INTRODUCTION
Condominium living has its blessings and its problems. In order to live
happily with our neighbors, it should be remembered that the essence
of condominium living indicates that there must be some curtailment of
individual rights in order to protect the interest of the community as a
whole.

DEFINITIONS
Please use the following definitions for a better understanding of the
Rules and Regulations.
FINE POLICY
Fines will be imposed according to these Rules. Fines will escalate for
repeated violations, acts, or omissions of the same character as those
previously determined by the Board to be an offense pursuant to the
Complaint and Hearing procedures set forth herein. The issue as to
whether a violation, act, or omission is "of the same character" may be
determined at the sole discretion or opinion of the Board of Directors
as established by a majority vote of all Directors on the Board.

ARCHITECTURAL CONTROL POLICY
All Common Areas, specifically that area which is outside of the front
door or outside the patio gate, is a controlled area. No landscaping,
decoration (including painting), construction, or alteration of
landscaping or buildings is permissible, except as provided for by Aliso
Villas Homeowners Association or as provided elsewhere in these
Rules. All residents are advised to submit plans for ANY changes
BEFORE attempting to make changes.
The Board of Directors has 30 days after having received the plans
and other information either from the homeowner at the monthly
homeowners meeting or from the property management company to
review any proposed construction, decoration or landscaping. The
homeowner is responsible for and must have all building permits and
satisfy all building codes. The homeowner must have the work done
by a licensed contractor and provide this information to the Board.
If the Board determines the proposed changes are not suitable, it may
ask the homeowner to alter the plans, or may disapprove the proposed
changes altogether. Any unauthorized changes are still subject to
Board's approval. Unauthorized changes are considered a violation
and subject to our fine policy and the homeowner may have to stop or
remove an unauthorized project.
AIR CONDITIONERS
Window air conditioners are no longer allowed. A central air
conditioning system is the only air conditioning allowed. The
homeowner must submit a plan in writing to the Board. The air
conditioning system must be installed by a licensed insured contractor.

The homeowner must submit the name of the contractor or business,
the address and phone number, and must have the air conditioning
system installed within 90 days after approval or go through the
approval process again. The rules for Architectural Control (see
above) must be followed to have the central air conditioning system
installed or the homeowner may be subject the fine policy and removal
of a non-approved central air conditioning system.
CLUBHOUSE
The clubhouse and facilities are designated for use by members for
Association activities.
Clubhouse activities are limited to the hours between 9:00 A.M. and
9:00 P.M. daily. The Clubhouse must be left clean and locked by the
end of the next day. After 8 PM, all Clubhouse activities must be
limited to the clubhouse interior and the clubhouse doors closed.

Clubhouse furniture, equipment or other property of the Association
must not be removed from the clubhouse.
No smoking is permitted.
COMMON AREA
There shall not be any object left upon, nor stored in, the Common
Area.
Clothesline poles shall not be installed upon the exterior of any unit or
in the Common Area of the community. Patio walls, fences, dividers,
porch railings or any surface plainly visible from the Common Area
shall not be used for drying of towels, clothing, screens, equipment or
other objects foreign to the specified area.

There shall be no climbing on any exterior portion of any building
including fences, railings, roofs, nor upon any tree or object within the
Common Area.
Ball playing near Aliso Villas buildings, garages and other structures is
damaging to the structures and paint, and is prohibited.

cause for legal action.
The storage of personal items, except for normal patio items in the
patio and deck areas, is not permitted in any Common Areas as
defined by the CC&Rs and which include areas adjacent to each unit,
the open parking areas, areas under stairs, decks, patios, slopes,
sidewalks, streets, etc. If personal items are observed being stored in
any of these areas, one warning letter will be sent asking that the items
be removed within 30 days. After 30 days, the enforcement procedure
starts and a fine may be assessed to the owner of the unit and/or the
Association may elect to have the personal items removed and stored
at the owner's expense.
Only proper outdoor furniture may be used on decks and patios. (No
cots, old unsightly couches, chairs, excess toys, playhouses, etc.).

