Introduction
The Maritime Safety Committee held its 92 session under the Chairmanship of Mr Christian Breinholt (Denmark). The following is a report on the most significant outcome of the meeting related to each agenda item.

Amendments to the International Convention for Safe Containers (CSC), 1972

3 Consideration and adoption of amendments to mandatory instruments Adoption of a new mandatory instrument, applicable from 1 January 2015
Code for recognized organizations RO Code adopted by res. MSC.349(92) The RO Code was adopted with minor amendments compared to the version adopted at MEPC 65, regarding the terms "Mobile Offshore Unit" and "offshore installation" which were replaced with "Mobile Offshore Drilling Unit". The Code will become mandatory upon the entry into force of the respective amendments to reg. XI-1/1 of the 1974 SOLAS Convention adopted by Res. MSC.350(92) and 1988 Load Lines Protocol adopted by Res. MSC.356(92). The previous references in SOLAS Reg. XI-1/1 to res. A.739(18), and res. A.789(19) will then be replaced with a reference to the RO Code. The Code contains all applicable requirements for ROs in one single IMO mandatory instrument and is intended to assist in achieving harmonized and consistent global assessment and authorization of recognized organizations, including Classification Societies, and will be the quality standard applied for audits of ROs.

Adoption of amendments to existing mandatory instruments in force from 1 January 2015


Amendments to the 1974 SOLAS Convention by res. MSC.350(92) The existing text of SOLAS Reg. III/19.2.2 requiring that the passengers shall muster within 24 hours after embarkation has been replaced with muster of newly embarked passengers shall take place prior to or immediately upon departure. Furthermore new SOLAS Reg. III/19.3.3 and 19.3.6 have been added related to enclosed space entry and rescue drills. Such drills are to be held on board the ship at least once every two months and cover: checking and use of personal protective equipment required for entry; checking and use of communication equipment and procedures; checking and use of instruments for measuring the atmosphere in enclosed spaces; checking and use of rescue equipment and procedures; and instructions in first aid and resuscitation techniques. SOLAS Reg. V/19, regarding application of requirements for bridge navigational watch alarm system (BNWAS) was amended to clarify that BNWAS is applicable to all ships, also existing ships built before 1 July 2002 with a phase-in implementation for ships constructed before 1 July 2002; and regarding exemptions for ships which would be taken permanently out of service within two years after the implementation date. st Phase in period is between 1 survey after 1 January 2016 and 1 January 2018, depending on ship type and size. Amendments to the 1994 and 2000 High-Speed Craft (HSC) Codes by res. MSC.351(92) and MSC.352(92) Amendments related to enclosed space entry and rescue drills were adopted to be in accordance with the equivalent amendment to SOLAS Reg. III/19. Amendments to the International Safety Management (ISM) Code by res. MSC.353(92) Amendments related to the requirement of qualified, certificated and medically fit seafarers, and to the requirement of those that are undertaking ISM responsibilities should be acting in conformity with the Company's responsibilities under the Code, were adopted. Amendments to the International Maritime Solid Bulk Cargoes Code (IMSBC) Code by res. MSC.354(92) may be applied voluntarily from 1 January 2014 Several amendments to the IMSBC Code were adopted, concerning inter alia: Insertion of new and revised definitions of GHS, Manual of Tests and Criteria, Potential sources of ignition, Sources of heat and Competent authority; cargo under in-transit fumigation; sampling procedures and certificates or declarations of the moisture content when a concentrate or other cargo which may liquefy is carried; 2

procedures to protect the cargo from any precipitation and water ingress, if the cargo is loaded on to the ship from barges; sampling of stationary stockpiles; hazards related to cargoes that may liquefy; Complementary test procedure for determining the possibility of liquefaction; A complete re-write of section 9.2.3 on Materials hazardous only in bulk (MHB). In addition the following individual schedules of solid bulk cargoes were amended: Ammonium nitrate UN 1942, Ammonium nitrate-based fertilizer UN 2067, Ammonium nitrate-based fertilizer UN 2071, Ammonium nitrate-based fertilizer (non-hazardous), Calcium nitrate UN 1454, Calcium nitrate fertilizer, Charcoal, Ferrous metal borings, shavings, turnings or cuttings UN 2793, Metal sulphide concentrates, Peat moss, Sand, Seed cake, Seed cake (non-hazardous), Silicomanganese (low carbon) and Sulphur (formed, solid) and the following new schedules were added: Alumina hydrate, Aluminium smelting / remelting by-products, processed, Clinker ash, wet, Coal tar pitch, Coarse iron and steel slag and its mixture, Crushed carbon anodes, Grain screening pellets, Granulated nickel matte (less than 2 % moisture content), Gypsum granulated, Ilmenite (rock), Ilmenite (upgraded), Nickel ore, Sand, heavy mineral, Silicon slag, Solidified fuels recycled from paper and plastics and Wood torrefied.

