Rich builders , crooks in their greed for more money ( knowing fully well the illegalities ) have constructed buildings on public land , constructed buildings violating the building bye-laws. Now , those crooks are earning lakhs of rupees rental income . The government law enforcement agencies were mum , didn t demolish such buildings in time , allowing time for crooks to benefit from anticipated regularisation. !owever the same government agencies have not shown kind consideration to poor people who have constructed temporary hutments on public land . Those hutments were immediately demolished " people evicted.

These building bye-law violators , #and grabbers are not poor people living below poverty line earning only rupees $% per day as per planning commission of india. These rich crooks don t deserve sympathy , kind consideration as they have committed the crime knowing fully well the illegalities and they can bear the loss due to the demolition of their illegal buildings. The government must also recover rent " other monetary gains made out of those illegal buildings by the builder.

The &overnor s green signal to the 1krama Eakrama Fill may bring cheer to thousands of property owners in the city. The property owners may now be able to regularise their building byelaw deviations, specifically deviations in setback and floor area ratio. 1s per the 'arnataka Town and 5ountry )lanning ('T5)) 1nd 5ertain Gther #aws (1mendment) 1ct, %BB?, and the amended 'arnataka Cunicipal 5orporations 1ct, +?HA, residential property owners will be able to regularise deviations up to a ma>imum of /B per cent and for the commercial buildings, the ma>imum deviations allowed is up to %/ per cent. This will apply to buildings constructed before ,ecember $, %BB?. Fruhat Fangalore Cahanagara )alike (FFC)) C. #akshminarayan told The Hindu that around @B per cent of the +A lakh properties in the city have one or the other form of deviation. !e said that the building byelaw violations are common and most citi(ens deviate from the sanctioned plan. This could be for a variety of reasons, including vaastu. The FFC) only allows five per cent violations. !e said that the largest beneficiaries of this scheme will be large apartment comple>es and big commercial buildings, who have accrued the violations. I4ndividual, small property owners may not be in large numbers, neither will the deviations be huge.J Cr. #askhminarayan said the FFC) had not yet assessed the revenue that it will get from this one-time payment to regularise their deviations. I!owever, the FFC) will not compromise on safety aspects. Regularisation of deviations will be done only if there is a full compliance of safety norms.J

F1N&1#GR0* 'arnataka government has planned to introduce an amendment to the 'arnataka #and Revenue 1ct +?A., to regularise unauthorised constructions of dwelling houses in government lands in urban areas, official sources said. The amendment Fill would seek to insert a new section ?. 55 in the 1ct, providing for grant of land in the case of unauthorised construction of dwelling houses in government land in urban areas. &overnor ! R FhardwaD had returned the 'arnataka #and Revenue (Eecond 1mendment) Fill, %B+%, passed in both the !ouses of the #egislature during the previous FK) government on the ground that Lthe amendment does not serve any public good or social cause. Gn the other hand, it may lead to illegal grabbing of government land.L 1 team of advocates is studying the points raised by the &overnor. 'eeping in mind public interest, the government would draft the Fill again and introduce it in the 1ssembly. Regularisation of constructions on government6revenue lands would benefit lakhs of households in Fangalore. The proposed legislation is aimed at regularising unauthorised occupation of revenue land belonging to government in urban areas with dwelling houses constructed, by granting the land to unauthorised occupants, the sources said.

4t has been almost a decade since different political parties promised regularisation of unauthorised development and constructions in urban areas, including Fangalore city which has the ma>imum number of such structures, through a scheme popularly known as 1krama-Eakrama. 1nd in %BBH, the then Kanata ,al(E)-Fharatiya Kanata )arty government made a little progress on this promise by enacting the 'arnataka Town and 5ountry )lanning ('T5)) and certain others (1mendment) 1ct, %BB. in giving ?B days for regularisation of four types of irregularities. 2ollowing this, the 1krama-Eakrama scheme was launched in Eeptember %BBH after rules, fi>ing fees for regularisation, depending upon type of violation, were framed. Then, the Fruhat Fangalore Cahanagara )alike (FFC)), with much fanfare, issued a booklet with application forms for regularising four types of irregularities M plot in unauthorised layout6sub-divided landN building with land use violationN set back violation (up to /B per cent for residential and %/ per cent for commercial)N and floor area violation M between Eeptember +/ and ,ecember +., %BBH. !owever, the scheme was put on hold after the owners of unauthorised structures6sites rose in protest, terming the regularisation fee as e>orbitant, and the government agreed to revise the fee. 1t the same time, the 'arnataka !igh 5ourt was moved by some citi(ens Ouestioning the legality of the scheme, while a few property owners Ouestioned the high fee. Ceanwhile, the FFC) refunded about Rs. %@ crore collected from about .,BBB applicants.

#ater, the FK) government during %BB@-+B, approved an Grdinance initially and later passed an amended Fill to facilitate re-launching of 1krama-Eakrama scheme while reducing the regularisation fee by about /B per cent. Fut, both the attempts were shot down by &overnor !.R. Fangalore ,evelopment 1uthority (F,1) has become a den of corruption and the government needs to take steps to check large scale irregularities in the authority, said ,eputy #eader of 5ongress in the 1ssembly T F Kayachandra. Epeaking on the demands on departments in the 1ssembly, the 5ongress leader on 2riday urged the government to constitute a !ouse 5ommittee to look into the irregularities. Ten days ago, the 3rban ,evelopment ,epartment had sent a letter to the !ome ,epartment seeking it to hand over the investigation of the irregularities in C3,1 and Ramanagaram-5hannapatana 3rban ,evelopment 1uthority to the 5entral Fureau of 4nvestigation (5F4). C3,1 commissioner 5 & Fetsurmath said a site in &okulam 444 stage was allotted to one C ' Ranganayaki in +?H$ through auction and she had obtained title deed in %BB%. Fut in the meantime, the accused NagaraD has created fake documents about the site and made the authorities believe that he had purchased the said land in +?H? in an auction. #ater he has taken title deed for it and then sold it to another party.

Fut the crime has come to light after the actual owner approached the authorities only recently. =hen the documents were verified, C3,1 authorities found that site number has been forged from $H to H$. The commissioner said the title deed of the said site obtained by NagaraD has been cancelled and we are investigating on this score. Fangalore* 1ttempting to clear the air on speculations regarding the alleged multi-crore bogus bill scam in three assembly constituencies, Fangalore Cetropolitan Task 2orce (FCT2) inspector general of police R) Eharma said the investigation will not be restricted to RaDaraDeshwarinagar, &andhinagar and Calleswaram constituencies. The probe will also include other areas, he clarified. Epeaking at the FFC) head office on =ednesday, Eharma said even though the 24R filed on November . by the additional commissioner (administration) pertains to only three constituencies, sleuths will look into other areas if necessary. 'allalli alleged that the decision was taken to help &opinath, who is the brother of senior REE functionary ' Narahari. !e claimed that the 'E,F had obDected to the decision, reminding that it was not only illegal, but would also affect the weaker sections of the society. The board also said that the tender process was almost over. !owever, the government set aside the obDections of the 'E,F and the tender process to construct houses. =hen contacted, 'umar said he had no information about the case since he was away in Fellary. !e said he would find out once he returned to Fangalore. 1 few months ago, 'umar had tendered his resignation after it was alleged that his family was the beneficiary of a Q& category site. !owever, the chief minister refused to accept the resignation as no substance was found in the allegation.
