facilities to the people particularly in Shia dominated areas during these auspicious days. stock of the pace of road widening and removal of bottlenecks in Srinagar city. He directed for speeding up the work and streamlining the traffic on roads in the Srinagar city. On this occasion, DDC Srinagar while apprising about the activities of district administration said that out of approved district plan of Rs. 6668.89 lakh for current fiscal out of availability of Rs. 2349.68 lakh, Rs. 1253.07 lakh expenditure has been recorded amounting to 53 percent of the total allocation.

Chief Engineer, Mechanical Department apprised the meeting that mobilisation of men and machinery for snow clearance shall be activated instantly after snowfall and control room set up for the purpose will be made operational from November 15 this year. He said 19 snow ploughs, 4 snow cutter machines have been kept ready for snow clearance besides keeping standby 6 plough machines.

Bowlers face difficulty due to new ODI rule: Virat


BANGALORE: Indian batsman Virat Kohli on Friday said the new ODI rule, which enforces an extra fielder inside the 30-yard circle at all times, should be looked into as it is working against the bowlers. "In batting-friendly conditions, it is very hard for the captain to contain runs and has been difficult for the bowlers. Hence, the rule should be be looked into as far as keeping five fielders (inside the circle) is concerned," Kohli told reporters at the pre-match press conference. "It is ICC's decision to give us the rule. So I can't comment more," he added. With this new rule in place, India and Australia together have scored a phenomenal 2,565 runs from four ODIs so far, excluding the 295 the visiting team scored in the abandoned one-dayer in Ranchi. Indian skipper Mahendra for big scores, Kohli said it was necessary for bowlers to have confidence otherwise team's winning momentum goes for a toss. Eighth seed Yuki pipped fourth seed Japanese Tatsuma Ito 6-4 1-6 7-5 in the quarterfinal, which lasted one hour and 46 minutes. The 277-ranked Yuki avenged his last year's defeat in Kyoto against the higherranked Japanese, who is 105 places above the Indian in the ranking chart. The tree-lined and narrow DGC is rated as one of the most difficult golf courses on the Asian Tour but Lahiri has enjoyed great outings winning three Asian Tour titles. "A lot of the players fear DGC, it's probably one of the feared courses on Tour. I'm comfortable at the Delhi Golf Club. For me, the Indian Open has been good, moving from one favourite venue to another. I'm looking forward to a win," said Lahiri. Lahiri said that winning his National Open remains as one of his top priorities in his golfing career. He has enjoyed some measure of success in the Indian Open in the past, finishing tied third, 15th and fifth in 2009, 2011 and 2012 respectively. "It's going to be a historic event. Everyone mention it's such an important event for the Indians, there is so much history and tradition behind

it. It's like a major for all of us. I know Jeev (Milkha Singh) even he wants to win the Indian Open before he retires. "That's what it means to someone like Jeev who has won so many events around the world. Being the 50th year, it's going to be special. n a long 24 year journey everything changes. For Sachin Tendulkar things have been no different. He started out as a marauding 16 year old who wished to tame every bowler he faced. And this had come at the back of his assault on Abdul Qadir in Pakistan in his debut series in 1989. The Qadir story goes thus. The match, a 50 over ODI, had been curtailed to a 20-20 because of rain. With a huge crowd waiting patiently for action, the organisers had little choice but to reduce it to a 20 over a side game. match was played in full seriousness and Pakistan scored a healthy 157 in their 20 overs. India, in reply, had lost a flurry of wickets to start with and when Tendulkar walked in to join his captain K Srikkanth the asking rate was touching 13 runs per over. The match was all but lost.

