VettingPolicyforLoretoCollegeCavan 1.Rationale: InthecontextoftheschoolsMissionStatementandofitscommitmenttothecareandprotectionofitsstudents andofallwhoworkintheschool,theBoardofManagementhasadoptedthepolicysetouthereundertogovernits applicationofGardavettingaspartofitsrecruitmentpractice. Thepolicyhasbeenframedincompliancewith: DEScircularletter0094/2006 TheChildProtectionGuidelinesforPostPrimarySchools(DES2004) TheDataProtectionActs1988and2003 EmploymentEqualityActs1998and2004 EqualStatusAct2000 IndustrialRelationsAct1990 TheGardaCentralVettingUnitsCodeofPractice 2.Goals: Toensurethattheschoolisasafeandsecureenvironment.

Toensurethatvettingofschoolpersonneliscarriedout: o tothehigheststandardsofgoodpractice o incompliancewithalllegalandethicalobligations o inanopen,transparentandjustmanner owithanassurancetoapplicantsforvettingthatthehigheststandardsofconfidentialityareobserved. 3.ThePolicy: Inphaseone,allnewstaffbeingrecruitedfrom1stSeptember2006orlaterwhohavenotbeenemployedina recognisedprimary,orpostprimaryschool,inaYouthreach,VTOS,JuniorEducationorTravellerTrainingCentrein thisstateatanytimesince1stSeptember2003mustbevettednow(circular0094/2006).Allnewstaffmeansall personnelworkinginafulltime,parttime,voluntaryorstudentcapacitywhowillhaveunsupervisedaccessto childrenandvulnerableadults(para2.3of0094/2006). Theextensionofvettingtootherschoolpersonnelwillbenotifiedtoschoolmanagementinduecourse. Atthecompletionoftheselectionprocess,whenthepreferredcandidatehasbeenselected,thecandidatemust completeaGardaVettingApplicationForm. Alloffersofemploymentwillbeinwritingandwillbesubjecttosatisfactoryvetting. FailuretocompletetheGardaVettingApplicationFormwilldisqualifythecandidateandnoofferofemploymentwill bemadetohimorher. TheprovisionofinaccurateinformationontheGardaVettingApplicationForm,suchasan inaccuratedateofbirthoraddress,maydisqualify. Failuretodiscloseaconvictionwilldisqualify. (Notethatinthisjurisdictionthereisnosuchthingasaspentconviction) Theattachedschedulesetsoutthoseoffencesorcategoriesofoffenceswhichwilldisqualifycandidates.Italso setsoutotheroffencesorcategoriesofoffenceswhichmaydisqualify.Indecidingwhetheraparticularconviction rendersacandidateunsuitableforappointment,theschoolwillhaveregardto: thenatureoftheoffenceanditspossiblerelevancetothepost theageoftheoffence(offencesmanyyearsinthepastmaybelessrelevantthanmorerecentoffences) thefrequencyoftheoffence(aseriesofoffenceswillgivemorecauseforconcernthananisolatedminor conviction). Offenceswhicharenotsexualorviolentinnatureordrugrelatedoffencesofaminornaturecommittedbeforethe ageof18willbejudgedinthelightoftheageoftheapplicantatthetimeoftheoffence. Wherethevettingprocessdisclosespendingprosecutionsorunsuccessfulprosecutions,suchprosecutionswill

beassessedinthelightofthenature,ageandfrequencyoftheallegedoffence(s)andoftheageofthecandidate atthetimeoftheallegedoffences. 4.RolesandResponsibilities: ThePrincipalwillbedesignatedastheLineManagerandwillberesponsiblefortheimplementationofthispolicy. ThePrincipal/LineManagerwillconducttheprocessonbehalfoftheschoolinconjunctionwiththeJoint ManagerialBody(JMB)and,throughtheJMB,withtheGardaCentralVettingUnit(GCVU). Intheeventofadisclosure,thePrincipalshouldmeettheapplicantinpersonandinprivacy.Theapplicantwillbe informedofthenatureofthedisclosureandwillbegivenanopportunitytorespondtoit.ThePrincipalmaywishto beaccompaniedtothismeetingbytheChairpersonoftheBoardortheManager.Insuchaninstancetheapplicant shouldbeinformedthattheChairpersonorManagerwillbepresentandtheapplicantshouldalsobeaffordedthe optionofbeingaccompaniedtothemeeting. ThePrincipal/LineManagershouldbeauthorisedtodetermineiftheoutcomeofthevettingofacandidatehasbeen satisfactoryornot,thedeterminationbeingmadeinaccordancewiththeschoolspolicyonvetting.Shouldthe Principal/LineManagerdeemitnecessary,he/shemayconsulttheChairpersonoftheBoardofManagement /Managerbeforereachingadecision. TheonlycircumstanceinwhichadisclosureofconvictionsorprosecutionswouldbemadeknowntotheBoardof Managementwouldbewheretheapplicantconsentsthattheybeconsulted. WheretheapplicantappliestotheschoolforacopyoftheGardavettingdisclosuredocument,acopywillbegiven tohim/her. TheEightRulesofDataProtectionwillbestrictlyobservedbytheschool. 5.Implementation: ThispolicywillbeeffectivefromthedateofadoptionbytheBoardofManagement. TheschoolsVettingPolicyismadeavailablethroughtheschoolswebsiteatwww.loretocavan.ietocandidatesfor employment,paidorunpaid.Atintervieweachcandidateisrequiredtoconfirmbysignaturethat: he/sheisawareoftheschoolspolicyonvetting he/sheacceptstheschoolspolicythatsatisfactoryvettingisanessentialrequirementforappointmenttoapost intheschooland He/sheauthorisesthePrincipal/LineManagertoreceivedisclosureoftheoutcomeofGardavettingandtohave regardtoitindeterminingifthecandidatemaybeappointedtothepost. Candidatesareinformedofthisrequirementwhencalled,usuallybytelephone,forinterview. 6.PolicyReview: Thispolicywillbereviewedasnecessaryandparticularlytocomplywithanyrelevantlegislativechanges.
