Decking Contract

Project Description: This decking project will include ground preparation consisting of all shrubbery removal from designated area and disposal. All ground leveling necessary will be done prior to construction along with laying plastic for grass and weed control. The construction of this deck will consist of building an 8 x 15 deck, adjacent and situated on the back side of homeowners residence centered with the existing sliding glass door and flush to the threshold. This decking project includes building entire deck including all railing, stairs, and skirting. Any sanding, waterproofing, or finishing will be the homeowners responsibility. All deck material, fasteners, and the construction of the deck will be per print. Work performed at: Time for completion: The work to be performed will start within ten business days from the day this contract is signed and will be completed approximately within ten business days upon commencement of project. Payment: Homeowner agrees to pay Contractor a total price of $3,200.00. Contractor request $1600.00 for down payment, and $1600.00 upon completion of work. The homeowner must pay in cash any payments due according to payment schedule. Satisfactory payment according to this payment schedule will be acknowledged with a receipt of payment explaining amount paid, date paid, amount due, and signed by the contractor. Upon completion of work, satisfactory payment will be acknowledged by a receipt of payment explaining amount paid, date paid, signed by the contractor, and stating paid- in- full. Allowances: All material prices are included in the contract as allowances. The contract price shall be adjusted upward or downward, not exceeding a 10% difference of the estimated contract price. This adjustment will be based upon actual amounts and not estimated amounts.

Page 2 of 3 Changes in the Work: If the homeowner wants changes to the work or additional work done, modifying the work that has been agreed upon in this contract, the changes in the work need to be in writing and will become part of the contract once signed. This written change order will include changes in price, and an explanation and description of the change in work. Responsibilities of the Parties: The contractor will notify the homeowner if there is any material changes needed due to unforeseen physical conditions of this project. The homeowner is responsible to supply water, gas, sewer, and electric. The homeowner will make aware to contractor where property lines are. The homeowner has to provide access to the property and toilet facilities. The homeowner must remove or protect any personal belongings in or near the working areas. Asbestos and hazardous wastes will not be the responsibility of the contractor to remove or dispose of. In the event the contractor does encounter asbestos or hazardous waste the work will stop and the homeowner will be responsible to obtain qualified asbestos/hazardous waste material remover contractors. The cost of removing the asbestos or hazardous waste will not be included in the contracted price of this project, but will be an additional cost to the homeowner. Delays: The contractor will start work on the assigned date and shall complete the project by the assigned completion date. The contractor will not be responsible for any delays including but not limited to; delays in permitting, weather conditions, work strikes, delay in loan approval, delays caused by inspections, the removal of asbestos or hazardous waste, or other cases beyond the contractors reasonable control. Plans and Specifications: All plans and specifications should be discussed prior to the start date of the deck. All plans and specification of the agreement will be made in writing and any additional plans or specifications later added to this agreement must be made as an amendment. Subcontracts: This contract may at his/her option distribute portions of this project to properly qualified and licensed subcontractors. Fees, Taxes, and Assessments: The contractor agrees to obtain and purchase any required building permits. The homeowner will be responsible for any assessments or changes that may occur during the completion of the project. Insurance and Deposits: The homeowner is responsible to have adequate insurance for the project/property. In the event of a natural disaster the contractor will not be responsible for any loss that may occur, but will be the loss and responsibility of the homeowner. If the homeowner does not have adequate insurance coverage, it is the responsibility of the contractor to purchase a policy to cover the contract in the event of loss; the cost will be added to the contract price that is quoted/charged in agreement with this contract.

Page 3 of 3 Right to Stop Work: If the contractor does not get paid according to the contract agreement schedule the contractor has the right to stop working. Non-payment will create a breach of this contract. Work will resume once payment is made and is no longer in a delinquent status. Clean-up: The contractor is responsible to clean up all un-used material and debris. The homeowners property will be left in good, clean condition upon completion of this project. Attorney Fees and Legal Limitations: Any legal issues that may arise from this agreement entering the contractor and homeowner into litigation creating attorney fees and court cost will be recovered by the prevailing party. No action will be taken against either party more than 2 years after completion of the project.
