JUSTO LUKBAN, ET AL. Issue: The writ of Habeas Corpus was filed by the petitioner, with the prayer that the respondent produce around 170 women whom Justo Lukban et, al deported to Davao. Liberty of abode was also raised versus the power of the executive of the Municipality in deporting the women without their knowledge in his capacity as Mayor. Facts: Justo Lukban as Manila City's Mayor together with Anton Hohmann, the city's Chief of Police, took custody of about 170 women at the night of October 25 beyond the latters consent and knowledge and thereafter were shipped to Mindanao specifically in Davao where they were signed as laborers. Said women are inmates of the houses of prostitution situated in Gardenia Street, in the district of Sampaloc. That when the petitioner filed for habeas corpus, the respondent moved to dismiss the case saying that those women were already out of their jurisdiction and that , it should be filed in the city of Davao instead. The court ruled in favor of the petitioner with the instructions; For the respondents to have fulfilled the court's order, three optional courses were open: (1) They could have produced the bodies of the persons according to the command of the writ; or (2) they could have shown by affidavit that on account of sickness or infirmity those persons could not safely be brought before the court; or (3) they could have presented affidavits to show that the parties in question or their attorney waived the right to be present.

action, could calmly fold his hands and claim that the person was under no restraint and that he, the official, had no jurisdiction over this other municipality. We believe the true principle should be that, if the respondent is within the jurisdiction of the court and has it in his power to obey the order of the court and thus to undo the wrong that he has inflicted, he should be compelled to do so. Even if the party to whom the writ is addressed has illegally parted with the custody of a person before the application for the writ is no reason why the writ should not issue. If the mayor and the chief of police, acting under no authority of law, could deport these women from the city of Manila to Davao, the same officials must necessarily have the same means to return them from Davao to Manila. The respondents, within the reach of process, may not be permitted to restrain a fellow citizen of her liberty by forcing her to change her domicile and to avow the act with impunity in the courts, while the person who has lost her birthright of liberty has no effective recourse. The great writ of liberty may not thus be easily evaded.

G.R. No. L-2662: Kuroda vs. Jalandoni Generality Accepted Principles of International Law

Kuroda was the highest ranking Japanese officer stationed in the Philippines during the Jap was then charged before the Military Commission due to the atrocities that were done a civilians and prisoners during the war. His trial was in pursuant to EO No. 68 which establis Crimes Office and prescribing rules and regulations governing the trial of accused war questioning the legality of the said EO arguing that the same is not provided for in the Co underscores the fact that the Philippines is not a signatory of the Hague Convention on Covering Land Warfare hence we cannot impose against him any criminal charges because on, national or international. ISSUE: Whether or not Kuroda can be charged in Philippine courts?

HELD: EO No. 68 is constitutional hence the Philippine courts can take cognizance of the case pursuant to the constitutional provision that states the Philippines renounces war as an i policy, and adopts the generally accepted principles of international law as part of the la Hague Convention and other similar conventions whose principles are generally accepted ar part of the law of the land.

Held: The court concluded the case by granting the parties aggrieved the sum of 400 pesos each, plus 100 pesos for nominal damage due to contempt of court. Reasoning further that if the chief executive of any municipality in the Philippines could forcibly and illegally take a private citizen and place him beyond the boundaries of the municipality, and then, when called upon to defend his official

AGUSTIN vs EDU FACTS: This was an original action in the Supreme Court for prohibition.Petitioner was an owner of a volkswagen beetle car,model 13035 already properly equipped

ISSUE: Whether the Letter of Instruction were considered valid and constitutional? HELD: YES, The court held that the letter of Instruction No.229,as amended as well as the implementing rules and regulations were valid and constitutional as a valid measure of police power. The Vienna Convention on Road signs and signals and the United Nations Organization was ratified by the Philippine local legislation for the installation of road safety signs and devices.It cannot be disputed then that this Declaration of Principle found in the Constitution possesses relevance,between the International law and municipal law in applying the rule municipal law prevails. Lao Ichong vs Jaime Hernandez Constitutional Law Treaties May Be Superseded by Municipal Laws in the Exercise of Police Power Lao Ichong is a Chinese businessman who entered the country to take advantage of business opportunities herein abound (then) particularly in the retail business. For some time he and his fellow Chinese businessmen enjoyed a monopoly in the local market in Pasay. Until in June 1954 when Congress passed the RA 1180 or the Retail Trade Nationalization Act the purpose of which is to reserve to Filipinos the right to engage in the retail business. Ichong then petitioned for the nullification of the said Act on the ground that it contravened several treaties concluded by the RP which, according to him, violates the equal protection clause (pacta sund servanda). He said that as a Chinese businessman engaged in the business here in the country who helps in the income generation of the country he should be given equal opportunity. ISSUE: Whether or not a law may invalidate or supersede treaties or generally accepted principles. HELD: Yes, a law may supersede a treaty or a generally accepted principle. In this case, there is no conflict at all between the raised generally accepted principle and with RA 1180. The equal protection of the law clause does not demand absolute