Srikkanth asked the young man to get some valuable batting practice and much to his surprise was told that Sachin was still keen on trying to win the match for India. The captain consented resulting in the start of the Tendulkar show. He soon hit Mushtaq Ahmed for a couple of sixes and

announced his intent loud and clear. At this the great Qadir is said to have walked up to him and said "bachhe ko kyun mar rahe ho. Agar dum hai toh mujhe mar ke dikhao." Sachin, forever respectful, had responded saying Qadir was a genius and wouldn't allow Sachin to get after his bowling. What followed was mayhem. Qadir was literally toyed with and Sachin hit him for 4 sixes in an over. Qadir, a true sportsman, came up to him post match to congratulate him on his performance and has gone on record to say that he realised that day itself that this man possessed special talent.

bring him back safely. The Shenzhou-5 on October 2003, carrying an astronaut and staying for more than 21 hours, was a major success. Since then, China has had five successful manned missions where 10 Indian Space Research Organisation by the Defence Research and Development Organisation and Hindustan Aircraft Limited. The combined strength of these organisations could perhaps benefit the space programme overall by allowing for knowledge and experience sharing, preventing duplication of efforts and achieving higher efficiencies in the days to come. But the distinct difference between the Indian and Chinese programmes is the manned space mission of the latter. In this, the Chinese are at least 10 years ahead of India. A manned space mission was also planned by India but it has been in cold storage for various reasons. The net result is that though in 2005 India declared that it was on in par with China in almost all respects except in the manned space mission, today the country is lagging far behind. In the global scenario, the European countries are concentrating on commercial launches of communication satellites in which they have been successful. The US space programme is virtually standstill for the last five years for want of policy decisions and lack of adequate funding. The Russian programme also is not progressing much because of the lack of funding. As a result, China is emerging as the global power in space. India also had the same opportunity, but the lack of initiatives and imaginative programmes let us down. It is not that India does not have the ideas; it is not that we do not have the technical capability; it is not that we do not have right kind of man power, but at this moment it is the lack of visionary leadership which is affecting the Indian space programme. The Chinese programme too had a bad patch. After the death of Mao in 1976, the rival group of Deng Xiaoping did not appreciate the efforts put into the satellite launch vehicle programme for almost 10 years, but later realised the importance of scientific exploration of outer space. The whole programme was revived in 1993. If India wakes up and puts its best foot forward with its large resource of highly talented personnel, well-equipped laboratories and accumulated knowledge, it can still emerge as the global power in space exploration and in providing space-based services.

THIRD FRONT IS AN ILLUSION
Those who believe that the coming together of 14 regional and Left parties on a common platform in Delhi on Wednesday signals the imminent formation of a robust Third Front regime, must stop having utopian ideas. It is one thing for parties with disparate goals and ideologies to share the dais to spew venom at opponents and another to form a cohesive Government. In any case, it is far from clear if jointly forming the Government has been on the agenda of this grouping. Even more unclear is whether many of these parties are going to remain aloof from either the Congress or the BJP in a post-poll scenario. Those such as the Nationalist Congress Party, which attended the 14-party convention, are currently part of the Congress-led UPA, while another participant, the Samajwadi Party, provides outside support to the UPA regime. That they are unhappy with the Congress is known. Yet, they have continued to back it, and the possibility of their doing so after the election, especially if they find that their purpose can be better served being with the Congress, cannot be altogether ruled out. On the other hand, those like the AIADMK, the Janata Dal (United) and the Biju Janata Dal have all been part of the BJP-led NDA at some point in time or the other. It may be that the JD(U) is today especially harsh on the BJP, but the AIADMK is not and the BJD is restrained in its criticism. How these two parties respond to the situation once the results of the Lok Sabha election come in, cannot be determined now. In other words, they are far from certain to be part of the so-called Third Front which will be pitted not just against the Congress but the BJP too. That the conglomeration of these parties on Wednesday confined itself to targeting the BJP while remaining largely silent on the misdeeds of the Congress, underscores their realisation that it is useless to deliberate much on a party that will be a spent force in the coming Lok Sabha election. Even the regional outfits and the Left know that the BJP will emerge as the dominant entity that they will have either counter or do business with. Given that the Left parties had taken the initiative for the Wednesday meet, which they have marketed as a convention against communalism', the anti-BJP sabre-rattling was only to be expected. However, there are many parties in the grouping that do not share the Left's visceral dislike for the main Opposition, and they are bound to speak up when the time is ripe. Given the incohesiveness of the 14 parties that had gathered as if under one banner, just what was the purpose of their posturing, apart from taking potshots at the BJP and its prime ministerial candidate Narendra Modi? It appears to be two: Enhance bargaining power and prepare the momentum for a possible political formation post-election. Given that the Left parties had supported UPA1, they may well be sending signals to the Congress through their show of strength. Many regional parties also believe that the Wednesday convention will strengthen the credibility of their claim that they are in a position to provide an alternative non-Congress, non-BJP Government to the people. But the people have not forgotten similar disastrous experiments in the recent past, and they are unlikely to swallow the bait. In any case, any so-called Third Front regime won't survive without the support of either of the two major national parties.

