From the Departments: Mayors Office (Michael Zuzel): VRT provided this update on the Boise Bike Share Program. Arts & History (Terri Schorzman): The July Boise 150 report. Public Works (Neal Oldemeyer): Update on miscellaneous improvements to City Hall. Police (Chief Masterson): Boise was listed as one of the 20 safest cities in America. Police (Chief Masterson): Dan Popkey of the Idaho Statesman will be featuring an article on U Visas in this Sundays edition of the paper. BPD has played a pivotal role in the treasure Valley in using this tool to encourage cooperation of non-status immigrants, particularly members of the Hispanic community. Overall I believe it will be a positive reflection on the department and u visa process but it will undoubtedly upset some members who have very different views on how we treat those here without legal status. Please see the attached powerpoint on the details of u-visas including the qualifying crimes and criteria and the police agency role in certifying the application. First,itisimportanttounderstandthatthisisonlyapilotprogram.Infact,theParksandRecreationCommissionhas directedParksandRecreationstafftomonitortheprogramonaweeklybasisandtoreportbacktotheCommissionat leastquarterly.AdjustmentswillbemadebytheCommissionasneeded,whichmightevenincludediscontinuingthe program.Theprogramwillbefullyreevaluatedafteroneyear,andshoulditturnoutthatWilliamsParkisnotagood locationforoffleashactivities,theprogramwillend. Second,thispilotprogramisnotbeingimposedontheneighborhoodbyParksandRecreationstafforCityHall.The suggestionthatWilliamsParkbeconsideredfortheoffleashpilotwasmadebyparkneighborswhosignedapetition.A subsequentsurvey,aninformationalmeeting,andapublichearingwereusedtogatheradditionalinput.Iunderstand thatopinionsintheneighborhoodaredividedonthisissue,butitmustbeacknowledgedthatasignificantnumberof residentsoftheareafavoroffleashhoursinthepark.Moreover,ParksandRecreationstaffmadenorecommendation regardingthisproposal;itwastheParksandRecreationCommission,madeupofunpaidcitizenvolunteers,who approvedthepilotonJuly18. Third,onlyaportionofWilliamsParkwillbedesignatedforoffleashpurposesanopenareathatexcludesthe playgroundandsportsfacilitiesandonlyatcertaintimesoftheday.Thisseemslikeareasonablecompromiseto accommodatethewishesofthoseonthevarioussidesofthisquestion. Finally,providingoffleashhoursatWilliamsParkinnowayreleasesdogownersfromkeepingtheirpetsundercontrol atalltimes,pickingupwaste,andgenerallybeingresponsibleneighbors.Theprogramsimplyprovidesadefinedareaat specifictimeswhendogownerscanallowtheirpetsoffleash.Allotherlawsandrulesapply. Boisehas6otheroffleashareasinneighborhoodparks,andthedogownerswhohavetheirdogsplayfetch, loveit.Dogownerswhowalktheirdogsonleashtolerateit,andhopetheirdogsdontfightandpulltheir ownersdownortanglethemupashashappenedattimes.SportsteamshavesuccessfullyforcedtheParks Dept.tomodifyhours,sothattheycanplay.Butfamilieswithsmallchildrenhavequietlyleft,figuringthat theycandonothingtostopit.TheirvoicesaresilencedbyParksdepartmentpersonnelwhoglossoverthe negativereports,andbyatleastonecouncilmemberwhohasaprodogagenda(ShellyAlder*).WilliamsPark willhavenohoursforfamiliesbeforeorafterschool,andonlymiddayduringthesummer.Itisnotfaironthe faceofit.Letslookattheissues. Intheoffleashareas,theparksdepartmentdoesnotprovidefencing,andsoitrestsontheadjacent house(s)(ifthereareany)toprovidethecontainmentmechanismfortheoffleashdogs.Alltheotheroff leashareasinneighborhoodparks,inBoise,havehomeswith56highchainlink,woodorironfencing,often withsubstantialfoliageasanoiseandvisualbarrier.ThedogparkthatisWilliamsParkisfencedby4high ironfencing(3atcertainpoints).Smalldogscanfitthrough,andablebodydogscanjumpit.Twoofthe entranceshavehomesthatdonthaveanyfencingatall.Myfencewasjumpedseveraltimes;once,thedog toreintotheplaytoysthatmy2yearoldhadbeenplayingwith.Myneighborhasalsohadherfencejumped onmorethanoneoccasion.Once,theironrodsevenimpaledadog. Inthe4dogparksinBoise,theParksDept.doesincludefencing.Theyincludecyclonefencingwithdouble gatestoallowfamiliestoplayoutsidethefencedoffleashareawithoutfear.Notethisimportantpoint:the ParksDept.hasspenttaxpayersmoneytoinstallfencingforthesolepurposeofsegregatingthedogactivity fromhumanactivity,butnotatWilliamsPark. TheParksDept.feelsthereisadifferencebetweenanoffleashareaandadogpark,butthisispurely semantic.Theyarethesame,exceptthattheparksdepartment,inone,providesacyclonefencewithdouble