Dear Sir/Madam, CIRCULAR 1/2011: REDETERMINATION OF MUNICIPAL BOUNDARIES On behalf of the Municipal Demarcation Board (MDB) I would like to thank you and all other stakeholders for your participation and contributions in the ward delimitation process during 2009/2010, and the successful local government election held on 18 May 2011. The Board would also like to congratulate all newly elected councillors. The Board wishes them all the best for a very successful term of office. To ensure that municipalities receive correspondence from the Board, your assistance is required to update the Boards contact database regularly. The attached form (Annexure 1) can be used in this regard. Please complete it and email it to vanie@demarcation.org.za or fax it to: 012-342 2480. Municipal Managers are requested to bring the contents of this circular to the attention of all councillors, and other stakeholders in their municipal areas such as ward committees, traditional leaders, community development workers etc. While this circular only deals with the programme for the re-determination of municipal boundaries, I would like to provide you with some background information on the MDB and its mandate: The MDB was established in 1999 in terms of the Local Government: Municipal Demarcation Act, 1998. It is, in terms of section 155 of the Constitution read with section 3 of the Demarcation Act, 1998, an independent, impartial and juristic person, that must perform its functions without fear, favour or prejudice.

In terms of sections 155(3)(b) of the Constitution read with sections 4 and 21 of the Demarcation Act, 1998, the MDB is responsible for the determination and redetermination of municipal boundaries, and in terms of sections 157(4)(a) of the Constitution read with Schedule 1 to the Structures Act, 1998 the MDB is responsible for the delimitation of wards. Other functions include the categorisation and demarcation of metropolitan areas, the declaration of district management areas, and the assessment of the capacity of district and local municipalities to perform their functions. These functions are provided for in sections 4, 6, and 85 of the Structures Act, 1998. The Constitution of the Republic of South Africa, 1996, the Local Government: Municipal Structures Act, 1998 and the Local Government: Municipal Demarcation Act, 1998 are available on the Boards website: www.demarcation.org.za In terms of the current constitutional and legal framework the next local government elections will only be held in 2016, following the National and Provincial elections which are due in 2014. This requires that all changes to municipal boundaries need to be finalised prior the National and Provincial elections so that the national voters roll can be segmented according to confirmed and final municipal boundaries. This means, that all the changes to municipal boundaries must be completed at the beginning of 2013. The Board will now start reviewing municipal boundaries again, and the intention is to finalise all changes to municipal boundaries by around May 2013, where after wards will be delimited for the 2016 local elections. It is envisaged that the process will, in broad terms, unfold as follows: PROVISIONAL PROGRAMME AND TIMEFRAMES FOR THE REDETERMINATION OF MUNICIPAL BOUNDARIES PRIOR TO THE WARD DELIMITATION PROCESS FOR THE 2016 LOCAL ELECTIONS June Dec 2011 MDB Chairperson and Board members visit Minister and MECs responsible for local government to explain process. Inputs by stakeholders on current outstanding boundary changes. Stakeholders submit new requests for boundary changes to the MDB. Visits to municipalities where necessary. Nov - Dec 2011 Mapping of new proposals Jan March 2012 Follow up communication and visits to municipalities, where necessary, to refine maps, and descriptions. March - May 2012 Prepare and publish Section 26 notices. Distribute notices to stakeholders. Communication campaign to inform public to submit views and representation on section 26 notices. 30 May 2012 Closing date for the submission of written views and representations on Section 26 notices to the MDB. The Board has already received some requests for the re-determination of certain municipal boundaries, and has also, in cooperation with stakeholders such as the IEC and StatsSA, identified a number of municipal boundaries which require technical alignment to other boundaries or natural features. To ensure easy access to these cases, they will be posted on the MDB website (www.demarcation.org.za) under specific reference (DEM) number, together with the necessary maps. Maps and information can also be obtained from the responsible staff members. Their names and e-mail addresses are provided on pages 5 and 6 of this circular.

All stakeholders are requested to consider these cases as soon as possible, and to forward written comments under the relevant DEM-number, to the Board. Where stakeholders are aware of other boundaries that may require a redetermination, such cases may also be brought to the attention of the MDB for consideration. Such request should reach the offices of the MDB by not later than 15 December 2011. Some information in this regard has been included in SALGAs Induction Manual for newly elected councillors. The first step for a stakeholder wishing to request the MDB to change a municipal boundary, is to consult the affected communities and the municipalities that will be affected by the proposal. Where traditional authority areas or boundaries, and/or magisterial district boundaries are affected, it is recommended that such authorities, the Provincial House of Traditional Leaders, and the relevant magistrate also be consulted. Once consensus has been reached with these stakeholders, the affected municipalities, and/or the MEC responsible for local government, can submit a request to the MDB to re-determine the boundary. Such a request should be submitted in terms of Section 22 of the Demarcation Act, 1998, and should include at least the following: the names of the affected municipalities; a proper description of the affected area that needs to be moved from one municipality to another municipality (use farm names, ward numbers, voting district numbers etc); the relevant DEM number; motivation for the proposed boundary change; and information that may be required by the MDB. The request should please be signed by all affected municipalities. Alternatively, the different municipalities can send separate supporting letters to the MDB. The DEM number and the information required can be downloaded from the MDB website (www.demarcation.org.za) or can be obtained by sending an e-mail to the responsible staff members referred to later in this circular. In general the required information will be related to the criteria that must be taken into account as provided for in Sections 24 and 24 of the Demarcation Act, 1998. Where a boundary of a metropolitan municipality is affected, Section 2 of the Structures Act, 1998, also needs to be taken into account. Upon receipt of the request, and the above-mentioned information, the MDB will consider the request, and, where feasible, initiate a consultative and legal process as set out in the above-mentioned provisional programme and timeframes. I wish to stress that the MDB will, in general, prioritise requests submitted jointly by the affected municipalities, or the Minister, or the MECs responsible for local government in terms of section 22 of the Demarcation Act, 1998. It is therefore advisable for persons and institutions wishing to propose certain changes to municipal boundaries, to first consult with the affected municipalities, and to convince the municipalities to submit a request to the MDB in terms of Section 22. Your attention is also drawn to the fact that the MDB can only deal with municipal boundaries. Where a proposal affects a provincial boundary, such proposals should

NOT be submitted to the MDB. The Constitution needs to be amended to deal with such cases, and such requests should be addressed to the Department of Cooperative Governance and the Department of Justice. The MDB has no authority to change provincial boundaries or the Constitution. You will note that the above-mentioned programme allows for MDB visits to municipalities. The first provisional period allocated for visits is from August to October 2011. The purpose of these visits is to: clarify any uncertainties pertaining to the role and responsibilities of the MDB; clarify the process and timeframes as set out in this circular; answer questions about the current list of cases (DEMs) available on the MDB website; assist municipalities experiencing problems with the submission of new requests to the MDB.

The MDB has prepared the attached provisional programme for the visits to municipalities (Annexure 2). It is suggested that one meeting be held per district area, and that the affected municipalities arrange a suitable and mutually convenient venue for the district meeting. The forms to be completed in respect of these visits are attached to the programme. (Annexures A and B) Municipalities interested in meeting with representatives of the MDB as set out in the programme, as well as Municipalities not interested in meeting with representatives of the MDB, are requested to complete the relevant form, and to send it to the MDB by not later than 20 July 2011. Municipalities not requiring the proposed meeting should complete Annexure A, and municipalities wishing the Board to visit them should complete Annexure B, please.
