This case arises under the Job Training Partnership Act

(JTPA) 1 29 U.S.C. § 1579 et se and the applicable regulations
issued at 20 C.F.R. Part xx+
On November 10, 1994, the Department of Labor (DOL) issued a
Final Determination regarding an audit of the JTPA program
operated by the Complainant which established a debt owed to DOL
in the amount of $18,02700 for violations of the above-mentioned
Act and regulations. On December 21, 1994, Complainant filed a
request for hearing in this Office. On January 20, 1995, this
Office issued a Pre-Hearing Order which required the Grant
Officer to file the administrative file and both parties to file
a Notice of Intent to Participate. DOL filed a response to the
Pre-Hearing Order on March 10, 1995. On March 27, 1995,
Complainant filed a request to withdraw the appeal stating that
the Tribe agrees with the revised final determination in this
matter.
As the parties have reached an agreement in this matter, it
is hereby ORDERED that the request to withdraw the appeal be
GRANTED and this case be DISMISSED.