gatedentry.Note,inboth,thereisstrongwordingcautioningfamiliestokeeptoddlersout,andyoung childreninclosecontroltopreventinjurybytheoffleashdogs. Thus,whenafamilyentersWilliamsParkbeforeorafterschool,theyareenteringwhatisbasicallyalarge dogpark.Itis,asifbysettingfootintheopengrassarea,theyhavejuststeppedthroughthedoublegatesof anyotherdogpark.AndthisveryactofenteringonesownparkisstronglydiscouragedbytheParksDept. itself.Sohowisitthattheythinkweashumanswithoursmallchildrenareexpectedtoshareintheparkas theyadvancedatthemeeting? Addingtothis,thehistoryofourfencesbeingjumpedmultipletimesand,onedogbeingimpaledthatIknow of;itisborderingonnegligence.TheParksDept.needstomakeareasonableefforttoprovideforthesafety ofthepublic.

NotonlydoestheParksDept.have4designateddogparks,allwiththeappropriatefencing;butBoiseis designing3additionalparks,allincludingdogareasthatwillbefencedaswell.So,itappearstheParksDept. understandstheneedforthefencing,yetstillwantstoprovidemoreroomforthedogsintheseoffLeash areas.Whatisafamilytodo? AtWilliamsPark,thereisonlyoneentrancethatdoesnotinterferewiththedogs.Thatentranceisonthe othersideoftheparkfrommyhome,muchoftheneighborhoodandatleastonedaycamp.Theownermust nowwalkherkidsanadditionalmiletoaccessthedogfreeentrance.Eveniftheownerwasfinewithherown childrennearstrangedogs,shecannotriskitwithherclientschildren.Itisironic,thatthisallstartedwitha fewdogownerswhodidnotwanttodrivethemiletoManitouparksad,really. Wesentpicturesofthefencingtothecitycouncilalongwithpowerpointpresentations,supporting documentation,andreportsfromtheexpertstohelpthecouncilseetheissues.Thoughweweregivenonly3 minutestospeak,wehadenoughsupporttoprovideoveranhouroftestimony.Ipersonallyspokeofthe homesthatabutalltheotherparksandthefactthattheirfencingisverydifferent.Ispokeofthe recommendationsofexpertswithregardtofencingandlocationofoffleashareas.Andaftermorethanan hour,oneofthefewquestionsthatwasaskedoftheParksDept.representative,wasnotwhatarethefences like?but:dotheotheroffleashareasinBoisehavehousesthatabuttheirparktoo.Iwasdumbfounded. Itisinfuriatingtohavegonethroughsucheffortstobeignored.ThePresidentdidntevenknowtherewasa videotestimonywehadsubmitted.Honestly,itisasiftherewasanefforttohidethematerialfromthe council. WhenyoulookatthefewslidesthatIsubmitted,isitnotcleartoyoualmostinstantaneouslythatthereare homesthatabuttheotherparks?Isitnotobviousthatthecouncilmadelittletonoefforttounderstandthis basicissue.ThecouncilevenneededtheParksDept.toreview,forthem,theirownrecommendationsfor familiesduringtheoffleashperiod.IalsoincludedthesesothatyoucanseetheenvironmenttheParksDept. wantstocreateinourneighborhoodpark. EvenifyouwereOKwithexcludingfamiliesfromtheirneighborhoodparks(whichIdontthinkyouare),the fencingisthesingleattributeofWilliamsParkthatmakesitunsuitableasanoffleasharea. Iunderstandthatitisapilotprogram.Butwealreadyknowthecontainmentmechanismforthisactivityis notonlyinsufficientgiventheexpertopinionsandtheParksDept.ownadmissionthattheyusebetterfencing fortheirdogparks;butwealreadyhavetheevidenceofitsfailure(impaleddog,destroyedtoys).Please dontwaitforanotherinjurytooccurbeforerealizingwhatotherexpertsinthefieldofcityplanninganddog behavioralreadytellus. Idontknowwhatyoucandoasmayor.Youcanseethefailureatthecitycouncillevel.Iamaskingthatyou thinkabouttheprocessanddotherightthing.Iwantmyfamilytohaveaccesstothepark.Atleast,Iwould liketofeelthatmybackyardissafe.TheParksDepartmentisabouttotakethataway.Iwouldbehappyto comeanytime.Thisisimportant,andIwouldliketodoanythingtoavoidfurtheraction. ThesamegoalwaspreviouslyimplementedbyPortland,Ore.Itisan"unprecedentedlevelofaction," accordingtoastaffmemofromBoulder'sCityCouncil. Residentswillhavetoreducetheirelectricityusebyaquarterby2020andinhalfby2030tomeetthegoal. Theywillalsohavetoreducetheircommutebycarfromanaverageof20milesadayin2013tolessthan4 milesin2050. You people have created a mess. You don't need to spend more money on parking meters. There isn't anything wrong with the system the way it works. It is all about you getting more revenue. So what if a person stays an extra 5 minutes on someone else's quarter? In the big scheme of things it really doesn't matter. As for Saturday, that will just insure I don't come downtown. It is pleasant to go to the Saturday market and not worry about meters. What is the big deal. It must be about revenue, but when you consider that you will have to have people walking the streets passing out tickets on Saturdays, your human resource costs may