THE CONGRESS OF THE REPUBLIC;

LAW HAS ISSUED THE FOLLOWING:

Law that promotes the development of industrial parks Techno-organic PRELIMINARY TITLE Article I. Creating Techno-Ecological Industrial Parks with cluster approach This Act promotes and regulates the creation of techno-ecological industrial parks (PITE) through public and private proposals. Creating Techno-Ecological Industrial Parks, hereinafter PITE, is part of the national strategy of promoting competitiveness, associativity and profitability of the production units of the industrial sector in general including agribusiness, in a context of economic and social development regions and decentralization of economic activities, consistent with the efficient use of environmental resources throughout the production process as a means to achieve sustainable development. The techno-ecological character comes from the adoption and development of technologies especially related to the priority production chains in the process of promoting each PITE, in accordance with national and international standards for environmental friendliness.

Article II. End of Techno-Ecological Industrial Parks with cluster approach The aims of the techno-ecological industrial parks (PITE) ensure orderly growth and development of national industries with cluster approach, in accordance with the care of the environment, efficient use of energy, social responsibility and caring water, in accordance with current legislation on the subject Also develop productive enterprises based agro-ecological technology, in order to add value to primary production in the country's natural regions. Article 1Object of the Law This law aims to establish guidelines and mechanisms for the promotion and development of techno-ecological industrial parks with cluster approach (PITE) in partnership with the private sector. State participation is given by i) the provision of public land for the siting of PITE, and / or ii) the execution cofinancing PITE.

Article 2 Alignment with national competitiveness The Techno-Ecological Industrial Parks (PITE) covered by this law, are aligned in accordance with the National Agreement and the Competitiveness Agenda National Competitiveness Council.

Article 3 Scope of Law This law applies in the area of national territory. They are the national government and regional and local governments in charge of the promotion and / or implementation of PITE. To ensure that the development will boost PITE properly, it is necessary that regional governments identify and prioritize potential productive development needs in each region for implementation, the type of industrial park to implement and industrial activities be developed on that site. This should be reflected in the Regional Strategic Plan in order to effectively promote the implementation of PITE, whether public or private participation. The implementation by regional governments should align national policies issued by the Ministry of Production as lead agency, and the National Competitiveness Council (CNC) within its jurisdiction.

Article 4 Development of International Standards The development and promotion of PITE with cluster approach are subject to the parameters of the current national and international standards related to quality, environmental care, efficient use of energy, social responsibility and caring for water and everything necessary to protect the planet and sustainable balance.

Article 5 From private proposals for creating Techno-Ecological Industrial Parks 5.1. The proposed development project PITE must be submitted to the Local Economic Development Management or Regional, or his substitute, of regional and local governments, through consortia, in accordance with the provisions of Articles 440 to 448 of Law 26887, General Law, in accordance with Article 145 of Supreme Decree 184-2008-EF, Regulation of the Law of Contracts and Procurement, which should consist of national legal entities and / or national and foreign. The regulations of this law shall contain the details of the processes involved. 5.2. Proposals are in the nature of private petitions of grace referred to in Article 112 of Law 27444, General Administrative Procedure Act, as appropriate, maintaining the character of the content reserved until approved project viability and execution. 5.3. 5.4. Management of Local or Regional Economic Development, or his substitute, must maintain the confidentiality and privacy of private proposals submitted under responsibility. This obligation extends to public entities and public officials who by their position or function are made aware of the presentation and content of the proposed private. The confidentiality and privacy will be maintained until approval.

Article 6 Requirements for private proposals for creating Techno-Ecological Industrial Parks The minimum requirement for the submission of proposals are:

a) Name and address of the bidder consortium indicating its general law powers accompanying the corresponding legal representative. b) Profile PITE project. c) Object of PITE. d) Report describing the PITE project. e) Plan management of industrial waste generated in PITE f) Metrado and enhancement of PITE project. g) concrete benefits the project will bring to the locality where it is executed. h) Business Plan Sustainability PITE administration. i) Rules of operation and maintenance for the operation of PITE.

Article 7 Of proposals for the creation of public parks-Ecological Techno 7.1. The proposed development project PITE may be initiated by the state through local and regional governments, in accordance with the provisions of this Act. The proposals include consideration of the requirements of Article 6 above, with the exception of part 7.2. The total time for the evaluation and approval of the projects is provided in the third paragraph of Article 5 of this law.

Article 8 Evaluation and approval of development projects PITE The evaluation of the study is the Local Management or Regional Economic Development, or his substitute. The regulations of this law shall detail the assessment and approval process.

Article 9 From the location of the public land PITE in 9.1. The identification of the premises where the PITE implemented would be determined by the approval of the proposed development of the park. 9.2. It is the responsibility of regional governments and local physical and legal sanitation of the properties identified as part of the promotion of PITE prior to approval of each initiative. Regional and local governments can apply to the National State Assets (SBN) reservation and purchase of state land for development projects PITE.