EVEN IN OUTER SPACE, CHINA BEATS INDIA

The Indian space programme was initiated by the visionary leader Vikram Sarabhai. He declared that India could be second to none in terms of acquiring the latest technologies related to space and their application to solve the problems of the common man. The Indian space programme has lived up to his expectations and today we have self-reliant technologies such as the Polar Satellite Launch Vehicle. We have also demonstrated how space-based assets can be put to use for improving the quality of life of common man. The Indian space programme though initiated in 1963 with the launch of a sounding rocket, serious work on development of the large booster started only in early 70s. Thus, India had 20-year-late start compared to other nations. Still, the achievements in the last 30 years are remarkable, considering that the entire effort is indigenous and undertaken in a civilian set up. In contrast, the Chinese space programme was initiated in 1950 by Mao Zedong for military application. He saw the threat of US missiles and wanted to create a network of anti-ballistic missiles. His primary objective was to develop the missiles for defence. Looking back, China was the first country to have use rockets (in fireworks) back in 600AD. Later they were used as weapons against the Mongolians. It is reported that one of the early inventers had fired a large number of rockets tied to his chair with the intention of flying out to space. This attempt failed because the rockets exploded and killed him and several other courtiers. Perhaps this is what motivated the Chinese leadership which demanded, in addition to creating a capability for missiles for defence, efforts should be mounted on human space flights. In the 1950s and 1960s, the Chinese focussed on developing different types of missiles. In the initial period, there was assistance from Russia but it was the strong will of Chairman Mao that ensured that China made progress on the missile front. He declared, Not only do we need more airplanes and artillery pieces, we also need the atomic bomb in this world today to avoid being bullied, we cannot be without it. satellite Sputnik on October 4, 1957, Mao decided to make China equal to the other superpowers. He implemented projects with the aim of placing satellites in the orbit by 1959. The goal was to be achieved in three phases: Developing sounding rockets first, launching small satellites and launching large satellites. True to this dictum, the Chinese implemented this plan and now they have capability to take satellites into the orbit as well. By 1970, China had established the launch capability of orbiting satellites around the earth. This is the time when Indias first satellite launch vehicle was on the drawing board, leading to a successful mission only in 1980. Parallely, the Chinese programme for development of the manned capsule was adopted in 1971. On the 50th anniversary of the Peoples Republic of China in 1999, the Shenzhou-1 Spacecraft was launched on-board the Long March 2F and recovered after a flight of 22 hours. Four years later, China became the third country with a successful space programme to send an astronaut into space and Tachonauts have travelled to space including two women. In these missions, they have carried out extra-vehicular and docking trials. Due to the potential of using the space technology for war, China was on the embargo list for a long time and not able to get technology from the Western world. This accelerated its internal effort. The net result is that today China has got a lead position in launching satellites in the Asia-Pacific region and the upper-hand in the manned mission. The Chinese programme is focused, and quite distinct from the Indian programme. India has been concentrating on the peaceful application of the spacecraft as well as launch vehicle technology whereas China has emphasised on integrated development of missiles and space launch vehicles. The China Aerospace Industry Corporation was established to carry out both civilian and military programmes for missiles, satellitebuilding and satellite-launching. In India, the missiles and aircraft programmes are organised independent of the