Adoption of amendments to existing mandatory instruments in force from 1 July 2014


Amendments to the International Convention for Safe Containers (CSC), 1972 by res. MSC.355(92), in force from 1 July 2014 Several amendments to the Convention were adopted concerning inter alia: Definitions of core terms as Acceleration of gravity, Load, Maximum operating gross mass or Rating, Maximum permissible payload and Tare and other related consequential amendments for example for the Safety Approval Plate; One door off stacking and racking strength; Test loadings and applied forces inter alia when lifting from corner fittings and any other additional methods and for racking and stacking and concentrated loads; Structurally sensitive components.

Adoption of Amendments to existing non-mandatory instruments


Governments are invited to take appropriate steps to give effect to the amendments by 1 January 2015: Amendments to the 1979, 1989 and 2009 Mobile Offshore Drilling Unit (MODU) Codes and the Dynamically Support Craft (DSC) Code by res. MSC.357(92), MSC.358(92), MSC.359(92), and MSC.360(92), respectively Amendments to these codes were approved in order to align with the above mentioned approved amendment to SOLAS Reg. III/19 concerning enclosed space entry and rescue drills.

4 Measures to enhance maritime security


A proposal to draft new guidelines for Companies performing security activities in accordance with the ISPS Code did not gain sufficient support. No other issues require special attention at this time, but see also agenda item 18.

5 Goal-based new ship construction standards


The working group established completed the MSC.1/Circ.1455 Guidelines for the approval of alternatives and equivalents as provided for in various IMO instruments, which was approved by MSC 92. The most controversial issue was related to the applicability of the alternatives and equivalents option in IMO instruments. The Committee confirmed that it was the prerogative of flag states to approve equivalents and alternatives, and that; therefore, the decision on the scope of application falls under their purview and should not be prescribed in the Guidelines. There was no activity on Goal Based Standard at MSC 92.

6 Passenger ship safety


The previously issued MSC.1/Circ.1446 Recommended interim measures for passenger ship companies to enhance the safety of passenger ships was further revised. The guidelines originally emphasized immediate actions the operators of passenger ships were encouraged to implement in their operational measures. Following items have been added to the new MSC.1/Circ.1446/Rev.2: securing heavy objects harmonization of bridge navigational procedures inclinometer data for the VDR. Based on the Costa Concordia Casualty Investigation Report several recommendations have been included in the revised action plan for long-term work on passenger ship safety. These recommendations, all in all 19, have been annexed to the revised circular. Also the survivability of passenger ships was further discussed. It was proposed that the required Subdivision Division R has to be reconsidered.

7 Dangerous goods, solid cargoes and containers


The Committee approved DSC.1/Circ.71 Guidelines for development of an approved continuous examination programme (ACEP) and CSC.1/Circ.138/Rev.1 Revised recommendations on harmonized interpretation and implementation of the International Convention for Safe Containers, 1972, as amended. The Committee also approved MSC circulars on Early implementation of amendments to the International Maritime Solid Bulk Cargoes (IMSBC) Code and two other MSC circulars associated with the IMSBC Code as listed in Annex 2.