Article 10 Managing Ecological Techno-Industrial Parks 10.1. For private proposals, the administration of PITE is done through a trust agreement signed with the consortium. 10.2. For public proposals, the administration is responsible PITE a directory consisting of one (1) representative of the consortium representing firms in the PITE, one (1) local government representative and one (1) regional government representative, as applicable.

Article 11 Criteria for setting the PITE For the development of the provisions of Article 6 and 7 of this law, taking into account the following criteria: 1. The laws relating to land use and environmental force, both at national, regional and local levels. 2. The identification of a potential demand for goods produced in the result of the study PITE corresponding market, according to the business plan of sustainability PITE administration. 3. Employment generation, occupying primarily to area residents. 4. The productivity and profitability of industrial activities to develop. 5. The contribution to economic and social development of the region, established in subparagraphs b) and g) of Article 6 of this law. 6. The creation or expansion of foreign markets for the industries established in the PITE. 7. Accessibility to a nearby urban center taking into account the provisions of Article 4, paragraph 9.2 Article 9, Article 14, paragraph 14.2 and requirement g) of Article 6 of this law.

8. The direct or indirect links among companies and technology transfer to the region or zone of influence.

Article 12 Transfer of public land for the siting of PITE 12.1. The national government, regional and local governments, under the provisions of the National State Assets and the current regulations, contractual arrangements facilitate transfer of land for the construction of PITE referred to this law. 12.2 With the approval of the relevant project, the property owner may transfer the land in accordance with the scope of Law 29151 and the provisions of the regulations of this law, investment plans and commitments. 12.3 The price or value of the land where they run the PITE projects is determined by the Ministry of Housing, Construction and Sanitation, by appraisal by the relevant body. The determined value is part of the project cost, the same can not be modified. 12.4 Where the PITE not come into operation by the deadline on the project and no request for an extension of that period, the land transferred to the development of them revert automatically to the holder of the property. Article 13 Obligations and rights of incumbents in PITE. The companies settled in PITE undertake: 1. Respect the rules of operation and maintenance for the operation of PITE. 2. Actively participate in the development of science and technology. 3. Establish agreements with institutions of higher education and research institutions of national and international. 4. Promote training for capacity development of human potential in the fields PITE components. 5. Do not change the architecture or productive activity for which it was awarded. 6. Access to common services, participate in technical conventions, scientific, economic and production management that achieves enter, participate in training events and other programs of capacity building. 7. Encourage the implementation of laboratories according to PITE productive activities. 8. Encourage innovation center and technological transfers PITE.

Article 16 Funding The provisions of this standard be funded from institutional budgets of the various agencies involved.

FINAL PROVISIONS

FIRST. Validity This law takes effect within 90 days of publication.

SECOND. Regulation Take charge of the Ministry of Production, the Ministry of Foreign Trade and Tourism and the Ministry of Environment, the drafting of regulations in a period not exceeding 90 days of its publication.

THIRD. Municipal Provisions The PITE to be developed and installed in accordance with the provisions of this Act must comply with municipal zoning and use compatibility, and others on the subject.

FOURTH. State Administrative Systems The proposals and implementation of the parks covered by this law are governed by the provisions of the administrative systems of the state and the current regulations, as applicable.

FIFTH. Annex 1, is the General Glossary, which contains the definition of technical concepts, which forms an integral part hereof.

SIXTH: Implementation Authorize the competent bodies of the provinces of Jaen in Cajamarca province of Mariscal Nieto in the department of Moquegua province Lucanas in the Department of Ayacucho, Huancayo province in the department of Junin, Province of Piura in the Department Piura, Tumbes province in the department of Tumbes, Pachacutec industrial park in the district of Ventanilla, Ancon district in the province and department of Lima, the implementation of the Ecological Techno-Industrial Parks in accordance with this Act.

SEVENTH. Adequacy Industrial parks created under the aegis of the Law 28,183, Law Development Fraamework of Industrial Parks, conform to the provisions of the regulations of this law.

GENERAL GLOSSARY

F) ISO: International Standardization Organization - International Organization for Standardization. G) ISO 9001: International Standard applies to Quality Management Systems (QMS) and focuses on all elements of quality management with what a company needs to have an effective system that allows you to manage and improve quality of their products or services. It is suitable for any organization looking to improve the operation and management mode, regardless of size or sector, and you should aim to be competitive. H) ISO 14000: An international standard that expresses how to establish an Environmental Management System (EMS) cash, designed to strike a balance between maintaining profitability and reducing impacts on the environment and, with the support of organizations. L) PITE: techno-eco-industrial park. Q) Social Responsibility: It is a form of management that is defined by the relationship business ethics and business goal setting compatible with the sustainable development of society. It is the active and voluntary contribution to social, economic and environmental firms, usually with the aim of improving their competitive position and valuation and its added value.

R) Types of industries. Industries may be:

- Industry clean. It is one that by its facilities or transformed or stored materials, poses no risk, nuisance or unhealthy for staff, neighboring buildings and facilities perimeter.

- Industrial pollution: That which by its facilities, materials handling, process and store, produce all kinds of trouble, fumes, noise, vibration, odor, fumes toxic or unhealthy, powders etc. Whose presence is annoying for users of neighboring properties, causing direct contamination.