Even as political parties take to the rally circuits demonising their opposition, we need to be proud of this robust campaigning and electoral process. We have conducted it better: from mega phones and rickshaws, wall posters and TV advertisements, talk shows, on-the-stump harangues, the internet and cellphone, through low-tech and high-tech, over jungle and stream, ballot-box to EVM; than any other country. It is a superb no-holds-barred venting of the national spirit that can only be subverted by the violence that silences. That is why electoral violence, the threat of sudden death that our politicians risk when they attend and address public meetings, is possibly the unkindest cut of all. And to use such violence, or permit it to happen by default, as a political tool, is truly despicable in its subversion. Is this what happened in the Hunkar Rally at Patna where Mr Narendra Modi addressed lakhs of people recently? If the Indian Mujahideen and its ilk thrives in India, it does so with the patronage of forces both within and without this country. Being soft on such terrorism is not at all a good turn done to millions of law abiding and patriotic Indian Muslims. It is this sinister and primitive stratagem of the politics of assassination, engineered riot, stampede, etc. that can stifle our vibrant democracy. In Pakistan, where non-state actors are pampered and maintained by the state, several politicians have been silenced. It has become such a Frankenstein that no one is safe. The Pakistani Taliban and others are quite willing to bite the hand that feeds and even dictate terms today. The politics of assassination has taken its toll in gun-happy America too. It kills Presidents, but school children, rock stars, people in congregations and gas stations too, because even though they say a fish rots from the head down, it actually does so from the gut outwards. We have done it too, killing in political vengeance, in riots and pogroms, and take for granted, is the level of freedom of opinion and expression, of conscience, we enjoy in this country. We must be proud of the purple prose of our editorials and the hectoring tone of our TV anchors for this reason alone. We must appreciate the lively debate between invited speakers on our talk shows even though the Indian way is to speak all at once and freely interrupt each other! Let alone the hyper-sensitive regimes and ble of being just as sinister as anything the pathologically aggressive ISI can dream up. This despite also being the land of the free and the home of the brave. When, in great metropolises such as London, Paris or New York, diversity is allowed its play without murderous reaction from opposing forces, it is cited is as a mark of civilisation and is celebrated. But Western civilisation has to remind itself to be tolerant. It does not come naturally to a people with crusades, which are just jihads by another name, in their genetic memory. And yet, in venal, corrupt, age-old India, we can, and mostly do say whatever we want. Hinduism preaches it. So does Buddhism, Jainism, Sikhism, etc along with non-violence, even Indian strains of Sufi influenced Islam say the same thing, as does an Indianised Christianity. We know how to embrace diversity. It runs in our genes. The British, affected by their Indian exposure, did have us locked up in political prisons, but not that many at that. The Mughals had their enemies murdered, but mostly the rivals to power from their own families and those in territories they conquered. We, even in the formation towards a nation state, have never indulged in massive genocide, ethnic-cleansing, or the bloodbaths of religious war, except at Partition. This country is essentially peaceful, god-fearing and blessed. Many the world over realise it. We who are born here tend to think nothing of it. But we do nevertheless benefit from it despite increasing lawlessness of late. The Soviets and the Chinese have murdered their own citizens in their tens of millions for being misfits, mildly critical or rabid dissidents, with almost no distinction made between minor and major affront. They say the best predictor of future human behaviour is past behaviour. Let us hope then that we vote for peaceful change to Modi Raj rather than a maintaining of the status quo out of habit or risk aversion. What will we get if Congress comes back either at the head or at the tail-end of a coalition? We will certainly get more povertarian politics! There will be no justice brought to all the masses of corruption perpetrated over the last few years. RaGa will continue to rule from the wings in tandem with his mother. Dynasty will become a non-issue just like the foreigner issue before it. Populism will be applied with a passion. Business and industry, GIP, infrastructure, security, diplomacy, reform, progress, practically everything else will languish. Accountability and Performance wont matter . There is a clear-cut choice this time. Mr Modi wants to go fast-forward to build the nation and its economy. Mr Gandhi wants continuity, of the failed but remarkably serviceable Socialist narrative. What is it that the people of India want?