8 Fire protection
The Committee approved MSC.1/Circ.1456 on Unified interpretations of SOLAS chapter II-2 and the FSS and FTP Codes. This consolidated set of unified interpretations takes account of the following IACS UIs: SC 245/Corr.1 concerning Suction and discharge piping of emergency fire pumps, which are run through the machinery space (SOLAS II-2/10.2.1.4.1), SC 247 concerning Emergency exit hatches to open deck (SOLAS Reg. II-2/13.1), SC 252; concerning Controls for releasing carbon dioxide and activating the alarm in the protected space (FSS Code 5.2.2.2), SC 149/Rev.2 concerning Gas Measurement and Detection Portable instruments and SC 250 concerning Fire-Extinguishing Arrangements in Cargo Spaces (Res. MSC.268(85), IMSBC Code). The Committee also approved MSC.1/Circ.1457 on Unified interpretations of the 2000 HSC Code. This text is based on IACS UI HSC 8 concerning Protection of load bearing structures. The Committee also approved MSC.1/Circ.1458 on Interpretation to the Revised Guidelines for the approval of equivalent water-based fire-extinguishing systems for machinery spaces and cargo pumprooms (MSC/Circ.1165) and MSC.1/Circ.1459 on Unified interpretation of the SOLAS Convention and the IBC and IGC Codes on the location of entrances, air inlets and openings in the superstructures and/or deckhouses of oil and chemical tankers and gas carriers.

9 Radiocommunications and search and rescue


The committee approved the following Circulars: MSC.1/Circ1382/Rev.2 on Questionnaire on shore-based facilities for the Global Maritime Distress and Safety System (GMDSS), MSC.1/Circ.1287/Rev.1 on Amendments to resolution A.705(17), as amended, on Promulgation of Maritime Safety Information, MSC.1/Circ.1288/Rev.1 on Amendments to resolution A.706(17), as amended, on World-Wide Navigational Warning Service, MSC.1/Circ.1460 on Guidance on the validity of radiocommunications equipment installed and used on ships, COMSAR.1/Circ.57 on Guidance on the use of the graph at figure N.14, appendix N of IAMSAR Manual, Volume II, COMSAR.1/Circ.54/Rev.1 on Audits of LRIT Data Centres and of the International LRIT Data Exchange Conducted by the LRIT Coordinator and SN.1/Circ.322 on Information on the display of AISSART, AIS Man Overboard and EPIRB-AIS devices.

10 Bulk liquids and gases


The Committee approved MSC-MEPC.5/Circ.7 on Guidance on the timing of replacement of existing certificates by revised certificates as a consequence of the entry into force of amendments to chapters 4

17 and 18 of the IBC Code. This final text was the same as that approved at MEPC 65. The Committee further decided not to exclude, fuel with a flashpoint between 52C and 60C from the scope of the IGF Code. However, the Committee invited interested delegations to propose a new output, in accordance with the Committees Guidelines, on a holistic review of SOLAS chapter II-2 in relation to low-flashpoint fuels between 52C and 60C.

11 Stability and load lines and on fishing vessels safety


The Committee adopted resolution MSC.362(92) on the Revised Recommendation on a standard method for evaluating cross-flooding arrangements and resolution MSC.363(92) on the Performance standards for electronic inclinometers. The Committee also approved MSC.1/Circ.1461 on the Guidelines for verification of damage stability requirements for tankers.

12 Flag State implementation


The Committee approved MSC.1/Circ.1462-FAL.2/Circ.127-MEPC.1/Circ.817 on List of certificates and documents required to be carried on board ships, 2013 including the amendment to the "Note" in order to remove the wording that "All certificates to be carried on board must be originals". The Committee also approved MSC.1/Circ.1463 on Application of SOLAS regulations XII/3, XII/7 and XII/11 concerning clarification of the meaning of "periodical survey" and MSC-MEPC.5/Circ.8, providing a Unified interpretation of the application of regulations governed by the building contract date, the keel laying date and the delivery date for the requirements of the SOLAS and MARPOL Conventions. This text is based on IACS UIs SC 256 and MPC 100. The Committee also approved MSC-MEPC.3/Circ.4 on Revised harmonized reporting procedures Reports required under SOLAS regulations I/21 and a XI1/6, and MARPOL, articles 8 and 12.

13 Ship design and equipment


The Committee approved MSC.1/Circ.1464 on Unified interpretations of the provisions of SOLAS chapters II-1 and XII, the technical provisions for means of access for inspections (resolution MSC.158(78)) and of the performance standards for water level detectors on bulk carriers (resolution MSC.145(77)), MSC.1/Circ.1465 on Unified interpretation of the performance standard for protective coatings for dedicated seawater ballast tanks in all types of ships and double-side skin spaces of bulk carriers (resolution MSC.215(82)), MSC.1/Circ.1466 on Unified interpretations on fall preventer devices (MSC.1/Circ.1392 and MSC.1/Circ.1327), MSC.1/Circ.1467 on Unified interpretation of SOLAS regulation II-1/26.3 concerning redundancy of fuel oil pumps for the normal operation of propulsion systems and MSC.1/Circ.1468 on Unified interpretation of paragraph 1.1.4 of the LSA Code concerning Greatest launching height for a free-fall lifeboat.