equality amongst residents; it merely requires that all persons shall be treated alike, under like circumstances and conditions both as to privileges conferred and liabilities enforced; and, that the equal protection clause is not infringed by legislation which applies only to those persons falling within a specified class, if it applies alike to all persons within such class, and reasonable grounds exist for making a distinction between those who fall within such class and those who do not. For the sake of argument, even if it would be assumed that a treaty would be in conflict with a statute then the statute must be upheld because it represented an exercise of the police power which, being inherent could not be bargained away or surrendered through the medium of a treaty. Hence, Ichong can no longer assert his right to operate his market stalls in the Pasay city market. Gonzales vs Hechanova Constitutional Law Treaty vs Executive Agreements Statutes Can Repeal Executive Agreements Then President Diosdado Macapagal entered into two executive agreements with Vietnam and Burma for the importation of ricewithout complying with the requisite of securing a certification from the Natl Economic Council showing that there is a shortage in cereals. Hence, Hechanova authorized the importation of 67000 tons of rice from abroad to the detriment of our local planters. Gonzales, then president of the Iloilo Palay and Corn Planters Association assailed the executive agreements. Gonzales averred that Hechanova is without jurisdiction or in excess of jurisdiction, because RA 3452 prohibits the importation of rice and corn by the Rice and Corn Administration or any other government agency. ISSUE: Whether or not RA 3452 prevails over the 2 executive agreements entered into by Macapagal. HELD: Under the Constitution, the main function of the Executive is to enforce laws enacted by Congress. The former may not interfere in the performance of the legislative powers of the latter, except in the exercise of his veto power. He may not defeat legislative enactments that have acquired the status of laws, by indirectly repealing the same through an executive agreement providing for the performance of the very act prohibited by said laws. In the event of conflict between a treaty and a statute, the one which is latest in point of time shall prevail, is not applicable to the case at bar, Hechanova not only admits, but, also, insists that the contracts adverted to are not treaties. No such justification can be given as regards executive agreements not authorized by previous legislation, without completely upsetting the principle of separation of powers and the system of checks and balances which are fundamental in our constitutional set up.

As regards the question whether an executive or an international agreement may be invalidated by our courts, suffice it to say that the Constitution of the Philippines has clearly settled it in the affirmative, by providing that the SC may not be deprived of its jurisdiction to review, revise, reverse, modify, or affirm on appeal, certiorari, or writ of error, as the law or the rules of court may provide, final judgments and decrees of inferior courts in All cases in which the constitutionality or validity of any treaty, law, ordinance, or executive order or regulation is in question. In other words, our Constitution authorizes the nullification of a treaty, not only when it conflicts with the fundamental law, but, also, when it runs counter to an act of Congress. In Re Garcia 2 SCRA 985 Facts: Arturo E. Garcia,has applied for admission to the practice of law in the phils. without submitting to the required bar examinations. In his verified petition, he avers among others that he is a filipino citizen born in bacolod city of filipino parentage. He finished Bachillerato Superior in spain. He was allowed to practice law profession in spain under the provision of the treaty on academic degrees and the exercise of profession between the republic of the phils. Issue: Whether treaty can modify regulations governing admission to the phil. bar. Held: The court resolved to deny the petition. The provision of the treaty on academic degrees between the republic of the phils. and spanish state cannot be invoked by the applicant. said treaty was intende to govern filipino citizens desiring to practice their profession in spain. The treaty could not have been intended to modify the laws and regulations governing admission to the practice of law in the phils., for the reason the executive may not encroach upon the constitutional prerogative of the supreme court to promulgate rules for admission to the practice of the law in the phils. The power to repeal, alter or supplement such rules being reserved only to the congress of the phils. G.R. No. L-42952: People vs Lagman Defense of State In 1936, Lagman reached the age of 20. He is being compelled by Sec 60 of Commonwealth Act 1 (National Defense Law) to join the military service. Lagman refused to do so because he has a father to support, has no military leanings and he does not wish to kill or be killed. Lagman further assailed the constitutionality of the said law.