MUZAFFARNAGAR BURNS AGAIN


Even before the thousands who were displaced during the September violence in Muzaffarnagar could return to their homes, that district in Uttar Pradesh is once again on fire. In fact, Wednesday's communal clash is only the latest addition to a long list of more than a 100 riots that have erupted under the watch of the Samajwadi Party Government in the State in less than two years. The irony of this cannot be overstated, given that not just the ruling party in the State but also the Congress which leads the Government at the Centre, both claim to stand for secular values. In fact, even after this latest bout of communal violence, Uttar Chief Minister Akhilesh Yadav had the gall to claim on Thursday that around the country, only a non-BJP, non-Congress coalition of supposedly secular parties (such as his Samajwadi Party of course) could rein in communal forces. That his statement must be viewed against the political imperatives generated by the 2014 general election goes without saying. Equally importantly, it also lays bare the fact that neither Mr Yadav nor the Samajwadi Party has cared to learn any lessons from the September riots. Instead, they continue to play with fire, despite being burnt by dangerous brand of communal politics that they peddle. Prima facie evidence suggests that the Wednesday night clash which claimed at least three lives in the Budhana area of Muzzafarnagar are an extension of the September riots. Those involved in the fighting were residents of the two villages that were affected by the previous spate of violence, and it seemingly took just one vicious rumour to inflame passions. But this is not surprising. The September riots in Muzaffarnagar, in which more than 60 people died and thousands were rendered homeless, were one of the worst instances of communal conflagration in recent memory, and it only served to deepened social faultlines. The matter was made worse by an apathetic and inefficient police force whose hands were firmly tied by the State's blatantly partisan political establishment. In fact, even after the riots, precious little has been done to bring the perpetrators to book. And as if that wasnt enough, even during Wednesday's clash, there were lapses on the part of police in containing the incident, as the Uttar Pradesh police chief himself has acknowledged. All of this put together has severely damaged Lucknow's credibility. The people have lost faith in the State machinery and they feel vulnerable. Cynical politicians are possibly hoping to use the tools of minority appeasement to leverage this social tension into votes. But they are mistaken just because the bleeding has been stopped, does not mean that the wounds have healed. And let there be no doubt that the people will punish those who inflicted the wounds in the first place.

Thus they have never intended to change the age old names of villages, towns, cities and district head quarters. The historical nomenclature of every village, town, city and district head quarter is intact as it stood as per revenue records. The district Anantnag is continuing by the name of Anantnag and so far no state has ever attempted to tamper with its original records. Therefore the perception of letter writer seems biased. Even then if some sections of society call it also by the name of Islamabad it never shows any obstinacy in belief nor it poses any threat to national interests. The vulnerability was increased because of hydro projects which have led to blasting of the mountains and dumping of debris on river beds, leading to rising of river beds and hence increased flooding and flood related disasters. The relentless wrath of nature was compounded in Orissa, the cyclone Phailin. The dam led to flood disasters in many towns. Many homes have lost all their crop. The coastal areas of Tamil Nadu were made more vulnerable to the Tsunami in 2004 because of industrial shrimp farming which had destroyed the mangroves. The Japan earth quake and tsunami were one of the most serious disasters recently. The Orissa super cyclone had a velocity twice the historical average and therefore caused more damage. Intensification of cyclones is driven by climate change. Oral instructions undermine accountability: Supreme Court


