Rules and Regulations TERMS

1.1 CONTESTANT BAND shall mean a band consisting of a minimum of 3 members, inclusive of the composer/s collaborating in one (1) Entry 1.2 ENTRY shall mean one (1) song composition. 1.3 MUSIKAHAN FESTIVAL STAFF shall mean anyone who works or heads in MUSIKAHAN FESTIVAL / TUNOG TAGUM committees and activities including organizers and board members, excluding volunteers

QUALIFICATIONS
2.1 The Competition is open to all bands (amateur or professional) nationwide.

2.2 All MUSIKAHAN FESTIVAL STAFF, members of their immediate household, or their relatives up are not qualified to join the Competition.

NUMBER OF ENTRIES
A CONTESTANT BAND must submit only one (1) entry.

TECHNICAL REQUIREMENTS FOR SONGS

4.1 Each entry must be an original composition of at least one of the members of the CONTESTANT BAND and all rights of copyright to the entry must be owned exclusively by the composers(s). 4.2 The following compositions shall not be eligible as entries

4.2.1 Those which have been previously published, recorded or released in any part of the world; 4.2.2 Those which have been commissioned by a third party; 4.2.3 Those which are found to contain two (2) or more bars of melody or lyrics similar to that of a published or released song in the Philippines or abroad; and 4.2.4 Any entry which in the sole determination of the competition committee is not suitable by reason of content. 4.3 Lyrics

4.3.1 The lyrics must be in Filipino, Bisaya, any Filipino Vernacular or English or a combination of any. 4.3.2 If the lyrics include a word which does not have a general and accepted definition, the contestant must explain the basis for including the word through a footnote in the lyric sheets. 4.3.3 Words which are registered trademarks are not allowed.

4.3.4 The songs lyrics should include the word TAGUMPAY and should include the following themes and/or content

4.3.5. The entry should contain no vulgar language or sexually explicit content. 4.4 Form and Length of Entries

4.4.1 The CONTESTANT BAND must submit one (1) accomplished entry form for one (1) ENTRY. 4.4.2 The melody and lyrics of an ENTRY shall be final once submitted, and may not be changed or amended before the selection of the Finalists. A song selected as Finalist may be modified subject to the prior approval of the MUSIKAHAN FESTIVAL Competition Committee. 4.4.3 A composition may consist of any musical arrangement, including a capella. However, instrumental compositions are not allowed. 4.4.4 The song must not exceed six (6) minutes inclusive of intro and extro. 4.4.5 The song should include a rap part not less than 8 lines. 4.5 Entries submitted to MUSIKAHAN FESTIVAL shall not be returned.

ENTRY SUBMISSION
6.1 6.1.1 6.1.2 6.4 Entries shall be submitted on or before 5:00PM February 17, 2014, Monday: Via email through tagumtourismofc@gmail.com or gerbeboja@gmail.com Via hand-delivery to Tagum City Tourism Office Beach Volleydrome at the Rotary Park, Tagum City and look for Gerbe T. Boja, Tourism Office Event Counterpart Each entry shall be composed of:

6.4.1.1 Complete accomplished entry form; 6.4.1.2 Recent band photo (JPEG file only) 6.4.1.3 Lyric sheet (.docx file only) with English translation; and 6.4.1.4 Audio recording of song (Mp3 file only); 6.4.1.4.5 The song file must be identified only with the correct title of the song. The composer must not be identified in any way. MUSIKAHAN FESTIVAL reserves the right to modify the title of the song

file should it not comply with this requirement. 6.4.1.5 Scanned Proof of Identification and residency per band member; (IDs with addresses are preferable)

INTELLECTUAL PROPERTY RIGHTS

7.1 All entries are deemed to be the properties of the respective Contestant/s, subject to the rights of MUSIKAHAN FESTIVAL hereunder. 7.2 MUSIKAHAN FESTIVAL shall have the right to use any of the songs chosen as finalist, free of charge, for the duration of the Competition, and after the competition, in connection with the airing, broadcast, and/or promotion of the competition on any and all media. 7.3 Contestants declared as finalists have the same rights as above mentioned