14 Training and Watchkeeping


The Committee concurred with the conclusion of the Sub-Committee that it was appropriate to include training and certification provisions for the Polar Code in chapter V of the STCW Convention and Code, and that the appropriate instrument to include training and certification provisions for personnel on ships using gases or other low flash-point fuels was chapter V of the STCW Convention and Code. The Committee also approved STCW.7/Circ.20 on Interim guidance on colour vision testing.

17 Formal safety assessment


It was noted that MSC 91 and MEPC65 had approved the Revised FSA Guidelines. The revised Guidelines will be issued as MSC-MEPC.2/Circ.12. There are now various activities in the sub-committees related to the implementation of recommendation from three FSAs: FSA study on the safe sea transport of dangerous goods, the FSA study on crude oil tankers and the FSA on General Cargo Ships.

18 Piracy and armed robbery against ships


The Committee noted and discussed the worsened security situation in the Gulf of Guinea, and also the situation in the waters off the coast of Somalia. However, no concrete decisions were made.

19 General cargo ship safety


The Committee noted that MSC 93 will review a status report and analysis of the RCOs referred from the Committee to the relevant Sub-committees.

20 Implementation of instruments and related matters Bridge Navigational Watch Alarm System BNWAS auto-function
It was decided that the discussion regarding automatic mode of performance standard of BNWAS has to be further considered at NAV 59 with a view to advice the Committee on the way forward at MSC 93.

22 Review and reform of the Organization, including application of the Committee's Guidelines
The following provides a summary after MSC 92 of the new Sub-Committee arrangements that appears will be put in place ready for 1 January 2014: renaming the FSI Sub-Committee as the Implementation of IMO Instruments (III) SubCommittee; renaming the STW Sub-Committee as the Human Element, Training and Watchkeeping (HTW) Sub-Committee; amalgamating the NAV and COMSAR Sub-Committees into a new Sub-Committee on Navigation, Communications and Search and Rescue (NCSR); establishing a new Sub-Committee on Pollution Prevention and Response (PPR). The terms of reference for this new Sub-Committee include the carriage of liquid bulk cargoes and the "pollution of the marine environment", which includes pollution from or through the atmosphere; consequential to the establishment of the PPR Sub-Committee, establishing a new SubCommittee on Carriage of Cargoes and Containers (CCC); amalgamating the work of the DE and SLF Sub-Committees (except for all matters related to life-saving appliances and machinery and electrical installations, which are to be transferred to the new SSE Sub-Committee) into a new Sub-Committee on Ship Design and Construction (SDC); and amalgamating the work of the DE Sub-Committee (on matters related to life-saving appliances and machinery and electrical installations) and the FP Sub-Committee into a new SubCommittee on Ship Systems and Equipment (SSE).

23 Work programme
The Committee added the following new work programmes of the sub-committees, with target completion date in brackets, as follows: HTW , CCC Development of guidelines for shipowners and seafarers for proper implementation of relevant IMO instruments in relation to the carriage of dangerous goods in packaged form by sea (2015) HTW Development of a globally consistent format for the certificate of training and education issued under the STCW Convention (2015) NCSR Interconnection of NAVTEX and Inmarsat SafetyNET receivers and their display on Integrated Navigation Display Systems" (one session after 2015) SDC 1 Review of conditions under which passenger ship watertight doors may be opened during navigation and prepare amendments to SOLAS regulation II-1/22 and MSC.1/Circ.1380 (two sessions after 2015) SDC 1 Guidelines addressing the carriage of more than 12 industrial personnel on board vessels engaged on international voyages (2015).

24 Election of Chairman and Vice-Chairman for 2014


Mr Christian Breinholt (Denmark) was re-elected as the Committee Chairman for 2014 and Captain M. Segar from Singapore Vice-Chairman.