ISSUE: Whether or not the National Defense Law is constitutional. HELD: The duty of the Government to defend the State cannot be performed except through an army. To leave the organization of an army to the will of the citizens would be to make this duty of the Government excusable should there be no sufficient men who volunteer to enlist therein. Hence, the National Defense Law, in so far as it establishes compulsory military service, does not go against this constitutional provision but is, on the contrary, in faithful compliance therewith. The defense of the State is a prime duty of government, and in the fulfillment of this duty all citizens may be required by law to render personal military or civil service." Aglipay v. Ruiz Case Digest Facts: In May 1936, the Director of Posts announced in the dailies of Manila that he would order the issuance of postage stamps commemorating the celebration in the City of Manila of the 33rd International Eucharistic Congress, organized by the Roman Catholic Church. The petitioner, Mons. Gregorio Aglipay, Supreme Head of the Philippine Independent Church, in the fulfillment of what he considers to be a civic duty, requested Vicente Sotto, Esq., member of the Philippine Bar, to denounce the matter to the President of the Philippines. In spite of the protest of the petitioners attorney, the Director of Posts publicly announced having sent to the United States the designs of the postage for printing. The said stamps were actually issued and sold though the greater part thereof remained unsold. The further sale of the stamps was sought to be prevented by the petitioner. Issue: Whether the issuance of the postage stamps was in violation of the Constitution. Held / Ruling: There has been no constitutional infraction in the case at bar, Act No. 4052 grants the Director of Posts, with the approval of the Secretary of Public Works and Communications, discretion to misuse postage stamps with new designs. Even if we were to assume that these officials made use of a poor judgment in issuing and selling the postage stamps in question still, the case of the petitioner would fail to take in weight. Between the exercise of a poor judgment and the unconstitutionality of the step taken, a gap exists which is yet to be filled to justify the court in setting aside the official act assailed as coming within a constitutional inhibition. The court resolved that petition for a writ of prohibition is hereby denied, without pronouncement as to costs.

JOSE ALMEDA VS. COURT OF APPEALS, digested (Remedial Law, Appeal) FACTS: Petitioner Jose Almeda filed a notice of appeal which was disapproved by the trial court due to it being filed five (5) days late beyond the reglementary period and subsequently denied of motion for reconsideration. Respondent court dismissed the petition contending that the requirement regarding perfection of an appeal was not only mandatory but jurisdictional such that the petitioners failure to comply therewith had the effect of rendering the judgment final. Subsequently, petitioner motions for reconsideration and is denied. Also, it was found that there was lack of merit in the petitioners reason for the late filing of the notice of appeal. ISSUE: Whether or not failure to comply with the requirement regarding perfection of an appeal within reglementary period would render a judgment final and executory. HELD: Yes, the period to appeal is prescribed not only by the Rules of Court but also by statute, particularly Sec 39 of BP 129, which provides: Sec.39. Appeals. The period for appeal from final orders, resolutions, awards, judgments, or decisions of any court in all cases shall be fifteen (15) days counted from the notice of the final order, resolution, award, judgment, or decision appealed from The right to appeal is a statutory right and one who seeks to avail of it must strictly comply with the statutes or rules as they are considered indispensable interdictions against needless delays and for an orderly discharge of judicial business. Due to petitioners negligence of failing to perfect his appeal, there is no recourse but to deny the petition thus making the judgment of the trial court final and executory. Estrella Ondoy vs Virgilio Ignacio Art II Sec 10 of the Constitution of the Philippines : The State shall promote social justice in all phases of national development. Facts: Jose Ondoy, son of Estrella Ondoy, drowned while in the employ of Virgilio Ignacio. According to thechief engineer and oiler, Jose Ondoy was aboard the ship as part of the workforce. He was invited byfriends to a drinking spree, left the vessel, and thereafter was found dead. Therefore, Estrella wasasking for employ. However, thestatement given by the chief engineer and oiler was ignored by the hearing officer and thereforedismissed the claim for lack of merit. Even when