Tree trimming within the confines of any patios is the responsibility of
the homeowner. Trees and foliage must look neat and be trimmed
regularly.
Potted plants on decks and patios must have saucers (plastic, glass or
ceramic not CLAY OR TERRA COTTA) to collect water and silt, which
in the past has caused damage to decks, patios, flashings and walls.
Clay and terra cotta leak water and ROT WOOD.
All landscaping within patios and decks must be kept neat. This is the
responsibility of the homeowner. This includes but is not limited to
trimming trees, shrubs, vines and flowers. Landscape cannot
overhang on roofs or fences. Any landscaping or anything else that
causes problems including but not limited to structural, infrastructure or
property damage must be addressed by the homeowner as defined by
the Board.
Some units have two (2) patios. Homeowners are responsible for all of
the above for both patios.
DOORS
All replacement doors must be approved by the Board of Directors
prior to installation. Doors must be painted to match the existing trim
colors used in the community. Metal screen doors or wood screen
doors must be of a type and color approved by the Board of Directors.
All doors and screen doors must be maintained in good repair by the
homeowner. Those found to be in poor condition must be repaired or
replaced within 30 days or they will be repaired or replaced by the

Association. The homeowner will be responsible for any repairs and/or
replacement and for any fines.
DRAINAGE
No owner or occupant of any unit within the community shall obstruct,
alter, change or remove any drainage structure or facility without the
prior written approval of the Board of Directors, nor shall any owner or
occupant of any unit within the community add additional drainage
structure or facility without such prior written approval of the Board.
Unauthorized additions may have to be removed and a fine may be
imposed.
Every unit has two assigned parking spaces: the enclosed garage and
one outside space marked with the unit number. Residents or guests
can use only the garage, the assigned space or the public street. If
someone uses a resident’s assigned space, the resident may have the
offending vehicle towed.

For the purposes of further defining this section, the following vehicles
will not be permitted to park or to be stored on Association property:
Trucks: Any modified truck, flatbed, stake-bed, or van with higher than
a one ton rating, and trucks with an expired license, expired
registration or in inoperable condition.
A WORD OF CAUTION:
GARAGES
County law and the Association Bylaws state that garages may be
used for parking vehicles and storage only, and shall not be converted
for living or recreational activities. Also, they are not to be used as
playrooms, workshops, mechanic's sheds, offices, sleeping quarters,
dog kennels, etc. Remember - garages are Common property.
Garage doors should remain closed and locked at all times, and
opened only when entering or leaving the garage. Garage doors must
be closed quietly. Slamming garage doors is damaging to the door
and building, as well as annoying to the neighbors. If a resident
damages a garage door or building, they will be responsible for all
repair or replacement costs.
Electric openers are intended to open and close the garage doors for
the entry or exit of vehicles from the garages. The openers cause
noise and vibration when in use and can cause a disturbance to other
residents, especially to residents of the upstairs units directly over the
garages. Please use the electric openers with regard for other
residents in your building.

Due to their inherent noise, please do not use washers or dryers after
10:00 p.m. or before 7:00 a.m.
HOLIDAYS
No July 4th fireworks of any type may be ignited anywhere in the
Common Area and restricted Common Areas (i.e. patios, garages) of
the Association (City Ordinance) at any time. Remember, Aliso Villas
is in a FIRE ZONE.
When there is a legal holiday, the trash collection will be picked up one
day later; therefore, the trash is to be put out one day later at the
"designated" hours.
INSURANCE
Nothing shall be done, kept, or permitted to exist in any building or in
the Common Area, which will result in increase of the rate of insurance
therein.
KEYS
Pool keys cannot be duplicated. If the key is lost, a replacement key
can be obtained from PCM. The Association does charge a fee (at this
time the fee is $40 per key) for the replacement.
LANDSCAPING
The Association is responsible for maintaining landscaping in the
Common Area.
The slopes were landscaped, not only for aesthetic value, but also for
structural control. Slope maintenance is very expensive and all
residents, children and guests must stay off the slopes. The
homeowner will be responsible for any damage or replacement costs,
and is subject the violation fine policy.
Residents should not interfere with the duties of the gardeners. They
have a job to do and a schedule to keep. If you have any special
problems or requests, please refer them to PCM.
NOTE: Homeowners must dispose of all debris and trash from their
area. Mulch, fertilizer, bags of planting mix, soil additives, gardening
tools, etc. must be kept hidden indoors and cannot be left in the
garden area.
LEASING A UNIT
The purpose of this section is to state the Rules regarding tenants in
Aliso Villas, and to explain some precautions recommended to protect
your Aliso Villas investment.

