Thaton2December2013,Mr.Lagonerareceivedacopyoftheprosecutions complaintthroughtheClerkofCourtdatedthesamedaywhichstatesthat:

Theabovenamedpetitioner(s)hasfiledacaseagainstyouintheStudentJudicialCourt. Thedocumentattachedtothissummonsstatesthebasisforthiscase.Ifyoudisputethe complaintslodgedagainstyou,youoryourrepresentativemustfileawrittenansweror motionwithinseventytwo(72)hoursofyourreceiptofyournotice.Ifyoudonotfileawritten answerormotionwithintheprescribeddeadlinetheCourtwilldecideonacceptanceofthe petitionregardlessofsubsequentmotions.

However,certifiedcopiesoftheAppendicesandAffidavits,citedthroughoutthe bodyofthemaincomplaints,werenotreceivedtogetherwiththemaincomplaint.Evenif theprosecutionindicatedwhattheypurportedtobeimportantpartsoftheaffidavitsand appendicesinthemainbodyofthecomplaint,thedefenseaversthatMr.Lagonerahasthe righttoreadtheallegationsagainsthimandthebasisthereofinfull,inaccordancewithhis righttodueprocess.NolessthanSupremeCourtoftheRepublicofthePhilippinesheldin Mercadov.People1 :

ThesubstanceoftheFootnotemaynotbetheratiodecidendiofthecase,butitstill constitutesanimportantpartofthedecisionsinceitenunciatesafundamental proceduralruleintheconductofappeals.ThatthisruleisstatedinaFootnoteto adecisionisofnoconsequenceasitismerelyamatterofstyle(emphasisours).

RELIEFS WHEREFORE,Mr.LagonerarespectfullypraysthatthisHonorableStudentJudicial Courtextendsthedeadlineforatleastfive(5)daysforthefilingofrepliesandother motionsregardingthecomplaintsfiledagainstme,thisistogivemyselfandmycounsel