well outweigh the revenue gained. Onatriphomeoneeveninglastweek,Iwentthroughapproximately9intersectionswithstoplights.Carsranredlights atthreeofthose.Notlightsthatwerechangingastheywereintheintersectionorevenlightsthathadjustchangedand theymisjudgedwhentheiryellowlightwouldturn.Thelightshadbeenredintheirdirectionforlongenoughforacar tohavestartedfromourtrafficstream.Atnoontoday,IwasatMacMillanandFranklinandfouryesfourpairsofcars wentthrougharedlightsequentiallyturningontoMacMillan.IdriveParkcentereveryday.Trafficthereroutinelyruns 55andcarsrunredlightsalmostalways. Idon'tknowwhatyourfocusis,butwouldsuggestthatattentioncouldbemovedtotraffictoproduceamuchmore positiveeffectforthecommunity.Itwould'ttakemuchtoproduceamajorimprovementinsafetyandrevenue.Anda boostinthepublic'sperceptionofyourgovernance,perhaps. Mayor Bieter, As a resident of the City of Boise I am writing to you today to declare my opposition to the "City Sidewalks Ordinance" and the "Aggressive Solitication Ordinance" (http://mayor.cityofboise.org/newsreleases/2013/05/city-council-to-consider-ordinances-to-curb-panhandling-and-other-sidewalk-issues/). Below I summarize current literature on the topic, and would also like you to know that I believe that panhandling that is violent and/or disturbing is already covered under numerous other laws and also that I do not want to live in a city that criminalizes survival. A review of the current scholarship on anti-panhandling shows: 1. Criminalizing means of survival means that those individuals who are having a difficult time getting stabilized are only further destabilized by being punished for trying to eke out a means of survival; 2. The United States Interagency Council on Homelessness (see attached) in a report called Searching Out Solutions identifies many alternative solutions which have been more productive at collaborating to find a solution together; 3. These solutions "have been effective in reducing and preventing homelessness in several cities around the country" and that they "can be relatively inexpensive to implement, result in overall cost-savings, and have a lasting positive impact on the quality of life for individuals experiencing homelessness and the larger community." 4. One of those solutions is http://streetsteam.org/our-work-first-model-for-ending-homelessness ; 5. Many research articles point out that anti-panhandling laws are ineffective and merely made the homeless relocate to areas without a police presence, neighborhoods that were not accustomed to such issues, and therefore result in bigger problems; 6. Anti-panhandling laws violate the First Amendment rights of specific classes of people, in this case homeless people; 7. Arguments against panhandling fail to acknowledge the "deep rooted associations among race, poverty, and homeless" and the laws do not actual address the issue at hand; 8. Creating laws such as this add "social distance" between one member of a city and another which has a negative impact on community building (Goldstein, The Limits of the Law, 1993). My final two cents: I lived in a city that enacted laws such as these and what I saw happen was bloody, messy, and disgusting and in the end caused me to leave that city. In my strong opinion it ruined the social fabric and community that the area had come to mean to me. I strongly advocate against a better solution. Best, Amy Vecchione

Mr. Mayor, I was unable to make last night's public hearing concerning the proposed panhandling ordinances, but I wanted to get an opportunity to share some of my experiences and thoughts. My wife and I moved from southern California last summer, where I had lived for years, in the town of Ventura. Panhandling has made the downtown area of Ventura unsafe and very unpleasant late at night. Many storefronts in the once flourishing downtown area were for lease since no one wanted to walk around there. "Just saying 'No'" isn't an answer when you have to do it 4-5 time in a single block. Saying "No" isn't fun, I don't like it, and it made me just shopping and walking around areas where I was forced to do that. When we moved to Boise we were pleasantly surprised how fun and safe it seemed in the downtown area. We have a 14 month old daughter, and we feel comfortable letting her walk a bit on her own when we are out. While I know that most of the people that showed up to the town-hall meeting expressed opposition to these laws, I think you would be misguided