a motion for reconsideration was filed, this was alsodenied by the Secretary of Labor for the same reason, that is, lack of merit. Issue: Whether or not the compensation for the death of Jose Ondoy is constitutional; is social justiceapplicable in this case? Ruling: Yes.Firstly, there was no due diligence in the fact finding of the Department of Labor. It merely disregardedthe statements made by the chief engineer and oiler. Secondly, the principle of social justice applied inthis case is a matter of protection, not equality. The Court recognized the right of the petitioner to theclaim of compensation because her son was shown to the actual performance of social laborer, usually poor and unlettered, and the employer, who hasresources to secure able legal advice, the law has reason to demand from the latter the MAXIMO CALALANG, petitioner, vs. A. D. WILLIAMS, ET AL., respondents.Maximo Calalang in his own behalf. The case of Calalang vs Williams is known for the elegant exposition of the definition of social justice. In this case, Justice Laurel defined social justice as neither communism, nor despotism, nor atomism, nor anarchy but humanization of laws and equalization of social and economic forces by the State so that justice in its rational and objectively secular conception may at least be approximated. As I browse through the entire case, I found out that there is more to this case than the definition of social justice. In fact, another important issue raised here is whether there was a valid delegation of power by the National Assembly to the Director of Public Works. Let us begin with the facts of the case. Facts: In pursuance of Commonwealth Act 548 which mandates the the Director of Public Works, with the approval of the Secretary of Public Works and Communications, shall promulgate the necessary rules and regulations to regulate and control the use of and traffic on such roads and streets to promote safe transit upon, and avoid obstructions on, roads and streets designated as national roads, the Director of Public Works adopted the resolution of the National Traffic Commission, prohibiting the passing of animal drawn vehicles in certain streets in Manila. Petitioner questioned this as it constitutes an undue delegation of legislative power.

Issues: Whether or not there is a undue delegation of legislative power? Ruling: There is no undue deleagation of legislative power. Commonwealth Act 548 does not confer legislative powers to the Director of Public Works. The authority conferred upon them and under which they promulgated the rules and regulations now complained of is not to determine what public policy demands but merely to carry out the legislative policy laid down by the National Assembly in said Act, to wit, to promote safe transit upon and avoid obstructions on, roads and streets designated as national roads by acts of the National Assembly or by executive orders of the President of the Philippines and to close them temporarily to any or all classes of traffic whenever the condition of the road or the traffic makes such action necessary or advisable in the public convenience and interest. The delegated power, if at all, therefore, is not the determination of what the law shall be, but merely the ascertainment of the facts and circumstances upon which the application of said law is to be predicated. To promulgate rules and regulations on the use of national roads and to determine when and how long a national road should be closed to traffic, in view of the condition of the road or the traffic thereon and the requirements of public convenience and interest, is an administrative function which cannot be directly discharged by the National Assembly. It must depend on the discretion of some other government official to whom is confided the duty of determining whether the proper occasion exists for executing the law. But it cannot be said that the exercise of such discretion is the making of the law. Meyer v. Nebraska Brief Fact Summary. Plaintiff was convicted for teaching a child German under a Nebraska statute that outlawed the teaching of foreign languages to students that had not yet completed the eighth grade. Synopsis of Rule of Law. The Fourteenth Amendment prohibits states from creating legislation that restricts liberty interests when the legislation is not reasonably related to an acceptable state objective. Facts. Plaintiff was convicted for teaching a child German under a Nebraska statute that outlawed the teaching of foreign languages to students that had not yet completed the eighth grade. The Supreme Court of Nebraska upheld the conviction. Issue. Does the statute as construed and applied unreasonably infringe on the liberty guaranteed by the Fourteenth Amendment? Held. The statute as applied is unconstitutional because it infringes on the liberty interests of the plaintiff and fails to reasonably relate to any end within the competency of the state. The Fourteenth Amendment encompasses more than merely the freedom from bodily restraint. The state argues that the purpose of the statute is to encourage the English language to be the native tongue of all children raised in the state. Nonetheless, the protection of the Constitution extends to those who speak other languages. Education is a fundamental liberty interest that must be protected, and mere knowledge of the German language cannot be reasonably regarded as harmful. Discussion. Liberty interests may not be interfered with by the states when the interference is arbitrary and not reasonably related to a purpose which the state may permissively regulate. Pierce v. Society of Sisters Brief Fact Summary. Appellees, two non-public schools, were protected by a preliminary restraining order prohibiting appellants from enforcing an Oregon Act that required parents and guardians to send their children to public school. Appellants appealed the order. Synopsis of Rule of Law. The 14th Amendment provides a liberty interest in a parents or guardians right to decide the mode in which their children are educated. States may not usurp this right when the questioned legislation does not reasonably relate to a viable state interest. Facts. Appellee the Society of Sisters, a corporation with the power to establish and maintain academies or schools and Appellee Hill Military Academy, a private organization conducting an elementary, college preparatory, and military training school, obtained preliminary restraining orders prohibiting appellants from enforcing Oregons Compulsory Education Act. The Act required all parents and guardians to send children between 8 and 16 years to a public school. The appellants appealed the granting of the preliminary restraining orders. Issue. Does the Act unreasonably interfere with the liberty of parents and guardians to direct the upbringing and education of children under their control?