Any "FOR LEASE" sign must be no larger than the size commonly
used by Real Estate companies (18" x 24"). Only one sign is permitted
and it can be displayed only in a window of the unit.
Suggested Precautions:
NOISE
All homeowners and tenants have the right to peaceful enjoyment of
their respective properties and the Common Areas.

3. Radios, televisions, audio equipment, musical instruments, and
noise emitting machinery, shall be operated in a manner and at a time
so as not to unreasonably disturb other residents.
8. Dog owners are prohibited from letting their dog bark to the extent
that the barking causes a disturbance to the peace and comfort of
other residents.
PETS
PET OWNERS ARE RESPONSIBLE FOR CLEANING UP AFTER
THEIR PETS (BOTH CATS AND DOGS) AT ALL TIMES. PET
DROPPINGS SHOULD BE IMMEDIATELY CLEANED UP AND
DEPOSITED IN AN APPROPRIATE TRASH CONTAINER. AT NO
TIME SHOULD THEY BE BURIED OR DISPOSED OF IN ANY
MANNER ACCEPT ABOVE.
All dogs and cats must have an identification collar. Any unidentified
pets may be reported to animal control.
Pets must not be left unattended or tied to a tree, stake or post in the
Common Area.

Cats should wear collars and be vaccinated and litter box trained.
Outdoor cats should be neutered to eliminate the problem of spraying
common areas. "Spray" clean up will be charged back to the
homeowner.
Cats must be kept off roofs. Cats tend to use the gravel roofs as litter
boxes, causing a very unpleasant odor for the nearby residents and
requiring cleanup.
The Association shall have the right to prohibit the maintenance of any
animal, which in the opinion of the Directors of the Association,
constitutes a nuisance or a danger to any other resident or to the
property, or interferes with any person's reasonable and comfortable
enjoyment of his property (CC&Rs).
Exotic pets such as snakes, birds of prey, lions, tigers, etc. are not
permitted.
Pet owners must comply with all sanitary practices and control their pet
so as not to destroy, ruin, or otherwise damage Homeowner or
Association property or landscaping.

PLAYGROUND
Playground hours are from 9:00 AM to 9:00 PM daily. Use of the
playground area other than at these times is strictly forbidden.
Pool Hours are from 9:00 AM to 9:00 PM daily. Use of the pool area
other than at these times is strictly forbidden.

No admittance to the pool is allowed unless the resident has a properly
numbered key.
All gates to pool areas are to remain closed and locked at all times. A
key is required for admittance.
Use of the pool and wading pool is limited to homeowners, tenants and
their invited guests. Three (3) guests is the maximum per unit.
Residents over the age of 14 and under the age of 18 are allowed one
(1) guest who must be 14 years of age or older. Guests must be
accompanied by a resident at all times.
For safety reasons children under 14 years of age are not allowed
within the gated/fenced pool area unless accompanied by an adult (18
years of age or older).
Use of the pool or wading pool facilities while under the influence of
alcohol, narcotics, drugs or medicines is prohibited.
Pool users must shower before entering the pool or wading pool.
Persons using suntan lotions, oils or creams should shower again
before re-entering pool or wading pool.
Floating devices, balls, swim toys, swim fins, diving gear, wet suits of
any kind and boogie boards are prohibited in the pool and wading pool.
Any person with long hair must wear a cap or put the hair into ponytails
or braids. The hair cannot be held in place with metal pins or clips.

Infraction of these rules will not only subject the homeowner to a
possible fine, but could also lead to denial of pool use to the
homeowner or residents of the unit.
PROPERTY MANAGEMENT
PCM of California provides a service to the Homeowner Association.
Their objective is to make your residence in the community as
comfortable and trouble-free as possible. Phone them with normal
maintenance requests such as broken sprinklers, to report vandalism,
or to report any major liability risks. Be aware that a request for other
than routine maintenance often requires the prior approval of the
Board of Directors
The Aliso Villas Board of Directors meets the second week of each
month at 7:30 p.m. in the meeting room at the pool. There are no
meetings in August and December.
RESPONSIBILITIES
Every resident owner is financially responsible for any damage caused
whatsoever by his household or guests. Every absentee homeowner
is financially responsible for any damage whatsoever caused by
his/her tenant and the tenant’s household or guests.