to assume that reflected anything other than a noisy minority. I feel like support for the handicapped and disabled through private charity (and even government programs) is far superior to panhandling. Programs like that attempt to help people out of that stage in life through accountability and assistance, not cash that will mostly end up funding the next high. Please, keep Boise a place that is fun to walk around. Keep Boise a safe place for my daughter to run around in and have fun. Help the homeless by not enabling the self-destructive tendencies that so often result from panhandling. I fully support the passage of these proposals to help curb these destructive habits. July 31, 2013 Council President Maryanne Jordan and members of the Boise City Council: Regarding the proposed Civil Sidewalk Ordinance. My name is Marc Schlegel, resident of Boise (525 Warm Springs Ave, 83712). I am pastor of Hyde Park Mennonite Fellowship in the Hyde Park neighborhood (1520 N. 12th Street, 83702), a congregation of about eighty members. It is my view that this is an unjust law that targets some of the most vulnerable in our community. It is a law that seeks to protect business first and foremost. In listening to the public testimony given at the July 30 council meeting, there was an overwhelming majority of Boise residents who spoke against the passing of this law. Those who spoke in favor of the law were certainly the minority of voices, though they were often representatives of the business community. I hope that the City Council will not simply favor the voice of those who own businesses and property over the overwhelming majority of regular citizens speaking against the law. While I am confident that the City Council members have the best interest of Boise in mind, I in no way believe this is in Boises best interest. I can see why it may seem that this will be good for Boise and the business community, but there is so much more to Boise than just this one narrow area. This is a short-sighted law that seeks only to put the smallest band-aid on a problem that needs serious medical attention. This is a law with many unintended consequences for the city, the police force, and certainly for those who find themselves without employment or a place to call home. What I find disappointing about this ordinance is its utter lack of creativity. Like so many things in our country and culture, rather than trying to work at innovative solutions to a difficult problem, we simply criminalize the activity. This ordinance simply looks at some of the surface problems of chronic homelessness in our community and does not look at trying to meet any of the deeper, root causes. We need to invest more time and resources into the deeper causes of homelessness, of finding permanent and affordable housing solutions for those living on the streets, in resident hotels, or staying in shelters. What our homeless and unemployed Boise residents do not need is another fine to pay, to feel more paranoid that the city police are unfairly targeting them, or to have such a violation be on their criminal record. I hope to work with the Council and Mayor on innovative and creative solutions in the future. I agree with the Boise businesses that having panhandlers and homeless downtown does not leave a good impression on what your citizens call a beautiful, clean city. I work on 8th Street and watch the homeless everyday, either laying on a bench in front of our highrise or sittng on the sidewalks. Some, who your city officials would probably call the music vendor (can't recall the correct term - the ones who think they are musicians), are a nuisance. If they are to be considered musical talent trying to make a living then they should be able to play a song, not just bang on a drum or play one musical note. These musicians and homeless are dirty and unappreciative. This is just my opinion of what I see. Now, in my heart, I feel differently and am always one to donate to someone in need, but I don't believe these people are in need, I think they are most likely just trying to rip people off for money. It doesn't help that your supposedly "clean" city, allows for tattoo parlors to be located downtown which attracts many of these young unbathed adults. On another note, having worked for Family & Children Services, the staff is aware of the so called "panhandlers" who are stationed around town, who are actually not broke, who are on