Buffalo Board of Education (BOE) and the Superintendent of the Buffalo Public Schools! Carl P. Paladino! November 7, 2013! Agenda for the November 13, 2013 meeting of the BOE!

1.) I re-submit item #42, Motion # 43 to dismiss Barbara Nevergold as BOE President. Attached is a copy of the Petition for her dismissal led with the Commissioner of the State Education Department.! 2.) Item # 41.Motion #47. Charter School for Applied Technologies (CSAT). I move that the BOE immediately furnish busing to the Charter School for Applied Technologies, ((CSAT) which has been doing an outstanding job educating Buffalo students, so long as the CSAT pays the share of the cost not reimbursed by the State Education Department (SED).! 3.) Item # 44. Motion # 48. Former Pinnacle Charter School. I move that the Superintendent immediately conduct negotiations with CSAT and SED to return the former Pinnacle School to Charter status either as a Regents or District Charter so as to allow the student body, parents and children to continue their harmonious and nurturing relationship and not allow the children to be disbursed throughout the Buffalo Public Schools (BPS).! 4.) Item # 37. PS #43. Apparently the superintendent is rejecting the implementation of the suggested Socratic method of teaching at the school. Please explain the rationale. Also explain why, after instructing Mr. Bakos to meet with the teaching staff to discuss the method and determine whether they would accept the changes, the central administration sent it's representatives to the school the day before the meeting to tell the staff that the Superintendent was opposed to the change and they shouldn't attend the meeting.!

5.) Item #36. Motion #50. Only on the recommendation of the General Counsel, who is unquestionably unt for her position, the Superintendent has designated a junior attorney with little experience in labor relations as labor relations attorney for the BPS . ! I move that the Superintendent furnish the BOE with the resumes of all applicants for the position, explain publicly why an attorney experienced in labor law and contract negotiations has not been hired, disclose any contacts or communications with BOE members or union representatives concerning this matter and hire an attorney competent in labor relations and union contract negotiation to represent the interests of the BPS!

! I know of two very qualied attorneys who applied and were rejected.! !

6.) Item #22. Motion # 49. The Superintendent has denied tenure to the Principal of Burgard High School after acknowledging to the BOE that the Principal is held in very high regard in the BPS, he was evaluated as "developing" but was scored 59 out of 60 by the district. He only scored 5 out of 20 on each of the 2 other grading blocks from SED because of poor student performance which the Chiefs of School Leadership admitted was brought on by the fact that he takes every challenged student sent to him where other principals reject those students to keep their performance numbers up. The Superintendent has indicated to the BOE that the man would be offered a JUUL. Apparently Crystal Barton, the union president, does not seek to contest the unfair denial of tenure. !

I therefore move that the BOE resolve that it does not support the denial of tenure, apologize to the Principal on behalf of the BPS, recommend that he hire an attorney to represent his interests and that the Superintendent explain publicly to the BOE any private communications she has had with Crystal Barton or any Board member, including President Nevergold in connection with her denial of tenure.!

7.) Item #4. Motion # 39. Superintendent Evaluation. Insofar as Counsel has advised that the June, 2013 evaluation of the Superintendent was conducted improperly and is not therefore binding or legally effective it is incumbent upon the BOE to re perform the evaluation. ! I therefore move that the BOE immediately conduct an evaluation of the Superintendent and I further move that the BOE Director of Talent Management release to me the entire June, 2013 evaluation le including all of the work papers, individual BOE member evaluations and scores that the Board President says that she deposited with him.! 8.) Item # 45. Motion # 51. Assistant Superintendent for Curriculum, Assessment and Instruction. I move that the BOE instruct that the Director of Talent Management furnish me with the personnel le for the person hired for this position. The DPCC has advised in writing that the appointment of this person should be rescinded and that parents should be involved in the decision making process.! 9.) Item # 4. Motion # 52. Deputy Superintendent for Curriculum, Assessment and Instruction. I move that the BOE instruct the Superintendent that the person holding this position in the BPS be discharged insofar as she is not competent to carry out the responsibilities of the position.! 10.) Item #47. Motion #53. Forged signature issue. The gravity of the crime committed and the evidence assembled to date raise the question of conict for any further efforts by the Superintendent to investigate the matter. There is a prima facie case of forgery and an attempt to cover up and whitewash the issue. ! I therefore move that the BOE instruct the Superintendent to immediately and formally refer the matter to the Erie County District Attorney for investigation.!