Held. The Act violates the 14th Amendment because it interferes with protected liberty interests and has no reasonable relationship to any purpose within the competency of the state. The Appellees have standing because the result of enforcing the Act would be destruction of the appellees schools. The state has the power to regulate all schools, but parents and guardians have the right and duty to choose the appropriate preparation for their children. Discussion. While the state has the right to insure that children receive a proper education, the 14th Amendment provides parents and guardians with a liberty interest in their choice in the mode in which their children are educated. Oposa vs Judge Factoran Political Law Harmony in Nature A taxpayers class suit was initiated by the Philippine Ecological Network Incorporated (PENI) together with the minors Oposa and their parents. All were duly represented. They claimed that as taxpayers they have the right to the full benefit, use and enjoyment of the natural resources of the countrys rainforests. They prayed that a judgment be rendered ordering Honorable Factoran Jr, his agents, representatives and other persons acting in his behalf to cancel all existing timber license agreements in the country and cease and desist from receiving, accepting, processing, renewing or approving new timber license agreements. ISSUE: Whether or not petitioners have a cause of action? HELD: Yes, petitioners have a cause of action. The case at bar is of common interest to all Filipinos. The right to a balanced and healthy ecology carries with it the correlative duty to refrain from impairing the environment. The said right implies the judicious management of the countrys forests. This right is also the mand ate of the government through DENR. A denial or violation of that right by the other who has the correlative duty or obligation to respect or protect the same gives rise to a cause of action. All licenses may thus be revoked or rescinded by executive action. Garcia vs. Board of Investments (BOI) FACTS: Former Bataan Petrochemical Corporation (BPC), now Luzon Petrochemical Corporation, formed by a group of Taiwanese investors, was granted by the BOI its have its plant site for the products naphta cracker and naphta to based in Bataan. In February 1989, one year after the BPC began its production in Bataan, the corporation applied to the BOI to have its plant site transferred from Bataan to Batangas. Despite vigorous opposition from petitioner Cong. Enrique Garcia and

others, the BOI granted private respondent BPCs application, stating that the investors have the final choice as to where to have their plant site because they are the ones who risk capital for the project. ISSUE: Whether or not the BOI committed a grave abuse of discretion in yielding to the application of the investors without considering the national interest COURT RULING: The Supreme Court found the BOI to have committed grave abuse of discretion in this case, and ordered the original application of the BPC to have its plant site in Bataan and the product naphta as feedstock maintained. The ponente, Justice Gutierrez, Jr., first stated the Courts judicial power to settle actual controversies as provided for by Section 1 of Article VIII in our 1987 Constitution before he wrote the reasons as to how the Court arrived to its conclusion. He mentioned that nothing is shown to justify the BOIs action in letting the investors decide on an issue which, if handled by our own government, could have been very beneficial to the State, as he remembered the word of a great Filipino leader, to wit: .. he would not mind having a government run like hell by Filipinos than one subservient to foreign dictation. Justice Grio Aquino, in her dissenting opinion, argued that the petition was not well-taken because the 1987 Investment Code does not prohibit the registration of a certain project, as well as any decision of the BOI regarding the amended application. She stated that the fact that petitioner disagrees with BOI does not make the BOI wrong in its decision, and that petitioner should have appealed to the President of the country and not to the Court, as provided for by Section 36 of the 1987 Investment Code. Justice Melencio-Herrera, in another dissenting opinion, stated that the Constitution does not vest in the Court the power to enter the realm of policy considerations, such as in this case. Basco v. PAGCOR FACTS: On July 11, 1983, PAGCOR was created under Presidential Decree 1869, pursuant to the policy of the government, to regulate and centralize through an appropriate institution all games of chance authorized by existing franchise or permitted by law. This was subsequently proven to be beneficial not just to the government but also to the society in general. It is a reliable source of much needed revenue for the cash-strapped Government.