CRITERIA AND SCREENING

8.1 Criteria a. Core Evaluation 50% Lyrical Quality (Grammar, poetry & language construction) 25% Message (Quality of the Message) 25% Clarity of the Message (How understandable the song is) 25% Melody (The quality and beauty of the tune) 25% Formula Final Core Evaluation Percentage = (Core Evaluation Total x 40) / 100 b. On-stage 50% Full Band Arrangement of the Song Entry (The songs overall dynamics) 30% Stage Presence (Performers stage ethics, chemistry and movement) 20% Voice Mastery (The vocalist(s)s quality) 20% Musical Mastery (The instrumentalists quality) 20% Audience Impact (Public acceptance of the performance) 10% Formula Final On-stage Percentage = (On-stage PercentageTotal x 40) / 100 c. Final Score= Final Core Evaluation Percentage + Final On-stage Percentage

8.2 Screening 8.2.1 MUSIKAHAN FESTIVAL will choose the judges and post their names on the official judging sheets 8.2.2Twelve Finalists will be chosen from the CONTESTANT BANDS in the Core Evaluation rating. 8.2.3 The Twelve Finalists will perform the entry song together with two other songs in full band to be judged live in a battle of the bands on March 1, 2014. 8.2.3.1 Each of the 12 finalists is allowed to be on stage for 15 minutes only, inclusive of their setup and performance. 8.2.3.2 A finalist must signify when they are about to play their ENTRY SONG for judges information.

DISQUALIFICATION
9.1 An Entry or Contestant may be disqualified for failure of the Entry or Contestant to comply with any of the rules and regulations, requirements, a violation of any of these rules, or breach of the warranties provided herein. 9.2 Specific rules on disqualification (Especially during the On Stage Battle Event): 9.2.1. A band borrowing any member from other competing bands is subject to disqualification. 9.2.2. Misbehaviour during the contest is ground for disqualification. 9.2.3. Performances that exhibit nudity and sexually explicit behaviour are ground for disqualification. 9.2.4. Only the Event Chairperson is authorized to disqualify a CONTESTANT BAND.

WARRANTIES
10.1 Contestant warrants and represents that Contestant is under no disability, restriction or prohibition, to execute this Agreement, or which may interfere with the ability of Contestant to deliver its obligations hereunder. 10.2 The Contestant warrants that the entry/ies submitted by him/her/them are his/her/their sole and original work, and that there exists no adverse claims to or in said Composition/s. The Contestant further warrants that neither the Composition nor any part thereof infringes upon the literary, musical, personal or property rights of any person, or entity. 10.3 Contestant agrees to fully indemnify, save and hold MUSIKAHAN FESTIVAL free and harmless from any and all damages arising out of, or in connection with, any claim by a third party that is inconsistent herewith. In the event that a claim, suit, or action is brought against MUSIKAHAN FESTIVAL, or any of its subsidiaries or affiliates, it shall notify Contestant thereof and shall allow Contestant to participate in the defence thereof. Contestant shall fully reimburse all expenses incurred by MUSIKAHAN FESTIVAL for any and all damages it may be required to pay by reason thereof. 10.4 Should the infringement be proven, the Contestant shall return any and all prize monies paid to him/her/them, with interest thereon at the legal rate until fully paid. MUSIKAHAN FESTIVAL shall, likewise, have the right to withdraw the prize and to award the prize to the Entry with the next highest result. Should it be proven that the infringement is wilful; Contestant shall be liable for actual and exemplary damages, including attorneys fees. 10.5 MUSIKAHAN FESTIVAL, its subsidiaries and affiliates, the judges and the members of the Competition Committee shall not be liable for any claim by any third party in connection with the ownership of copyright to an Entry submitted to the Competition.

Deadline of Submission of Entry Forms: 5:00PM January 31, 2014, Monday Deadline for the Submission of Original Compositions: 5:00PM, February 14, 2014 Declaration of the top 12 Finalists: February 21, 2014, Monday TunogTagums Songwriting Battle of the Bands On Stage Competition March 1, 2014, 8:00PM, Freedom Park, Tagum City The 12 Finalists are required to send at least one (1) representative for a general briefing meeting on February 3, 2014, 5:00PM; look for Event Chairperson Junrey G. Kho or Vice Chairperson Harold Humawid. Finalists must be in the event area an hour before the competition proper.

That in any such case, said information has been found by the committee falsified during the festivals competition, the committee has the right to disqualify its official participation and shall not be declared winner as the case may be.