services and have had their children removed from their homes, yet, their signs state "father of two" or "homeless mother". While that may be true, technically, it is not. Another instance of their untruth to the public, thus my reason for not really feeling sorry for these people. Senate The Senate convened at 9:30 a.m. Eastern and resumed consideration of the FY 2014 Transportation and HUD annual appropriations bill. The Senate will also consider the nominations of B. Todd Jones for director of the Bureau of Alcohol, Tobacco, Firearms and Explosives and Samantha Power for U.N. ambassador. Yesterday, the Senate confirmed the first of several nominees to the National Labor Relations Board. House The House convened at 10 a.m. Eastern and was expected to finish consideration today of its version of the FY 2014 Transportation and HUD annual appropriations bill, but the bill was evenutally pulled from consideration due to disagreements within the Republican Caucus. The House is currently voting on a Senate approved bill to address student loan interest rates, which is expected to pass. It will also vote on an Iran sanctions bill and several bills aimed at curbing government abuse of taxpayer dollars.

By Josh Kraushaar The National Journal 07/31/2013 As the prospects for passing comprehensive immigration reform have dwindled, a favorite pundit talking point has emerged: "House Republicans are voting so conservatively because they fear a campaign challenge from their right." The mere threat of primaries has become the catch-all for explaining Republican opposition in the House. But as the argument became ubiquitous in 2013, something funny happened. The number of conservative challengers going up against GOP members of Congress hasn't developed as had been expected. In fact, there are currently as many notable Democratic primary challengers to incumbents as Republican intraparty battles. Rep. Mike Simpson of Idaho is the only Republican currently facing a credible primary challenger, who is backed by the Club for Growth. House Agriculture Committee Chairman Frank Lucas of Oklahoma, facing blowback over passing a subsidy-filled farm bill, is the other member facing a similar threat. Freshman Rep. Rodney Davis is facing former Miss America Erika Harold in the Republican primary in Illinois, but few expect her to win. In his original tome from the mid-1800s, Robert wrote: Where there is radical difference of opinion in an organization, one side must yield. POSITION SUMMARY: Valley Regional Transit is seeking a Bike Share Program Director. Reporting to the Executive Director, the Bike Share Program Director is responsible for financial development, program implementation, and administration of the bike share program in compliance with state, local and federal requirements. This position will be a member of the Valley Regional Transit Executive Team. RESPONSIBILITIES: Assures the financial viability of the bike share program through the development of sponsorships and advertising opportunities. Responsible for developing and assuring compliance with program policies pertaining to operations, customer service, membership, and user fees. Oversees the development of the program including location and placement of bike share stations and bicycles. Determines the necessary program support required and oversees the day to day operations through the administration of third-party contracts. Administers all procurements and program operations for the bike share program in compliance with federal, state and local requirements. Develops program objectives to meet Valley Regional Transits strategic goals. Develops and manages Valley Regional Transits Bike Share Program operation and capital budgets. Develops and implements communication strategies, public outreach and stakeholder engagement activities

Works with other departments to assure coordination with regional transportation products and services Collects and analyzes data to prepare program performance reports Develops and delivers presentations to general public and policy-makers Manage, train, and coach staff. Creates, assures compliance of, and implements policy, procedures, and processes that support division. Maintains a professional and courteous demeanor at all times. Provides timely, respectful and thorough customer service to internal and external customers. Responsible to be dependable, punctual, and a self-starter. Other duties as assigned.