Petitioners filed an instant petition seeking to annul the PAGCOR because it is allegedly contrary to morals, public policy and public order, among others. ISSUES: Whether PD 1869 is unconstitutional because: 1.) it is contrary to morals, public policy and public order; 2.) it constitutes a waiver of the right of the City of Manila to improve taxes and legal fees; and that the exemption clause in PD 1869 is violative of constitutional principle of Local Autonomy; 3.) it violates the equal protection clause of the Constitution in that it legalizes gambling thru PAGCOR while most other forms are outlawed together with prostitution, drug trafficking and other vices; and 4.) it is contrary to the avowed trend of the Cory Government, away from monopolistic and crony economy and toward free enterprise and privatization. HELD: 1.) Gambling, in all its forms, is generally prohibited, unless allowed by law. But the prohibition of gambling does not mean that the government can not regulate it in the exercise of its police power, wherein the state has the authority to enact legislation that may interfere with personal liberty or property in order to promote the general welfare. 2.) The City of Manila, being a mere Municipal Corporation has no inherent right to impose taxes. Its charter was created by Congress, therefore subject to its control. Also, local governments have no power to tax instrumentalities of the National Government. 3.) Equal protection clause of the Constitution does not preclude classification of individuals who may be accorded different treatment under the law, provided it is not unreasonable or arbitrary. The clause does not prohibit the legislature from establishing classes of individuals or objects upon which different rules shall operate. 4.) The Judiciary does not settle policy issues which are within the domain of the political branches of government and the people themselves as the repository of all state power. Every law has in its favor the presumption of constitutionality, thus, to be nullified, it must be shown that there is a clear and unequivocal breach of the Constitution. In this case, the grounds raised by petitioners have failed to overcome the presumption. Therefore, it is hereby dismissed for lack of merit. Limbona vs. Mangelin

Facts: Petitioner, Sultan Alimbusar Limbona, was elected Speaker of the Regional Legislative Assembly or Batasang Pampook of Central Mindanao (Assembly). On October 21, 1987 Congressman Datu Guimid Matalam, Chairman of the Committee on Muslim Affairs of the House of Representatives, invited petitioner in his capacity as Speaker of the Assembly of Region XII in a consultation/dialogue with local government officials. Petitioner accepted the invitation and informed the Assembly members through the Assembly Secretary that there shall be no session in November as his presence was needed in the house committee hearing of Congress. However, on November 2, 1987, the Assembly held a session in defiance of the Limbona's advice, where he was unseated from his position. Petitioner prays that the session's proceedings be declared null and void and be it declared that he was still the Speaker of the Assembly. Pending further proceedings of the case, the SC received a resolution from the Assembly expressly expelling petitioner's membership therefrom. Respondents argue that petitioner had "filed a case before the Supreme Court against some members of the Assembly on a question which should have been resolved within the confines of the Assembly," for which the respondents now submit that the petition had become "moot and academic" because its resolution. Issue: Whether or not the courts of law have jurisdiction over the autonomous governments or regions. What is the extent of self-government given to the autonomous governments of Region XII? Held: Autonomy is either decentralization of administration or decentralization of power. There is decentralization of administration when the central government delegates administrative powers to political subdivisions in order to broaden the base of government power and in the process to make local governments "more responsive and accountable". At the same time, it relieves the central government of the burden of managing local affairs and enables it to concentrate on national concerns. The President exercises "general supervision" over them, but only to "ensure that local affairs are administered according to law." He has no control over their acts in the sense that he can substitute their judgments with his own. Decentralization of power, on the other hand, involves an abdication of political power in the favor of local governments units declared to be autonomous. In that case, the autonomous government is free to chart its own destiny and shape its future with minimum intervention from central authorities. An autonomous government that enjoys autonomy of the latter category [CONST. (1987), Art. X, Sec. 15.] is subject alone to the decree of the organic act creating it and accepted principles on the effects and limits of "autonomy." On the other hand, an autonomous government of the former class is, as we noted, under the supervision of the national government acting through the President (and the Department of Local Government). If the Sangguniang Pampook (of Region XII),

then, is autonomous in the latter sense, its acts are, debatably beyond the domain of this Court in perhaps the same way that the internal acts, say, of the Congress of the Philippines are beyond our jurisdiction. But if it is autonomous in the former category only, it comes unarguably under our jurisdiction. An examination of the very Presidential Decree creating the autonomous governments of Mindanao persuades us that they were never meant to exercise autonomy in the second sense (decentralization of power). PD No. 1618, in the first place, mandates that "[t]he President shall have the power of general supervision and control over Autonomous Regions." Hence, we assume jurisdiction. And if we can make an inquiry in the validity of the expulsion in question, with more reason can we review the petitioner's removal as Speaker. This case involves the application of a most

Claiming that his right to be informed of the eligibilities of Sibonghanoy and Agas is guaranteed by the Constitution, and that he has no other plain, speedy and adequate remedy to acquire the information, petitioner prays for the issuance of the extraordinary writ of mandamus to compel the respondent CSC to disclose said information. The respondent CSC takes issue on the personality of the petitioner to bring the suit. It is asserted that the petition is bereft of any allegation of Legaspis actual interest in the civil service eligibilities of Sibonghanoy and Agas.