The Association has the responsibility to maintain such items as roofs,
rough plumbing (generally plumbing within the walls), “main” water and
sewer lines and irrigation lines. However, should a leak develop with
one of these items and is repaired in a timely fashion by the
Association, damage caused by a leak to personal property or
household fixtures of a member or resident will be the owner's or
resident's responsibility. It is the resident's responsibility to report any
problems immediately.
The Association is responsible for repairing the roofs. Please report all
roof leaks promptly to PCM of California.
Bicycle riding is permitted on city streets provided that the rules of the
road are observed. Safety helmets are required by law. In the interest

of pedestrian safety, skateboarding, bicycle riding, roller-blading, roller-
skating and similar activities on the sidewalks is strictly prohibited.
Except as noted in the section dealing with driveways, parking lots and
cul-de-sacs, sidewalks are for pedestrian traffic only.
Due to the high cost of repairs and repainting, and the potential
exposure to liability in case of an accident, skateboard riding and street
hockey are strictly prohibited in Aliso Villas.
Aliso Villas adopts the curfew laws of the City of Mission Viejo.

Vandalism is prohibited and vandals will be prosecuted to the fullest
extent of the law. Any observed vandalism should be reported
immediately to the Mission Viejo Police Department at 949-770-
6011, furnishing any descriptions, addresses, names, etc. The
Management Company (PCM) should also be advised.
All applicable local, state and federal laws must be obeyed at all times.
SIGNS
No signs, posters or displays shall be shown or displayed from
residences, excepting one sign or notice of customary and reasonable
dimension which states that the unit is for rent or for sale. Signs
advertising a unit "FOR SALE" or "FOR RENT/LEASE" shall be of the
size commonly used by Real Estate companies (18" X 24"). All signs
are to be removed within forty-eight (48) hours after the signing of the
sale or rental agreement. Signs may not be affixed to the building or
mailboxes.
STREET LAMPS
Malfunctioning street lamps may be reported to PCM of California or
directly to the Edison Company at 800-611-1911 or 800-655-4555 and
online at www.sce.com. Edison will request the pole number (usually
on a metal plate on the pole) as well as the address of the nearest
condominium.
TERMITE WORK
The Association is responsible for the treatment of the structures for
termite control. When selling a unit, the owner is responsible for a
termite inspection of the unit at the owner's expense. If the inspection
discovers a termite infestation, contact Diversified for treatment
arrangements.
TRASH

Garbage or rubbish and recycle containers must be kept in the
garage until pick-up day.
This means that a resident cannot just sit out the garbage bags or
place them beside the garbage or recycle containers. Residents must
put the bags into the proper containers.
TV ANTENNAS/DISHES
Association approval is required PRIOR to the installation of such
devices. All requests for 24" diameter and under DBSS/MMDS
antennae must be submitted, in writing, to the Board of Directors. In
the case of non-owner occupied units (i.e.: rental units) the request
must be submitted by the owner of the unit, not the tenant. No TV
antennas are allowed.

mounting, cables, etc.
Because the Association has more than one building architectural style
within the project, the Association has designated antennae locations
on a unit-by-unit basis, with all dish installation located NO higher than
the upper fascia board of the unit. Under NO circumstances will
roof mounting be permitted. All mini-dishes MUST be mounted on
wooden surfaces only (i.e., fascia boards) without piercing the stucco
surface, or any wood trim surface that leads directly into the interior
wall area of the unit.
Our Bylaws state that "units shall be used for residential purposes
only.
WINDOW TREATMENTS

It is against Association policy to put aluminum foil, sheets, or
cardboard or any such substance in windows. It is suggested that
those desiring brightly colored drapes or curtains, please line them so
that a more presentable and conservative appearance within the
community is maintained.
Keep the weep holes at the bottom of your windows open so the rain
will not collect in the slide and spill over.
Keep your doors and windows locked. Keep garage doors closed and
locked.
The bathtubs require caulking around the soap dishes, overflow drains,
mixer valves, shower heads, etc. to prevent water leaks from causing
damage to floors and ceilings of units below. The owner of the unit in
which the leak occurs is responsible for repairing such leaks and for
the repair of any damage caused by these leaks to other units.
MISCELLANEOUS

Orange County Ordinance 36.015 states that it is against the law to
leave children under the age of 14 years without a responsible person
in charge. Remember also that there is a 10:00 p.m. curfew in effect.
Bicycles, Big Wheels, skateboards, roller blades, etc. are not permitted
on the sidewalks around the units. This is for the safety of
pedestrians.
