1. Ralth Stanley is the owner of a transnational import company that provides highly specialized robotic machine assembly equipment for U.S. manufacturing companies. He has business relations with a Chinese company named Joy-Luck Cyber Enterprises. In the event that there is no wish of his to get familiarized with Chinese laws and travel to China if a dispute occurs, there are several essential pieces of advice that can help to protect Ralph's company and its rights. First of all, Ralph needs to be sure that his business partner is the right one and he can rely on him. This is particularly critical because it is known that China is famous for its slow and quite expensive judicial process which is a subjest to corruption. So instead of relying on legal safeguards Ralph should be sure that his Chinese business partner is motivated as much as he is for fulfilling the contract. The second thing is that Ralph needs to clarify all contract terms and conditions before signing it. He should avoid any types of illegal agreements. In case Ralph needs help with any business issues (lawful or any other), he can use available services from the U.S. Department of Commerce, or from any professional law or accounting firms (World Law Direct, 2010). 2. As a high fashion lederhosen designer Marissa just had made a great deal with a company in Bavaria called Volkstanz. They agreed to purchase a large inventory of her upscale lines but they want her to deliver all the garments before they provide any payments. In this situation Marissa needs to analyze her possible risks before she takes any action. There are two potential courses of events. The first one is that she agrees and sends her garments before Volkstanz provides payments for it. Marissa takes risks in

this case. The second one lies in making another agreement with Volkstanz which can help Marissa to protect her interests. It calles a definitive agreement. (Private Business Law, 2012). I will advise her to make this kind of agreement where she is able to discuss and state different conditions. She can offer to deliver all her garments but the company should pay her a half of the money before any deliveries are made. At this point Marissa does not take high risks. 3. Penny is the owner of a business in the country that has good relations with the U.S.A. But there is a political unrest in the country. Penny is worried about her business because she thinks it can become the subject of expropriation. I would advise her to get a full consultation at any professional law firm of this country. A lawyer may confirm or disperse her doubts and give the most appropriate advice. In case there are any risks for her business, she can use any of the options available. The first one lies in closing business for some time with taking losses. The second one is to transfer her business to the U.S.A but consulting the U.S. Department of Commerce and professional law firm in there before she does so (United States Department of Commerce, 2012). Critical Thinking 1. Two people bother to argue about who is the best movie director in the history ever. My cousin Vinnie is sure that Stephen Spielberg is the greatest movie maker of all times because of some reasons. Many people support his point of view. But DeMille just can't believe and accept that Stephen Spielberg is the one who created a new movie concept. Here goes an issue between Vinnie and DeMille which sounds this way: they can't agree with each other about who is the greatest movie director. To make a specific

conclusion out of the situation these people are in the best thing is to see all the pros and cons. Of coarse, movies of Stephen Spielberg is much more impressive because of unusual plots, different special effects and fantastic adventures while movies of other movie directors like Woody Allen or Francoise Truffaut are about usual lives of usual people. That's why to drow the line under this issue we should just accept that Stephen Spielberg is really the one who deserves to be named the best in a movie-making industry (Top Ten Reviews, 2012). 2. Analyzing the issue between Vinnie and DeMille I can define several fallacies that are present. First of all, it is impossible to put all movies under one and the same line. There are different movie styles. Some movies are fantastic and another ones are realistic. Of coarse, you won't see any horrible creatures with special powers in a realistic movie about life of usual people. But you will surely see it in a fantastic movie. So at this point the best movie director can't be defined on the basis of special effects in his movies or something like that. Another thing is an understanding of people's interests. Stephen Spielberg is the greatest about creating fantastic movies full of action but anyway not everyone likes to watch it. Some people prefer real life stories full of romance and daily problems. So there must be a movie style separation. Moreover, movies directed by Stephen Spielberg do not have a deep life sense which is surely and obviously shown in every movie of Woody Allen. There are many more factors that should be disscussed before stating who is really that one perfect movie maker of all times without any doubts.

In fact this is one of the most interesting discussions. Each day a lot of

people are trying to name that one best movie director who completely changed our vision of a movie as an art form. This is our human nature and necessity to allocate the

best ones among many others. It is how we make our history filling it out with the names of the best, so we can learn and take cue from them. That's why this argument between Vinnie and DeMille has such a valuable nature.