Where a law is capable of two interpretations, one in favor of centralized power in Malacaang and the other beneficial to local autonomy, the scales must be weighed in favor of autonomy. Upon the facts presented, we hold that the November 2 and 5, 1987 sessions were invalid. It is true that under Section 31 of the Region XII Sanggunian Rules, "[s]essions shall not be suspended or adjourned except by direction of the Sangguniang Pampook". But while this opinion is in accord with the respondents' own, we still invalidate the twin sessions in question, since at the time the petitioner called the "recess," it was not a settled matter whether or not he could do so. In the second place, the invitation tendered by the Committee on Muslim Affairs of the House of Representatives provided a plausible reason for the intermission sought. Also, assuming that a valid recess could not be called, it does not appear that the respondents called his attention to this mistake. What appears is that instead, they opened the sessions themselves behind his back in an apparent act of mutiny. Under the circumstances, we find equity on his side. For this reason, we uphold the "recess" called on the ground of good faith. Legaspi vs. CSC G.R. No. L-72119, May 29, 1987 Facts: The respondent CSC had denied petitioner Valentin Legaspis request for information on the civil service eligibilities of Julian Sibonghanoy and Mariano Agas who were employed as sanitarians in the Health Department of Cebu City. Sibonghanoy and Agas had allegedly represented themselves as civil service eligibles who passed the civil service examinations for sanitarians.

Held: The petitioner has firmly anchored his case upon the right of the people to information on matters of public concern, which, by its very nature, is a public right. It has been held in the case of Tanada vs. Tuvera, 136 SCRA 27, that when the question is one of public right and the object of the mandamus is to procure the enforcement of a public duty, the people are regarded as the real party in interest, and the person at whose instigation the proceedings are instituted need not show that he has any legal or special interest in the result, it being sufficient to show that he is a citizen and as such interested in the execution of the laws. It becomes apparent that when a mandamus proceeding involves the assertion of a public right, the requirement of personal interest is satisfied by the mere fact that the petitioner is a citizen, and therefore, part of the general public which possesses the right. The petitioner, being a citizen who as such, is clothed with personality to seek redress for the alleged obstruction of the exercise of the public right. CASE DIGEST - AKBAYAN VS. AQUINO Facts: The signing of the Japan-Philippines Economic Partnership Agreement (JPEPA) at the sidelines of the Asia-Europe Summit in Helsinki in September 2006 was hailed by both Japanese Prime Minister Junichiro Koizumi and Philippine President Gloria Macapagal Arroyo as a milestone in the continuing cooperation and collaboration, setting a new chapter of strategic partnership for mutual opportunity and growth (for both countries). JPEPA which has been referred to as a mega treaty is a comprehensive plan for opening up of markets in goods and services as well as removing barriers and restrictions on investments. It is a deal that encompasses even our commitments to the WTO. The complexity of JPEPA became all the more evident at the Senate hearing

conducted by the Committee on Trade and Commerce last November 2006. The committee, chaired by Senator Mar Roxas, heard differing views and perspectives on JPEPA. On one hand the committee heard Governments rosy projections on the economic benefits of JPEPA and on the other hand the views of environmental and trade activists who raised there very serious concerns about the country being turned into Japans toxic waste basket. The dis cussion in the Senate showed that JPEPA is not just an issue concerning trade and economic relations with Japan but one that touches on broader national development concerns. Issues: 1. Do the therein petitioners have standing to bring this action for mandamus in their capacity as citizens of the Republic, as taxpayers, and as members of the Congress 2. Can this Honorable Court exercise primary jurisdiction of this case and take cognizance of the instant petition. 3. Are the documents and information being requested in relation to the JPEPA exempted from the general rules on transparency and full public disclosure such that the Philippine government is justified in denying access thereto. Rulings: The Supreme Court en banc promulgated last July 16, 2008 its ruling on the case of Akbayan Citizens Action Party et al vs. Thomas G. Aquino et al (G.R. No. 170516). The Highest Tribunal dismissed the Petition for mandamus and prohibition, which sought to compel respondents Department of Trade Industry (DTI) Undersecretary Thomas Aquino et al to furnish petitioners the full text of the Japan-Philippines Economic Partnership Agreement (JPEPA) and the lists of the Philippine and Japanese offers submitted during the negotiation process and all pertinent attachments and annexes thereto.