NEW DELHI, NOVEMBER 1: Civil servants must refrain from acting on oral instructions of political bosses, except in certain exceptional circumstances, the Supreme Court made it clear on Thursday. The judgement, on a public interest writ petition by 83 persons, comes on the heels of controversies surrounding action against Ashok Khemka, IAS officer of the Haryana cadre, over the DLFRobert Vadra land deal, and Durga Sakhti Nagpal, U.P. cadre IAS officer, for alleged misconduct. A Bench of Justices K.S. Radhakrishnan and Pinaki Chandra Ghose referred to the recommendations of the Hota Committee (2004) and the Santhanam Committee report, which highlighted the necessity of recording instructions and directions by public servants. The Bench said: We notice that much of the deterioration of the standards of probity and accountability with the civil servants is due to the political influence of persons purporting to represent those who are in authority. The Santhanam Committee on Prevention of Corruption, 1962 has recommended that there should be a system of keeping some sort of records in such situations. Rule 3(3) (iii) of the All India Service Rules specifically requires that all orders from superior officers shall ordinarily be in writing. It added, Where in exceptional circumstances, action has to be taken on the basis of oral directions, it is mandatory for the officer superior to confirm the same in writing. The civil servant, who has received such information, in turn, is required to seek confirmation of the directions in writing as early as possible and it is the duty of the officer superior to confirm the direction in writing. The Bench said: There must be some records to demonstrate how the civil servant has acted, if the decision is not his, but if he is acting on oral directions, instructions, he should record such directions in the file. If the civil servant is acting on oral directions or dictation of anybody, he will be taking a risk, because he cannot later take the stand the decision was in fact not his own. Recording of instructions, directions is, therefore, necessary for fixing responsibility and ensuring accountability in the functioning of civil servants and to uphold institutional integrity. Pointing out that democracy requires an informed citizenry and transparency of information, the Bench said: Oral and verbal instructions, if not recorded, could not be provided [to citizens]. By acting on oral directions, not recording the same, the rights guaranteed to the citizens under the RTI Act could be defeated. The practice of giving oral directions/instructions by the administrative superiors, political executive etc, would defeat the object and purpose of RTI Act and would give room for favouritism and corruption. The Bench, therefore, directed all State Governments and Union Territories to issue in three months directions like Rule 3(3) (iii) of the All India Services (Conduct) Rules, 1968. The petitioners said weak governance manifesting in poor service delivery, excessive regulation, whimsical interventions for personal benefit, wasteful public expenditure, inadequate transparency and lack of accountability had reduced effectiveness of government policies and impinged on development. They submitted that lack of good governance affected the quality of life and violated the guarantees provided under Article 21 (right to life and liberty) of the Constitution.

Sri Lankan fishermen remanded to judicial custody till November 15


RAMANATHAPURAM: A local court on Friday remanded 24 Sri Lankan fishermen, who were arrested by the Indian Coast Guard for allegedly entering into the countrys waters, to judicial custody till November 15. The fishermen, arrested on Oct 30, were later taken to the Puzhal prison at Chennai, officials said.

Rape accused commits suicide after marrying victim


NEW DELHI: A rape accused committed suicide by jumping before a Metro train, said police, adding that he was depressed due to his marriage. Manoj Kumar, 28, jumped in front of the train at the Chhatarpur Metro station Thursday night. He came under the wheels and lost both his legs. He later died in hospital. Police said a suicide note was recovered in which Manoj wrote that he was depressed because of his wife. According to a police officer, Manoj in April this year married a woman whom he and his friend had allegedly raped. "Both the accused were arrested and sent to police custody. After getting bail, Manoj tied the knot with the woman but was not happy," his family members told police. Manoj, who was employed in a transport company, lived in the Mehrauli area of south Delhi.

Some States enacted laws and implemented the directions in part, prompting the court early this year to once again remind all of them of the need for compliance. The matter is still pending. Main objectives In its September 22, 2006 verdict in the Prakash Singh vs. Union of India case, the court sought to achieve two main objectives: functional autonomy for the police through security of tenure, streamlined appointment and transfer processes and creation of a buffer body between the police and the government; and enhanced police accountability, both for organisational performance and individual misconduct.

