a. Tis is a HAP cntract bew n te PHA ad the
ower. Te H cntract is enterd to provide
assistace fr the family under te Sion 8 voucher
program (see UU prgrm rglaions at
24 Code of Federal Regulations Part 982).
b. Te HAP contract only applies to the household ad
cntract unit spiDed in Par A of the HAP
contract.
c. Ding the HAP cntract ten, the PHA will pay
housng asistac payment to the ower in
acrdance Wthe H0onm0l.
d. Te family will reside in the contact unit with
assistance under the Section 8 voucher prgam. The
housing assistnc payments by the PHA assist the
tenant to lease the contract unit from the owner fr
occupancy by the faily.
2. Lase of Contract Unit
a. The ower has led te cntract unit to th tenant
fr occupacy by the family with assistance under
the Section 8 vouche program.
b. The PH has appove lasing of the m! in
accordance with requirments of the Section 8
vouN6rpK.
c. Te lease fr the cntract unit must include wr

b. PHA must deterine whethr the rnt to owner is
raonable in cmpn to rent for oter cmparable
unassisted units. To mae this determination, the PHA
must cnsider:
( I ) Te locaton, quality, size, unit typ, and age of
the cntraclmand
(2) Any. amenities, housing services, maintenac
and utilitie prvided and paid by the owner.
c. Te PHA must redeteninc the rnable rent when
required in acCrda with H requirements. The
rH may redetermine the rasnable rnt at any time.
d. During 0 HAP contract tr, the rnt to ower may
not elcced t0al charged by 0 owner fr comparabIe
un W u0U n 0 premiss. The ower must give
the PHA ay infrmation rud by the PHA on
rents charged by the ower fr other units in the
prmises or elsewhere.

deterines that late payment by the PHA is due

by the PHA are delayed or de0ie as a remedy for

sub-contactor or agent of te PH. who
frmulates plicy or who influncs decisions
with rspt to te prgram;
(3) Any public ofcia, membr of a goving bdy,
or Stae or 0w legslator, wo exerciss
fnctions or rspnsibilities with rspct to the
program; or
(4) Any member of the Congress of te Unitd
States.
b. A coverd individual may not have any 0H or

infrmation a requird by the PHA pertinent to the
prpsed assignment.
c. The HAP contract may not be assigned to a new owner
that is debar d, suspended or subjec to a limited
denial of participation under HU rgulations (see 14
Code of Federal Regulations Part 24).
d. Te H cntact may not b assignd to a new ower
if HUD has prohibited sch a ignment bcus:
(I ) Te Federal govement ha instituted a
administrative or judicial acion aainst te
ower or proposed newower fr violation of te
Fair Housing Act or other Federal equal
opprtunity rquirments, and such action is
pnding; or
(1J A court or administrative agency has determined

afct ay State or local law that provides longer time periods or

housing assistance payment to the ower is not a
violation of te lease. The ower may not terinate
the tenanc for nonpayment of the PHA housing
assistanc pament.
e. The owner may not charge or accept, fom the
family or fm any other surc , any payment fr
nM of th unit m addition to the rnt to ower. Rent
to owner includes all housing seics, maintenance,
utilities and appliances to b ptovided and paid by
the ower in accrdac with te lease.
f. Te ower must immediately rtur any excess rent
payment to the tenant.
6. Other Fees and Charge
a. Rent to ower does not include cst of any meals or
supprtive serics or fritur wich my be
providd by the ower.
b. The 0W0I may not rquir W tnant or family
members to pay chages for any meals or supprtive
srices or furiture which may b prvided by the
ower. Nonpayment of any such chares is not
grounds fr tenination of tenacy.
c. The oWc may not chare the tnant extra amounts

the locality, or prvided a O additional cost to
unsubsidized tenat in the premises.
7. Maintenance, Utilitie, and Other Serice

who engages in ciminal acts of physicl violence
against family member or others. This action may

question against the tenant or a member of the
tenant's household, prvided thnt te ower,
maager, or public housing agenc dos nt subject
an individual who is or m ben a victim of
domesic violence, daing violenc, or stlking to a
more demanding standll'd than other tenants in
deterining whether to evict or terinate.
(6) Nothing in this setion ma be cnstrued to limit
the authority of an ower or manager to evict, or
the public housing agency to terminate assistance,
to any tnat if the ower, manager, or public
housing agency can demonstrate an actual and
imminent thrat to other tenats or those employed