approved' the offers exchanged by the parties during the negotiations continue to be privileged even after the JPEPA is published. It is reasonable to conclude that the Japenese representatives submitted their offers with the understanding that 'historic confidentiality' would govern the same. Disclosing these offers could impair the ability of the Philippines to deal not only with Japan but with other foreign governments in future negotiations. It also reasoned out that opening for public scrutiny the Philippine offers in treaty negotiations would discourage future Philippine representatives from frankly expressing their views during negotiations. The Highest Tribunal recognized that treaty negotiations normally involve a process of quid pro quo, where negotiators would willingly grant concessions in an area of lesser importance in order to obtain more favorable terms in an area of greater national interest. In the same Decision, the Court took time to address the dissent of Chief Justice Reynato S. Puno. It said: We are aware that behind the dissent of the Chief Justice lies a genuine zeal to protect our people's right to information against any abuse of executive privilege. It is a zeal that We fully share. The Court, however, in its endeavour to guard against the abuse of executive privilege, should be careful not to veer towards the opposite extreme, to the point that it would strike down as invalid even a legitimate exercise thereof. The Checkpoints Case : Valmonte v. De Villa, G.R. No. 83988 September 29, 1989 (173 SCRA 211) DECISION PADILLA, J.: I. THE FACTS

In its Decision, the Court noted that the full text of the JPEPA has been made accessible to the public since 11 September 2006, and thus the demand to be furnished with copy of the said document has become moot and academic. On 20 January 1987, the National Capital Region District Command (NCRDC) was activated pursuant to Letter of Instruction 02/87 of the Philippine General Headquarters, AFP, with the mission of conducting security operations within its area of responsibility and peripheral areas, for the purpose of establishing an effective territorial defense, maintaining peace and order, and providing an atmosphere conducive to the social, economic and political development of the National Capital Region. As part of its duty to maintain peace and order, the NCRDC installed checkpoints in various parts of Valenzuela, Metro Manila. Petitioners Atty. Ricardo Valmonte, who is a resident of Valenzuela, Metro Manila, and the Union of Lawyers and Advocates For Peoples Rights (ULAP) sought the declaration of checkpoints in Valenzuela, Metro Manila and elsewhere as unconstitutional. In the alternative, they prayed that respondents Renato De Villa and the National Capital Region District Command (NCRDC) be directed to

formulate guidelines in the implementation of checkpoints for the protection of the people. Petitioners contended that the checkpoints gave the respondents blanket authority to make searches and seizures without search warrant or court order in violation of the Constitution. II. THE ISSUE

True, the manning of checkpoints by the military is susceptible of abuse by the men in uniform, in the same manner that all governmental power is susceptible of abuse. But, at the cost of occasional inconvenience, discomfort and even irritation to the citizen, the checkpoints during these abnormal times, when conducted within reasonable limits, are part of the price we pay for an orderly society and a peaceful community.

Do the military and police checkpoints violate the right of the people against unreasonable search and seizures? III. THE RULING

[The Court, voting 13-2, DISMISSED the petition.] NO, military and police checkpoints DO NOT violate the right of the people against unreasonable search and seizures. xxx. Not all searches and seizures are prohibited. Those which are reasonable are not forbidden. A reasonable search is not to be determined by any fixed formula but is to be resolved according to the facts of each case.

Where, for example, the officer merely draws aside the curtain of a vacant vehicle which is parked on the public fair grounds, or simply looks into a vehicle, or flashes a light therein, these do not constitute unreasonable search.

The setting up of the questioned checkpoints in Valenzuela (and probably in other areas) may be considered as a security measure to enable the NCRDC to pursue its mission of establishing effective territorial defense and maintaining peace and order for the benefit of the public. Checkpoints may also be regarded as measures to thwart plots to destabilize the government, in the interest of public security. In this connection, the Court may take judicial notice of the shift to urban centers and their suburbs of the insurgency movement, so clearly reflected in the increased killings in cities of police and military men by NPA sparrow units, not to mention the abundance of unlicensed firearms and the alarming rise in lawlessness and violence in such urban centers, not all of which are reported in media, most likely brought about by deteriorating economic conditions which all sum up to what one can rightly consider, at the very least, as abnormal times. Between the inherent right of the state to protect its existence and promote public welfare and an individual's right against a warrantless search which is however reasonably conducted, the former should prevail.