CHENNAI: A fire broke out at the storehouse of the British-era Government Central Press on Mint Street in Seven Wells in north Chennai on Friday. The police suspect an electrical short circuit might have caused the fire. Around 2 am on Friday, employees saw smoke coming from the storehouse and alerted the firemen. Fire fighters with tenders from New Washermenpet, Esplanade, Vepery, Royapuram, Tondiarpet and six water tankers from Chennai Metrowater were pressed into service. The fire spread quickly in the storehouse and due to the heat, the dilapidated building caved in. This is second incident in less than three months. Papers were gutted in a similar fire accident in June. Originally, the press was constructed in 1807 for minting coins and it was converted into the central printing press of the government of Tamil Nadu. DEHRADUN: A court on Thursday awarded capital punishment to a 26-year-old man in a case of rape and double murder in Haridwar district's Manglaur town. The additional district judge's court found Wajid Ali guilty of kidnapping a 13-year-old girl from her residence in Manglaur, raping her in a nearby village, poisoning her to death and also causing her grandmother's death by running his car over the woman on February 19. The court said since the case belonged to the rarest of rare category, the culprit deserved to be accorded a punishment not less than the death penalty. It said the manner in which Ali crushed the teenage girl's grandmother, 65-year-old Momin, to death was most inhuman and brutal. Momin had been grappling with Ali to prevent him from kidnapping her granddaughter. The cases against Ali were registered based on the statement made by the teenager before the police a couple of minutes before her death.

Pakistan asks Iran for clarification on gas pipeline


I S L A M A B A D , NOVEMBER 1: The Pakistan government has asked for a clarification from Iran after its Oil Minister publicly stated two days ago that the peace pipeline project was likely to be annulled. Federal Minister for Petroleum Shahid Khaqan Abbasi on Friday said that there was an agreement signed between Pakistan and Iran for the gas pipeline and it cannot be called off unilaterally. The government had asked for a clarification and also a meeting to discuss the project and its future, he said. The meeting could be held later in November depending on when Iran responds. He said that media reports cannot be the basis for judging if a project is called off or not and no official word had come from Iran on this. The pipeline project is facing flak for not negotiating a proper price for gas which is linked to international crude oil prices. There are provisions for heavy penalties if the Pakistan government does not fulfill its share of building the pipeline for which it had last month sought funds from Iran. Mr. Abbasi said these issues including the p e n a l t y clauses will have to be discussed when the meeting with Iran takes place. On Thursday, the Pakistan governm ent said it was committed to the project and was exploring all means of sourcing energy keeping in mind the acute shortage. This winter in Punjab for three months gas will only be supplied for cooking purposes and vehicles will not get compressed natural gas. The government was confident of signing a construction contract for the pipeline but that will remain in limbo till the Iran government gets back on the issue. Mubin Saulat, managing director of Interstate Gas Systems Limited, a public sector company, said while most of the 1,100 km portion of the pipeline in Iran is complete, financing the project for Pakistan was a challenge. The military said it carried out the strike after five of its soldiers were wounded as they tried to demolish another tunnel used by the Palestinian Islamic militant group Hamas that rules Gaza. That incident drew Israeli fire that killed one Hamas militant. The latest violence was the deadliest along the volatile boundary since an eight-day Israeli military campaign last November aimed at stopping attacks from Gaza, a coastal strip that borders both Israel and Egypt. The soldiers were blowing up the infrastructure of a recently discovered tunnel dug in Gaza that stretched into Israel when an explosive device was detonated late Thursday, wounding the troops and drawing Israeli fire, the military said. The import tariff value is the base price at which the customs duty is determined to prevent under-invoicing. The tariff value on imported gold was hiked two days back to $ 442 per ten gram, while it was kept unchanged at $ 699 per kg for silver. JAMMU, NOV 01- Minister for Planning Ajay Sadhotra on Friday said that the coalition government led by Chief Minister Omar Abdullah is expanding advanced sports edifice in the state with focus on rural and remote pockets. Shabir inaugurates free AYUSH aid cum awareness camp