KNOWLEDGE/EXPERIENCE REQUIREMENTS: Bachelors degree in related field or equivalent experience. Five years of successful upper level management. Ability to work in a rapidly changing environment and to change priorities accordingly. Ability to respectfully work with a diverse range of people. Ability to continually learn and adapt as job requirements change and new opportunities arise. Above average use of the English language in verbal and written forms. Ability to communicate complicated technical information in simple and easy to understand terms. Working knowledge of applicable federal, state and local rules and regulations as they apply to transit. Willing to become the authority expert in one or more subjects. Upper level supervisory experience. Must have a valid drivers license or be able to earn one. Must be able to operate a motor vehicle.

July 31, 2013 TO: Mayor Bieter and City Council FR: Terri Schorzman RE: BOISE 150 UpdateJULY 2013 report The July Sesqui-Month began with walking tours of Boises historic plat on the 5th and 6th. The tours kicked off the BOISE 150 Sesqui-Party weekend. We had hoped for 200, planned for 400, and had over 1000 (of which we could accommodate 800 with the generosity of our volunteer tour guides and their willingness to lead extra tours). The Sesqui-Party in Julia Davis Park on July 7 was a smashing success! It started with a bike parade of hundreds, which led to live music by Finn Riggins, a.k.a. Belle, and Steve Fulton (all featured on the BOISE 150 music compilation); performances by Idaho Shakespeare Festival, Ballet Idaho, Trey McIntyre Project and the poet laureate at the Bandshell; historic fashion show; vintage car show; arts and music performances throughout the park; free admission to the Idaho State Historical Museum, food trucks, beverages, and many community booths staffed with people who let people know about their good work and encouraged involvement. The booths were slammed all day. Our estimated attendance was about 20,000 throughout the day.

Over 1500 people visited the shop in JULY, for a total of 13,000+ guests in the Shop since midDecember. The exhibit for July, Faces of Boise--A Look at Local Identity explored the many identities that make Boise unique. It showcased work by Wingtip Press, Melanie Fitton Folwell, the Burn's Studio and Jose Angle Saenz. From modern immigrants, teachers, preachers, farmers, and merchants to remarkable Boise women, to historic photographs of Boise buildings, businesses, people, and activities, this stunning collection of over 200 images reflect life in Boise through the lens of over 15 Boise artists. The exhibit for August: BOISE 150 and the Boise WaterShed will host artist Kirsten Furlong in the creation of an environmental art installation titled Standing Still: The Trees. The installation will begin August 1 (First Thursday) and take twenty days to complete. Kirsten Furlong will act as resident artist in the Sesqui-Shop during the length of the installation, offering individuals the opportunity to participate in the project. In addition to the installation, the Sesqui-Shop will become a resource center offering educational materials on sustainability and conservation presented by the Boise WaterShed and other environmental groups. Join us First Thursday (August 1) for the introduction of Standing Still: The Trees. 1

Violent crime reports rose in America for the first time in 2006, according to FBI statistics. However, the recent 1.2% increase belies a long-term trend: America is becoming a much safer country.

To find out which parts of America are the safest, we looked at the FBI's latest report on crime and found cities with violent crime rates substantially below the national average. We only included cities with populations of more than 200,000 to exclude suburban areas. Many of the cities are repeat winners from our 2011 report on America's safest cities. Irvine, Calif. has been the safest city in the country for the 9th consecutive year. The city of just more than 200,000 has one of the country's top-ranked school systems, a median household income well above the national average, and a crime prevention method that includes keeping a thorough record of violence. Nine of the 20 safest cities are located in the Southwest, with another six located in California. Conversely, on our list of the 25 most dangerous cities, there were no Southwestern
cities and only two California cities.

It should be noted, however, that different crime reporting policies among police departments may make some cities appear safer or more dangerous than they really are. Neighboring cities Virgina Beach and Chesapeake, VA, are the only two on the list with murder rates equal to or above the national average. However, rape and robbery rates substantially below the national average compensate for this difference.