RAJOURI, NOV 01 Minister of State for Health, Mr Shabir Ahmad Khan has said that maximum poor people would be covered under health insurance in the State adding that, the government has decided to extend Rashtriya Swasthya Bima Yojana (RSBY) to 10 more districts in the state, 5 each in Kashmir and Jammu. Addressing a public gathering on Friday at border village Sawani, the Health Minister said that RSBY, a National Health Insurance Programme for the people living Below Poverty Line, was earlier implemented under Pilot Project only in two districts: Jammu and Srinagar. ''It was decided to extend it to 10 more districts" he said and added that the scheme would later be extended to other districts of the state in a phased manner. The minister said that new districts to come under RSBY include Uadhampur, Rajouri, Reasi, Samba and Kathua in Jammu region, and Kulgam, Budgam, Islamabad (Anantnag), Pulwama and Speaking on the occasion, the Minister said the government was keen to promote the Indian system of treatment in the state. He said in this regard 438 AYUSH medical officers have been engaged at PHCs., 160 posts of Ayurveda and Unani medical officers created by corresponding reduction of equal number of posts of Assistant surgeons besides 396 AYUSH Pharmacist have also been engaged under National Rural Health Mission at Primary Health Centers across the State. He asked the department to encourage people to avail of this system of treatment. He said the government had set up ISM health centers at all state and district level hospitals, besides primary health centers, where free of cost medicines and other related facilities had been made available to needy patients. He underscored the need for organising more such camps in remote and hilly area for ensuring maximum benefits to the people by this type of health care facilities.

Schools to record attendance via SMS


PUNE, NOV 01: After a failed effort to register attendance of school students online, the state education department will now attempt to conduct it via SMS. Only 10% of the one lakh schools in the state responded to the online attendance system which prompted the education department to initiate the attendance through cellphones used widely by school officials and teachers. The department conducted a survey to find out how many schools used the online attendance system introduced by the government this academic year. Of the 1.3 lakh primary schools in the state, only 10,000 had adopted the system since June. Primary schools were asked to register daily attendance of students and teachers online through a special software. State education director Mahavir Mane, said, "Many schools in the interiors said they faced problems with internet connectivity as well as power cuts that created barriers in updating the attendance online, eventually leading them to stop using the software. Some schools were negligent despite being able to use it efficiently. Hence, we decided to use cellphones now available with almost every individual." The online attendance system was aimed at monitoring attendance of students and teachers in all the primary schools. The authorities can take immediate action against schools with poor attendance. According to the rule, all students, teachers and principals must have at least 80% attendance. The education department would prepare an application for cellphones for the attendance system which could be freely downloaded by teachers on their phone and send daily attendance to the education department. Mane said the current online system will also be used once the cellphone-based application is introduced. "The online system will not be scrapped. We have installed a software where each primary school has been given a login identity to register their attendance details. A report was prepared to review the system. Only 10,000 primary schools were found to have registered attendance, so far. The schools that fell short of the mandatory attendance have been warned. However, more awareness would be conducted about the system."

MELBOURNE, NOV 01: The new Australian government is set to announce a series of steps to make its student visa regime simpler to attract more foreign students, including those from India, and revive the billion dollar higher education industry. Immigration minister Scott Morrison and education minister Christopher Pyne jointly announced that the new coalition government was keen to revive the industry by undoing the damage done by the former Labor government, according to an official media statement. The two ministers announced that steps would simplify student visas through a streamlined assessment-level framework (ALF) and by extending streamlined visa processing arrangements to low-risk non-university degree providers. "The changes will assist all providers, but particularly the vocational education and training sector, making access to Australia's education system more attractive for overseas students," Morrison said. "Assessment levels under the ALF would be reduced from five levels to three, while financial evidence for AL3 students would reduce from 18 months to 12 months, provided funds were from a close relative of the student applicant. This would mean students from a number of key markets would be able to apply for a student visa with up to 40,000 Australian dollars less in the bank. Streamlining of the visa application process that Morrison announced last week would benefit up to 22 low-risk non-university providers for students enrolled in Bachelor, Masters or Doctoral degree courses or an eligible exchange programme. REASI, NOV 01 - District Development Commissioner Reasi Dr Shahid Iqbal Choudhary, who is also the District Election Officer stressed on organizing special awareness drives for the voters in a meeting convened to finalise the District Plan Of Action for Systematic Voters Education and Electoral Participation (SVEEP). Dr Choudhary informed officers that the SVEEP action plan basically involves registration of eligible voters, inclusion of names in photo electoral rolls, distribution of EPIC cards, ensure increase in the number of voters at polling booths, equal participation of all sections in polling and voting, stressing greater participation for stronger democracy. He asked all the departments to actively participate in this plan and prepare action plan for their respective departments so that a complete action plan be drafted for district.
